Davison Named Editor<br />
Of Drake Law Review<br />
DES MOINES – Collin Davison of <strong>Garner</strong> has been<br />
chosen as the 2011 Editor in Chief of the Drake Law<br />
Review.<br />
The position of chief editor of the law review is the<br />
highest award a student can achieve during their law<br />
school studies. The Drake Law Review is a highly<br />
regarded and authoritative law journal which is<br />
frequently relied upon by lawyers and judges.<br />
A graduate student at Drake University Law School,<br />
Davison is currently an intern at CritelliLaw, P.C. He<br />
will receive his law degree in May of 2011 and plans to<br />
return to <strong>Garner</strong> to practice law.<br />
Davison is the son of Wendell and Brenda Davison,<br />
rural <strong>Garner</strong>, and a 2005 graduate of <strong>Garner</strong>-Hayfield<br />

“Scholars Day” Event<br />

Buena Vista University recently held its sixth annual<br />
Scholars Day event. The event provides an opportunity<br />
for BVU students to present their original research and<br />
academic work to their peers, professors and the public.<br />
Tanner Urich from <strong>Garner</strong> presented a poster<br />
presentation entitled “Antibiotic Synergism and<br />
Antagonism by the Skin by the Skin Bacterium<br />
Staphylococcus Epidermidis and Staphylococcus<br />
Simulans.” Urich is a junior majoring in biology.<br />
“Scholars Day is a wonderful festival of ideas and<br />
research by BVU students,” says Dr. Matt Packer,<br />
assistant professor of English and chair of the events<br />
committee of the Faculty Senate, which helped to plan<br />
the event.<br />
Wartburg Announces<br />
Winter/May Dean’s List<br />
The Wartburg College Academic Affairs Office has<br />
released the 2010 winter/May term dean’s list.<br />
The list recognizes students who earned a cumulative<br />
grade point average of 3.5 or above in at least five course<br />
credits during the two terms. Four of the five course<br />
credits must be graded with a traditional letter grade.<br />
Wartburg students take four courses during winter<br />
term, which runs from January to April, and one course<br />
during the one-month May Term. May term courses<br />
often involve travel and study abroad.<br />

G-H Girls Drop<br />
Pair of Games<br />
It’s been a challenging season to date for<br />
the <strong>Garner</strong>-Hayfield softball team and<br />
the weather has not helped the Cardinals’<br />
cause. <strong>Garner</strong> managed to complete<br />
only two of five games last week as wet<br />
weather interfered with games on Monday,<br />
Thursday and Friday.<br />
The rain stopped long enough on Tuesday<br />
for G-H to host Algona in a non-conference<br />
match up. The Bulldogs scored<br />
two runs in the first inning to take an early<br />
lead, but <strong>Garner</strong> answered with a run<br />
in their half of the first to keep the game<br />
close. Algona then scored multiple runs<br />
in the third, fifth, sixth and seventh innings<br />
while holding the Cardinals scoreless<br />
to post an 11 - 1 victory.<br />
G-H finished the night with six hits but<br />
were unable to string them together and<br />
produce runs. Jasmine Doble hit a pair<br />
of singles to lead the Cards while Taylor<br />
Nelson, Jenna Wellik, Karah Huinker<br />
and Megan Waddingham all added base<br />
hits. Doble surrendered 11 hits and four<br />
walks on the mound for <strong>Garner</strong> while<br />
picking up four strikeouts.<br />
“When our number of hits match our<br />
number of errors, its hard to win,” remarked<br />
coach Anita Smith. “It was a<br />
positive for us to have lots of base runners<br />
tonight, but we stranded many of<br />
them. We just couldn’t come up with that<br />
big hit when it was really needed.”<br />
G-H resumed North Iowa conference<br />
play on Wednesday with a home game<br />
with Forest City. After two scoreless innings,<br />
the Indians gained the lead with<br />
three runs in the top of the third. Forest<br />
City then added lone insurance runs in<br />
the fifth and seventh inning on the way<br />
to a 5 - 0 win.<br />
Again, the Cardinals were able to produce<br />
hits at the plate but the inability to<br />
put the ball in play with runners in scoring<br />
position kept G-H scoreless. Jasmine<br />
Doble had another two-hit night for the<br />
Cards and Chelsey Formanek added<br />
a pair of singles to the offense. Megan<br />
Waddingham’s third-inning single was<br />
the other offensive bright spot for <strong>Garner</strong>.<br />
Jasmine Doble again went the distance<br />
on the mound for <strong>Garner</strong>, allowing a<br />
dozen hits with no walks and two strikeouts.<br />

