meaningful, I envy them for having coined it first before us!<br />

I chose <strong>to</strong> use it in this message <strong>to</strong> you in this issue of <strong>The</strong><br />

Developer’s <strong>Digest</strong> however, because it is important that you<br />

our members know just how important you are <strong>to</strong> us. Without<br />

W. Macharia on Friday 24th<br />

August <strong>2018</strong> gazetted the<br />

appointment of members of<br />

the Board of the National<br />

Construction Authority for a<br />

period of 3 years with effect<br />

from 1st <strong>July</strong> <strong>2018</strong>.<br />

Act, 2012 and Community Land Act, 2016. Mr.<br />

Eric Nyadimo, Chairman GIS Chapter, will chair<br />

the 15 member committee that includes 1 KPDA<br />

Member, Mr. David Gatimu. Other nominated<br />

KPDA members include Caroline Kihara of KCB<br />

and Esther Omulele of MMC Africa Law who are<br />

also members of KPDA.<br />

KPDA VISITS THE WATER<br />

RESOURCE AUTHORITY<br />

(WRA), 3 rd AUGUST <strong>2018</strong><br />

On Friday, 3 rd August <strong>2018</strong> the KPDA Regula<strong>to</strong>ry<br />

Bodies Working Group were garciously hosted by<br />

the Chief Executive Officer of the Water Resources<br />

Authority, Mr. Mohamed Moulid Shurie. <strong>The</strong> group<br />

was well received and praised for ‘their courage <strong>to</strong><br />

contact the regula<strong>to</strong>ry body despite the somewhat<br />

tumul<strong>to</strong>us relationship that exists between WRA<br />

and private developers.’<br />

During the meeting, KPDA officials emphasized<br />

that ‘KPDA members are keen <strong>to</strong> ensure close<br />

and focused engagement with regula<strong>to</strong>ry<br />

bodies such as WRA who KPDA members<br />

interact with whilst doing business in the<br />

Kenyan real estate sec<strong>to</strong>r.’<br />

<strong>The</strong> Water Resources Authority (WRA) – formerly<br />

the Water Resources Management Authority, is a<br />

state corporation established under Section 11 of<br />

the Water Act, 2016. Pursuant <strong>to</strong> Section 6 of the<br />

Act which came in <strong>to</strong> effect on 21st April, 2017 vide<br />

Legal Notice No. 59, the Authority is an Agent of<br />

the National Government responsible for regulating<br />

the management and use of water resources.<br />

<strong>The</strong> Water Act, 2016 makes extensive provisions<br />

on the Authority’s role in regulating the use and<br />

management of water resources.<br />

THE PROGRAM<br />

THE DELIVERY OF 500, 000<br />

HOUSING UNITS HOLDS A<br />

MEETING ON 2ND AUGUST<br />

<strong>2018</strong><br />

<strong>The</strong> Program Implementation Unit (PIU) on the<br />

delivery of 500, 000 housing units, which is<br />

under the State Department for Housing, Urban<br />

Development and Public Works held a meeting on<br />

Thursday, 2nd August <strong>2018</strong>. KPDA who also has<br />

nominees on the various technical committees of<br />

the PIU was in attendance.<br />

<strong>The</strong> various subcommittees are organized<br />

in<strong>to</strong> the various thematic areas that<br />

shall assist the private sec<strong>to</strong>r <strong>to</strong> invest in<br />

