News from the President<br />

Since the last <strong>Bulletin</strong>, we had the Awards Dinner on 9th March.<br />

<strong>The</strong>re were over 550 guests. John Sergeant, political journalist and<br />

former Strictly Come Dancing star, compered what was a<br />

memorable evening. <strong>The</strong> talent in the legal community in<br />

Birmingham is extremely impressive. <strong>The</strong> judges of the awards<br />

commented on the high quality of the entrants and said how<br />

difficult it was to choose the ultimate winners. Congratulations to<br />

all those who were on the short list and particularly to the<br />

winners.<br />

He gave a very interesting and<br />

thought provoking speech on how<br />

to ensure that the English (and<br />

Welsh) Courts retain its<br />

reputation and popularity as the<br />

jurisdiction of choice for<br />

international disputes. Something<br />

which is under threat from rival<br />

jurisdictions particularly<br />

following Brexit.<br />

On 8th March I attended the Jill Poole Memorial Lecture at Aston<br />

University where the Lord Chief Justice, Lord Thomas, spoke. He<br />

gave a very interesting and thought provoking speech on how to<br />

ensure that the English (and Welsh) Courts retain its reputation<br />

and popularity as the jurisdiction of choice for international<br />

disputes. Something which is under threat from rival jurisdictions<br />

particularly following Brexit.<br />

On 16th March I attended a meeting arranged on behalf of Lord<br />

Jackson at St Philips Chambers. Lord Jackson wished to discuss<br />

the proposed reforms to fixed costs in commercial disputes. A<br />

lively discussion took place and Lord Jackson went away with a<br />

great deal to consider. On the same day I attended a Legal<br />

Education Foundation networking event at the Council House.<br />

<strong>The</strong> Foundation does some very valuable work encouraging pro<br />

bono work and in particular funding Justice First Fellowship<br />

which provides support to trainees undertaking training contracts<br />

in Law Centres throughout the country.<br />

On 22 March we welcomed Stephen Denyer, Director of Strategic<br />

Relations at the Law Society, to the monthly Council Meeting. He<br />

explained what considerable efforts the Law Society is making to<br />

get its message across to Government in respect of protecting<br />

the profession against the effects of Brexit. Following that<br />

meeting, I chaired the panel of judges for the annual<br />

Birmingham Law Society Debating Competition. <strong>The</strong> finalists<br />

were teams from Birmingham City University and <strong>The</strong> University<br />

of Birmingham. <strong>The</strong> motion was that this house supports the<br />

privatisation of the National Health Service. Despite the<br />

controversial topic, the proposers, <strong>The</strong> University of Birmingham,<br />

won but that does not necessarily mean the judges agreed with<br />

the motion ! Both teams were very impressive.<br />

On 23 March I attended an event held at Kitchen Gallery in the<br />

Mailbox where about 40 guest from a number of professions<br />

enjoyed a cookery demonstration from a chef from Tom’s Kitchen<br />

based in the Mailbox. <strong>The</strong> event organised as “Greater<br />

Birmingham One Voice” was the idea of the former President,<br />

Mushtaq Khan. A most enjoyable evening in a relaxed and<br />

unusual setting.<br />

As I approach the end of my year as President, I look back with<br />

pleasure at the number of events I attended and realise that it is<br />

the office of President of Birmingham Law Society which carries a<br />

great deal of respect. <strong>The</strong>re is no doubt that the Birmingham Law<br />

Society is held in highest regard not only by the national Law<br />

Society but by the judiciary and the Justice Department. I am<br />

particularly grateful to the team in Temple Street, Becky, Liz,<br />

Johanna and Denise, who have worked tirelessly and cheerfully<br />

throughout the year. As we approach our bicentenary year the<br />

Society is in good shape and ready to face the next two hundred<br />

years with confidence and enthusiasm !<br />

6 Legal Awards <strong>2017</strong><br />

Legal sector stalwart honoured<br />

at Awards <strong>2017</strong><br />

Chris Owen, the former chief executive of St Philips Chambers in Birmingham,<br />

has been honoured for his service to the legal profession at this year’s<br />

Birmingham Law Society Legal Awards.<br />

Chris, who has dedicated his entire career, spanning almost 50 years, to the law<br />

was presented with the Society’s prestigious ‘Lifetime Achievement Award’ in front<br />

of a sell-out crowd at the ICC on 9th March.<br />

<strong>The</strong> son of a policeman, Chris started his career in 1968 as a clerk at a firm in<br />