Cardinals Crush Forest City<br />
Wet, stormy weather led to an abbreviated<br />
week of baseball action for the <strong>Garner</strong>-Hayfield<br />
Cardinals. Games at Osage<br />
on Monday and Belmond on Friday were<br />
both postponed due to the wet conditions<br />
while Thursday’s game at West Fork<br />
was called off in the fifth inning when a<br />
heavy thunderstorm arrived. The Cards<br />
hosted Algona on Tuesday, dropping<br />
a 10-run decision to the Bulldogs but<br />
bounced back with a big win over Forest<br />
City on Wednesday.<br />
Algona scored five runs in the first inning<br />
and three more in the second on the<br />
way to a 12 - 2 win over the Cardinals.<br />
Algona then stretched the lead to 9 - 0<br />
in the fourth inning when the Cardinals<br />
plated two runs to keep the game interesting.<br />
Three Bulldog runs in the fifth<br />
inning led to an early end to the game.<br />
G-H managed only two hits in the<br />
game, with Tom Legge picking up two<br />
RBI’s on a single. Nick Svare’s single<br />
was the only other hit of the game for<br />
<strong>Garner</strong>. Tim Molencamp started on the<br />
mound, allowing 11 hits and four walks<br />
with a strikeout. Zach Buseman relieved<br />
Molencamp in the fifth, holding the<br />
Bulldogs to no hits with two walks.<br />
G-H got back into the win column in a<br />
big way against Forest City on Wednesday.<br />
After giving the Indians a run in<br />
the top of the first, the Cardinals took<br />
advantage of some Forest City pitching<br />
trouble to score seven runs in their half<br />
of the first. Four walks, three hits and<br />
two Indian errors allowed the Cardinals<br />
to send a dozen batters to the plate in that<br />
inning. The <strong>Garner</strong> bats remained hot in<br />
the second, bringing home three runs in<br />
that inning followed by a four-run fourth<br />
that resulted in an early end to the game.<br />
Aaron Babcock had a big night at the<br />
plate for <strong>Garner</strong>, finishing the night with<br />
three RBI’s on two hits. Joe Ermer added<br />
a single and a double to the offense followed<br />
by Nick Svare and Blake Risius<br />
with two hits apiece. Tom Legge and<br />
Zach Buseman completed the offensive<br />
effort with a single each.<br />
Nick Svare tossed a one-hitter for<br />
the Cards while earning the win. Svare<br />
Coach Smith stated, “The game was a<br />
step in the right direction for us. Overall,<br />
it was a decent game. We made some<br />
base running mistakes and just couldn’t<br />
get the hits grouped together to score,<br />
but we had some base runners on.”<br />
In the first game of the season, an untimely<br />
storm cost the Cardinals what<br />
would have likely been a victory. That<br />
was the case again on Thursday as <strong>Garner</strong>-Hayfield<br />
traveled to Northwood, In<br />
just three innings the Cards had already<br />
collected 10 hits and were ahead 5 - 1<br />
when the clouds opened up and halted<br />
the game.<br />
G-H is now 2 - 10 overall and 1 - 3<br />
in North Iowa Conference play and will<br />
have a full week of action, providing<br />
the weather cooperates. The Cardinals<br />
are scheduled to play at North Iowa on<br />
Monday before hosting Clear Lake and<br />
West Hancock on Tuesday and Wednesday.<br />
<strong>Garner</strong> will then travel to Newman<br />
on Friday before hosting the Cardinal<br />
Invitational Tournament on Saturday.<br />

Cardinal coach Bill Awtry commented,<br />
“This was a good win for us. Forest City<br />
has been playing good ball and we knew<br />
we would have to play well to win. We<br />
had great at-bats and were very patient.<br />
Once we got runners on base we were<br />
able to do a lot of things. We ran well<br />
and put some pressure on their defense<br />
which made them do some things that<br />
were out of character. Aaron Babcock<br />
got his first varsity start and did a nice<br />
job at the plate going two-for-three with<br />
three RBI’s. He had been swinging the<br />
bal well at the JV level and continued<br />
to do so tonight. Nick Svare did a very<br />
good job on the mound. He had good<br />
control of his pitches and hit his spots<br />
pretty well.”<br />
Stormy weather on Thursday turned<br />
a very close game at West Fork into a<br />
disappointing Cardinal loss. West Fork<br />
scored once in the third inning to take<br />
an early lead, but G-H knotted the score<br />
with a run in the fourth. West Fork answered<br />
with a run in their half of the<br />
fourth and then Mother Nature decided<br />
to send everyone home.<br />
G-H finished the night with four hits<br />
as Nathan Hrubes, Blake Risius, Damon<br />
Quandt and Keith Schwickerath all singled.<br />
Blake Risius allowed four hits and<br />
a walk on the mound for <strong>Garner</strong> while<br />
fanning two Warhawks.<br />
The Cardinals are now 3 - 11 on the<br />
year and 2 - 2 in North Iowa Conference<br />
play. They will spend plenty of time on<br />
the road this week, traveling to North<br />
Iowa on Monday, Garrigan on Tuesday,<br />
Central Springs on Thursday and Newman<br />
on Friday. The Cards will have one<br />
home game this week, hosting West<br />
Hancock on Wednesday.<br />

