Chapter <strong>10</strong>.15 Clam Sanitation<br />
<strong>10</strong>.15.0<strong>10</strong> Commercial Harvest in<br />
Unapproved or Prohibited Areas<br />
It is unlawful to harvest clams or other<br />
mollusks for sale from areas which have been<br />
unapproved, or prohibited for public health<br />
reasons.<br />
Violations of any provision of this section<br />
shall be punishable by civil penalties as<br />
follows:<br />
First violation<br />
$300.00 to $600.00 and forfeiture of gear and<br />
all clam harvesting privileges until the<br />
violator, after a period of one year, meets with<br />
the Council and the Commission and receives<br />
permission to exercise clam harvesting<br />
privileges again.<br />
<strong>10</strong>.15.020 Commercial Harvest without<br />
Proper Monitoring<br />
It shall be a violation of this title to:<br />
(a) Provide false information to a monitor<br />
concerning the origin of clams being<br />
monitored for sale, or<br />
(b) To possess any clams in a monitored area<br />
that have not been taken from that area during<br />
the current monitoring period, or<br />
(c) To offer for placement into an official<br />
Lummi Commercial Clam Harvest Bag any<br />
clams which have not been harvested by a<br />
member with the Fishing Identification card<br />
currently validated for clam harvest pursuant<br />
to Section <strong>10</strong>.04.030 who has not checked in<br />
with the monitor prior to the current harvest,<br />
or<br />
(d) To combine or attempt to combine<br />
unmonitored clams with appropriately<br />
monitored clams at the buyer’s station at the<br />
time of sale.<br />
(e) To solicit the aid of a Lummi Fisher with<br />
clams which have been appropriately<br />
monitored to sell clams, which have not been<br />
appropriately monitored.<br />
Violation of this section shall be punishable<br />
by civil penalties as follows:<br />
First violation<br />
$300.00 to $600.00 and forfeiture of gear<br />
Second violation<br />
$600.00 to $1,200.00, forfeiture of gear, and<br />
all clam harvesting privileges until the<br />
violator, after a period of one year, meets with<br />
the Council and the Commission and receives<br />
permission to exercise clam harvesting<br />
privileges again.<br />
<strong>10</strong>.15.030 Shellfish Sanitation Program<br />
Regulations<br />
The Director, in consultation with the<br />
Commission, the Washington State<br />
Department of Health and the federal Food<br />
and Drug Administration may promulgate<br />
regulations required to implement an agreed<br />
program to protect the public health through<br />
control of bivalve mollusk harvest and<br />
marketing under the jurisdiction of the Lummi<br />
Nation. The penalties for violation shall be<br />
contained within the regulations.<br />
Violation of any provision of a regulation<br />
filed pursuant to this section shall be<br />
punishable by civil penalties as follows unless<br />
otherwise specified:<br />
First violation<br />
$300.00 to $600.00 and forfeiture of gear and<br />
all clam harvesting privileges until the<br />
violator, after a period of one year, meets with<br />
the Council and the Commission and receives<br />
permission to exercise clam harvesting<br />
privileges again.<br />
Chapter <strong>10</strong>.16 Miscellaneous Shellfish<br />
Fisheries<br />
<strong>10</strong>.16.0<strong>10</strong> Subsistence Squid and<br />
Octopus Fisheries<br />
Subsistence Squid and Octopus Fisheries on<br />
and off reservation will be opened with a limit<br />
of 2 octopus and <strong>10</strong> pounds of squid per day,<br />
unless otherwise specified by regulation<br />
issued pursuant to Chapter <strong>10</strong>.06.<br />
