NOTICE INVITING BIDS FOR STRENGTHENING OF ROAD WORKS<br />

NIT no. 04/WBSRDA/RIDF/XVI Dated: 30.09.2011<br />

<strong>The</strong> Executive Engineer (P&RD), <strong>Jalpaiguri</strong> Zilla Parishad, on behalf <strong>of</strong> Jalpaizguri Zilla<br />

Parishad invites sealed Tender in percentage rates for each <strong>of</strong> the following works by two cover<br />

system -<br />

Resourceful and bonafied contractors <strong>of</strong> P&R.D/P.W.D/I&W.D/C.P.W.D and also others may<br />

submit their bids. <strong>The</strong> intending contractors must have completed at least one work <strong>of</strong> similar<br />

nature within last five years, value <strong>of</strong> which is not less than 50% <strong>of</strong> the value put to tender. <strong>The</strong> pre-<br />

qualification documents are to be uploaded in two separate folders. One <strong>of</strong> the folder shall contain<br />

Technical documents along with scanned copy <strong>of</strong> challan for cost <strong>of</strong> bid documents, copy <strong>of</strong> Earnest<br />

Money . Financial Bids are to be uploaded in another folder. :<br />

� <strong>The</strong> pre-qualification documents alone will be opened on …25.10.11..( Tuesday) at 02.00 P.M by<br />

the Executive Engineer (P&RD), <strong>Jalpaiguri</strong> Zilla Parishad in presence <strong>of</strong> bidders present.<br />

� Name <strong>of</strong> Technically qualified bidders will be displayed in this Office notice board by 01.11.11.<br />

(Tueday) at 02.00 P.M<br />

� <strong>The</strong> Financial bid document <strong>of</strong> the technically qualified bidders will be opened for evaluation and<br />

selection <strong>of</strong> qualified bidders on 02.11.11. (Wednesday) at 02.00.P.M and the bid documents <strong>of</strong><br />

non-qualified will remain unopened. No separate intimation will be given for this, unless the above<br />

date is changed. In case <strong>of</strong> change <strong>of</strong> date, due intimation will be given on-line. No individual<br />

intimation will be given.<br />

� <strong>The</strong> Executive Engineer, (P& R.D) reserves the right to reject or cancel any or all pre-qualification<br />

documents and financial bid document without assigning any reason what so ever.<br />

� 1% cess under W.B building and other construction workers (Regulation <strong>of</strong> Employment&<br />

Conditions <strong>of</strong> service) Welfare cess Act, 1996 will be deducted from the running and final<br />

bills<br />

� Time allowed for completion <strong>of</strong> each work is 09 (Nine) months (excluding rainy season 3 month)<br />

from the date <strong>of</strong> issue <strong>of</strong> work order.<br />

� <strong>The</strong> intending Bidders must inspect the alignment <strong>of</strong> the proposed road before quoting their rates.<br />

A] Eligibility <strong>of</strong> Contractors:<br />

1. Contractors / Firms / Registered Unemployed Engineers’ Co-operative Societies / Registered Un-<br />

employed Labour Co-operative Societies and bonafied outsider contractors with sound financial<br />

status and having experience in timely completion <strong>of</strong> similar nature <strong>of</strong> work as mentioned above<br />

and also who have satisfactorily completed at least one similar type <strong>of</strong> work and having a<br />

magnitude <strong>of</strong> not less than 50% <strong>of</strong> the value <strong>of</strong> work for which applications are invited or they / he<br />

/ she should be satisfactorily executing currently at least one similar nature <strong>of</strong> work and having<br />

completed billing not less than 50% <strong>of</strong> the value <strong>of</strong> work for which tender is invited .Turnover in<br />

any <strong>of</strong> the last 5 years should not be less than same <strong>of</strong> the tender value. <strong>The</strong> relevant documents<br />

supporting turnover must also be uploaded at the time <strong>of</strong> submission <strong>of</strong> bids.<br />

2. <strong>The</strong> credential should be in the name & style <strong>of</strong> the intending Tenderer only, and not in the name<br />

and / or style <strong>of</strong> any <strong>of</strong> the Partner(s).<br />

3. <strong>The</strong> applicants must have own/hired all machineries related to the construction <strong>of</strong> road work. List<br />

and pro<strong>of</strong> <strong>of</strong> machineries owned / hired by the Agency to be submitted at the time <strong>of</strong> receiving<br />

tender with Technical Bid.<br />

4. Field testing laboratory equipments must be set-up by the Agency at work site at the time <strong>of</strong><br />

execution. List and pro<strong>of</strong> <strong>of</strong> test laboratory equipments owned/hired by the Agency to be<br />

submitted at the time <strong>of</strong> receiving tender with technical bid.<br />