June 14, 2010<br />
A regular meeting of the Board of Directors of<br />
the <strong>Garner</strong>-Hayfield Community School District<br />
was held on June 14, 2010, in the board room<br />
at the high school building at approximately<br />
5:33 p.m.<br />
Board Members Present: Tusha, Greiman,<br />
and Zrostlik<br />
Board Members Absent: Gamerdinger and<br />
Toppin (Toppin arrived at 5:35)<br />
Motion by Greiman, second by Zrostlik, to<br />
approve the proposed agenda. All voted in<br />
favor.<br />
Motion by Greiman, second by Zrostlik,<br />
to approve the minutes of the May 10, 2010,<br />
regular meeting. All voted in favor.<br />
Motion by Greiman, second by Zrostlik, to<br />
approve the Secretary’s Financial Reports, as<br />
well as the bill lists to be paid from the General<br />
Fund, Capitol Projects Fund, Management<br />
Fund, Insurance Fund, Activity Fund, PPEL<br />
Fund, Band Uniform Fund, House Construction<br />
Fund, and Nutrition Fund. All voted in favor.<br />
Debra Quintus presented information to the<br />
board on the various GAP programs as well as<br />
information on grants applications submitted to<br />
continue the programming.<br />
Supt. Williams reported that one spare bus<br />
had been permanently removed from service<br />
during the latest bus inspection.<br />
Motion by Zrostlik, second by Greiman,<br />
to approve the following personnel hires:<br />
Cam Smith, .5 FTE HS Teacher, .5 FTE MS<br />
Principal – no change in compensation; Jenny<br />
Rose, K-8 Art Teacher; Josh Omans, HS<br />
Industrial Tech. Teacher – pending release from<br />
current contract; Paul Childress, 9th Grade<br />
Girls Basketball Coach; Heather Baumgard,<br />
Associate – increase in hours; Carol Larsen,<br />
Sp. Ed. Associate; Ramon Wynter, Volunteer<br />
FB Coach. All voted in favor.<br />
Motion by Toppin, second by Greiman,<br />
to approve Joint Agreement with the City of<br />
<strong>Garner</strong> for ball field maintenance. All voted in<br />
favor.<br />
Motion by Zrostlik, second by Toppin, to<br />
approve Open Enrollment Transportation<br />
Agreements with all contiguous school districts.<br />
All voted in favor.<br />
Motion by Greiman, second by Toppin, to<br />
approve the revised 2010-2011 calendar as<br />
presented. All voted in favor.<br />
Motion by Zrostlik, second by Toppin, to<br />
authorize Supt. Williams to purchase a used<br />
school bus if an appropriate bus can be located<br />
not to exceed $40,000.00. All voted in favor.<br />
Board members were reminded of the<br />
upcoming IASB meeting on June 22, 2010, and<br />
the board work session on June 29, 2010.<br />
There being no further items to come before<br />
the board at this time, upon motion by Zrostlik,<br />
second by Toppin, and unanimously carried, the<br />
regular meeting was adjourned by Pres. Tusha<br />

