Hurricane Watch - What To Do
• Listen to local radio and television stations for up-to-date storm information.
• Prepare to bring inside any lawn furniture, outdoor decorations, trashcans, hanging plants, and anything else that can
become a flying object during a storm.
• Cover all windows and doors of your home.
• Fill your car/vehicles with gas.
• Check your Disaster Supply Kit.
• Turn refrigerator/freezer to coldest settings.
• Store drinking water in clean jugs, and bottles.
• Secure boats and trailers.
• Make arrangements for pets.
• Make arrangements for elderly and others with special needs such as those who depend on electrical life support.
• Make arrangements for a shelter if you are in an evacuation area.
Hurricane Warning - What To Do
• Listen to local radio and television stations and listen to the advice of local officials on whether to evacuate or not.
• Complete preparation for storm.
• If you are not advised to evacuate, stay indoors and away from windows.
• Be aware that the calm “eye” of the storm is deceptive; the storm is not over. Stay inside until local officials say it is safe
to leave the home.
• Be alert of tornados. Stay indoors, in the center of your home, in a closet or bathroom without windows.
• Stay away from floodwaters.
After the Storm - What To Do
• Listen to local radio and television stations for safety instructions.
• If evacuated, return to home when local officials tell you to.
• Stay away from disaster areas. DO NOT SIGHTSEE!!!
• Obey all curfews and emergency orders that are issued.
• If you must drive, drive with CAUTION!! Lights are down, so use all four-way intersections as a four way stop.
• Advise interested parties that you are safe.
• Call for emergency workers if medical assistance is needed.
• Avoid downed power lines. Assume that they are all live.
• Use flashlights in the dark, not candles.

Want To Lose ½ Of Your Retirement…?
…Get a divorce. Yes, in divorce proceedings your retirement
is a marital asset which is subject to distribution.
Absurd you say? Welcome to Florida, an equitable
distribution state. Florida’s dissolution of marriage laws
found in Chapter 61 of the Florida Statutes provide for
equitable distribution.
In essence, all assets acquired during a marriage are
considered marital and therefore equitably divided.
This applies to assets despite whose name they are titled
in. For example, take this fictitious couple, Officer
Smith is married to Wife Smith. They have been married
for 15 years. Officer Smith has been with the PBSO
for 14 years. He has acquired retirement, accrued vacation
time and an investment account which he worked
very hard to save from his detail work. Wife Smith files
for a divorce. Wife Smith is entitled to half of the retirement,
cash value of the vacation time accrued and half
of the investment account. Best bet for Officer Smith?
Marriage counseling.
There are circumstances in which would change the
equitable distribution of your retirement to where one
party would be entitled to slightly more than the other
(unequal distribution). However, these circumstances
are so limited that they rarely apply in practice.
In the event that your spouse also has a retirement plan
then it would of course be part of the marital pile of assets
to be divided. Consider this example: Detective Alvarez
has a retirement which he has been accumulating
for 20 years. Wife Alvarez has a retirement she has been
accumulating for 22 years. They have been married for
10 years. In this case, there are 10 years of accumulation
of marital retirement assets which need to be divided. If
during the 10 years of marriage/accumulation the Detective
accumulated $75,000 and the Wife accumulated
$50,000 then we would be equalizing the marital portion
of the retirement accounts. The pre-marital portions
would remain in-tact.
Whatever your factual situation, have an expert assist
you in the process so that you don’t end up like Client
X. Client X thought he had struck a great deal with his
spouse. X’s retirement assets were worth $750,000. Their
post tax investment account was also worth $750,000.
After agreeing to the “equal” exchange with Wife X (and
signing the agreement) Client X wanted me to filing the
divorce case. Lesson? Retirement accounts are pre-tax
assets and therefore the net value of the pre-tax retirement
account is lower than after tax assets. This is not
an “equal” exchange. Don’t make this or other costly errors.
