<strong>10</strong>.16.020 Miscellaneous Commercial<br />
Fisheries<br />
Commercial fisheries for squid, octopus, other<br />
cephalopods, sea cucumbers, sea urchins, and<br />
other shellfish not otherwise provided for in<br />
this title shall be closed unless opened by<br />
regulation issued pursuant to Chapter <strong>10</strong>.06.<br />
<strong>10</strong>.16.030 Miscellaneous Shellfish<br />
Commercial Harvest Penalties<br />
The penalties for commercial harvest of the<br />
shellfish subject to this Chapter:<br />
(a) Harvesting without appropriate<br />
authorization as provided for in regulations<br />
shall be as follows:<br />
First violation<br />
$300.00 to $600.00 and forfeiture of gear<br />
Second violation<br />
$600.00 to $1,200.00, forfeiture of gear, and<br />
all clam harvesting privileges until the<br />
violator, after a period of one year, meets with<br />
the Council and the Commission and receives<br />
permission to exercise clam harvesting<br />
privileges again.<br />
(b) Violation of provisions of a permit shall<br />
be as follows:<br />
First violation<br />
$ 25.00 to $ 50.00<br />
Second violation<br />
$ 50.00 to $<strong>10</strong>0.00<br />
Third violation$<strong>10</strong>0.00 to $200.00<br />
Subsequent violation<br />
$150.00 to $300.00<br />
Chapter <strong>10</strong>.17 Hunting<br />
<strong>10</strong>.17.0<strong>10</strong> Lawful Off Reservation<br />
Hunting<br />
No person subject to the jurisdiction of the<br />
Lummi Nation shall hunt under the authority<br />
of the Lummi Nation off of the Lummi<br />
Reservation except in compliance with this<br />
title and regulations adopted pursuant to this<br />
title. Violations shall result in civil penalties,<br />
which must be paid in order to retain the<br />
privilege of exercising the treaty hunting<br />
rights of the Nation. In the event of a<br />
violation of any portion of this Chapter, which<br />
does not specify a penalty, a civil penalty as<br />
follows will apply:<br />
First violation<br />
$ 50.00 to $<strong>10</strong>0.00<br />
Second violation<br />
$<strong>10</strong>0.00 to $200.00<br />
Subsequent violation<br />
$150.00 to $300.00 and loss of all hunting<br />
privileges until the violator, after a period of<br />
one year, meets with the Council and the<br />
Commission and receives permission to<br />
exercise hunting privileges again, and loss of<br />
hunting. Notwithstanding any other provisions<br />
of this Chapter, the Lummi Tribal Court, at its<br />
discretion, may suspend the hunting privileges<br />
of any person convicted of any offense under<br />
this title. Such suspension shall be for a<br />
specified number of hunting days set by the<br />
court.<br />
<strong>10</strong>.17.020 Commercial Hunting<br />
Forbidden<br />
It shall be unlawful for any citizen of the<br />
Lummi Nation to sell or exchange for<br />
monetary value, offer to sell or exchange for<br />
monetary value or hunt for or possess with<br />
intent to sell or exchange for monetary value,<br />
the meat of any wild animal, except marine<br />
mammals, provided that the reimbursement to<br />
a hunter of his actual expenses for fuel,<br />
ammunition and the like, by a Lummi tribal<br />
member or tribal group on whose behalf he<br />
has been designated to hunt, shall not be<br />
considered to be a sale or exchange for value.<br />
Violations of this section shall be punishable<br />
by civil penalties as follows:<br />
First violation<br />
$300.00 to $600.00<br />
Second violation<br />
$600.00 to $1,200.00 and loss of all hunting<br />
privileges until the violator, after a period of<br />
one year, meets with the Council and the<br />
Commission and receives permission to<br />
exercise hunting privileges again.<br />
