on the corner of Wairere Dr<br />

and Ruakura Rd. PlaceMakers<br />

already has two Hamilton<br />

stores.<br />

The moves are in response<br />

to booming DIY and trade sales<br />

built on the back of a housing and<br />

renovation boom as Hamilton<br />

undergoes a period of growth<br />

rivalling pre-Global Financial<br />

Crisis times.<br />

New building consents were<br />

up almost 10 percent in the year<br />

to March while house sales were<br />

up 26 percent, according to<br />

Hamilton City Council general<br />

manager for city growth Kelvyn<br />

Eglinton.<br />

Consent inspection visits had<br />

doubled year on year for the last<br />

two.<br />

“In March alone there were<br />

75 new building consents granted<br />

which is huge.”<br />

Kelvyn says Hamilton’s<br />

economy is growing at a rate of<br />

4.3 percent, compared with the<br />

national average of 3.6 percent.<br />

Most of the building is going<br />

on in the city’s north eastern<br />

suburbs, particularly Rototuna,<br />

but of the 400 land use consents<br />

granted since July 2015, nearly<br />

half of them were for infill housing<br />

in established suburbs like<br />

Hillcrest, Glenview, Melville and<br />

and 30 percent were for apartments.<br />

The figures reflect widespread<br />

anecdotal evidence about<br />

the difficulty in finding builders,<br />

while builders report difficulty<br />

in finding sufficient numbers of<br />

apprentices.<br />

Stories of Aucklanders buying<br />

up in Hamilton are also backed<br />

up by statistics. Kelvin says in the<br />

first three months of this year, 17<br />

percent of the city’s houses were<br />

bought by Aucklanders.<br />

Meanwhile, renovators are<br />

having a ball and stores like<br />

PlaceMakers, Bunnings and<br />

Mega Mitre 10 are buzzing with<br />

DIY shoppers every weekend.<br />

PlaceMakers recently set up joint<br />

management of its Te Rapa and<br />

Huntly stores, both of which are<br />

busy with increased trade growth<br />

from new subdivisions to the<br />

north.<br />

Construction of the $24.7 million<br />

new Bunnings Warehouse<br />

South Hamilton is now well<br />

underway through <strong>Waikato</strong><br />

building firm Livingstone<br />

Building. Bunnings says the store<br />

is strategically located to serve<br />

existing and new customers.<br />

Bunnings expects about 110<br />

jobs to be created when the store<br />

opens later this year and the creation<br />

of more than 150 construction<br />

jobs throughout the build.<br />

The new Bunnings will<br />

comprise the main store, indoor<br />

timber trade sales area, building<br />

materials, landscape supplies<br />

yard and an outdoor nursery.<br />

The complex will also include<br />

an indoor playground, cafe, and<br />

provide parking for 269 cars.<br />

Meanwhile, Mitre 10 Mega<br />

has yet to begin construction at<br />

its site on the corner of Wairere<br />

Dr and Ruakura Rd.<br />

“We’re very encouraged by<br />

the level of customer interest<br />

we’re receiving in the store,” says<br />

Mitre 10 Mega managing director<br />

Terry Wilson.<br />

“We’re working as quickly<br />

as we can to get the store open,<br />

as we know local residents are<br />

eagerly awaiting having access<br />

to home improvement materials<br />

without having to drive across<br />

town.”<br />

Hamilton Central online marketplace ‘a first’<br />

Consumers want to purchase<br />

locally-made goods and support<br />

local businesses, and they are<br />

doing more product research<br />

online before stepping in store to<br />

purchase.<br />

These are two trends<br />

that the Hamilton CBD<br />

is taking advantage of<br />

with the launch of the new<br />

Hamilton Central online marketplace<br />

website, says Sandy<br />

Turner, general manager of<br />

the Hamilton Central <strong>Business</strong><br />

Association (HCBA).<br />

Hamilton's 'online CBD'<br />

is the first of its kind in New<br />

Zealand, provided by ecommerce<br />

company Storbie.<br />

A common perception is that<br />

online is a sales channel that<br />

detracts from bricks-and-mortar<br />

sales, however research shows<br />

that digital interactions in fact<br />

have a huge influence on in store<br />

sales and buying behaviour.<br />

A recent study by Roy<br />

Morgan Research published on<br />

ecommerce.org.nz stated that<br />

just under half (49.3 percent) of<br />

New Zealanders aged 14 plus<br />

bought at least one product over<br />

the internet in the previous four<br />

weeks. The study also showed<br />

that half of Kiwis agree they<br />

research products or services<br />

online before buying in-store,<br />

and almost one in three did product<br />

research online within the<br />

last four weeks.<br />

Paul Manning, managing<br />

director of .99, New Zealand’s<br />

leading retail specialist advertising<br />

agency, says even in today's<br />

hyper-connected digital world,<br />

ecommerce still contributes less<br />

than eight percent of retail sales<br />

across Australasia.<br />

“That said, the influence of<br />

digital is skyrocketing. Research<br />

suggests around half<br />

of retail sales are<br />

influenced by digital<br />

and that trend is<br />

expected to continue.<br />

No longer simply<br />

looking to the web to<br />

take away the inconvenience<br />

of physical<br />

transactions,<br />

consumers are discovering<br />

new products,<br />

researching<br />

them, and making<br />

purchase decisions<br />

before they walk into<br />

the store.”<br />

Further research<br />

backs this up. Data<br />

published by Google<br />

shows that the internet was used<br />

in 53 percent of recent purchase<br />

journeys in New Zealand leading<br />

to either an online or offline purchase.<br />

The most common activities<br />

by Kiwis are gathering information<br />

on pricing, promotions,<br />

and product availability.<br />

Research from Deloitte shows<br />

that 72 percent of Australian<br />

shoppers already know what<br />

they want to buy before they<br />

go into a shop. What’s really<br />

important to recognise, says<br />

Sandy Tuner, isn’t so much the<br />

dominance of digital, it’s how<br />

online and offline channels work<br />

together.<br />

HCBA is poised to help all<br />

Hamilton CBD businesses take<br />

full advantage of the habits of<br />

digitally-connected consumers<br />

by featuring their business and<br />

products in the new marketplace<br />

website for free. "Online channels<br />

have become mainstream<br />

for not only the next generation<br />

of shoppers, but those aged<br />

40+ too, so supporting Hamilton<br />

Central businesses in their online<br />

marketing efforts is crucial,"<br />

says Sandy.<br />

"We want to encourage members<br />

to not only have a brochure<br />

website, but also an online store<br />

with their product catalogue so<br />

consumers can research and<br />

browse online, anywhere and at<br />

any time, and then head in store<br />

to purchase".<br />

"Online shopping is here to<br />

stay. So are the big overseas<br />

brands. We won't see that slow<br />

down until the GST laws come<br />

in to effect. But buying online<br />

from a local business means consumers<br />

can trust there is a bricksand-mortar<br />

store they can go to<br />

when they want or need".<br />

'Something unique on every<br />

street' is the message that HCBA<br />

wants to get across in their efforts<br />

to inform people what Hamilton<br />

has to offer.<br />

"The business directory pages<br />

on our website were getting the<br />

most visits each month and the<br />

stats showed such a huge number<br />

of people were browsing on a<br />

mobile device, but our website<br />

was not mobile-friendly so it<br />

was vital to change that. Now<br />

that we have launched the new<br />

mobile-friendly website with<br />

ecommerce capability, we're<br />

focusing on making sure all<br />

CBD businesses get the most out<br />

of it," says Sandy.<br />

"It's so important to support<br />

in-store sales with online, something<br />

we're educating members<br />

about and encouraging them to<br />

pursue".<br />

"As more businesses add their<br />

products to the marketplace, it<br />

becomes a hub of information<br />

about the local products that are<br />

on offer in the Hamilton CBD.<br />

Sandy Turner resigns from<br />

Hamilton Central job<br />

resigned from her position<br />

after five years in the job.<br />

It is understood she plans to<br />

run as a candidate for Hamilton<br />

City Council in October’s elections.<br />

Sandy’s resignation was<br />

announced by acting chair of<br />

the Hamilton Central <strong>Business</strong><br />

Association Executive (HBCA)<br />

Committee, Michelle Baillie.<br />

“Sandy has done a fantastic<br />

job for Hamilton Central and<br />

has achieved a lot in almost five<br />

years as general manager,” said<br />

