Community Access to Information<br />

By-Laws<br />

Council undertook a review of the By-Laws during<br />

2015/2016 and adopted new By-Laws in June 2016<br />

which came into effect on 1 January <strong>2017</strong>.<br />

The following five By-Laws are in operation:<br />

accessible from Council’s website or Council’s office during<br />

business hours.<br />

List of Codes of Conduct / Practice<br />

During <strong>2017</strong>/<strong>2018</strong>, Council maintained the following Codes of<br />

Conduct/Practice as required by the Local Government Act<br />

1999 or the Local Government (Elections) Act 1999:<br />

Code of Practice for Access to Meetings and Documents<br />

»»<br />

Code of Practice for Meeting Procedures.<br />

Both of these documents are available on Council’s website<br />

or from Council’s Office (during business hours) throughout<br />

the financial year. In addition, Council provides a copy of the<br />

State Government’s Code of Conduct for Elected Members<br />

and Code of Conduct for Employees on its website to assist<br />

members of the Community seeking this information.<br />

Freedom of Information<br />

Council received 6 requests for information under the Freedom of Information Act from 1 July <strong>2017</strong> to 30 June <strong>2018</strong> (compared<br />

to 10 in 2016 / <strong>2017</strong>).<br />

Three applications were granted in part. The basis for disallowing access in full for these applications was based on<br />

Schedule 1 Clause 6 – Documents affecting personal affairs of the Freedom of Information Act 1991<br />

One application was refused on the basis that the applicant did not respond to Council’s requests for further clarification<br />

of the scope of the application which subsequently exceeded the 30 day limit<br />

»»<br />

One accredited Freedom of Information Officer spent approximately 2% of their time assessing applications and making<br />

their determinations.<br />

Council publishes an updated Freedom of Information Statement on its website annually in accordance with the requirements<br />

Section 9(1a) of the Freedom of Information Act 1991.<br />
