Management and Catch Reporting Area 20A<br />

within the area bounded by a line from Lilly<br />

Point to Birch Point, and Lilly Point to the<br />

North Alden Bank Buoy to where those lines<br />

are intersected by a line projected<br />

approximately 230 degrees south from Birch<br />

Point to Alden Point on Patos Island are<br />

closed from June 1 to June 30.<br />

(d) All marine waters less than 30 feet deep.<br />

(e) It is unlawful to take bottomfish for<br />

commercial purposes in pelagic trawl except<br />

in Marine Fish and Shellfish Management and<br />

Catch Reporting Area 20A from March 1<br />

throughout April 14, or at any time and area<br />

specified by permit issued by the Director.<br />

<strong>10</strong>.12.040 Log Books<br />

The operator of trawl gear must obtain from<br />

the Lummi <strong>Natural</strong> <strong>Resources</strong> Department and<br />

accurately maintain a “Lummi Trawl<br />

Logbook” on the vessel while fishing for or in<br />

the possession of bottomfish taken with the<br />

trawl gear. The completed logbook must be<br />

submitted on request to authorized Lummi<br />

<strong>Natural</strong> <strong>Resources</strong> Department personnel. For<br />

each fishing trip, and prior to landing, vessel<br />

operators shall record the vessel name and<br />

tribal vessel identification number, the dates<br />

of departure and return to port, and the<br />

buyer(s) of the fish landed. In addition, for<br />

each trawl tow conducted during the trip, the<br />

vessel operator shall record the month and<br />

day, duration of the tow, specific area fished,<br />

net type, target species, and estimated weight<br />

of each species retained. Copies of this log<br />

shall be turned in to the Lummi <strong>Natural</strong><br />

<strong>Resources</strong> Department within ten days of the<br />

end of each calendar month in which fishing<br />

occurs or by the tenth day following the<br />

termination of commercial fishing activity,<br />

which ever occurs first.<br />

<strong>10</strong>.12.050 Legal Gear for Dogfish<br />

It shall be legal to take and possess dogfish<br />

taken with:<br />

(a) Set nets- set nets must be as described<br />

below:<br />

(1) Maximum four (4) nets per vessel each<br />

net having a length not to exceed <strong>10</strong>00 feet.<br />

(2) Net depth must not exceed 25 meshes.<br />

(3) Net mesh must not be less than 5<br />

inches.<br />

(4) Net web material must be no finer than<br />

2<strong>10</strong>/30 (12) denier nylon.<br />

(5) Net must have Lummi Treaty Fishing<br />

Identification Card number on a buoy at<br />

each end of the net.<br />

<strong>10</strong>.12.060 Set Net Seasons<br />

It shall be permitted to take and possess<br />

dogfish and other species of bottom fish,<br />

except halibut, salmon and shellfish, taken<br />

with dogfish set net gear for commercial<br />

purposes only in the following Marine Fish<br />

and Shellfish Management and Catch<br />

Reporting areas during the seasons designated<br />

below:<br />

(a) Areas 20A and 20B - November 1 through<br />

June 15<br />

(b) Areas 21A - March 1 through June 15<br />

<strong>10</strong>.12.070 Set Line Seasons<br />

It shall be unlawful to take, fish for, or possess<br />

dogfish and other bottomfish with set lines in<br />

all Lummi usual and accustomed areas unless<br />

otherwise permitted by regulation.<br />

<strong>10</strong>.12.080 Commercial Jig Seasons<br />

It shall be unlawful to take, fish for, or possess<br />

bottomfish for commercial purposes with<br />

commercial jig gear except from April 30 to<br />

November 30.<br />