Michelle.<br />

“We will miss Sandy’s pas-<br />

sion and energy and would<br />

like to thank her for everything<br />

she has done to help make the<br />

Hamilton CBD a better place for<br />

all of us.”<br />

Key projects and achievements<br />

that Sandy has been<br />

involved in driving include<br />

redevelopment, the HCBA digital<br />

strategy and business awards.<br />

Sandy also contributed to<br />

the development of both the<br />

Hamilton River Plan and the<br />

“I have loved this challenging<br />

role, working with you all and<br />

have learned a lot during my<br />

almost five years,” says Sandy.<br />

“I am very proud of the work<br />

we have achieved and the current<br />

position of the HCBA,” she said.<br />

Sandy will leave her position<br />

on June 20 and Michelle says<br />

Hamilton Central will begin the<br />

search for a new general manager<br />

Kiwi Property Group follows the growth north<br />

Three years after opening the<br />

revamped Centre Place shopping<br />

mall, Kiwi Property Group has<br />

followed the growth to the city’s<br />

north by buying into The Base.<br />

Kiwi Property Group<br />

(KPG), New Zealand's<br />

biggest listed property<br />

investor, has agreed to buy 50<br />

percent of The Base shopping<br />

centre from Tainui Group<br />

Holdings (TGH).<br />

The deal comes four months<br />

after KPG announced the sale of<br />

the southern part of Centre Place<br />

to an undisclosed local buyer for<br />

$46.7 million, a three percent<br />

discount to its book value.<br />

Commentators say the move<br />

is a vote of confidence for The<br />

Base and the northern suburbs<br />

of Hamilton and a good strategic<br />

move from KPG.<br />

The signal for the Hamilton’s<br />

CBD is less clear given that only<br />

four years earlier, KPG invested<br />

$40 million in revamping Centre<br />

Place and Downtown Plaza into<br />

a combined mall and has already<br />

sold off half of that property.<br />

KPG has paid $192.5 million<br />

and offered $197.5 million for<br />

the balance. <strong>Waikato</strong>-Tainui will<br />

consider the offer for the remaining<br />

purchase of the initial 50 percent<br />

stake includes about 6.7 hectares<br />

of vacant land suitable for development,<br />

it said.<br />

The offer closes on <strong>May</strong> 17.<br />

KPG, which owns a number<br />

of New Zealand malls including<br />

Auckland’s Sylvia Park, says it<br />

will fund the acquisition through<br />

borrowing which would increase<br />

its gearing to 34 percent. Its ratio<br />

was 30.3 percent at September<br />

30, 2015.<br />

"Although the acquisition of<br />

reduce gearing following the sale<br />

of a number of non-core assets<br />

over the next two years as part of<br />

our asset recycling programme,"<br />

the sale of a half stake in The<br />

Base last August, saying it would<br />

use the funds to repay debt and<br />

for other investments.<br />

manage the centre, will help us<br />

ensure that the tenants and shoppers<br />

of The Base shopping centre<br />

continue to have an experience<br />

up there with New Zealand’s<br />

best,” said TGH chief executive<br />

Chris Joblin.<br />

Rahui Papa, chairman of the<br />

tribe’s executive committee Te<br />

Arataura welcomed the partial<br />

sale, saying it meets the tribe’s<br />

financial objectives in order to<br />

support its social, cultural and<br />

environment development goals.<br />

It will also protect tribal ownership<br />

of the underlying land,<br />

and preserve the unique <strong>Waikato</strong>-<br />

Tainui cultural elements within<br />

The Base shopping centre.<br />

“At the end of the long-term<br />

lease, ownership of The Base<br />

shopping centre will return to<br />

<strong>Waikato</strong>-Tainui at no cost.”<br />

He said TGH had retained one<br />

hectare, and secured an option<br />

over a further half hectare, in a<br />

prime location at The Base shopping<br />

centre for <strong>Waikato</strong>-Tainui<br />

to develop a possible future<br />

Whanau Ora centre, which will<br />

provide additional benefits to the<br />

people of <strong>Waikato</strong>-Tainui once<br />

completed.<br />

The partial sale of The Base<br />

shopping centre is part of a concerted<br />

effort by <strong>Waikato</strong>-Tainui to<br />

diversify its investments, according<br />

to a statement on TGH’s website.<br />

The sale proceeds will be<br />

used by TGH to reduce debt and<br />

ultimately re-invest in a balanced<br />

range of investment classes to<br />

grow jobs, increase cash returns<br />

to further a range of tribal objectives,<br />

and extend the land estate<br />

for <strong>Waikato</strong>-Tainui.<br />

Victoria on the River work begins<br />

Work on the Victoria on the<br />

River site, in Hamilton’s central<br />

city, has begun.<br />

The Victoria on the River<br />

project will see the transformation<br />

of a central city car park<br />

into a park-like public space<br />

with views across the <strong>Waikato</strong><br />

River.<br />

Stage one of the project<br />

has begun with the removal<br />

of material from the Victoria<br />

Street site. It is expected to take<br />

approximately three months,<br />

and will mean the car park will<br />

be unavailable.<br />

Contractors working on<br />

the site will be using a range<br />

of heavy machinery and from<br />

time to time there will be some<br />

temporary road closures at the<br />

Victoria Street-Collingwood<br />

Street intersection.<br />

‘Riff Raff park’ set to dazzle in CBD<br />

The latest stage of a dramatic<br />

revamp of Embassy Park in Victoria<br />

St which could boost visitor<br />

numbers to the CBD is nearing<br />

completion.<br />

The stunning redevelopment<br />

including a Rocky<br />

Horror-themed toilet<br />

block, a chandelier and a<br />

theatrical light show, planter<br />

boxes and vibrant gardens is<br />

expected to be launched in the<br />

next two months.<br />

The park’s identity was created<br />

when the Riff Raff statue was<br />

erected in 2004, but in recent<br />

years a puff shop nearby contributed<br />

to the park becoming a<br />

hangout for streeties, prompting<br />

concerns from business-owners<br />

and members of the public.<br />

A redevelopment plan was<br />

put up and in 2014 Hamilton<br />

City Council agreed to hand the<br />

park over to a working group<br />

led by chairman of the Riff Raff<br />

Public Art Trust Mark Servian.<br />

The trust raised $150,000<br />

and is now embarking on the<br />

most exciting part of the project<br />

– the physical works.<br />

Mark says the pavilion - or<br />

toilet block - will essentially be<br />

a converter container.<br />

“It will be a very stylish<br />

rocky horror-themed convenience.”<br />

has designed a chandelier which<br />

will hang in the middle of the<br />

park, part of the whole idea of<br />

referencing the Embassy Theatre<br />

that used to be on the spot.<br />

Another interesting feature<br />

will be an interactive art piece; a<br />

Gadget Box on the pavilion wall<br />

which if you pull a lever will<br />

cause something to happen in<br />

another part of the park.<br />

There will also be a Green<br />

Room in the pavilion, a changing<br />

space for street performers.<br />

In the long term the working<br />

group is keen to put a stage in<br />

the park and create a dedicated<br />

events space.<br />

More murals will be painted<br />

while full-on theatrical light<br />

shows created by lighting engineer<br />

Aaron Chesham will be a<br />

permanent feature in the evenings.<br />

“Once there are more things<br />

to be lit up, the canvas is limitless<br />

in terms of what can happen<br />

in there,” says Mark.<br />

An exciting development<br />

has been involvement of<br />

Wintec landscape students who<br />

designed and built planter boxes<br />

and put up a selection of colourful<br />

planting designs suiting<br />

the Rocky Horror theme which<br />

will go around the pavilion. The<br />

final design is a mix of those six<br />

design concepts.<br />

Mark says an underlying<br />

principle behind the project is<br />

that if you want to fix a public<br />

space, you need to get more<br />

people in there. Embassy Park<br />

installed and the new features<br />

“My feeling has always been,<br />

‘what can we do to transform<br />

this park so people say ‘this is<br />

really cool, nice place to be?’”<br />

is already quite good.<br />

“It’s not going to be the<br />

magic bullet but it’s something<br />

new in terms of telling our stories<br />

proud of and sending a message<br />

about diversity.”<br />

the first time that she’s aware of<br />

that the council has handed over<br />

a public place to stakeholders.<br />

Once the project is completed<br />

the park goes back to council<br />

care.<br />

“There was a lot of goodwill<br />

in the first place from councillors.<br />

