we may see more of them mandating at least several hours of sexual harassment training for management and lesser<br />

training for non-management employees. We might also see companies in states where training is not mandatory offer<br />

it anyway.<br />

Paid Leave Laws<br />

Next year will be a banner year for those states implementing or expanding paid leave laws. Arizona, California, New<br />

Jersey, and a handful of others have had paid leave laws in place for several years. However, California recently<br />

expanded its law with new changes set to take effect in <strong>2020</strong>. New York's law gradually expands every year for the next<br />

several years.<br />

Paid leave also kicks in next year in Nevada and Washington state. Meanwhile, representatives in Washington are<br />

seriously considering national paid leave legislation. It appears as though it is just a matter of time before mandated<br />

paid leave is the norm.<br />

Companies doing business in states with laws already in place should check for changes in the coming year. As previously<br />

mentioned, several states are expanding their programs in <strong>2020</strong>.<br />

Employee Cannabis Use<br />

One of the stickiest compliance issues of all relates to cannabis use among employees. Federal law still considers<br />

cannabis a controlled substance, though enforcement has been lax in recent years. That has empowered a number of<br />

states to take up both medical and recreational cannabis laws in recent years.<br />

In states that allow recreational use of cannabis, employers must make a clear distinction between what is considered<br />

medical and recreational use for establishing their own policies. This is necessary so as to avoid running afoul of laws<br />

that allow possession of medically necessary cannabis in the workplace.<br />

<strong>Compliance</strong> is always a priority as we approach a new calendar year. Again, we strongly urge companies to know and<br />

understand all of the laws that apply to them – before January 1 arrives. Strategies for complying should also be<br />

implemented well in advance. Companies do not need to be caught off guard when the calendar turns to <strong>2020</strong>.
