<strong>10</strong>.13.050 Identification<br />

It shall be unlawful to take or possess crab for<br />

commercial purposes without the vessel<br />

operator having a Treaty Fishing<br />

Identification Card currently validated for<br />

crab pursuant to Sections <strong>10</strong>.04.020 and<br />

<strong>10</strong>.04.030 above in his/her possession.<br />

Helpers need only a Treaty Fishing<br />

Identification Card issued pursuant to Sections<br />

<strong>10</strong>.04.020 above, which has a current general<br />

fishing validation. Violation of this section<br />

shall be treated as a violation of Section<br />

<strong>10</strong>.04.050 above.<br />

<strong>10</strong>.13.060 Registration of Commercial<br />

Crab and Shrimp Gear<br />

All commercial crab and shrimp gear used in<br />

fisheries under the jurisdiction of the Nation<br />

must be registered with the Lummi <strong>Natural</strong><br />

<strong>Resources</strong> Department. A validation for the<br />

commercial crab or shrimp fisheries shall not<br />

be issued pursuant to Section <strong>10</strong>.04.030 above<br />

until the applicant has registered commercial<br />

crab gear (crab pots or crab ring nets) or<br />

shrimp gear as follows by:<br />

(a) Proven ownership (including but not<br />

limited to a valid bill of sale) of no less than<br />

50 legal commercial crab gear equal in<br />

condition to the average of those being used in<br />

the fishery, which shall include but not be<br />

limited to a photograph taken just prior to<br />

registration and verification by Lummi<br />

<strong>Natural</strong> <strong>Resources</strong> Department authorized<br />

staff of the number of the gear units and the<br />

nature of the individual markings.<br />

(b) Identification of the vessel which will be<br />

used to fish the registered gear, and any<br />

changes in the vessel which will be used to<br />

fish the gear. Vessels recorded in the crab or<br />

shrimp gear registry must be powered and<br />

capable of independent operation under<br />

conditions experienced in the crab fishery.<br />

(c) The Director in consultation with the<br />

Commission and the Council may require<br />

registration and unique identification of each<br />

registered pot.<br />

(d) Each pot must be registered by the owner,<br />

and new pots added during the year must be<br />

added to the current registration.<br />

(e) All sales of pots during the year must be<br />

reported to the Lummi <strong>Natural</strong> <strong>Resources</strong><br />

Department to ensure the registration statistics<br />

remain current.<br />

Violations of this section are punishable by<br />

civil penalties of $50.00 per pot.<br />

<strong>10</strong>.13.070 On Reservation Crab<br />

Management Areas<br />

(a) Bellingham Bay - The Bellingham Bay on<br />

reservation crab management area shall be<br />

that area landward to the north, and west of a<br />

line drawn from the large boulder exposed at<br />

low tide at Point Francis to the single piling to<br />

the east of Stevie’s Point, once used to mark<br />

the Bellingham side of the river mouth.<br />

(b) Lummi Bay - The Lummi Bay on<br />

reservation crab management area shall be<br />

that area landward to the east of a line from<br />

the Entrance Buoy at Sandy Point to<br />

Gooseberry Point.<br />

<strong>10</strong>.13.080 Crab Harvest Seasons<br />

Currently there are three Crab Management<br />

Regimes in areas under the jurisdiction of the<br />

Nation.<br />

The Spring Management Regime extends<br />

from April 15 through July15 yearly and may<br />

be restricted by regulation in gear limit, area<br />

or time.<br />

The Summer Management Regime extends<br />

from July 15 through September 15 yearly and<br />

is severely restricted by regulation in gear<br />

limit, area and time.<br />

The In Common Winter Fishery Regime<br />

extends from September 15 of one year until<br />

April 15 of the following year.<br />

<strong>10</strong>.13.090 Crab Openings<br />

(a) It shall be unlawful to have in the water<br />

any commercially registered crab pots except<br />