It’s such a great story<br />

because we have now proven<br />

ourselves.<br />

“This was an opportunity to<br />

say ‘let us help and trust us to<br />

do this job’. Nothing happens<br />

without collaboration and it’s<br />

been a massive voluntary effort<br />

from a number of people”.<br />

Between the age of 16 and<br />

21 Rocky Horror Picture Show<br />

creator Richard O’Brien worked<br />

in a barber shop which stood<br />

where the statue now is. On<br />

Sunday nights he went to the<br />

late night double feature picture<br />

show at the Embassy Theatre.<br />

Mark says the lower part of<br />

the park towards the river is<br />

still a blank canvas and the next<br />

stage of development. There are<br />

tentative plans to build a “proscenium<br />

arch” – another nod<br />

to the Embassy Theatre days.<br />

Volunteers managed to collect<br />

from Hamilton Gardens thousands<br />

of bricks stored away following<br />

the Embassy Theatre’s<br />

demolition which may be used,<br />

possibly to form a stage.<br />

“We want to open up that<br />

bottom area, flatten it out so it<br />

links really nicely with the river.<br />

You can’t actually see the river<br />

at the moment.”<br />

Exiting an employee – how to get it right<br />

Issues to Consider When Exiting<br />

an Employee<br />

Last month’s column<br />

looked at options to protect<br />

your business when<br />

a key employee resigns. More<br />

commonly, however, employers<br />

face the problem of an<br />

employee who hasn’t resigned,<br />

even though it would be in<br />

everyone’s best interests if they<br />

did. This article raises points<br />

to consider when attempting<br />

to exit an employee, and a<br />

number of pitfalls employers<br />

need to avoid.<br />

Opening Negotiations<br />

When and how an employer<br />

proposes that the parties start<br />

talking about an exit package<br />

is the first decision to be made.<br />

Most employers are now aware<br />

that asking an employee to resign<br />

or face dismissal, is technically<br />

referred to as a constructive dismissal.<br />

Constructive dismissals<br />

are generally held to be unjustified<br />

as despite the resignation<br />

coming from the employee, it<br />

is actually a dismissal initiated<br />

by the employer, the most basic<br />

form being ‘jump or be pushed.’<br />

Ideally, it is better to let the<br />

employee raise the idea of an<br />

exit package to avoid potential<br />

allegations against the employer<br />

of constructive dismissal.<br />

Negotiating<br />

Once the discussion is on<br />

the table, negotiations are usually<br />

said to be on a ‘Without<br />

Prejudice’ basis. Colloquially,<br />

that means it is ‘off the record’<br />

but the legal meaning is more<br />

complex than this. In legal terms,<br />

‘Without Prejudice’ means that<br />

discussions or documents created<br />

during negotiations, cannot<br />

later be used as evidence before<br />

a court. The purpose of this is to<br />

allow the parties to frankly and<br />

genuinely attempt to resolve a<br />

problem, without the fear that<br />

any concession they make during<br />

negotiations will be used<br />

against them in litigation.<br />

Without Prejudice protection<br />

only applies to genuine attempts<br />

to settle a problem which has<br />

the potential to be litigated,<br />

“Without Prejudice”. Writing<br />

a letter to an employee asking<br />

them to resign or be dismissed,<br />

will not enjoy without prejudice<br />

protection, merely by labelling it<br />

“Without Prejudice”.<br />

Terms of Agreement<br />

The terms the parties include<br />

in agreements typically cover<br />

the termination date of the<br />

employment relationship, how<br />

it is terminating (for example,<br />

by resignation or redundancy),<br />

the amount and timing of any<br />

payments that will be made to<br />

the employee and that the agreement<br />

is in full and final settlement<br />

of all matters relating to the<br />

employment relationship and its<br />

termination.<br />

Agreements, however, often<br />

include much more such as a<br />

confidentiality clause stating that<br />

the terms and the existence of<br />

the agreement are confidential<br />

to the parties and a non-disparagement<br />

clause preventing either<br />

party from making disparaging<br />

comments about the other. The<br />

parties can include any terms<br />

they agree to, as long as they are<br />

not contrary to law.<br />

Types of Agreements<br />

When drafting an exit agreement,<br />

there are two main types<br />

used. The first, known as a s 149<br />

Agreement (s 149 being the relevant<br />

section in the Employment<br />

Relations Act 2000) is signed<br />

by the parties and then sent to a<br />

mediator at MBIE. The mediator<br />

will phone both parties to ensure<br />

they have signed voluntarily and<br />

fully understand that the agreement,<br />

once signed off by the<br />

mediator, is legally binding and<br />

enforceable.<br />

Once signed, it cannot be<br />

reopened or renegotiated at a<br />

later date and any party who<br />

breaches their obligations under<br />

the agreement, may be forced<br />

to comply and may be subjected<br />

to penalties if the non-breaching<br />

party puts the matter before<br />

the Employment Relations<br />

Authority (‘Authority’).<br />

An exit agreement that is not<br />

settled pursuant to s 149, cannot<br />

be put before the Authority or<br />

the Employment Court as it is<br />

outside their jurisdiction. It can,<br />

however, be pursued through the<br />

District or High Courts (depending<br />

on the amount being sought),<br />

and a party can also seek damages<br />

for loss that arose because<br />

of the breaching party’s conduct.<br />

The 2015 case of Lewis v JP<br />

Morgan Chase Bank highlights<br />

the difference. Mr Lewis was<br />

CEO of JP Morgan Chase Bank<br />

(‘Bank’) from 2008 to 2010. Mr<br />

Lewis resigned as part of a settlement<br />

agreement, and following<br />

his resignation, the Bank refused<br />

to confirm to Mr Lewis’ potential<br />

employers that he had indeed,<br />

been the CEO. Obviously, this<br />

resulted in considerable difficulty<br />

for Mr Lewis obtaining new<br />

employment.<br />

Mr Lewis pursued the matter<br />

before the Authority claiming<br />

it breached the non-disparagement<br />

clause in his agreement.<br />

He sought damages for the loss<br />

of the employment opportunities<br />

the Bank’s conduct had cost him.<br />

The matter went all the way<br />

to the Court of Appeal. The<br />

upshot was that the Authority or<br />

Employment Court do not have<br />

the jurisdiction to enforce non-<br />

149 exit agreements, and therefore<br />

do not have the jurisdiction<br />

to award damages for loss when<br />

they are breached. Mr Lewis<br />

was free, however, to pursue his<br />

case and seek damages in the<br />

High Court.<br />

sales double in Hamilton<br />

Sales of houses for more than<br />

a million dollars in Hamilton<br />

have nearly doubled in the<br />

year to March, compared<br />

with the previous year.<br />

Lodge Real Estate’s managing<br />

director, Jeremy O’Rourke,<br />

says that residential property<br />

buyers looking for homes over<br />

the million dollar mark are<br />

more confident than ever when<br />

it comes to purchasing in the<br />

Hamilton market.<br />

“A year ago, we were seeing<br />

hesitancy from buyers at<br />

the top end of the market to<br />

purchase homes over the million<br />

dollar mark in Hamilton.<br />

Buyers often perceived they<br />

might struggle to make a capital<br />

gain – or even recoup costs<br />

– on such a high value property<br />

when they eventually sold.<br />

“However, this attitude has<br />

shifted dramatically. Over the<br />

past few months, buyers in this<br />

top bracket are very confident<br />

about purchasing homes in<br />

Hamilton. There are multiple<br />

buyers active in the Hamilton<br />

market who are competing for<br />

properties above the million<br />

dollar mark,” says Jeremy.<br />

He says there were 34 sales<br />

above a million dollars for the<br />

12 months ending March <strong>2016</strong><br />

compared with 18 for the same<br />

period ending March 2015.<br />

He said the highest quality<br />

homes in newer Rototuna suburbs<br />

were now going for more<br />

than one million dollars, which<br />

was virtually unheard of six<br />

months ago.<br />

“We now have Hamilton<br />

buyers who would normally<br />

gravitate towards the river for<br />

these sorts of properties looking<br />

at non-traditional areas<br />

such as Rototuna.<br />

“Currently the best value for<br />

money, however, in this price<br />

bracket is definitely along the<br />

river - inside or adjacent to the<br />

CBD,” said Mr O’Rourke.<br />

Margaret Comer to ‘semi-retire’<br />

working part-time and with<br />