5. At least one degree engineer with one year experience or one diploma engineer with three years<br />

experience and one laboratory technician to be deputed at work site at the time <strong>of</strong> execution and<br />

their documents in this effect to be submitted at the time <strong>of</strong> receiving tender in Technical Bid.<br />

6. Duly attested photocopies <strong>of</strong> Authentic documents <strong>of</strong> experience, resource and financial solvency<br />

in the shape <strong>of</strong> payment certificates supported with relevant Work Orders and / or completion<br />

issued by authority not below rank <strong>of</strong> Executive Engineer<strong>of</strong> works already executed during last 5<br />

(five) years and details <strong>of</strong> technical personnel under his / her / their incumbency etc are to be<br />

uploaded online and manually to be produced at the time <strong>of</strong> opening <strong>of</strong> Tender. Tender without<br />

documentary evidence <strong>of</strong> having in possession <strong>of</strong> machinery and equipment may not be<br />

entertained. Relevant certificate from any Nationalised Bank in pro<strong>of</strong> <strong>of</strong> financial solvency need<br />

also be submitted along with the tender with Technical Bid.<br />

7. <strong>The</strong> intending Tenderers should furnish a list <strong>of</strong> works executed by them / him / her <strong>of</strong> similar<br />

nature and magnitude as mentioned above with necessary certificate from the concerned Executive<br />

Engineer or an Engineer <strong>of</strong> same rank or above <strong>of</strong> any Government / Government undertaking<br />

regarding satisfactory performance <strong>of</strong> such works are to be uploaded online and manually to be<br />

produced at the time <strong>of</strong> opening <strong>of</strong> Tender. In absence <strong>of</strong> the above details tender may not be<br />

accepted.<br />

8. All the related documents are to be produced IN ORIGINAL to this <strong>of</strong>fice as and when asked for.<br />

B] Application for getting Tender Document<br />

1. Intending Tenderers are requested to download the Tender Document from our website<br />

www.wbprd.nic.in within the stipulated time.<br />

2. NO INTENDING TENDERER IS ALLOWED TO APPLY for more than one no. <strong>of</strong> works, unless<br />

the turnover remains at desire level after successive deduction <strong>of</strong> value awarded work opened as<br />

per sequence.<br />

3. If any Intending Tenderer is willing to apply for more than one no <strong>of</strong> roads, he / she / they is / are<br />

requested to submit separate set <strong>of</strong> application along with cost <strong>of</strong> Tender Document separately for<br />

each no. <strong>of</strong> roads.<br />

4. All the relevant documents in support <strong>of</strong> the eligibility are required to be submitted along with the<br />

Tender itself.<br />

C] Earnest Money<br />

1. <strong>The</strong> amount should be deposited in Punjab National Bank in the Account No<br />

D] Submission <strong>of</strong> Tender<br />

NIT for RIDF-XVI (2011-12), <strong>Jalpaiguri</strong> Zilla Parishad<br />

1. All intending Tenderers are required to upload scanned copies <strong>of</strong> duly attested photocopies <strong>of</strong> all<br />

valid and up-to-date Sales Tax, Income Tax and Pr<strong>of</strong>essional Tax clearance certificates and VAT<br />

registration certificate and all relevant documents in support <strong>of</strong> pro<strong>of</strong> <strong>of</strong> their eligibility together<br />

with a forwarding letter mentioning the list <strong>of</strong> enclosures submitted along with the Tender.<br />

2. Intending Tenderers may submit Tender for more than one work. But, in that case, uploading <strong>of</strong> all<br />

relevant documents to be done separately.<br />

3. <strong>The</strong> intending tenderers may also submit their bids in hard form and drop in the box which shall be<br />

kept at the chamber <strong>of</strong> the undersigned within stipulated date and time.<br />

4<strong>The</strong> Documents IN ORIGINAL are to be produced to this <strong>of</strong>fice as when asked for.<br />

E] Documents to be enclosed along with the Tender<br />

1. Pan Card.<br />

2. Pr<strong>of</strong>essional Tax Clearance Certificates.<br />

3. Income Tax Clearance Certificate.<br />

4. VAT Registration Certificate.<br />

5. Sales Tax Clearance Certificate ( both State & Central) if any.<br />

6. Payment Certificate <strong>of</strong> the work which the tenderer intended to furnish as support <strong>of</strong> pro<strong>of</strong> <strong>of</strong><br />

experience.<br />

7. Work Order <strong>of</strong> the works, against which the payment certificate is being submitted.<br />

8. Certificate from the employer ( not below the rank <strong>of</strong> Executive Engineer ), under whom the work<br />

has been executed / under execution.<br />

9. All the relevant documents in support <strong>of</strong> pro<strong>of</strong> <strong>of</strong> having road construction machineries, Tools &<br />