Leicester, later going on to hold a number of senior positions at barristers’<br />

chambers in London and Birmingham, including 7 Bedford Row and St Philips<br />

Chambers.<br />

He was a member of the Bar’s Equality and Diversity Committee and the Bar’s Pro<br />

Bono Unit. Chris also served on the Birmingham Law Society council and was<br />

chairman of the board for four years.<br />

John Hughes, president of the Birmingham Law Society, said: “<strong>The</strong>re is no one<br />

more deserving of this accolade than Chris.<br />

“Widely regarded in the profession as a ‘legend’ and the best connected person in<br />

the law, throughout his career he has worked tirelessly to promote Birmingham as<br />

a centre for legal excellence and it is only fitting that his efforts are recognised in<br />

this way.”<br />

<strong>The</strong> annual Birmingham Law Society Legal Awards have been held since 2002 and<br />

recognise and reward the achievements of those working in the legal profession<br />

across the West Midlands.<br />

John Hughes said: “Birmingham has one of the best legal centres in the world and<br />

all of this year’s winners and finalists demonstrate the strength and depth of legal<br />

talent we have, not just in Birmingham, but across the whole of the region.”<br />

More than 560 people attended this year’s Legal Awards, which was hosted by<br />

former BBC broadcaster and journalist John Sergeant.<br />

Veale Wasbrough Vizard's Healthcare Team recognised<br />

among best in the UK<br />

Chambers UK, the world’s largest researching guide for lawyers, has<br />

given Veale Wasbrough Vizard's (VWV) Healthcare team the highest<br />

ranking - Band 1. Five out of seven ranked lawyers in this section are<br />

from VWV.<br />

As part of the research carried out by Chambers UK, VWV's Healthcare<br />

lawyers have been praised for being "knowledgeable, proactive and<br />

responsive to issues raised”.<br />

With 31 lawyers, VWV's Healthcare team provides a range of legal services<br />

to GP Practices, care homes, healthcare charities, social enterprises,<br />

Senior Appointment for Higgs’ Corporate Team<br />

A senior commercial lawyer has joined the expanding Corporate<br />

Team at leading West Midlands law firm Higgs & Sons.<br />

Peter Manford joins Higgs as Commercial Partner from Knights. He brings<br />

with him a wealth of business experience specialising in all forms of<br />

commercial contractual services particularly in the fields of outsourcing,<br />

supply chain, pharmaceuticals and education.<br />

He said: “I am delighted to have joined Higgs & Sons team of specialist<br />

lawyers and am very much looking forward to promoting the firm’s<br />

Chalcrafts move to Shakespeare Martineau is “Big Coup”<br />

Prominent regeneration and projects<br />

lawyer Stephen Chalcraft has joined<br />

leading UK law firm Shakespeare<br />

Martineau as a partner, bolstering the<br />

firm’s expanding real estate and projects<br />

team across the Midlands and the North<br />

West.<br />

Chalcraft will work closely with the firm’s<br />

real estate, energy, infrastructure and<br />

planning lawyers, delivering end-to-end<br />

major projects across higher education,<br />

public and private sectors. He has nearly<br />

two decades’ experience working with<br />

major law firms in the City of London and<br />

the North West.<br />

at their Birmingham Chambers.<br />

Following a brief outline of the<br />

progress being made to make<br />

the Court of Protection more<br />

open through its Transparency<br />