Catering, is officially enjoying the<br />

taste of award-winning success.<br />

The catering company,<br />

which is part of The<br />

Pumice Food Group,<br />

has been named Outstanding<br />

Caterer of the Year, at the NZ<br />

Wedding Industry Awards.<br />

The judges described Kerr<br />

& Ladbrook as a “clear winner<br />

among its peers in this highly<br />

contested category”.<br />

Kerr & Ladbrook were<br />

applauded for going the extra<br />

mile in customer service.<br />

“The importance they place<br />

on attention to detail is clearly<br />

evident throughout their entry,<br />

website, social media presence,<br />

and most importantly client<br />

feedback. They are able to cater<br />

company runs The Ferrybank,<br />

and Bella Vista Lodge in<br />

Tauranga.<br />

It has been an eventful and<br />

successful last six months for<br />

the company. Late last year<br />

Pumice Food Group opened the<br />

eagerly awaited Ember restaurant<br />

in Hamilton. Ember rose<br />

from the ashes of the former<br />

award-winning Pumice restaurant,<br />

which was razed by fire<br />

<strong>2016</strong> New Zealand<br />

Wedding Industry Awards.<br />

Clare, owner of Clare<br />

Gordon Photography, was<br />

among five wedding photographers<br />

from across the country<br />

to be named a finalist in<br />

the Awards’ ‘Outstanding<br />

Photographer’ category this<br />

year.<br />

“To be recognised as<br />

Outstanding Photographer is<br />

reflective of wanting nothing<br />

but excellence for all my clients<br />

every time I photograph,”<br />

Clare said.<br />

Clare has owned her photography<br />

business for four<br />

years.<br />

“Last wedding season I<br />

photographed 28 weddings<br />

between September and <strong>April</strong><br />

with a wedding every month<br />

during winter. I also specialise<br />

in landscape, portrait and<br />

underwater photography,” she<br />

said.<br />

It doesn’t take long to see<br />

how Clare goes above and<br />

beyond for her clients.<br />

“When someone agrees<br />

to have me as their wedding<br />

photographer, it’s not simply a<br />

business opportunity; it’s a true<br />

privilege to be part of their day.<br />

“Recently, a couple told me<br />

they wanted wedding photographs<br />

at Lake Mangakino;<br />

yet the only way<br />

to get the shots<br />

they wanted was<br />

for someone to get<br />

in the water,” she<br />

said.<br />

“So of course I<br />

said I’d bring my<br />

underwater camera.<br />

I got in my<br />

togs, jumped in,<br />

and took photos<br />

from the water<br />

looking back at the<br />

jetty where they were standing.<br />

They couldn’t believe the<br />

results.”<br />

“When clients tell me what<br />

they want, I always ask myself<br />

‘how do I make that happen?’”<br />

Before Company-X, based<br />

at Wintec House, built the<br />

mobile app funeral directors<br />

would have to take notes during<br />

a visit to the family of<br />

the deceased, and then transpose<br />

those notes to the funeral<br />

management system.<br />

“The funeral director<br />

would usually use a funeral<br />

arrangement sheet, there's a<br />

lot of personal information to<br />

capture, such as where the<br />

funeral will be held, when,<br />

who the pallbearers will be,<br />

the name of the deceased’s<br />

mother and father, any honours<br />

they have, if they are<br />

descended from Maori and<br />

ages of their children.”<br />

That’s how it worked for<br />

two decades in funeral homes<br />

using Freedom Software’s<br />

system up and<br />

down the country.<br />

Now, with the<br />

app, the funeral<br />

director can enter<br />

the information<br />

straight into a tablet<br />

computer running<br />

Google’s<br />

Android operating<br />

system. The<br />

Samsung Galaxy<br />

Tab range, for example.<br />

It synchronises with the<br />

funeral home over Wi-Fi or a<br />

cellular data connection.<br />

“The app brings over the local<br />

data from the funeral home<br />

database, including details of<br />

local cemeteries, celebrants,<br />

and funeral home staff.<br />

“You might have five<br />

funerals coming up and you<br />

need to know where the funerals<br />

are happening when you<br />

are planning the sixth.”<br />

The app collects a lot of<br />

information, and goes a long<br />

way in helping the undertaker<br />

deliver exactly what the family<br />

would like for their loved<br />

one’s funeral.<br />

“The app helps construct<br />

the death notice for the newspaper,<br />

and captures the information<br />

required for the registration<br />

of the death with<br />

Births, Deaths and Marriages<br />

at the Department of Internal<br />

Affairs,” Alan said.<br />

He had been wanting to<br />

be able to offer his clients a<br />

mobile app for a while, but<br />

hadn’t found the right company<br />

to work with on the project.<br />

“I had been looking for<br />

people to build an app for<br />

a while and had basically<br />

given up finding them” he<br />

said. “Everyone wants an app<br />

but not everyone can build an<br />

app well. A business associate<br />

found Company-X through<br />

a BNI business networking<br />

group.”<br />

Alan was very pleased with<br />

the result.<br />

The project could have<br />

been web browser based,<br />

but not everywhere in New<br />

Zealand has guaranteed internet<br />

access, so an app was<br />

decided to be the best direction.<br />

Like most other software,<br />

there will be updates bringing<br />

new functionality to the fingertips<br />

of the country’s funeral<br />

directors through the app.<br />

“As things progress we'll be<br />

building new functions into<br />

the app,” Alan said.<br />

“I have a plan for<br />

Company-X adding four or<br />

five new sections to the app.<br />

For example we can use the<br />

device’s stylus to capture sig-<br />

natures when required. We<br />

can use the tablet to display<br />

the funeral director’s range<br />

of caskets. We can use the<br />

camera to record images that<br />

can be transmitted back to the<br />

funeral home database, and<br />

we can use the device’s GPS<br />

capabilities to help guide the<br />

funeral director to the address.<br />

We live in a mobile and<br />

connected world – I want to<br />

ensure that funeral directors<br />

are also able to use the latest<br />

technology to improve the<br />

way they work.<br />

Compared to February sales<br />

across the region rose 19%<br />

with sales rising 44% in Mt<br />

Maunganui/Papamoa, 36% in<br />

Hamilton and 30% in Tauranga. Sales<br />

for March were the strongest March<br />

sales since 2005.<br />

The median price across the region<br />

rose $75,000 (+22%) compared to<br />

March 2015 with prices rising 35% in<br />

Hamilton. Compared to February the<br />

median price rose $12,500 (+3%) to<br />

reach another record high, with prices<br />

rising 8% in Hamilton.<br />

The number of days to sell improved<br />

six days in March, from 36 days in<br />

February to 30 days in March. The number<br />

of days to sell improved by nine days<br />

compared to March 2015. Over the past<br />

10 years the average number of days to<br />

sell during March for the region has been<br />

47 days.<br />

REINZ Regional Director, Philip<br />

Searle noted that “Sales volumes across<br />

the region continue to rise strongly with<br />

demand from Auckland investors being<br />

the most noticeable feature across the<br />

region. It seems clear that investors from<br />

Auckland are selling out of that market<br />

with its low yield and LVR restrictions<br />

and investing where yields are better<br />

and with fewer restrictions. The level of<br />

available listings is described as ‘horrendously<br />

low’ in the major cities, although<br />

smaller centres also have low levels of<br />

properties available for sale.”<br />

Award went to Team Stratcom<br />

for its idea, New Air.<br />

New Air is a portable and<br />

easy-to-use breathing product<br />

for people in smog-filled cities<br />

that instantly improves air<br />

quality. The product provides<br />

a portable breath of fresh New<br />

Zealand air and enables a temporary<br />

solution for people in<br />

toxic atmospheres.<br />

“It was a crazy idea and<br />

we do crazy,” wrote Stratcom<br />

team member Deanna Morse<br />

in her recent blog about Wintec<br />

Innes48.<br />

The SODA ‘Best Pitch’<br />

Award was won by Team<br />

Girl’s Power, creators of Step<br />

by Step, a specialist wedding<br />

planning service that aims to<br />

fly Chinese couples to New<br />

Zealand for a unique Kiwi<br />

wedding.<br />

The competition runs over<br />

one action packed weekend<br />

which encourages teams to<br />

turn their ideas into businesses<br />

in just 48 hours. For<br />

the 20 experienced mentors<br />

who dedicated their time and<br />

knowledge to help the teams,<br />

