Birds and Fish Preservation Act, amended in 1974<br />

(Laws of <strong>Tonga</strong>, 1988 Revised Edition, Volume, Chapter 125)<br />

2. In this Act-<br />

"protected area" means any area comprising land, or water, or land and water, as is<br />

specified in the Third Schedule hereto;<br />

Part ll- Protected Areas.<br />

6. The area specified in the third schedule to this Act is hereby declared as a protected<br />

area; and the Prime Minister may by Order with the consent of Privy Council amend the<br />

Third Schedule.<br />

THIRD SCHEDULE- PROTECTED AREA<br />

(Inserted by Act 24 of 1974)<br />

The following area is hereby declared to be a protected area: -<br />

The whole the lagoon in <strong>Tonga</strong>tapu known as Fanga'uta and Fangakakau, being the area<br />

lying to the South of a straight line drawn from Niutao on the northernmost point of<br />

Nukunuku Motu and including the straights known as Holeva and all mangrove<br />

foreshore.<br />

7. (1) No person may, within a protected area, and without the prior consent in writing of<br />

the Prime Minister<br />

(i) discharge or cause to be discharged into the protected area any effluent or noxious or<br />

toxic liquid of substance;<br />

(11) erect and harbour, wharf, pier, jetty or other building works, temporary or<br />

permanent;<br />

(iii) cut, damage, remove or destroy any mangrove;<br />

(iv) erect any fish-fence, or set any fish trap; or trawl or fish (including shellfish) or<br />

engage in fishing for commercial purposes;<br />

(v) carry out any boring, drilling or dredging operations.<br />

1976 Parks and Reserves Act<br />

This legislation provide for the establishment of a Parks and Reserves Authority by<br />

Cabinet. The Parks and Reserves Authority was recently established in 1998 with the<br />

following membership:<br />

� Minister for Lands, Survey and Natural Resources (as chair), and with the<br />

power to co-opt members<br />

� Director of Agriculture and Forestry<br />

� Director of Fisheries<br />

� Director of Tourism<br />

� Secretary for Lands, Survey and Natural Resources<br />

� Environmental Planning and Conservation Section (secretariat).