NOXIOUS WEED NOTICE<br />
TO ALL LANDOWNERS, OCCUPANTS AND<br />
PERSONS IN POSSESSION OR CONTROL<br />
INCLUDING RAILROADS, LANDS, AND<br />
LOTS WITHIN HANCOCK COUNTY, IOWA:<br />
The Board of Supervisors of Hancock<br />
County, Iowa, in a meeting held on June 14,<br />
2010 passed the following Resolution, to wit:-<br />
BE IT RESOLVED by the Board of<br />
Supervisors of Hancock County, Iowa, that<br />
pursuant to the provision of Chapter 317, Code<br />
of Iowa, it is hereby ordered:-<br />
1. That each owner and each person in<br />
possession or control of any land or lots in<br />
Hancock County, Iowa, shall cut, burn or<br />
otherwise destroy all noxious weeds thereon,<br />
as defined in this Chapter, at such times, in<br />
each year, in such manner as shall prevent said<br />
weeds from blooming or coming to maturity,<br />
and shall keep said lands free from such growth<br />
of any other weeds, as shall render the streets<br />
and highways adjoining said land unsafe for<br />
public travel. Noxious weeds shall be cut or<br />
otherwise destroyed on or before the following<br />
dates and as often thereafter as is necessary to<br />
prevent seed production.<br />
GROUP 1: June 15, 2010 for leafy spurge,<br />
perennial peppergrass, sour dock, smooth<br />
dock, sheep sorrel and buckthorn.<br />
GROUP 2: June 15, 2010 for Canadian<br />
thistle, bull thistle, other thistle belonging in<br />
genera or cirsium, Russian knapweed, quack<br />
grass, wild mustard, shatter cane and teasel.<br />
GROUP 3: July 15, 2010 for field bindweed<br />
and wild carrot.<br />
GROUP 4: July 15, 2010 for sunflower,<br />
horse nettle, perennial sow thistle, cocklebur,<br />
butter print (velvet leaf), puncture vine, poison<br />
hemlock, multi-flora rose and marijuana.<br />
2. That each person and owner in possession<br />
or control of any land in Hancock County,<br />
infested with any noxious weed, as listed above,<br />
shall adopt a program of weed destruction<br />
prescribed by the Weed Commission which<br />
in five years may be expected to destroy and<br />
will immediately keep under control such<br />
infestations of said noxious weeds.<br />
3. That all weeds other than noxious weeds<br />
on all county truck primary and local county<br />
roads and between the fence lines thereof, shall<br />
be treated by the adjoining property owners to<br />
prevent seed production on or before JULY 15,<br />
2010.<br />
4. That if the owner or person in possession<br />
or control of any land in Hancock County, Iowa,<br />
fail to comply with the foregoing orders, the<br />
Weed Commission shall cause this to be done<br />
and the expense of said work including costs<br />
of serving notice and other costs, if any, to<br />
be assessed against the land and the owners<br />
thereof.<br />
5. That the County Auditor be and she<br />
is hereby directed to cause notice of the<br />
making and entering of the foregoing order by<br />
publication in each of the official newspapers in<br />
Hancock County, Iowa.<br />
The foregoing Resolution was offered<br />
and read by Supervisor Hall who moved its<br />
adoption, seconded by Supervisor Greiman.<br />
Whereupon Chairman Tlach placed the motion<br />
for adoption and upon roll call, the vote was<br />
unanimously, “AYE.” The Chairman duly<br />
declared the Resolution adopted this 14th day<br />
of June, 2010.<br />

Supervisors met in adjourned session on the<br />
above captioned date pursuant to adjournment<br />
with Supervisors Florence (Sis) Thomas-<br />
Greiman, and Jerry J. Tlach present. Absent:<br />
Ted D. Hall.<br />
The minutes of June 1, 2010 meeting were<br />
read and approved.<br />
On motion by Supervisor Greiman, seconded<br />
by Supervisor Tlach and carried unanimously,<br />
the Board gave approval to the following:<br />
Abatement of property taxes for a junked<br />
mobile home certificate number 410109684<br />
under Greenfield Estates for the amount of<br />
$1,969. as being determined uncollectible by<br />
Hancock County Treasurer. Hiring of Daniel<br />
Barickman, fulltime in Secondary Road<br />
Department, effective June 9, 2010 at $16.97<br />
per hour. Hiring of Melinda West, part-time<br />
home care registered nurse for Public Health,<br />
effective June 14, 2010 at $21.27 per hour.<br />
On motion by Supervisor Greiman, seconded<br />
by Supervisor Tlach and carried unanimously,<br />
the Board gave approval to the following:<br />
ROAD CLOSING RESOLUTION<br />
As per <strong>Section</strong> 306.41 Code of Iowa be<br />
it resolved that the Board of Supervisors<br />
of Hancock County hereby declare closed<br />
temporarily the following roads in Hancock<br />
County due to construction, reconstruction,<br />
maintenance or natural disaster. This resolution<br />
shall become effective upon placement of<br />
temporary road closure signs and shall expire<br />
when the said temporary signs are removed<br />
upon completion of said project.<br />
DESCRIPTION OF ROADS AFFECTED<br />
Between <strong>Section</strong> 21 and <strong>Section</strong> 28, Orthel<br />
Township.<br />
On motion by Supervisor Greiman, seconded<br />
by Supervisor Tlach and carried, the Board<br />
authorized the County Auditor to issue checks<br />
for the claims on file on June 7, 2010. (All<br />
claims for the month of June, 2010 will be listed<br />
in the June 28 board minutes.)<br />