Pilot, he answered questions<br />

from solicitors, practitioners,<br />

health and social care<br />

professionals and advocates.<br />

“<strong>The</strong> Transparency Pilot is<br />

conceptually very important, and<br />

very close to my heart, but has<br />

had virtually no impact on the<br />

ground,” said Sir James.<br />

“In an ideal world, we would be<br />

teaching children in schools how<br />

the law works – not just the<br />

welfare state and Court of<br />

Protection, but the judicial<br />

system, the constitution and<br />

significant examples such as<br />

Brexit and Article 50.”<br />

Sir James also talked about<br />

regionalisation of CoP which he<br />

said was vitally important: “We<br />

have to take justice to the people<br />

and not expect people to come<br />

to us.”<br />

And he said the next level was to<br />

hear cases much more locally, at<br />

the ‘convenience of families’.<br />

“Particularly in places like central<br />

Wales, East Anglia and the Lake<br />

District we are looking at<br />

administering justice in<br />

appropriate settings that are not<br />

necessarily a designated court,”<br />

said Sir James. As long as the<br />

building is suitable, a judge could<br />

hear cases right at the heart of<br />

the locality.<br />

Overall, Sir James said initiatives<br />

to implement the disciplines of<br />

the Family Court into the<br />

workings of CoP was going well,<br />

and described the future as ‘rosy’.<br />

And he added that a vital part of<br />

his job was to attend meetings<br />

such as the one at No5 where he<br />

Birmingham Legal Walk<br />

<strong>The</strong> Birmingham Legal Walk <strong>2017</strong> takes place on Monday 8th<br />

May <strong>2017</strong>. <strong>The</strong> 10km sponsored walk around the city sights is<br />

a great opportunity to show your support and raise funds for<br />

free legal advice charities.<br />

Indeed, advice services support some of the most disadvantaged<br />

and vulnerable people in our society. Over the last few years over<br />

50% of Law Centres have had to reduce their services and become<br />

smaller centres, others have merged but many have ceased to<br />

provide services altogether leaving whole communities with no<br />

access to advice whatsoever if they are unable to afford legal fees.<br />

While we can’t overcome the effects of the funding cuts over the<br />

past few years, we can provide an alternate stream of funding to<br />

ensure that free legal advice services remain available and<br />

effective for those who are most in need.<br />

sponsorship from your friends, family and colleagues, you will be<br />

helping to secure vital funds needed for this important cause.<br />

Last year, the Legal Walk raised more than £20k and helped<br />

prevent several families from being made homeless and women<br />

and children who have been trafficked for domestic servitude or<br />

prostitution. <strong>The</strong>se are only a few examples of the great work these<br />

legal advice services do.<br />

This year, we want to make the walk even bigger and hopefully<br />

raise over £25k to ensure that even more people get the help they<br />

Regulation Report<br />

<strong>The</strong> independence of the profession<br />

“Where there is no independent legal profession<br />

there can be no independent judiciary, no rule of law,<br />

no justice, no democracy and no freedom”<br />

<strong>The</strong>se are the words of <strong>The</strong> Hon Michael Kirby, the<br />

