Why are Madrid refusals a key<br />

component of a data-driven<br />

marketing strategy with digital tools?<br />

Rising numbers of trademark applicants<br />

are opting for the Madrid System instead of<br />

filing national applications, leading to more<br />

provisional refusals than ever before.<br />

The Madrid System has never been this<br />

popular. In 2018, the Madrid System achieved<br />

a new record when trademark owners filed a<br />

combined total of over 60,000 applications for<br />

international registrations. More interestingly,<br />

over 120,000 provisional refusals were issued<br />

by Madrid member jurisdictions in the same<br />

year (W<strong>IP</strong>O 2019).<br />

The total number of provisional refusals by<br />

designated Madrid members increased by<br />

7.6% in 2018.<br />

Most Madrid member jurisdictions require<br />

a local law firm to handle the response to<br />

a provisional refusal. Consequently, any<br />

provisional refusal can be considered a<br />

business opportunity for a local law firm<br />

within the designated jurisdiction.<br />

To take advantage of this opportunity, the<br />

question that must be answered is: Which firms<br />

are receiving the most provisional refusals and<br />

therefore have the most cases?<br />

Many <strong>IP</strong> attorneys are familiar with the<br />

frequent frustrating experience when a client<br />

does not send them any cases after they have<br />

invested a significant amount of time and effort<br />

in developing a relationship with them.<br />

Therefore, knowing which filers (trademark<br />

holders or representatives) have the most<br />

cases in a jurisdiction is crucial in order to<br />

most revenue can be generated.<br />