Plants, labrotary equipments etc in possession <strong>of</strong> the Tenderer.<br />

10. Details <strong>of</strong> technical personnel under the incumbency <strong>of</strong> the Tenderer.<br />

11.Declaration, stating the fact <strong>of</strong> having well established Laboratory set up with competent Lab.<br />

Asstt. / Engineers as well as the capability <strong>of</strong> setting <strong>of</strong> Field Laboratory at site.<br />

12. In case <strong>of</strong> Partnership Firm / Registered Company, the intending Tenderers are requested to<br />

submit the copy <strong>of</strong> the DEED <strong>of</strong> Partnership / relevant document in support <strong>of</strong> pro<strong>of</strong> <strong>of</strong> so.<br />

13. <strong>The</strong> intending tenderer in the same name and style should have achieved annual tern over <strong>of</strong> the<br />

year for 100% <strong>of</strong> proposed contract.<br />

14. <strong>The</strong> Documents IN ORIGINAL is to be produced to this <strong>of</strong>fice as when asked for.<br />

F] Opening <strong>of</strong> Tender<br />

1. <strong>The</strong> Tenders, so received upto 24.10.11 upto …02.00. PM, only Technical Bid will be opened on<br />

25.10.11 at 02.00 PM or date & time fixed by the authority <strong>of</strong> <strong>Jalpaiguri</strong> Zilla Parishad in<br />

presence <strong>of</strong> the available Tenderers or their authorized representatives.<br />

2. All participating Tenderers are requested to remain present at the time <strong>of</strong> opening <strong>of</strong> Technical Bid.<br />

No objections in this regard will be entertained raised by any participant who will not be present<br />

during opening <strong>of</strong> tenders.<br />

F] Terms and Conditions<br />

NIT for RIDF-XVI (2011-12), <strong>Jalpaiguri</strong> Zilla Parishad<br />

1. All the Intending Tenderers are requested to visit the sites <strong>of</strong> works prior to the submission <strong>of</strong><br />

Tender at their own effort and interest.<br />

2. This Notice Inviting Tender will be treated as part <strong>of</strong> the Tender Document.<br />

3. In case <strong>of</strong> any day, meant for this tender, appears to be an unscheduled holiday, the next working<br />

day will be treated as scheduled / prescribed day for the same purpose.<br />

4. For any communication towards getting <strong>of</strong> tender document or submission <strong>of</strong> tender, postal delay,<br />

in no case, will be entertained.<br />

5. No materials, Tools & Plants etc. will be issued by <strong>Jalpaiguri</strong> Zilla Parishad.<br />

6. No preconditioned tender will be accepted.<br />

7. All the rates <strong>of</strong> works are inclusive <strong>of</strong> all taxes, cess, levy, octroi, royalties, transportation, loading,<br />

unloading, stacking, etc including all other incidental charges therein.<br />

8. <strong>The</strong> Successful Tenderer, herein after called the Contractor, will have to execute an agreement on a<br />

Non Judicial Stamp worth Rs. 100/- only, and, will purchase two additional copies <strong>of</strong> Tender<br />

Document @ Rs. 1000.00 per set from this <strong>of</strong>fice, duly signed and submit to this <strong>of</strong>fice which will<br />

be treated as part <strong>of</strong> the Agreement.<br />

9. Both, the Contractor and the employer have agreed that it is not feasible to precisely estimate the<br />

amount <strong>of</strong> losses due to delay in completion <strong>of</strong> works and the losses to the public and the economy,<br />

therefore, both the parties have agreed that the Contractor shall pay liquidated damages to the<br />

Employer and not by way <strong>of</strong> penalty, at the rate per week or part there<strong>of</strong> stated in the Contract Data<br />

for the period that the Completion Date is later than the Intended Completion Date. Liquidated<br />

damages at the same rates shall be withheld if the Contractor fails to achieve the milestones<br />

prescribed in the Contract Data. However, in case the Contractor achieves the next milestone the<br />

amount <strong>of</strong> the liquidated damages already withheld shall be restored to the Contractor by<br />

adjustment in the next payment certificate. <strong>The</strong> employer and the contractor have agreed that is a<br />

reasonable agreed amount <strong>of</strong> liquidated damages and the total amount <strong>of</strong> liquidated damages shall<br />

not exceed 10% <strong>of</strong> the contract price. <strong>The</strong> employer may deduct liquidated damages from payments<br />

due to the contractors. Payment <strong>of</strong> liquidated damages shall not affect the contractor’s other<br />

liabilities.<br />

If the Intended Completion Date is extended after liquidated damages have been paid, the Engineer<br />

shall correct any overpayment <strong>of</strong> liquidated damages by the Contractor by adjusting the next<br />

payment certificate.<br />

10. <strong>The</strong> Contractors are required to set well equipped laboratory for exercising effective quality control.<br />