Resolution:<br />
NOXIOUS WEED RESOLUTION<br />
BE IT RESOLVED by the Board of<br />
Supervisors of Hancock County, Iowa, that<br />
pursuant to the provision of Chapter 317, Code<br />
of Iowa, it is hereby ordered:-<br />
1. That each owner and each person in<br />
possession or control of any land or lots in<br />
Hancock County, Iowa, shall cut, burn or<br />
otherwise destroy all noxious weeds thereon,<br />
as defined in this Chapter, at such times, in<br />
each year, in such manner as shall prevent said<br />
weeds from blooming or coming to maturity,<br />
and shall keep said lands free from such growth<br />
of any other weeds, as shall render the streets<br />
and highways adjoining said land unsafe for<br />
public travel. Noxious weeds shall be cut or<br />
otherwise destroyed on or before the following<br />
dates and as often thereafter as is necessary to<br />
prevent seed production.<br />
GROUP 1: June 15, 2010 for leafy spurge,<br />
perennial peppergrass, sour dock, smooth<br />
dock, sheep sorrel and buckthorn.<br />
GROUP 2: June 15, 2010 for Canadian<br />
thistle, bull thistle, other thistle belonging in<br />
genera or cirsium, Russian knapweed, quack<br />
grass, wild mustard, shatter cane and teasel.<br />
GROUP 3: July 15, 2010 for field bindweed<br />
and wild carrot.<br />
GROUP 4: July 15, 2010 for sunflower,<br />
horse nettle, perennial sow thistle, cocklebur,<br />
butter print (velvet leaf), puncture vine, poison<br />
hemlock, multi-flora rose and marijuana.<br />
2. That each person and owner in possession<br />
or control of any land in Hancock County,<br />
infested with any noxious weed, as listed above,<br />
shall adopt a program of weed destruction<br />
prescribed by the Weed Commission which<br />
in five years may be expected to destroy and<br />
will immediately keep under control such<br />
infestations of said noxious weeds.<br />
3. That all weeds other than noxious weeds<br />
on all county truck primary and local county<br />
roads and between the fence lines thereof, shall<br />
be treated by the adjoining property owners to<br />
prevent seed production on or before JULY 15,<br />
2010.<br />
4. That if the owner or person in possession<br />
or control of any land in Hancock County, Iowa,<br />
fail to comply with the foregoing orders, the<br />
Weed Commission shall cause this to be done<br />
and the expense of said work including costs<br />
of serving notice and other costs, if any, to<br />
be assessed against the land and the owners<br />
thereof.<br />
5. That the County Auditor be and she<br />
is hereby directed to cause notice of the<br />
making and entering of the foregoing order by<br />
publication in each of the official newspapers in<br />
Hancock County, Iowa.<br />

of $2,694 for work on the WW Plant project,<br />
carried unanimously.<br />
Following discussions regarding possible<br />
change orders to the WW Plant project for a<br />
SCADA System and UV Bulb Cleaner, CA to<br />
return with additional information at a future<br />
Council meeting.<br />
Motion by Drabek, seconded by Schmidt<br />
to approve a Liquor License Outdoor Service<br />
Request for an expanded outdoor service area<br />
for the VFW, carried unanimously.<br />
Following discussion regarding the property<br />
at 695 Rose, there was a motion by Voortmann,<br />
seconded by Drabek not to require replacement<br />
of a non-functional sidewalk at this time<br />
but subject to future sidewalk development<br />
guidelines, Ayes: Drabek, Schmidt, Voortmann,<br />
Nays: Smith, Absent: Bauer.<br />
Motion by Voortmann, seconded by Smith to<br />
accept the recommendation from the BOA for<br />
a front yard variance at 715 West 6th, Walter<br />
Elling, Ayes: Schmidt, Smith, Voortmann, Nays:<br />
Drabek, Absent: Bauer.<br />
Motion by Schmidt, seconded by Voortmann<br />
to accept the recommendation from the BOA<br />
for a variance in the number of required parking<br />
spaces at 150 Hwy 18 West, Al Larson, carried<br />
unanimously.<br />

to accept the bid of $4,770 from Heartland<br />
Asphalt of Mason City for street repairs at<br />
