and loss of all hunting privileges until the<br />
violator, after a period of one year, meets with<br />
the Council and the Commission and receives<br />
permission to exercise hunting privileges<br />
again.<br />
(b) Violation of any provision of this section<br />
by a Lummi Citizen who is eligible for but has<br />
not obtained the necessary permits and tags<br />
shall be punishable by civil penalties as<br />
follows:<br />
First violation<br />
$200.00 to $400.00<br />
Second violation<br />
$400.00 to $600.00<br />
Subsequent violations<br />
$800.00 to $1,000.00 and loss of all hunting<br />
privileges until the violator, after a period of<br />
one year, meets with the Council and the<br />
Commission and receives permission to<br />
exercise hunting privileges again.<br />
(c) Violation of any provision of this section<br />
by a Lummi Citizen whose hunting privileges<br />
are revoked by the Court, or who cannot meet<br />
the conditions for the appropriate permits is<br />
punishable by forfeiture of all animals taken<br />
in violation of this title, and all hunting<br />
equipment and gear, including boats, motors,<br />
and vehicles used in the commission of the<br />
violation, by a civil penalty of no less than<br />
$3000.00 and loss of all hunting privileges<br />
until the violator, after a period of one year,<br />
meets with the Council and the Commission<br />
and receives permission to exercise hunting<br />
privileges again.<br />
<strong>10</strong>.17.<strong>10</strong>0 Assistance<br />
It shall be a violation of this title for any<br />
member of the Lummi Nation to be<br />
accompanied by or assisted by any other<br />
person while hunting unless that person is<br />
either:<br />
(a) A member of a Treaty tribe having hunting<br />
rights in the area where the hunting is taking<br />
place, permitted by that tribe to hunt in that<br />
area at that time, and having in his or her<br />
possession a valid tribal or Bureau of Indian<br />
Affairs identification card attesting to such<br />
membership;<br />
(b) A citizen of the Lummi Nation with a<br />
valid Lummi Nation Treaty of Point Elliott<br />
identification card issued pursuant to Section<br />
<strong>10</strong>.04.0<strong>10</strong>, or<br />
(c) A citizen of the Lummi Nation with a<br />
valid hunting or designated hunter’s permit.<br />
Violation of any provision of this section shall<br />
be punishable by civil penalties as follows:<br />
First violation<br />
$ <strong>10</strong>0.00 to $200.00<br />
Second violation<br />
$300.00 to $400.00<br />
Subsequent violations<br />
$500.00 to $700.00 and loss of all hunting<br />
privileges until the violator, after a period of<br />
one year, meets with the Council and the<br />
Commission and receives permission to<br />
exercise hunting privileges again.<br />
<strong>10</strong>.17.1<strong>10</strong> Issuance of Hunting Tags<br />
(a) The Lummi <strong>Natural</strong> <strong>Resources</strong><br />
Department may upon payment of a<br />
refundable fee of $<strong>10</strong>.00 issue to permitted<br />
hunters, Lummi Hunting Tags with the<br />
following information:<br />
(1) A hunting permit number and the type<br />
of permit, and the name of the designated<br />
hunter, if applicable,<br />
(2) The types of animal for which the tag<br />
may be valid; only one animal may be<br />
harvested on a single tag,<br />
(3) The dates when the tag is valid, and<br />
(4) The signature of the authorizing<br />
official.<br />
