(b) The tags may be issued one at a time and<br />

the fee shall be refunded in full or exchanged<br />

for a new tag to the permittee upon<br />

presentation to the Lummi <strong>Natural</strong> <strong>Resources</strong><br />

Department of:<br />

(1) An unused tag, or<br />

(2) A properly validated used tag.<br />

<strong>10</strong>.17.120 Hunting Tag Requirements<br />

Each hunter shall:<br />

(a) Have in his possession while hunting an<br />

appropriate Lummi hunting tag, but no more<br />

than bag limits for two persons, the hunter and<br />

as the designated hunter for another citizen<br />

issued pursuant to section <strong>10</strong>.17.1<strong>10</strong> (a),<br />

(b) Validate the Lummi Hunting Tag by<br />

notching the month and the day of the kill and<br />

the writing in the area of the kill prior to<br />

moving the animal,<br />

(c) Attach a validated Lummi Hunting Tag to<br />

any carcass in his possession as soon as the<br />

carcass is placed in a vehicle for transit and<br />

ensure that it remains attached during transit<br />

and storage, and<br />

(d) Return the validated hunting tag to the<br />

Lummi <strong>Natural</strong> <strong>Resources</strong> Department.<br />

(e) Return all unused tags to the <strong>Natural</strong><br />

<strong>Resources</strong> by March 1 following the hunting<br />

season,<br />

(f) Not have in possession while hunting any<br />

tags, which have expired.<br />

Violation of any provision of this section shall<br />

be punishable by civil penalties as follows:<br />

First violation<br />

$ 50.00 to $<strong>10</strong>0.00<br />

Second violation<br />

$<strong>10</strong>0.00 to $200.00<br />

Subsequent violations<br />

$150.00 to $300.00 and loss of all hunting<br />

privileges until the violator, after a period of<br />

one year, meets with the Council and the<br />

Commission and receives permission to<br />

exercise hunting privileges again.<br />

<strong>10</strong>.17.130 Marine Mammal Hunting<br />

Tags<br />

After determining in annual regulations<br />

promulgated under Chapter <strong>10</strong>.06 that a<br />

harvestable number of any species of marine<br />

mammal exists, the Lummi <strong>Natural</strong> <strong>Resources</strong><br />

Department may issue tags to Lummi citizens<br />

with hunting permits for the taking of specific<br />

marine mammals up to the limit identified in<br />

the annual regulation or if the season should<br />

be otherwise closed by emergency regulation<br />

of the Lummi <strong>Natural</strong> <strong>Resources</strong> Department.<br />

The number of animals taken incidentally to<br />

fisheries will be included in the total permitted<br />

take each year. Regulations may require that<br />

the animals be presented for biological<br />

examination by the Lummi <strong>Natural</strong> <strong>Resources</strong><br />

Department. The meat and other parts of the<br />

marine mammals taken pursuant to a valid tag<br />

may be sold, and traditional handicrafts<br />

utilizing parts of such marine mammals may<br />

be sold.<br />

Violation of any provision of this section shall<br />

<strong>10</strong>.17.140 Firearm Restrictions<br />

It shall be unlawful for any citizen of the<br />

Lummi Nation to use firearms of a type or in a<br />

manner as specified below in any lawful hunt:<br />

(a) A fully automatic firearm.<br />

(b) A shotgun, except that shotguns from <strong>10</strong><br />

to 20 gauge, using shells loaded with slugs or<br />

buckshot size #1 or larger, may be used to<br />

hunt deer and bear.<br />