the increase in diversity was<br />

refreshing. Mentors said the<br />

teams presented challenging<br />

cases, some confronting, and<br />

others totally out of the box.<br />

The judges included Chip<br />

Dawson, Melissa Clark-<br />

Reynolds, Graham Gaylard,<br />

and Robett Hollis. They<br />

reviewed 15 team submissions<br />

in under three hours and decided<br />

on the top six teams to pitch<br />

at the Wintec Innes48 closing<br />

ceremony.<br />

“Focus on the customer and<br />

the problem you are solving,<br />

and remember to keep the<br />

Mineral processing plant opened near Tokoroa<br />

South <strong>Waikato</strong> mineral extraction<br />

and processing company, Blue<br />

Pacific Minerals (BPM) opened a<br />

multi-million dollar processing<br />

plant this month which will<br />

allow it to more than quadruple<br />

production.<br />

The plant is the main<br />

feature of the Tokoroabased<br />

company’s $11<br />

million capital investment<br />

programme. The investment<br />

includes the construction<br />

of a 4500 square metre<br />

building expansion to house<br />

BPM’s new state-of-the-art<br />

zeolite processing plant.<br />

It is one of the biggest<br />

industrial process and storage<br />

facilities constructed in<br />

Tokoroa since the original<br />

Kinleith Mill was built in the<br />

early 1950s. The investment<br />

also encompasses an upgrade<br />

of BPM’s quarrying equipment<br />

and quarry storage facil-<br />

processing plant enables the<br />

company’s former north sited<br />

zeolite and perlite-combined<br />

plant to now concentrate<br />

entirely on perlite.<br />

what to look for in houses,<br />

and the people living there, to<br />

determine if the house has been<br />

used for manufacturing drugs.<br />

Knowing when it’s the right time to move<br />

We’ve all struggled with our<br />

motivation to go to work from<br />

time to time – the alarm goes off<br />

and you feel like you’re stuck in<br />

groundhog day.<br />

In fact, until we’ve had our<br />

coffee, it’s as if the human<br />

race hasn’t evolved at all<br />

(she speaks from experience!).<br />

But what if it’s more than<br />

that? What if that heavy sense<br />

of dread about work follows<br />

you everywhere you go? Does<br />

that mean it’s time to leave<br />

your job?<br />

You’d think a job that makes<br />

us feel awful would be easy<br />

to leave, but for many of us<br />

it’s not the case. Either we feel<br />

it’s impossible to find something<br />

better, or we worry that<br />

if we leave, we’ll end up in a<br />

worse position than we are in<br />

now. Here’s the first thing I’ve<br />

learned: no job is ever worth<br />

your health. In fact, nothing is.<br />

Yet our need for financial survival<br />

constantly gets the best of us.<br />

Let’s face it – the human race is<br />

hard wired to crave stability.<br />

At Everest Group we hear a<br />

variety of reasons why people<br />

feel they “have” to stay in their<br />

jobs. The most common being<br />

“I’m not sure what I want to do<br />

(can do/am skilled to do), but<br />

I know I’m not happy” (insert<br />

any other feeling here such as<br />

engaged, motivated, satisfied,<br />

enjoy the people I work with…<br />

and the list goes on). Therefore,<br />

they are prepared to stay, be<br />

miserable and wait until something<br />

magical happens. Worse<br />

still, they are prepared to stay at<br />

work and share their misery with<br />

others who are enjoying their<br />

jobs. Here’s the next thing I’ve<br />

learned: you’re a long time dead<br />

and if you’re not happy in your<br />

job, then make some change.<br />

Now.<br />

If you’re teetering on the<br />

edge, here’s a simple four step<br />

plan to help you assess whether<br />

it’s time to take the leap.<br />

Firstly, figure out whether<br />

you’re staying just for the sake<br />

of it. If your boss is like Donald<br />

Trump or you’re working 90<br />

hours a week then perhaps it’s<br />

a no-brainer to leave your job.<br />

However, if you’re too comfortable,<br />

coasting, sitting on auto-pilot<br />

then it’s probably time for a<br />

reality check. Sit down, write up<br />

your pros and cons and make a<br />

fair assessment. Try and keep<br />

emotion in check.<br />

Next, get real about what’s<br />

super important to you. To<br />

work out your priorities you<br />

need to really break things down<br />

into rational benefits. Ask yourself<br />

questions like – what does<br />

work/life balance actually look<br />

like to me? How much might<br />

I give up to achieve that? Am<br />

I willing to take a pay cut to<br />

achieve my priorities?<br />

Then…do your research<br />

– make connections. This is<br />

where your great detective skills<br />

come in handy – where do you<br />

want to work, what culture and<br />

values are important to you,<br />

who do you know that can help<br />

you discover new opportunities.<br />

Write up a list and start arranging<br />

Management and HR<br />

coffee dates… in the mornings.<br />

Get out there and start letting<br />

the market know you’re seeking<br />

change and ask for help.<br />

Lastly ask yourself – what are<br />

truly happy in your career? The<br />

an alternative that will make a<br />

huge difference to you and your<br />

to the food industry in<br />

New Zealand, and the role that<br />

its processing business, in particular,<br />

country’s dairy sector.<br />

refocus. She began consulting<br />

and met “two fantastic women”-<br />

Pam Roa, from Longveld Ltd<br />

and experienced HR professional<br />

Jennifer Kerr. They started the<br />

business – initially from home<br />

and then in office space borrowed<br />

from Longveld.<br />

recalls Pam.<br />

“We focused on educating<br />

these leaders on how to use HR<br />

every day to improve their communication<br />

and relationships<br />

with their teams, rather than<br />

treat HR as something done by a<br />

department to the staff.”<br />

Senga says the three women<br />

were passionate about <strong>Waikato</strong><br />

business. “We had this information<br />

we had gathered through our<br />

joint experience and we wanted<br />

to share it with businesses and<br />

make them better.”<br />

Their skills were in demand<br />

and Jennifer was soon head-hunted<br />

by Fonterra. After three<br />

years with Everest Group, Pam<br />

resumed a full-time role at<br />

Longveld.<br />

Enter Diane Hallifax and as<br />

Senga puts it “the planets just<br />

aligned”. As directors at Everest<br />

Group, Senga and Diane work<br />

in a similar way, have similar<br />

backgrounds and experiences<br />

and similar values and ethics.<br />

“We trust each other implacably<br />

and the business runs really well<br />

because of that.”<br />

Diane was a catalyst for<br />

growth in the business and<br />

brought more structure to planning,<br />

according to Senga. From<br />

the start, they would take two<br />

days out every quarter to nut out<br />

what was working well and what<br />

they could grow.<br />

“We’ve had an excellent<br />

team and great relationships but<br />

we don’t take it for granted and<br />

that’s why we take time out from<br />

the business. We work on it, not<br />

just in it,” says Diane.<br />

In the last six years in particular,<br />

Everest Group has had<br />

substantial year-on-year growth.<br />

Senga and Diane work alongside<br />

nine other staff at their office at<br />

<strong>Waikato</strong> Innovation Park where<br />

they’ve been based for eight<br />

years.<br />

An exciting step for Simcro <br />

It’s all go for home-grown innovators<br />

Simcro, as the company moves to build on<br />

its acquisition of Hamilton based ISL and<br />

Australian based NJ Philips last September. In<br />

doing so, Simcro strengthened its position as<br />

the largest supplier of speciality packaging and<br />

applicators for global animal health markets.<br />

A major step was consolidation of the<br />

two local businesses and opening of a new<br />

warehouse at the former ISL site in the<br />

Pukete Industrial Estate, on the outskirts of<br />

Hamilton.<br />

Covering 900 square metres, the new<br />

warehouse supports a production floor<br />

area of 1300 square metres and up to 150<br />

staff, including 12 R&D engineers and<br />

100+assembly workers.<br />

Alongside it’s Hamilton base Simcro now<br />

operates the NJ Phillips manufacturing plant<br />

in Australia and fields an expanded overseas<br />

sales team. Four staff are based at Simcro USA<br />

in Kansas City, one is based in the United<br />

Kingdom, two are based in Brazil for the Latin<br />

American market and two are based in Hong<br />

Kong and Shanghai covering Asia.<br />

In Australia, a further 50 staff work at NJ<br />

Philips in New South Wales.<br />

As part of the integration process, Simcro<br />

again enjoyed working with the Everest Group<br />