Periodical tests on materials and works shall have to be conducted as per relevant codes. Suitable<br />

Laboratory Assistants are to be posted in the Laboratories for the same. <strong>The</strong> results <strong>of</strong> all quality<br />

control tests and observations should be required for getting any payments . No claims regarding<br />

payment will not be entertained without quality control test including certificate <strong>of</strong> Engineers.<br />

11. Necessary deduction towards VAT, Income Tax and Welfare Cess etc. will be made as per Govt.<br />

norms, and Security Deposit @ 13% <strong>of</strong> the value <strong>of</strong> work will be deducted from each progressive<br />

Bill. <strong>The</strong> Earnest Money will form part <strong>of</strong> the the Security Deposit.<br />

12. <strong>The</strong> Contractor is to render performance guarantee <strong>of</strong> the works for a period <strong>of</strong> 3 years from the<br />

date <strong>of</strong> completion <strong>of</strong> the work. A retention towards performance guarantee / security amounting to<br />

10% <strong>of</strong> the billed amount shall be made by in the first and following interim payments, until the<br />

amount so retained reaches a limit <strong>of</strong> retention money towards performance guarantee / security<br />

equal to 13% (15% including earnest money deposit) <strong>of</strong> contract price . At this stage or at any<br />

intermediate stage the agency may, at his / her / their opinion, replace the retention amount with an<br />

unconditional Bank Guarantee from a bank acceptable to, <strong>Jalpaiguri</strong> Zilla Parishad.<br />

13. <strong>The</strong> performance security will be repaid to the agency, or the Bank Guarantee will be progressively<br />

reduced in the following manner, provided that the agency has executed and completed the works<br />

and rectified any defect therein to the satisfaction <strong>of</strong> Engineer-in-charge as mentioned below:<br />

I. After expiry <strong>of</strong> 1 year form the date <strong>of</strong> completion <strong>of</strong> the work : 1/3 rd <strong>of</strong> the total amount<br />

<strong>of</strong> retention money / bank guarantee.<br />

II. After expiry <strong>of</strong> 2 years form the date <strong>of</strong> completion <strong>of</strong> the work : 1/3 rd <strong>of</strong> the total amount<br />

<strong>of</strong> retention money / bank guarantee.<br />

III. After expiry <strong>of</strong> 3 years form the date <strong>of</strong> completion <strong>of</strong> the work : 1/3 rd <strong>of</strong> the total amount<br />

<strong>of</strong> retention money / bank guarantee.<br />

14. Each bonafied tenderer irrespective <strong>of</strong> the fact whether he / she is a Degree or Diploma holder must<br />

have in his / her employment at least one Degree holder & one Diploma holder in Civil Engineering<br />

and to be posted at site, and the document in this effect to be submitted along with tender, unless he<br />

dedicates himself at work site and an affidavit must be furnished in this respect.<br />

15. <strong>The</strong> successful contractor shall have to submit 3 (three) copies <strong>of</strong> application in the prescribed form<br />

for license (Form No VI) duly filled and signed by the contractor along with the tender. <strong>The</strong> license<br />

fee in terms <strong>of</strong> Rule – 26(2) and the Security Deposit <strong>of</strong> Labour in terms <strong>of</strong> Rule – 24 <strong>of</strong> West<br />

Bengal Contract & Labour (Regulation & Abolition) Act, 1972 should be separately deposited to<br />

the Local Treasury under the Head <strong>of</strong> Account - : 843 Civil Deposit – Deposit under various central<br />

and State Acts deposit under the contract Labour (Regulation and Abolition) Act, 1970.<br />

16. Sub-allotment <strong>of</strong> work maximum upto 25% <strong>of</strong> work value may be permitted subject to approval <strong>of</strong><br />

the competent authority.<br />

17. Any bill (running account/final) payment <strong>of</strong> proposed executed work may be made to Agency as<br />

per availability <strong>of</strong> fund under RIDF-XVI.<br />

18. <strong>The</strong> registered cooperative should submit the registration certificate, current renewal certificate<br />

<strong>of</strong> their cooperative from competent authority with Technical bid.<br />

19. Escalation claimed by the Agency will not be entertained by Authority.<br />

20. <strong>The</strong> authority reserves the right to accept or reject any or all the tenders without assigning any<br />

reason. And the right to add, alter or delete any <strong>of</strong> the conditions & terms, laid above, is also<br />

reserved.<br />
