incidental catches legal under current general<br />

bottom fish restrictions may be sold under a<br />

Commercial Fishing Identification Card<br />

validated for halibut.<br />

Violations of this provision shall be treated<br />

under the appropriate Sections dealing with<br />

the bottom fish.<br />

Chapter <strong>10</strong>.12 General Bottom Fisheries<br />

<strong>10</strong>.12.0<strong>10</strong> Legal Bottomfish Gear<br />

It is unlawful to take, fish for, or possess<br />

Bottomfish except with gear described below,<br />

unless otherwise provided by regulation:<br />

(a) Set line gear-set line gear must meet the<br />

following conditions:<br />

(1) Hook size must not be smaller than size<br />

7/0 Kirby style hooks or size 8 for tuna<br />

circle hooks.<br />

(2) Set lines must be marked at the surface<br />

by a buoy clearly marked in a permanent<br />

fashion with only the owner’s Commercial<br />

Fishing Identification Card number.<br />

(b) Set Nets - including dogfish set nets but<br />

excluding pacific cod set nets.<br />

(c) Commercial Jig.<br />

(d) Troll Lines -<br />

(1) No more than two troll lines per vessel,<br />

(2) No more than 4 spreads per troll line,<br />

(3) The top spread can not be more than<br />

twenty-four feet from the weight on the end<br />

of the line.<br />

(e) Drag (Beach) Seines - must not be longer<br />

than 350 feet in length with mesh no smaller<br />

than 1/2 inch stretch measure.<br />

(f) Beam and Otter Trawls - including<br />

bottom, roller and surface trawls may be used<br />

with the following restrictions:<br />

(1) Mesh Size - Mesh in the cod end<br />

section shall not be less than 4 1/2 inches,<br />

except that pelagic trawls used to take<br />

Pacific Whiting during legal openings may<br />

contain mesh in the cod end section of not<br />

less than 3 inches.<br />

(2) Chafing Gear - On bottom trawl chafing<br />

gear must have a minimum mesh size of 15<br />

inches unless only the bottom half of the<br />

cod end is covered by chafing gear. For<br />

pelagic trawls chafing gear covering the<br />

upper one half (top side) of the cod end<br />

must have a minimum mesh size of 6<br />

inches.<br />

(3) Roller Trawl - Roller Trawl gear is<br />

prohibited.<br />

<strong>10</strong>.12.020 Bottomfish General<br />

Provisions<br />

(a) It is unlawful to take, fish for, or possess<br />

for commercial purposes any starry flounder<br />

less than 14 inches in length taken by<br />

commercial bottomfish gear.<br />

(b) It is unlawful to retain for commercial<br />

purposes any lingcod less than 22 inches.<br />

(c) It is unlawful to take or possess lingcod<br />

taken for commercial purposes with any gear<br />

from December 1 through April 30.<br />

(d) It is unlawful to take, fish for, or possess<br />

any species of shellfish taken with lawful<br />

bottom fish gear, except for octopus.<br />

<strong>10</strong>.12.030 Beam and Otter Trawl<br />

Fisheries<br />

It shall be lawful to fish for and possess<br />

bottomfish taken with bottom trawl and beam<br />

trawl gear in Lummi usual and accustomed<br />

fishing except as noted below, or otherwise<br />

provided by regulation:<br />

(a) Waters east of a line from Point Whitehorn<br />

to Sandy Point and Marine Fish and Shellfish<br />

Management and Catch Reporting Area 21B<br />

are closed for the entire year.<br />

(b) Waters in Marine Fish and Shellfish<br />

Management and Catch Reporting Area 20A<br />

in an area bounded by lines from Lilly Point<br />

and from the southwest corner of Point<br />
