<strong>10</strong>.09.070 In-River Fishing Restriction<br />
It shall be unlawful to fish a drift gill net from<br />
bank to bank in any river fishery under the<br />
jurisdiction of this title.<br />
Violation of any provision of this section shall<br />
be punishable by civil penalties as follows:<br />
First violation<br />
$ 50.00 to $<strong>10</strong>0.00<br />
Second violation<br />
$<strong>10</strong>0.00 to $200.00<br />
Subsequent violations<br />
$150.00 to $300.00<br />
Chapter <strong>10</strong>.<strong>10</strong> Herring Fishery<br />
<strong>10</strong>.<strong>10</strong>.0<strong>10</strong> Lawful Herring Gear<br />
(a) Purse Seine - Not to exceed 300 fathoms<br />
in length, 1/2 inches [maximum] mesh.<br />
(b) Gill Net - as established by Regulation<br />
promulgated pursuant to Chapter <strong>10</strong>.06.<br />
(c) Beach Seine - By authorization of the<br />
Commission.<br />
The use of unlawful herring gear in a herring<br />
fishery shall be an offense requiring forfeiture<br />
of catch, or catch value if sold, and additional<br />
civil penalties as follows:<br />
First violation<br />
$<strong>10</strong>0.00 to $200.00 and suspension of fishing<br />
privileges for 14 to 28 days.<br />
Second violation<br />
$250.00 to $500.00 and suspension of fishing<br />
privileges for 30 to 60 days.<br />
Third violation<br />
$500.00 to $1,000.00 and suspension of<br />
fishing privileges until after the period of a<br />
year, the violator meets with the Council and<br />
the Commission and has fishing privileges<br />
reinstated.<br />
<strong>10</strong>.<strong>10</strong>.020 Management Regimes<br />
When the herring stocks within the Lummi<br />
usual and accustomed fishing areas are not<br />
sufficiently abundant to support the harvest of<br />
a normal open fishery by members the<br />
Director, in consultation with the Lummi<br />
<strong>Natural</strong> <strong>Resources</strong> Commission, may establish<br />
limited entry fisheries, and in the worst case,<br />
enterprise fisheries to ensure preservation of<br />
the access to the commercial harvest and<br />
maximum benefits to all Lummi members.<br />
The conduct of normal and limited entry<br />
fisheries shall be by regulations promulgated<br />
pursuant to Chapter <strong>10</strong>.06 above, while<br />
enterprise fisheries will be governed by the<br />
terms of the contract with the Council.<br />
Chapter <strong>10</strong>.11 Halibut Fisheries<br />
<strong>10</strong>.11.0<strong>10</strong> Legal Halibut Gear<br />
The following are lawful gear for use in the<br />
halibut fishery:<br />
(a) Hook and Line - a rod and reel with no<br />
more than two (2) hooks.<br />
(b) Hand line - a single line with no more than<br />
two (2) hooks.<br />
(c) Longline - A weighted ground line with<br />
fixed gear tied to, or attached to line with snap<br />
hooks. The size of the hooks, the number of<br />
skates or the number of hooks, and/or the<br />
amount of halibut which can be landed during<br />
a day of an opening may be limited by<br />
regulation.<br />
(1) A long line skate shall be no more than<br />
1800 feet in length and anchored at each<br />
end.<br />
(2) Each long line skate or combination of<br />
skates shall be attached at either end by an<br />
anchor or fishing boat and marked by<br />
buoys, one at each end of the line marked<br />
with fishermen’s Treaty Indian Fishing<br />
Identification Card Number.<br />
(d) Troll Line - Troll line when related to its<br />
use for commercial purposes shall be defined<br />