international jurist and former judge, used to<br />

introduce the recent report of the International<br />

Bar Association (“IBA”) on the independence of the<br />

legal profession.<br />

<strong>The</strong> report identifies areas where legal<br />

independence is under attack across the world<br />

including in the UK. Whilst we usually consider<br />

ourselves to be immune from such pressures here<br />

in the UK, the condemnation of the judiciary by<br />

the press and MPs over the Article 50 decision<br />

brought this issue into sharp focus. <strong>The</strong>re are also<br />

developments closer to home that warrant<br />

concern.<br />

First, one cannot describe the legal profession’s<br />

oversight regulator, the Legal Services Board, as<br />

free from government interference. <strong>The</strong> Legal<br />

Services Board is a non-departmental public body<br />

whose majority lay board is appointed by a<br />

government minister (the Secretary of State for<br />

Justice) and whose Chief Executive Officer has a<br />

reporting role as the accounting officer for the<br />

organisation ultimately to the Secretary of State<br />

for Justice. <strong>The</strong> Legal Services Board in turn<br />

oversees the operation of the SRA.<br />

Second, complaints to the SRA by government<br />

departments about solicitors appear to be being<br />

used as a method of curtailing the activities of the<br />

clients themselves. An example is HMRC. Without<br />

the resources to challenge all the individual<br />

taxpayers using Stamp Duty Land Tax avoidance<br />

schemes, it seems that HMRC encouraged the SRA<br />

to investigate the law firms undertaking this type<br />

of work in the hope that without solicitors willing<br />

to take on this work the schemes themselves<br />

would perish. A Warning Notice published by the<br />

SRA in 2012 had the immediate effect of reducing<br />

the pool of solicitors to nil.<br />

We can see this strategy being further developed<br />

with the announcement in the Spring Budget<br />

<strong>2017</strong> that “enablers” of tax avoidance schemes that<br />

are later defeated by HMRC will be subject to<br />

“tough new financial penalties”. With the definition<br />

of an “enabler” being “any individual or entity who<br />

has enabled another person or business to use a tax<br />

avoidance arrangement”, one can foresee<br />

specialist tax solicitors and the tax Bar being loath<br />

to recommend anything other than cast iron<br />

schemes.<br />

More curiously, the SRA has during the last 6<br />

months been investigating law firms who deal<br />

with holiday travel claims because it received a<br />

complaint from the Foreign & Commonwealth<br />

Office which had in turn received a complaint<br />

from the Spanish government.<br />

Whilst not a government department, the<br />

judiciary is showing increasing tendencies to<br />

complain publicly about solicitors before there<br />

has been any investigation by the SRA. <strong>The</strong><br />

Guardian reported on 2 March <strong>2017</strong> that the SRA<br />

was investigating allegations by Mr Justice<br />

McLoskey (President of the Immigration & Asylum<br />

Chamber) that a firm of solicitors in Nottingham<br />

acting for a “Rochdale grooming gang” had<br />

deliberately obstructed an immigration tribunal<br />

with “sustained and marked disrespect”. <strong>The</strong> law<br />

firm concerned refused to comment (quite rightly<br />

in my view) citing that it did not want to do so at<br />

this stage in order to avoid prejudicing any<br />

ongoing action. <strong>The</strong> same restraint was not<br />

exercised by the local MP commenting on behalf<br />

of child victims of the gang or the Chief Executive<br />

of the SRA in agreeing to meet with the Judge.<br />

Thirdly, there was a time when the prosecution<br />

work before the SDT was dealt with by an external<br />

panel of solicitors all in private practice. From<br />

January <strong>2017</strong>, the panel now comprises one single<br />

law firm which will be paid (it is rumoured) not by<br />

the individual case but by a substantial annual<br />

retainer. Any remaining work is undertaken by the<br />

in-house legal team at the SRA assisted by<br />

Counsel. One might question whether either<br />

arrangement would result in wholly independent<br />

(and if necessary unpalatable advice) advice to the<br />

SRA about what does and what does not<br />

constitute professional misconduct.<br />

<strong>The</strong> IBA Standards for the independence of the<br />

profession (adopted in 1990) state clearly that “the<br />

lawyer in discharging his or her duties shall at all<br />

times act freely, diligently and fearlessly in<br />

accordance with the legitimate interest of the client<br />

and without any inhibition or pressure from the<br />