Disputes involving domain names<br />

with .nz extensions (for example,<br />

.nz and .co.nz) can be resolved<br />

using the Dispute Resolution<br />

Service Policy (DRSP).<br />

The DRSP is administered<br />

by the Dispute<br />

Resolution Service<br />

arm of the Domain Name<br />

Commission in Wellington.<br />

The process under the<br />

DRSP is as follows:<br />

- Stage 1: Complainant files<br />

complaint<br />

- Stage 2: Respondent<br />

defends complaint by filing<br />

response (not compulsory)<br />

- Stage 3: Complainant files<br />

reply (if response filed)<br />

- Stage 4: Informal mediation<br />

to try and resolve<br />

dispute (if response filed)<br />

- Stage 5: Expert determination<br />

of the complaint (if no<br />

response filed or mediation<br />

fails)<br />

Assuming the complaint<br />

is defended, and mediation<br />

fails, the whole process takes<br />

about 14 weeks. The DRSP is<br />

without question an excellent<br />

forum for deciding domain<br />

name disputes. It is inexpensive<br />

and, dare I say it, light-<br />

ning fast when compared with<br />

court proceedings. (If only<br />

there was a similar system<br />

for resolving other kinds of IP<br />

disputes...watch this space...)<br />

In my view however the<br />

DRSP has one fundamental<br />

flaw: that in a defended complaint<br />

the complainant has to<br />

pay 100 percent of the expert<br />

determination fee (currently<br />

$2000+GST).<br />

This is unfair. Which is<br />

ironic given the DRSP is<br />

based on the principle of fairness.<br />

Why is it unfair? Because:<br />

one, it does not reflect the<br />

respondent's equal participation<br />

in the dispute resolution<br />

process; and, two, it presents<br />

no incentive for a respondent<br />

to settle during informal<br />

mediation (there being no<br />

financial consequence on the<br />

respondent if settlement is not<br />

achieved). This second reason<br />

often leads respondents<br />

- especially those whose only<br />

goal is to cause a complainant<br />

financial pain - to say 'Why<br />

should I settle? It's no skin off<br />

my nose if I don't.'<br />

Fairness surely demands<br />

that each party to the dispute<br />

pays an equal portion of the<br />

fee. No?<br />

I accept that in an undefended<br />

complaint a complainant<br />

has to pay the entire<br />

fee; but even then a complaint<br />

should, I believe, have<br />

the option to pay a lower fee<br />

for a summary decision, as<br />

complainants have under the<br />

equivalent policy in the UK<br />

on which the DRSP is modelled.<br />

In New Zealand we constantly<br />

trumpet how innovative<br />

we are; how we were the<br />

first to do this, the first to<br />

make that. We also lead the<br />

charge on many other fronts<br />

in fairness and equality. Is it<br />

not then about time we practised<br />

what we preached and<br />

changed the complainant-pays<br />

feature of the DRSP to make<br />

it fair and equal? Also, isn’t<br />

it time we gave complainants<br />

the opportunity to pay less for<br />

a decision in an undefended<br />

complaint? I think so.<br />

Ultrafast Fibre marks milestone with end<br />

of Hamilton network<br />

Ultrafast Fibre Limited celebrated<br />

the completion of work on<br />

Hamilton’s Ultra-Fast Broadband<br />

(UFB) network with a function at<br />

its Te Rapa office this month.<br />

Hamilton’s completion<br />

marks the conclusion<br />

of a five-year<br />

network build for Ultrafast<br />

Fibre, covering eight urban<br />

centres across the central<br />

North Island.<br />

The local fibre company<br />

began construction of its<br />

3000km UFB network in<br />

2011, which now passes a<br />

total of more than 183,000<br />

businesses, homes and<br />

schools, representing about<br />

13 percent of the national<br />

UFB network.<br />

network here in Hamilton,<br />

which is where we originally<br />

The ostrich approach can be a costly one<br />

MacGregor v Corboy Forest<br />

Time and again I read<br />

cases where the employer<br />

has just ignored the<br />

Employment Authority and it<br />

has come back to bite them.<br />

It can be a deliberate strategy<br />

to contain losses, if you don’t<br />

have a leg to stand on, as you<br />

are not adding to your costs<br />

with legal bills. However the<br />

employer can mitigate their<br />

losses by representing themselves<br />

to have their side of the<br />

story heard.<br />

Mr MacGregor started as<br />

a truck driver for Corboy in<br />

January 2015 and signed his<br />

employment agreement a couple<br />

of weeks later. The employment<br />

agreement included a 90 day trial<br />

period.<br />

On March 9, MacGregor<br />

advised the office manager he<br />

wanted a day’s annual leave on<br />

March 28 to attend a wedding<br />

(a Saturday). She acknowledged<br />

the request and he heard nothing<br />

further until the day before the<br />

wedding when he reminded his<br />

boss he would be away the next<br />

day. That evening he received a<br />

text message from his manager<br />

stating that he was expected to<br />

start work at 4am the following<br />

morning. A series of messages<br />

between the pair ensued and the<br />

outcome was that MacGregor<br />

was told that there was no work<br />

from him on Monday if he did<br />

not turn up on the Saturday<br />

because the manager would have<br />

the truck.<br />

MacGregor was concerned<br />

for his position at Corboy so went<br />

into the office on the Monday<br />

to try and resolve the situation<br />

with his manager. Both the truck<br />

and the manager were not on<br />

site but were at the manager’s<br />

house, which was adjacent to<br />

the depot. The manager initially<br />

did not respond to MacGregor’s<br />

texts and eventually, told him<br />

that there would be no work for<br />

MacGregor on Tuesday because<br />

the truck would be in the workshop.<br />

MacGregor turned up on<br />

the site on Tuesday to see the<br />

truck sitting in the yard and he<br />

was advised it had been sitting in<br />

the yard all day on Monday.<br />

MacGregor made repeated<br />

attempts to communicate with<br />

the manager to resolve the situation<br />

but kept being ignored.<br />

He very efficiently lodged a personal<br />

grievance for constructive<br />

dismissal the next day.<br />

Corboy refused to attend<br />

mediation on the basis that there<br />

was no right to a personal grievance<br />

under the trial period provision.<br />

By taking this stance,<br />

the manager was giving up the<br />

first (and cheapest) opportunity<br />

to mitigate the damage from<br />

his earlier actions. The authority<br />

later directed the parties to mediation<br />

but they did not settle.<br />

Corboy initially cooperated<br />

with the Authority investigation<br />

by sending a response to the<br />

authority when the grievance<br />

was raised, but then refused<br />

to respond to further communications.<br />

It therefore gave up<br />

the opportunity to challenge<br />

the information put forward by<br />

MacGregor, which could have<br />

made a significant difference to<br />

the result.<br />

The authority found that the<br />

trial period was void because<br />

the employment agreement was<br />

not signed before the employment<br />

commenced. It also found<br />

that MacGregor’s manager had<br />

ended the employment relationship<br />

- or at least it was foreseeable<br />

that MacGregor would resign<br />

from the text messages that were<br />

sent between them (which is a<br />

test for constructive dismissal).<br />

Therefore the Authority found<br />

that MacGregor had been unjustifiably<br />

dismissed.<br />

It is an interesting conclusion<br />

to reach as it is normal for the<br />

authority to be more definite<br />

that the dismissal was an actual<br />

dismissal or it was a constructive<br />

dismissal, not that it could be<br />

one or the other.<br />

MacGregor was awarded<br />

$16,548 for hurt and humiliation,<br />

lost wages and to cover<br />

his legal costs. The authority<br />

commented that the level of<br />

award for his legal costs was<br />

higher than usual as a result of<br />

how Corboy conducted its case.<br />

What’s more, had MacGregor<br />

been out of work for longer than<br />

12 days, the costs would have<br />

been much higher.<br />

This situation never needed<br />

to happen and when employers<br />

find it so hard to get good,<br />

enthusiastic workers it is a waste<br />

to lose them in this way. The<br />

manager needed to take a step<br />

back and think about what was<br />

in the long term best interests of<br />

the business. We all get frustrated<br />

with our team from time to<br />

time and that is when we need to<br />

take advice on the best way forward,<br />

express our frustration and<br />

get on with doing the right thing.<br />

one, splitting the hours,<br />

