Lummi Citizens who meet the following terms<br />
and conditions:<br />
(a) Produces signed permission for the<br />
proposed activity from all of the owners of<br />
record of the land where it is to be conducted.<br />
(b) Produces a plan for the activity which<br />
details, among other things, the use of the<br />
products harvested, the period in which the<br />
harvest is to occur, site clean up activities, and<br />
plans for reforestation, and any other<br />
condition deemed appropriate by the Lummi<br />
<strong>Natural</strong> <strong>Resources</strong> Department in consultation<br />
with the Commission.<br />
(c) Any other terms and conditions for the<br />
conservation and enhancement of the<br />
reservation forestry resources deemed<br />
necessary by the Lummi <strong>Natural</strong> <strong>Resources</strong><br />
Department in consultation with the<br />
Commission.<br />
Failure to observe any condition of this<br />
section or permit issued pursuant to this<br />
section shall be a violation punishable by civil<br />
penalties as follows:<br />
First violation<br />
$ 50.00 to $500.00<br />
Second violation<br />
$<strong>10</strong>0.00 to $2,000.00 and loss of permit<br />
forfeiture of wood and loss of permit<br />
privileges until the violator, after a period of<br />
one year, meets with the Council and the<br />
Commission and receives permission to<br />
receive permits again.<br />
<strong>10</strong>.18.<strong>10</strong>0 Fire Suppression Authority<br />
The Lummi <strong>Natural</strong> <strong>Resources</strong> Department on<br />
approval of the Commission in the interest of<br />
protection of the forest resources on the<br />
reservation may issue regulations governing<br />
burning within the exterior boundaries of the<br />
Lummi Reservation during periods of extreme<br />
danger due to dry weather and/or scarce water<br />
reserves. These regulations may include but<br />
shall not be limited to:<br />
(a) An open burning ban.<br />
(b) The requirement for a permit for open<br />
burning with terms and conditions required for<br />
fire protection.<br />
(c) Provide requirements for safe burning.<br />
Notice of the implementation of regulations<br />
under this section shall be posted<br />
conspicuously at the <strong>Natural</strong> <strong>Resources</strong> Office<br />
and around the Reservation.<br />
Failure to observe any regulation or term or<br />
condition of a permit issued pursuant to this<br />
section shall be a violation punishable by civil<br />
penalties as follows:<br />
First violation<br />
$ 50.00 to $500.00<br />
Second violation<br />
$<strong>10</strong>0.00 to $2,000.00, forfeiture of wood and<br />
loss of permit privileges until the violator,<br />
after a period of one year, meets with the<br />
Council and the Commission and receives<br />
permission to receive permits again.<br />
Chapter <strong>10</strong>.19 Enforcement<br />
<strong>10</strong>.19.0<strong>10</strong> Enforcement<br />
This title and all regulations issued pursuant to<br />
it shall be enforced by the Lummi <strong>Natural</strong><br />
<strong>Resources</strong> Enforcement Patrol, Lummi Tribal<br />
Law Enforcement personnel, and by any other<br />
person authorized by the LIBC.<br />

<strong>10</strong>.19.020 Lummi <strong>Natural</strong> <strong>Resources</strong><br />
Enforcement Patrol<br />
The Lummi <strong>Natural</strong> <strong>Resources</strong> Enforcement<br />
Patrol shall consist of an administrator, a<br />
sergeant, and several enforcement officers<br />
with the general duties and responsibilities as<br />
set forth in the following sections. These<br />
positions are subject to the Personnel Policies<br />
of the LIBC, including, but not limited to,<br />
hiring, supervision, pay, discipline and<br />
grievances. The Chief of Lummi Law and<br />
Order shall be responsible to the Council and<br />
the Commission for the effective execution of<br />
the objectives of the <strong>Natural</strong> <strong>Resources</strong><br />
Enforcement Patrol.<br />
