Request for Proposal for establishing e-Governance Systems
(34) “Network” means the physical medium through which Data is transferred from
source to destination.
(35) “New Version” means a version of Licensed Software or hardware released as “New
Version” by the OEM.
(36) “OEM” or “Original Equipment Manufacturer” means the original manufacturer of
the software or hardware that owns the original Intellectual Property rights to the
software or hardware to be used in the Project and to which the BUYER has been
granted license to use.
(37) “Operations and Maintenance Services” or “O&M” includes the activities covered
during the period from “Go Live” till the expiry or termination of the Contract. Some
of the key activities in this stage include but are not limited to the warranty for
equipments, ATS for software, handholding for the implemented software solution,
supporting the End Users in using the new system, maintenance of the entire
Information Technology infrastructure, New Versions, Helpdesk services and AMC.
(38) “Operative Period of Contract” or “Term”means the period of the Contract
commencing from the Effective Date of Project Commencement and continuing till
the last day of Operations and Maintenance Service, or the date of termination, in
case of earlier termination of the Contract.
(39) “Project” means the entire set of activities that include “System Integration
Services” and “Operations & Maintenance Services”.
(40) “Project Assets” means the assets (including hardware and software), other than ASI
Supplied Equipment, supplied for the purpose of the Project, pursuant to this
Contract.
(41) “Project Site” means all the sites that include Development Site, Implementation
Sites, DataCenter and DisasterRecoveryCenter.
(42) “Request for Proposal (RFP)” means the documents containing the general,
technical, functional, commercial and legal specifications for the implementation of
the Project issued in different parts and as different Appendices and Annexure and
includes the clarifications, explanations, minutes of the meetings and amendments
issued from time to time during the bidding process.
(43) "Replacement SI" means any third party that the BUYER may appoint to replace SI
on or before the expiry of the Operative Period of Contract or on termination of this
Contract to undertake the Project or part or extension thereof.
(44) "Service Level" means the level of service and the completeness of the services
delivered, and other performance criteria which will apply to the services as set out
in Article 3.