affordable hsouing through its engagemenyt with<br />

the government. <strong>The</strong>se sub committees are;<br />

3. Land<br />

4. Infrastructure & Services<br />

5. Information Communication & Technologies<br />

6. Communications and PR<br />

KPDA PAYS THE NATIONAL<br />

BUILDINGS INSPECTORATE<br />

(NBI) A COURTESY CALL,<br />

2 nd AUGUST <strong>2018</strong><br />

Representatives from the KPDA Regula<strong>to</strong>ry<br />

Bodies Working Group paid a courtesy visit<br />

<strong>to</strong> the Secretary of the National Buildings<br />

Inspec<strong>to</strong>rate, Qs. Moses Nyakiongora at their<br />

offices in Works House.<br />

During the meeting, NBI was able <strong>to</strong> share a brief<br />

on its objective <strong>to</strong> ‘ensure that a safe, healthy,<br />

quality sustainable built environment was achieved<br />

through observation of the laid down building<br />

regulations and standards thorough continous<br />

Quality testing, Audit and Inspections of unsafe<br />

buildings and structures.’<br />

NBI was conceived as a result of Presidential<br />

Directive in 2015, following a spate of buildings<br />

collapsing in Nairobi.<br />

NBI is currently not anchored in any law the<br />

proposed Built Environment Bill 2012 seeks <strong>to</strong><br />

bring order in the booming construction industry by<br />

establishing minimum standards and practices will<br />

also establish the Building Authority of Kenya.<br />

KPDA will be seeking <strong>to</strong> engage with NBI in order<br />

<strong>to</strong> establish a specific liaision <strong>to</strong> address member<br />

needs, carry out sensitization on buiolding safety<br />

and partner <strong>to</strong> train on building regulations and<br />

standards as well as the aspects of NBI’s Quality<br />

testing, Audit and Inspections of unsafe buildings<br />

and structures.<br />

We will keep members posted as we continue <strong>to</strong><br />

engage with the National Buildings Inspec<strong>to</strong>rate.<br />

Summary on KPDA Committees<br />

Members are encouraged <strong>to</strong> request <strong>to</strong> join any of<br />