authorities or the public”. <strong>The</strong> Standards further<br />

provide that “the lawyer is not to be identified by the<br />

authorities or the public with the client or the client’s<br />

cause, however popular or unpopular it may be” and<br />

that “no lawyer shall suffer or be threatened with<br />

penal, civil, administrative, economic or other<br />

sanctions or harassment by reason of his or her<br />

having legitimately advised or represented any client<br />

or client’s cause”<br />

We should remind ourselves of these standards<br />

when we go about our daily work and remain<br />

independent of political and media pressure in the<br />

interests of our clients. More importantly we<br />

should ensure that our young solicitors<br />

understand what it means to be a member of the<br />

legal profession.<br />

Forresters ranked in top 5 for EU<br />

trade mark applications<br />

Forresters, a leading Birmingham-based firm of patent and<br />

trademark attorneys, has been named as one of the top five British<br />

filers of EU trade mark applications at the European Union<br />

Intellectual Property Office.<br />

It is with great sadness that we announce the death of Sam Driver<br />

White, former senior partner of Harrison Clark, on Monday 20<br />

February <strong>2017</strong>.<br />

Sam, who was 78, started his career in Worcester at Clark and Co, which<br />

merged with Col Roy Harrison’s firm in 1965 to create Harrison Clark. He<br />

died suddenly at home and leaves behind his wife Christine, his two<br />

daughters, Miranda and Laura and granddaughters Blossom and Mimi.<br />

He was well-known throughout the Three Counties for his love of<br />

classical music and for his commitment to the local community. As vice<br />

chair of the Elgar Foundation and the Elgar Birthplace Trust, chair of the<br />

Museum of Royal Worcester Porcelain, and trustee of the Elmley<br />

Foundation, the Worcestershire and Dudley Historic Churches Trust, the<br />

Dyson Perrins Museum Trust and the Harrison Clark Rickerbys Charitable<br />

Trust, he was active in supporting the arts in many arenas, including a<br />

lengthy involvement with the Three Choirs Festival.<br />

He was also supportive of local schools, including Malvern St James and<br />

its predecessors, and of Worcester Cathedral, as well of the business<br />

community and of his own profession through the Worcestershire Law<br />

Society. Additionally, he was a member of <strong>The</strong> Worshipful Society of<br />

Apothecaries of London.<br />

Jonathan Brew, the firm’s senior partner, said: “Sam lived his life in<br />

accordance with his belief that, as a lawyer, he served the community<br />

and therefore should be part of that community and contribute to it. He<br />

retired from the practice in 2003, but remained a close friend to many of<br />

us – he will be very greatly missed.”<br />

A private family funeral was held, to be followed by a memorial service at<br />

Worcester Cathedral later this year.<br />

Boyzone star joins call up for bikers to sign up to “Ride<br />

Out” in aid of Midlands Air Ambulance<br />

He has had 21 hit singles in the UK Top 40, nine number one singles,<br />

sold over 25 million records worldwide and was a member of one of<br />

the biggest and most successful boybands of all time. Former<br />

BOYZONE pop star Shane Lynch, has today pledged his support and<br />

is leading the call for bikers to sign up for the Bike4Life Ride Out and<br />

Festival on Sunday 30th <strong>April</strong>, to help support Midlands Air<br />

Ambulance Charity.<br />

<strong>The</strong> Irish singer/songwriter - who is also a professional drift driver and<br />

motorcycle enthusiast, will join former World Superbike champion Carl<br />

Fogarty, motorcycle and truck racing legend, Steve Parrish and adventure<br />

motorcyclist and author, Nick Sanders, in leading 3,500 bikers on the<br />

annual 23 mile Ride Out to RAF Cosford.<br />

Midlands Air Ambulance Charity, organiser of Bike4Life, is urging bikers to<br />

pre-book their Ride Out place online at www.bike4lifefest.com as the<br />

Ride Out is limited to 3,500 bikes by the authorities.<br />

Both Shane, Carl and Steve will be supported by Triumph motorcycles<br />

Birmingham and will be riding Triumph motorbikes for the event.<br />

<strong>The</strong> Ride out will start at 11.30am on Sunday 30th <strong>April</strong> from Meole Brace<br />

in Shrewsbury with the 3,500 bikers take to the roads in convoy before<br />

arriving at RAF Cosford where the festival will be under way.<br />

Commenting on the event the former BOYZONE pop star Shane Lynch<br />

said; "I was delighted to be asked to support and lead the Bike4Life Ride<br />

Out to the Festival alongside the other VIPS, as I am a huge admirer of the<br />

work of Midlands Air Ambulance Charity. “<strong>The</strong> Bike4Life Ride Out and<br />

