<strong>10</strong>.12.<strong>10</strong>0 Commercial Bottomfish<br />

Seasons<br />

It shall be unlawful to take, fish for, or possess<br />

bottomfish for commercial purposes except in<br />

the following Marine Fish and Shellfish<br />

Management and Catch Reporting Areas:<br />

20A, 21A, 21B, 23A, and 23B from April 30<br />

to November 30 unless otherwise provided by<br />

regulation.<br />

<strong>10</strong>.12.1<strong>10</strong> Bottom Fishing with Illegal<br />

Gear<br />

Violations of Chapter <strong>10</strong>.12 requirements for<br />

legal gear and fishing in closed seasons shall<br />

be punishable by civil penalties as follows:<br />

First violation<br />

$ 50.00 to $<strong>10</strong>0.00<br />

Second violation<br />

$<strong>10</strong>0.00 to $250.00<br />

Subsequent violations<br />

$250.00 to $500.00<br />

Chapter <strong>10</strong>.13 Crab and Shrimp<br />

<strong>10</strong>.13.0<strong>10</strong> Subsistence Dungeness Crab<br />

Male, hard Dungeness Crab greater than 6<br />

1/4” caliper measure across the back in front<br />

of the horns (Cancer magister) may be taken<br />

for subsistence use by crab pot gear or hand,<br />

net or ring gear under the following terms and<br />

conditions:<br />

(a) Open season shall be whenever it has been<br />

determined by Lummi <strong>Natural</strong> <strong>Resources</strong><br />

Department that the crab meet the hardness<br />

criteria.<br />

(b) Each fisher may fish, without crab blocks,<br />

only two pots not to exceed 32” diameter at<br />

any one time, and must harvest only pots<br />

marked with a red buoy of durable material<br />

capable of floating at the surface while<br />

supporting a 5 pound weight, permanently<br />

marked with the fisher’s name and tribe.<br />

(c) Each pot must have two escape rings not<br />

less than 4.25 inches inside diameter located<br />

in the upper half of the pot, and<br />

(d) Each pot must be marked with the Fishing<br />

Identification Card number issued pursuant to<br />

<strong>10</strong>.04.020 above.<br />

(e) The fisher is not a commercial crab fisher<br />

with a commercial fisheries identification card<br />

validated for crab issued to him or her.<br />

(f) No more than 12 crab may be in the<br />

possession of the fisher at any one time.<br />

(g) The fisher maintains a record the date of<br />

harvest and number of crabs taken for<br />

subsistence purposes and provides it to the<br />

Lummi <strong>Natural</strong> <strong>Resources</strong> Department on<br />

request.<br />

Violations of this section are punishable by<br />

civil penalties as follows:<br />

First violation<br />

$50.00 to $<strong>10</strong>0.00<br />

Subsequent violations<br />

$<strong>10</strong>0.00 to $200.00<br />

<strong>10</strong>.13.020 Subsistence Shrimp<br />

Spot and Coonstripe shrimp may be from<br />

April 1 through October 15 yearly under the<br />

following conditions:<br />

(a) Spot shrimp greater than 30mm carapace<br />

measure shall not be retained.<br />

(b) Each fisher may fish only two pots not to<br />

exceed 32” diameter at any one time, and must<br />

harvest only pots marked with the fisher’s<br />

name and tribe.<br />

(c) There shall be no more than 2 fishers per<br />

vessel participating in the subsistence fishery<br />

(d) Each pot must be marked with a solid red<br />

buoy of durable material capable of floating at<br />

the surface while supporting a 5 pound<br />

weight, permanently marked with the Fishing<br />

Identification Card number issued pursuant to<br />

<strong>10</strong>.04.020 above.<br />

(e) The pots may only be set in areas opened<br />

on the hotline.<br />
