We ask that you re<strong>in</strong>state the Private Rights of Action (H.R. 5876, Sec.5).<br />
Ma<strong>in</strong>tenance of Action-Any person suffer<strong>in</strong>g an <strong>in</strong>jury-<strong>in</strong>-fact traceable to<br />
a violation of a regulation promulgated pursuant to section 3(a) may br<strong>in</strong>g<br />
suit or a claim demand<strong>in</strong>g relief.<br />
Relief—A court hear<strong>in</strong>g a claim or suit under subsection (a) may order<br />
any appropriate equitable remedy and award damages <strong>in</strong>clud<strong>in</strong>g punitive<br />
damages, costs, reasonable attorney’s fees, <strong>for</strong> a violation of a regulated<br />
promulgated pursuant to section 3(a).<br />
We ask that you also allow <strong>for</strong> victims br<strong>in</strong>g suit <strong>in</strong> federal court when<br />
<strong>in</strong>terstate commerce is <strong>in</strong>volved to <strong>in</strong>sure a fair and impartial hear<strong>in</strong>g.<br />
We also ask that you create a federally imposed statute of limitations of no less<br />
than thirty years so victims of the <strong>in</strong>dustry have time to recover from the trauma,<br />
f<strong>in</strong>d their voice, and seek relief.<br />