into rewarding work, and it’s<br />

great for your work/life balance.<br />

So why don’t more people<br />

do it? The difficulty has been<br />

The idea for the website<br />

occurred to Kate after her<br />

second child started going to<br />

kindergarten. She wanted to<br />

get back into the workforce<br />

but full-time employment<br />

was out because of her kids<br />

and part-time work tended to<br />

be dull, low-level, and lowpaid.<br />

She was familiar with<br />

job sharing from her experiences<br />

working in the United<br />

Kingdom but found it hard to<br />

find someone with a similar<br />

skillset to partner with.<br />

“So I set up jobsharing.<br />

co.nz to help people connect<br />

with others who also want to<br />

job share,” she says.<br />

Job sharing enables<br />

employees to progress their<br />

careers, learn from their<br />

job-sharing partner, and get<br />

mutual support and encouragement<br />

on the job, while<br />

retaining the ability to switch<br />

off and hand over responsibility<br />

to someone else.<br />

For employers, it’s a great<br />

way to attract, retain, and<br />

progress talent. It reduces<br />

absenteeism and provides<br />

better continuity, including<br />

Council has decided to ask the people<br />

for their views. The consultation<br />

process is expected to run for four<br />

The Founders Theatre has been<br />

part of this city for 54 years and this<br />

community should be involved in.<br />

New laws mean shake up on the employment front<br />

Just in case you thought<br />

things might finally settle<br />

down having navigated<br />

the financial year’s end,<br />

Parliament has decided to<br />

keep you on your toes.<br />

It has passed sweeping<br />

reforms targeting the<br />

Employment Relations Act,<br />

Holidays Act, Minimum<br />

Wage Act, Parental Leave and<br />

Employment Protection Act<br />

and Wages Protection Act.<br />

A number of changes came<br />

into force on <strong>April</strong> 1 and we<br />

expect these to have quite an<br />

impact on the workplace. It is<br />

important to get on top of the<br />

changes now to avoid hefty<br />

penalties coming your way.<br />

Paid parental leave is one<br />

area that looks a bit different<br />

under the new law. The entitlement<br />

extension from 14 to<br />

18 weeks heralded in Budget<br />

2014 is now here, along with<br />

increased employee flexibility<br />

within the scheme. The biggest<br />

changes are that leave doesn’t<br />

have to be taken as a solid<br />

block and casual and seasonal<br />

workers are now eligible; as<br />

are a wider group of primary<br />

carers (anyone who is primarily<br />

responsible for the upbringing<br />

of a child under six years<br />

of age, not just biological or<br />

adoptive parents). If you have<br />

employees who may be eligible<br />

for paid parental leave it<br />

will be important to give careful<br />

consideration to the new<br />

criteria.<br />

The changes are aimed at<br />

striking a fine balance between<br />

giving employees more certainty<br />

in terms of employer<br />

obligations, while maintaining<br />

flexibility in an increasingly<br />

dynamic market. So-called<br />

“zero-hour contracts” are one<br />

of the main practices caught<br />

in the crosshairs of reform.<br />

Employers can no longer<br />

require employees to be available<br />

to work without a ‘genuine<br />

reason’ for doing so and without<br />

‘reasonable compensation’.<br />

Employers are now precluded<br />

from cancelling shifts without<br />

‘reasonable notice or compensation’.<br />

In addition, ‘unreasonable<br />

restrictions’ on employees<br />

having secondary employment<br />

are also now off the table.<br />

Now is the time to seek<br />

legal advice if any of these<br />

changes sound as though they<br />

could affect the way your business<br />

A dental procedure worth travelling for<br />

Over the past 13 years Old Villa Dental’s Dr. Nettie Eksteen<br />

has become the most experienced practitioner in NZ using<br />

Chipmunks makes day<br />

care an easy option<br />

With our busy work lives,<br />

wouldn’t it be nice not to be<br />

rushing our children around so<br />

much before and after school?<br />

Chipmunks Playland and<br />

Café before and after<br />

school care for five to<br />

11 year olds - complete with a<br />

drop off and pick up service -<br />

provides a way around those<br />

stressful rush hour drives.<br />

The Te Rapa facility’s before<br />

school service starts at 7am and<br />

Chipmunks provides breakfast,<br />

entertainment and activities<br />

for children before dropping<br />

them off at schools all around<br />

Hamilton. Already the service<br />

extends to four city schools as<br />

well as Te Kowhai School and<br />

<strong>Waikato</strong> Montessori Education<br />

Centre in Tamahere. Whatever<br />

school is involved around<br />

Hamilton, Chipmunks can<br />

accommodate it.<br />

For after school care, children<br />

are picked up from school,<br />

brought back to Chipmunks<br />

where they are helped with<br />

homework if required, and given<br />

plenty to do until parents pick<br />

them up by 6pm. Before school<br />

and continual supervised activities<br />

very open communication policy<br />

with parents and will act on their<br />

“It’s all about improving the<br />

programme for the children.<br />

We’ve always found it pays to<br />

listen,” she says, adding that parents<br />

will often grab a coffee and<br />

relax at Chipmunks café and take<br />

some time out.<br />

Family and WINZ subsidies are<br />

available for qualifying families.<br />

funded by the <strong>Waikato</strong> community<br />

(in Huntly). The Kiwi Can programme,<br />

with weekly lessons<br />

during a child’s time at school,<br />

teaches them to persevere, problem<br />

solve, set goals, make good<br />

choices, be accountable and to<br />

resolve conflict. Children are<br />

encouraged to develop leadership<br />

skills, to be a good role model<br />

and to always play fair.<br />

A new initiative is Kiwi Can<br />

Champ, sponsored by PL Bell<br />

Plastering Ltd. For term 1 this<br />

celebrates a Kiwi Can student in<br />

Huntly, Tokoroa and Hamilton<br />

who has shown an outstanding<br />

demonstration of respect.<br />

manners all the time, being<br />

Maths is Nathan Stewart’s second<br />

favourite school subject, just<br />

edged out by PE, which is what<br />

you’d expect from a sporty 12 year<br />

old boy.<br />

Nathan wouldn’t have<br />

had maths anywhere<br />

near the top of his<br />

list a few years ago, and his<br />

mum Suzanne smiles when<br />

he shares his faves.<br />

Nathan is a Year 8 student<br />

at Melville Intermediate,<br />

and he’s in his fourth year<br />

of receiving tuition in maths<br />

and English from tutors at<br />

NumberWorks’nWords.<br />

NumberWorks’nWords is<br />

a worldwide specialist tuition<br />

provider for children in maths<br />

and English, and Suzanne<br />

Stewart can’t speak highly<br />

enough of how the Hamilton<br />

centre that Nathan attends has<br />

helped him.<br />

Nathan Stewart's time at NumberWorks’nWords has led to<br />

a dramatic improvement in maths and english.<br />

“In Year 5, when he started<br />

at NumberWorks’nWords,<br />

he was significantly behind<br />

where he should have been. So<br />

we looked around for something<br />

that would suit him.”<br />

Says Nathan: “I needed<br />

some help with my schoolwork.<br />

I couldn’t read that well<br />

and I didn’t know most of my<br />

times table.”<br />

Now, he’s where he should<br />

be academically, he’s doing<br />

well with maths and reading,<br />

and he’s reading for pleasure<br />

as well as for school work. He<br />

says the Diary of a Wimpy Kid<br />

series is a favourite. “I’ve read<br />

most of them, I’ve just got two<br />

to go.”<br />

Nathan began at<br />

NumberWorks’nWords with<br />

maths tuition, but soon added<br />

English as well, which covers<br />

reading, writing, vocabulary<br />

and punctuation. He attends<br />

hour-long classes in each subject<br />

each week, and Suzanne<br />

says he’s never been unwilling<br />

to go. “They are so good at<br />

setting goals for Nathan, and<br />

keeping in touch about his<br />

progress. His progress in the<br />

first year was huge, we were<br />

shocked by it. I couldn’t recommend<br />

them more.”<br />

Nathan says his tutors<br />

make learning fun, and most<br />

of the work is computer-based,<br />

which he likes. And the best<br />

thing about it? “Now I’m<br />

the same as the other kids in<br />

class.”<br />

Limelight Dance Academy is a dance school located in Rototuna. The<br />

school has a group of twenty two students fundraising to attend<br />

specialist dance workshops and perform a specially choreographed<br />

dance in Disneyland L.A. in September <strong>2016</strong>. These students are<br />