the Association committees <strong>to</strong> connect and engage<br />

with professional/peer networks and government<br />

leadership; as well as identify a leadership<br />

position that aligns with one’s professional goals<br />

and objectives. KPDA members are encouraged<br />

<strong>to</strong> play a more active role in the Association by<br />

getting involved in leadership opportunities.<br />

I. THE KPDA AFFORDABLE<br />

HOUSING TASK FORCE<br />

Established at the beginning of 2017, the aim of<br />

the KPDA Affordable Housing Task Force is <strong>to</strong><br />

clearly demonstrate what the private sec<strong>to</strong>r can do<br />

and propose ways in which the government (and<br />

its relevant agencies) can be engaged <strong>to</strong> bridge<br />

the housing gap in Kenya.<br />

<strong>The</strong> Task Force is chaired by the KPDA Vice<br />

Chairman, Palkesh Shah.<br />

II. THE PUBLIC POLICY AND<br />

ADVOCACY COMMITTEE<br />

<strong>The</strong> Public Policy and Advocacy Committee is<br />

committed <strong>to</strong> ensuring that KPDA impacts the<br />

industry through engagement on policy issues<br />

and becomes the most reputable body for the<br />

advocacy of real estate issues.<br />

Mandates:<br />

1. Ensures that KPDA enhances the business<br />

environment that KPDA members are<br />

operating in;<br />

2. Engaged in increased advocacy for issues<br />

facing members;<br />

3. Ensures focused engagement with policy<br />

makers;<br />

4. Ensures increased knowledge on priority<br />

areas of advocacy and best approaches;<br />

5. Facilitates increased dissemination<br />

of research findings and KPDA’s main<br />

areas of focus;<br />

6. Facilitates increased capacity of KPDA <strong>to</strong><br />

conduct impactful advocacy by increased<br />

engagement with likeminded organizations,<br />

associations and institutions.<br />

<strong>The</strong> Convenor of this Committee is KPDA Board<br />

Direc<strong>to</strong>r Gikonyo Gi<strong>to</strong>nga.<br />

<strong>The</strong> committee has also subdivided<br />

itself in<strong>to</strong> working groups who work on<br />

focused advocacy areas:<br />

1. <strong>The</strong> National Government Working Group:<br />

Facilitate KPDA’s engagement with central<br />

government (primarily the Ministry of Lands<br />

and Physical Planning as well as the<br />

Ministry of Transport, Infrastructure, Housing<br />

and Urban Development).<br />

<strong>The</strong> Group is led by Esther Omulele of MMC<br />

Africa Law.<br />

2. <strong>The</strong> County Government Working Group:<br />

Ensure effective engagement with various<br />

county governments <strong>to</strong> enhance the<br />

business environment that KPDA members<br />

work in.<br />

3. <strong>The</strong> Research and Development Working<br />

Group: Spearhead the project <strong>to</strong> develop<br />

the KPDA Construction Process Handbook.<br />

<strong>The</strong> Group is led by Azmeena Bhanji of PDM<br />

(Kenya) Ltd<br />

4. <strong>The</strong> Regula<strong>to</strong>ry Bodies Working Group:<br />

Ensure close and focused engagement<br />

with regula<strong>to</strong>ry bodies that KPDA members<br />

interact with doing business in the Kenyan<br />

real estate sec<strong>to</strong>r.<br />

Group is led by Alex Waiharo of Jabez Properties.<br />

III. MEMBERSHIP AND OUTREACH<br />

COMMITTEE<br />

<strong>The</strong> main aim of the Membership and Outreach<br />

Committee is <strong>to</strong> develop KPDA <strong>to</strong> be the most<br />

relevant association for property developers<br />

and other players in the real estate sec<strong>to</strong>r. This<br />

committee supports the secretariat by maintaining<br />

active members by organizing vibrant and active<br />

activities and events as well as increasing<br />

membership numbers.<br />

<strong>The</strong> Convenor of the Committee is KPDA Board<br />

Direc<strong>to</strong>r Ken Luusa.<br />

III. THE INSTITUTIONAL<br />

STRENGTHENING COMMITTEE<br />

It is the mandate of this committee <strong>to</strong> develop<br />

structures that will ensure financial sustainability,<br />

operational capacity and facilitate realization of<br />

KPDA’s mission and vision.<br />

<strong>The</strong> Convenor of the Committee is KPDA Board<br />

Developers can peruse some<br />

development strategies <strong>to</strong> reduce the<br />

cost of development, while increasing<br />

the likelihood of success<br />

1<br />

. Unit Sizing: Building smaller<br />

units can help reduce the price of<br />

units, while allowing developers <strong>to</strong><br />

retain their margins. Reducing unit<br />

sizes can increase the per unit cost of<br />

a development, given the finishes and<br />

internal walls required.<br />

2<br />

. Incremental Housing: <strong>The</strong><br />

affordability of housing may also<br />

be increased by making use of basic<br />

materials with the provision that home<br />

owners can make improvements on the<br />

house over time through an incremental<br />

housing model.<br />

3<br />

. Land JVs: Land is a big upfront<br />

expense. Land JVs can help reduce<br />

the cost of land, but also reduce the<br />

speculation of land prices. Clear<br />

objectives and assumptions should be<br />

agreed at the outset and codified in<strong>to</strong><br />

robust legal agreements.<br />

. Parking Ratios: Buildings with<br />

smaller unit sizes and more units<br />

may need <strong>to</strong> provide a smaller parking<br />

ratio per unit than buildings with larger<br />

units. Developers need <strong>to</strong> either selling<br />

parking or limiting the number of parking<br />

available by building along public<br />

transport routes.<br />

. Sales & Cash Flow: Managing<br />

a developers cashflow is paramount.<br />

It’s important <strong>to</strong> have a robust financial<br />

model at the outset of a development<br />

and <strong>to</strong> moni<strong>to</strong>r expenditures against<br />

the budget. Timely collection of cash is<br />

imperative for a developer <strong>to</strong> manage his<br />

interest expense.<br />

THE REITS ASSOCIATION OF KENYA<br />

<strong>The</strong> REITS Association of Kenya (RAK) was established in 2017 by players in the<br />

Real Estate and Capital markets industries. Although in its infancy, the Association<br />

Membership has grown <strong>to</strong> include diverse range of market participants including:<br />

We will run your advertisement for a period of four (4) consecutive weeks at a cost of Kshs. 15, 000.<br />

Advertisers who commit <strong>to</strong> advertise for four (4) consecutive months will get an additional four (4) weeks<br />

for free<br />

Payment is required within two (2) working days of the production of the report (First Wednesday of every month<br />

from commencement of agreement).<br />

Online Advertising Terms and Conditions: Payment is due within two (2) working days of an invoice being<br />
