as a fishing line used to drag a lure or lures<br />
behind a moving vessel and shall permit the<br />
use by any one vessel of not more than six (6)<br />
lines. The size and type of hook may be<br />
limited by regulation.<br />
<strong>10</strong>.11.020 Subsistence Halibut<br />
The taking of halibut for personal use in the<br />
Lummi Usual and Accustomed Fishing Areas<br />
shall be under the following restrictions:<br />
(a) The season shall be open from January 1<br />
to December 31 each year.<br />
(b) There is no minimum size limit on fish<br />
taken in the subsistence fishery.<br />
(c) The number and total weight of fish taken<br />
during a commercial opening and kept for<br />
personal use must be recorded on a Treaty<br />
Indian Fish Receiving Ticket and/or reported<br />
to the Lummi <strong>Natural</strong> <strong>Resources</strong> Department.<br />
(d) The number and estimated weight of all<br />
halibut taken in a non-commercial fishery<br />
shall be recorded and reported to the Lummi<br />
<strong>Natural</strong> <strong>Resources</strong> Department on request.<br />
Failure to observe the conditions of this<br />
section shall be punishable by civil penalties<br />
as follows:<br />
First violation<br />
$ 25.00 to $ 50.00<br />
Second violation<br />
$ 50.00 to $<strong>10</strong>0.00<br />
Subsequent violations<br />
$<strong>10</strong>0.00 to $200.00<br />
<strong>10</strong>.11.030 Ceremonial Halibut<br />
Any member with a valid subsistence fishing<br />
and hunting card or Commercial Fishing<br />
Identification Card issued pursuant to Sections<br />
<strong>10</strong>.04.0<strong>10</strong> or <strong>10</strong>.04.020 above may by special<br />
permit issued by the Director of Lummi<br />
<strong>Natural</strong> <strong>Resources</strong>, take halibut for special<br />
ceremonial use under the terms and conditions<br />
of that permit.<br />
<strong>10</strong>.11.040 Commercial Halibut<br />
The commercial halibut fishery shall be<br />
conducted under the following terms and<br />
conditions:<br />
(a) Identification - the vessel operator must<br />
have on his/her person, a current halibut<br />
validation for his/her Commercial Fishing<br />
Identification Card. Others on board the<br />
vessel must have a valid Commercial Fishing<br />
Identification Card, which may be without a<br />
halibut validation. Failure to comply with<br />
these conditions shall be punishable as in<br />
Section <strong>10</strong>.04.050.<br />
(b) Registration - a fisher must provide the<br />
Lummi <strong>Natural</strong> <strong>Resources</strong> Office with the<br />
following information prior to receiving their<br />
Halibut Validation stickers pursuant to<br />
Section <strong>10</strong>.04.030 (a) above:<br />
(1) Treaty Vessel Identification Number.<br />
(2) Vessel Gross and Net Tonnage.<br />
(3) Gear type and proof of ownership and if<br />
Longline, the number of skates normally<br />
fished.<br />
(4) Names and fishing Identification Card<br />
Numbers of helpers, or others whom might<br />
operate the vessel.<br />
(c) Openings - The commercial season is<br />
closed unless opened by regulation.<br />
(d) Size Limits - It shall be illegal to sell or<br />
offer for sale, or barter, halibut less than 32<br />
inches in total length. All halibut offered for<br />
sale must be landed with the head on.<br />
Violation of this provision shall be subject to<br />
forfeiture of fish or value thereof and<br />
additional civil penalties as follows:<br />
First violation<br />

Second violation<br />
$<strong>10</strong>0.00 to $250.00<br />
Subsequent violations<br />
$250.00 to $500.00<br />
(e) Bycatch - All lingcod taken prior to April<br />
15th each year in the commercial halibut<br />
