(f) No more than 25 pound of shrimp in the<br />
round may be retained per fisher on any day.<br />
(g) The fisher maintains a record the date of<br />
harvest and pounds per species of shrimp<br />
taken for subsistence purposes and provides<br />
this information to the Lummi <strong>Natural</strong><br />
<strong>Resources</strong> Department on request.<br />
(h) Shrimp may be taken for subsistence<br />
purposes during a commercial fishery<br />
provided that the quantity taken for<br />
subsistence purposes is accurately reported on<br />
the Treaty Indian Fish Receiving Ticket.<br />
Violations of this section are punishable by<br />
civil penalties as follows:<br />
First violation<br />
$50.00 to $<strong>10</strong>0.00<br />
Subsequent violations<br />
$<strong>10</strong>0.00 to $200.00<br />
<strong>10</strong>.13.030 Ceremonial Crab or Shrimp<br />
Permit<br />
The Director, or his designee, may issue a<br />
permit for the ceremonial harvest of hard,<br />
male crab for funeral, memorial or other<br />
ceremonial purposes approved by the<br />
Commission. All crab taken under a<br />
ceremonial permit must be held in a container<br />
clearly marked for ceremonial harvest. This<br />
permit shall contain the name of the<br />
harvesters, the purpose of the harvest, the<br />
number of pots to be used, the quantity of crab<br />
and/or shrimp to be harvested, the area of<br />
harvest and the dates of permit validity. At<br />
the expiration of the permit, the permitee shall<br />
report the area fished and the quantity of crab<br />
and/or shrimp taken.<br />
It shall be a violation of this section to have<br />
more than <strong>10</strong>% of the numbers of crab taken<br />
between 6” and 6.25” caliper measure across<br />
the back in front of the horns and any; male<br />
crab smaller than 6” caliper measure across<br />
the back in front of the horns.<br />
Violations of the provisions of a permit shall<br />
jeopardize the ability of the permittee to<br />
obtain permits in the future and be punishable<br />
by civil penalties as follows:<br />
First violation<br />
$50.00 to $<strong>10</strong>0.00<br />
Subsequent violations<br />
$<strong>10</strong>0.00 to $200.00<br />
<strong>10</strong>.13.040 Commercial Crab Legal<br />
Gear<br />
It shall be unlawful to harvest Dungeness<br />
Crab (Cancer magister), have on board a<br />
registered crab vessel, or to have in a staging<br />
area during or immediately before a<br />
commercial crab opening, gear, which does<br />
not meet the following specifications:<br />
(a) Crab pots - standard commercial crab pots<br />
with:<br />
(1) Two escape rings of not less than 4.25<br />
inches inside diameter in the fixed upper<br />
half of the pot, and<br />
(2) Pot lid hooks or tie down straps secured<br />
with a biodegradable single strand or loop<br />
of untreated natural fiber twine no larger<br />
thread than #120 strand of untreated<br />
natural, or an opening in the pot mesh no<br />
less than 3” x 5” which is laced or sewn<br />
closed with untreated natural fiber twine no<br />
larger than thread size 120; and<br />
(3) Each pot or string of pots attached to a<br />
surface buoy of durable material capable of<br />
floating at the surface with a 5 pound<br />
weight attached, and each buoy clearly<br />
marked in a permanent fashion with the<br />
Fishing Identification Card number of the<br />
registered operator of the pots.<br />
(4) Each pot shall be registered with the<br />
Lummi <strong>Natural</strong> <strong>Resources</strong> department as<br />
required in Section <strong>10</strong>.13.060 below.<br />
(b) Ring Nets - in addition to the confiscation<br />
of crab pots without escape rings or obstructed<br />
escape rings which shall be forfeit, each and<br />
every failure to comply with the requirements<br />
in this section shall be an offense punishable<br />
by civil penalties per illegal pot as follows:<br />
First violation involving less than <strong>10</strong> pots<br />
