defined as fishing gear consisting of a lead<br />
line, cork line, auxiliary lines and mesh net<br />
webbing fashioned in such a manner that can<br />
be used to encircle fish in waters adjacent to<br />
any beach, with the catch landed directly on<br />
the beach. Beach seines shall not exceed<br />
1,200 feet in length and contain meshes of a<br />
size no less than four (4) inches.<br />
Identification buoy(s) shall be attached to cork<br />
line. Each beach seine must be individually<br />
authorized in writing by the Commission and<br />
LIBC.<br />
(e) Lampara - Lampara shall be defined as<br />
fishing gear having no purse line or rings but<br />
employing a lead line, cork line, special tag or<br />
auxiliary lines attached to the lead line and<br />
webbing in such a manner that the fish are<br />
encircled in open water. Identification buoys<br />
shall be attached to the cork line. Must be<br />
authorized in writing by the Commission and<br />
LIBC.<br />
(f) Stake Nets - Stake nets are a gill net<br />
attached to poles, which have been pushed<br />
into the bottom and have a definite pot and<br />
lead. The total length of nets shall not exceed<br />
1,800 feet. The pot shall not exceed 600 feet,<br />
the lead shall not exceed 1,200 feet.<br />
Identification buoy(s) shall be attached to cork<br />
line. All poles come out of the water at dusk.<br />
(g) Troll Line - Troll line when related to its<br />
use for commercial purposes shall be defined<br />
as a fishing line used to drag a lure or lures<br />
behind a moving vessel and shall permit the<br />
use by any one vessel of not more than six (6)<br />
lines. The size and type of hook may be<br />
limited by regulation.<br />
(h) Hook and Line (Angling) - “Hook and<br />
line” or “angling” shall be identical in<br />
meaning and shall be defined as the use of no<br />
more than four (4) lines per person with one<br />
hook per line. The size and type of hook may<br />
be restricted by regulation/hotline.<br />
<strong>10</strong>.09.020 Legal River Salmon and<br />
Steelhead Fishing Gear<br />
The following are legal fishing gear for<br />
Salmon and Steelhead in river waters (waters<br />
upstream of the line of permanent vegetation)<br />
unless specifically prohibited by regulations<br />
promulgated under the Section <strong>10</strong>.06.020 and<br />
<strong>10</strong>.06.030 and Hotline Messages issued<br />
pursuant to Section <strong>10</strong>.06.040 above.<br />
Identification buoys shall contain the Treaty<br />
Fishing Identification Number of the owner of<br />
the fishing gear in permanent markings of a<br />
size sufficient to read from a distance of 6<br />
feet.<br />
(a) Drift Gill Nets - River salmon or steelhead<br />
gill nets shall not exceed 660 feet in length<br />
nor contain meshes of a size less than five<br />
inches unless otherwise authorized by<br />
regulation. Other mesh sizes may be set from<br />
time to time by regulation. These nets must<br />
be free drifting and not anchored, tied or<br />
otherwise weighted in a manner that they can<br />
not drift. Identification buoy(s) shall be<br />
attached to end(s) of cork line.<br />
(b) Hand Dip Net - Hand dip nets shall be<br />
defined as a section of netting distended by a<br />
rigid frame, operated by a process commonly<br />
recognized as dipping. Any size dip net shall<br />
be lawful.<br />
(c) Hook and Line (Angling) - “Hook and<br />
line” or “angling” shall be identical in<br />
meaning and shall be defined as the use of not<br />
more than (2) two lines per person with one<br />
hook per line. The size and type of hook may<br />
be restricted by regulation.<br />
<strong>10</strong>.09.030 Use of Illegal Salmon and<br />
Steelhead Fishing Gear<br />
It shall be an offense under this title to take<br />
salmon with any gear except that specified in<br />
<strong>10</strong>.09.0<strong>10</strong> and <strong>10</strong>.09.020 as appropriate.<br />
Violation of this section, including but not<br />
limited to use of eddy nets, or mesh size and<br />
net length violations in excess of those noted<br />
above shall be punishable by forfeiture of the<br />
illegal nets, the fish taken or the value of the<br />
fish if sold, and the additional civil penalties<br />
as follows:<br />
First violation<br />
$<strong>10</strong>0.00 to $200.00 and suspension of fishing<br />
privileges for 14 to 28 days.<br />
Second violation<br />
$250.00 to $500.00 and suspension of fishing<br />