Festival is a fantastic way for the biking community to come together,<br />

raise funds for the charity, and awareness of biker safety.<br />

motorcycle season. <strong>The</strong> annual event raised over £200,000 for Midlands<br />

Air Ambulance Charity since it first started, attracting bikers to the Ride<br />

<strong>The</strong> MIDLANDS AIR AMBULANCE CHARITY (MAAC) is one of the busiest air<br />

ambulance services in the UK. <strong>The</strong> charity was the first ever air ambulance<br />

to be established in the UK in 1991 and last year it celebrated its 25th<br />

anniversary having saved over 46,000 lives since its inception. <strong>The</strong> charity<br />

receives NO GOVERNMENT FUNDING and NO NATIONAL LOTTERY<br />

donations and relies solely on the generosity of the public each year. <strong>The</strong><br />

Midlands Air Ambulance currently operates three emergency helicopters<br />

covering the largest air ambulance region in the UK of 5,500 square miles<br />

serving a population in excess of 5.5 million people and covering<br />

Birmingham and the wider West Midlands, Staffordshire, Gloucestershire,<br />

Worcestershire, Herefordshire and Shropshire.<br />

No5 donates Blues shirt sponsorship to Headway<br />

No5 Barristers’ Chambers are to donate their Birmingham City FC<br />

‘back of the shirt’ sponsorship to a leading UK-wide brain injury<br />

charity.<br />

No5 have been sponsoring the Championship team for the past two<br />

seasons. On Saturday, March 18th, when Championship League leaders<br />

Newcastle United visit St Andrew’s, they have agreed to donate their back<br />

of shirt sponsorship and digital board advertising to Headway – the brain<br />

injury association.<br />

Birmingham City FC players will wear special one-off kits featuring<br />

Headway’s logo with the aim to help raise more awareness of brain<br />

injuries in sports as well as vital funds for the charity.<br />

Headway works to improve the lives of people affected by brain injury<br />

through a range of frontline services including a network of around 130<br />

groups and branches across the UK. <strong>The</strong> charity supports individuals,<br />

families and carers to adapt to the challenges brain injury can bring.<br />

Alongside the players wearing the kits, the match day mascots will have<br />

special kits with the Headway logo emblazoned on the front. Headway<br />

Ambassador, Team GB Paralympian and Cerebral Palsy Football Captain<br />

Jack Rutter, will be the special guest on the day. He will be interviewed by<br />

Sky TV presenter, Chris Skudder at half-time.<br />

Former Birmingham City youth team player Jack was 18 years old when, a<br />

month away from signing his first professional contract, he and headed<br />

out for a celebratory night with friends at a nightclub in Gloucester. A few<br />

hours later, his life changed irreparably when he was brutally assaulted in<br />

an unprovoked attack outside the club. A sickening punch to the back of<br />

Jack’s head caused him to fall and hit his head on the curb, leaving him<br />

with a brain injury. Jack woke up from a coma in intensive care with his<br />

dreams of becoming a professional footballer shattered. Jack then began<br />

the slow and arduous task of rebuilding his life with help from Headway.<br />

Showing tremendous courage and tenacity, Jack has since gone on to<br />

achieve great things, not least captaining the GB Football team at the<br />

Paralympics in Rio de Janeiro last summer.<br />

Other promotional activity on the day will include Headway branding in<br />

and around the stadium and volunteers, staff and brain injury survivors<br />

from Headway Birmingham and Solihull around the ground handing out<br />

leaflets and speaking to fans about the importance of being concussion<br />

aware. <strong>The</strong> Blues first team squad will also provide the charity with signed<br />

playing shirts to be used for auctions and competitions all designed to<br />

get people talking and more aware of the impact of brain injuries.<br />

Tony McDaid, Chief Executive and Director of Clerking at No5 Barristers’<br />

Chambers said: “We have been working with Headway over many years<br />

and continue to marvel at the level of support they offer to individuals<br />

and their families post brain injury.<br />

“<strong>The</strong> charity’s Concussion Aware campaign is an initiative that both we at<br />