undertaking the huge task of fundraising $5000 each.<br />

How to cash out R&D losses<br />

New tax rules designed to<br />

encourage innovation and help<br />

grow the New Zealand economy<br />

have come into force.<br />

The Government has<br />

introduced a tax incentive<br />

that allows research<br />

and development (R&D) companies<br />

to “cash out” tax losses.<br />

Loss making entities with<br />

balance dates beginning on or<br />

after 1 <strong>April</strong> 2015, are now able<br />

to “cash out” tax losses arising<br />

from R&D expenditure provided<br />

they meet certain criteria.<br />

This allows R&D focused companies,<br />

which traditionally have<br />

high upfront costs and restricted<br />

access to funding, to access the<br />

benefits of their tax losses when<br />

they need it most. Previously,<br />

tax losses would need to be<br />

carried forward and deducted<br />

against future taxable income.<br />

The ability to cash out losses<br />

is available to eligible companies<br />

in the form of a refundable tax<br />

credit in cash. Companies can<br />

receive a cash tax credit where<br />

they have incurred tax losses as<br />

a result of R&D expenditure and<br />

at least 20 percent of their wage<br />

bill is spent on R&D. If eligible,<br />

the company will generally<br />

be entitled to a cash tax credit<br />

equal to 28 percent of their R&D<br />

expenditure.<br />

This incentive is available<br />

from the <strong>2016</strong> income year so it<br />

is worthwhile considering how<br />

the rules apply to your business<br />

and the practical aspects of making<br />

a claim with Inland Revenue<br />

(IR) to get the cash back.<br />

Qualifying for the cash tax<br />

credit<br />

In order to qualify for the<br />

incentive, there are a number of<br />

specific criteria that a company<br />

must meet. In summary, the criteria<br />

are:<br />

• The company must be a New<br />

Zealand tax resident company<br />

and not one of a limited<br />

number of excluded entities,<br />

which includes publicly listed<br />

and look through companies;<br />

• The entity must be in a net<br />

loss position;<br />

• Have eligible R&D expenditure<br />

for the income year;<br />

• The wage intensity criteria<br />

must apply (as described<br />

above);<br />

• R&D must not be in relation<br />

to certain excluded activities;<br />

and<br />

• The entity must own (solely<br />

or jointly) the intellectual<br />

property and know-how that<br />

results from the R&D activity.<br />

If the company is part of a<br />

Taxation and the law<br />

group of companies, tests must<br />

be applied at the group level.<br />

To be considered as ‘eligible’<br />

research or development<br />

expenditure, the costs must<br />

fall within the definition of<br />

‘research’ or ‘development’<br />

expenditure. Basically, these<br />

definitions provide that, in order<br />

to cash out your losses, the costs<br />

must support sufficient technological<br />

or scientific advances.<br />

Typically a company will<br />

carry out an R&D project alongside<br />

its regular business activities,<br />

making it necessary to separately<br />

identify and document<br />

R&D expenditure as distinct<br />

from a company’s day to day<br />

costs. For example, insurance<br />

and rates relating to business<br />

premises could be apportioned<br />

on an area basis, taking into<br />

account the amount of space<br />

used for R&D during the period.<br />

The IR will require a company<br />

to show that a robust method<br />

has been applied to arrive at an<br />

accurate apportionment.<br />

Exceptions and exclusions to<br />

the rules<br />

There are also specific R&D<br />

activities which are excluded<br />

from the regime and expenditure<br />

on these will not be included<br />

when determining a company’s<br />

eligibility to cash out losses.<br />

Research conducted outside<br />

New Zealand, administrative or<br />

routine activities, payments of<br />

interest, finance lease payments<br />

for R&D equipment, expenditure<br />

to transfer or acquire<br />

intellectual property, cosmetic<br />

changes to product development<br />

that involves reproduction<br />

of a commercial product from<br />

plans, blueprints or other publicly<br />

available information, are all<br />

excluded as they are not seen as<br />

contributing towards scientific<br />

or technological advancement.<br />

Applying for the R&D cash<br />

tax credit<br />

IR has established an online<br />

portal to process R&D cash tax<br />

credit applications. The portal<br />

is maintained by the Ministry<br />

of <strong>Business</strong>, Innovation and<br />

Employment. Before applying<br />

to cash out R&D losses, a company<br />

will first need to register<br />

for the online portal by completing<br />

a form on the IR website.<br />

To make a claim for R&D<br />

tax credits, once registered<br />

online, a taxpayer will need<br />

to file additional information<br />

with the IR. In addition to the<br />

income tax return, a company<br />

must complete an R&D activity<br />

statement and an R&D supplementary<br />

form. Both of these<br />

forms must then be submitted<br />

through the online portal by the<br />

due date for filing your income<br />

tax return.<br />

Note that, once losses are<br />

cashed out, they are no longer<br />

available to apply against<br />

income in future years until they<br />

are repaid.<br />

Repayment of the cash tax<br />

credit<br />

The catch is, these new<br />

measures amount to an interest<br />

free loan (and not a grant) from<br />

the Government to be repaid<br />

from the taxpayer’s future taxable<br />

income. It is intended to<br />

provide a temporary cash flow<br />

head. I’m looking forward to<br />

being there for him to be able<br />

to put a medal around my neck<br />

after they win at Rio,” says Lynn.<br />

Brook, 21, was selected to<br />

be part of the New Zealand<br />

Olympic men’s rowing eight<br />

crew earlier this month, following<br />

their fourth placing at the<br />

World Rowing Championships<br />

in France in September.<br />

property;<br />

• 90 percent of the shares in the<br />

company are sold;<br />

• The company amalgamates<br />

with another company;<br />

• The company becomes<br />

non-resident (for tax purposes);<br />

or<br />

• The company is liquidated.<br />

can be a very real and costly<br />

threat.<br />

The use of closed circuit<br />

television and security<br />

cameras (CCTV) are<br />

an indispensable security tool<br />

for deterring and catching<br />

thieves. When deciding whether<br />

to install and use CCTV it<br />

is essential that your business<br />

be aware of the legal responsibilities<br />

under the Privacy Act<br />

1993.<br />

The use of security footage<br />

has made headlines in recent<br />

months. For example, a picture<br />

was taken from security camera<br />

footage in a clothing shop and<br />

posted on a social media site.<br />

The individuals in the picture<br />

were easily identifiable and it<br />

was paired with a description<br />

accusing the group of theft.<br />

Despite some of the individuals<br />

pictured being charged and convicted<br />

of theft, one individual<br />

was innocent and subsequently<br />

defamed. The business posting<br />

the picture was later ordered to<br />

pay damages to the innocent<br />

party for privacy interference,<br />

resulting from the business’s<br />

failure to comply with the privacy<br />

principles under the Act.<br />

The Act contains 12 privacy<br />

principles. The key principles in<br />

this situation are as follows:<br />

Collection: Principles 1 and 2<br />

of the Act require that personal<br />

information may only be collected<br />

for a lawful purpose.<br />

Use: Principle 10 specifies that<br />

CCTV must only be used by the<br />

business for the lawful purpose,<br />

or for any other purpose authorised<br />

by the individual.<br />

Disclosure: Principle 11 requires<br />

that a business that holds personal<br />

information shall not disclose<br />

the information to any other person,<br />

business, or body unless that<br />

disclosure is within the purposes<br />

for which it was collected, or the<br />

disclosure is to the individual<br />

concerned, unless it is publically<br />

available information.<br />

In order to comply with these<br />

principles in relation to CCTV,<br />

we suggest you consider displaying<br />

signage which is visible<br />

before individuals entering the<br />

filmed area. This signage should<br />

make it clear that CCTV is operating,<br />

the reasons why it is operating,<br />

and the proposed use of<br />

the information collected.<br />

We also suggest that you need<br />

to have a good understanding<br />

of the following points before<br />

installation of the CCTV:<br />

• The purpose of collecting<br />

personal information via<br />

CCTV;<br />

• How you intend to use CCTV<br />

images;<br />

• Whether you intend to disclose<br />

CCTV images or information<br />

to others (such as the<br />

police or social media);<br />

• How long the images are<br />

likely to be kept for;<br />

• How you will securely store<br />

the images, and minimise<br />

risk of unauthorised access;<br />

and<br />

• How you will enable the<br />

images to be accessed by the<br />

individual concerned.<br />

The Privacy Commissioner<br />

has released a CCTV guide<br />

which can be found on the<br />

Privacy Commissioner’s website<br />

(www.privacy.org.nz). The<br />

guide provides further practical<br />

information for businesses<br />

using CCTV.<br />

Failure to understand and<br />

comply with the Privacy Act<br />

could result in your business<br />

facing expensive fines or other<br />

legal action. Getting it right at<br />

the outset can save your business<br />

spending large amounts of<br />

time and money in dealing with<br />

or remedying potential breaches<br />

in future.
