Agriculture.”<br />

The Committee on Health and Sanitation, Ecology and Environmental<br />

Protection recommends that <strong>the</strong> proposed ordinance be consolidated with Proposed<br />

Ordinance Numbered PO 004-11 entitled, “Prescribing rules and regulations governing<br />

<strong>the</strong> operation <strong>of</strong> <strong>the</strong> slaughterhouse, livestock and meat inspection service in <strong>the</strong> <strong>City</strong> <strong>of</strong><br />

<strong>Baguio</strong> and amending Sections 34-G and 35 <strong>of</strong> tax Ordinance Numbered 2000-001” <strong>of</strong> <strong>the</strong><br />

Committee on Health and Sanitation, Ecology and Environmental Protection.<br />

Fur<strong>the</strong>r, that said ordinances be forwarded to <strong>the</strong> Committee on Styles for<br />

amendments and consolidation and <strong>the</strong>reafter submit said proposal to <strong>the</strong> Committee on<br />

Health and Sanitation, Ecology and Environmental Protection for study and<br />

recommendation.<br />

9. Committee Report Nr. CR 00832-11<br />

Proposed Resolution Nr. PR 0239-11 <strong>of</strong> Hon. Peter C. Fianza and Hon. Vice Mayor<br />

Daniel T. Fariñas “Urging <strong>the</strong> barangays to adopt and implement a comprehensive solid<br />

waste management system in <strong>the</strong>ir respective barangays.”<br />

The Committee on Barangay Affairs recommends that <strong>the</strong> matter be returned to <strong>the</strong><br />

proponents to consider <strong>the</strong> following matters:<br />

a. The creation and composition <strong>of</strong> <strong>the</strong> Barangay Solid Waste Management Committee<br />

is already provided for under Section 7 <strong>of</strong> <strong>the</strong> Implementing Rules an Regulations <strong>of</strong><br />

R.A. 9003, and was reiterated through DILG Memorandum Circular 2001-<strong>19</strong>, and<br />

DILG Memorandum Circular 2001-38, which has called for <strong>the</strong> creation <strong>of</strong> <strong>the</strong> said<br />

committee in <strong>the</strong> barangays;<br />

b. <strong>City</strong> Tax Ordinance No. 200-01 as amended by Tax Ordinance No. 2003-03,<br />

particularly Section 32 <strong>the</strong>re<strong>of</strong> provides for Garbage Fees, Section 32B likewise<br />

authorizes <strong>the</strong> barangays to collect garbage fees from private residence/households<br />

and apartment houses. Administrative Order No. 132, series <strong>of</strong> 2011 <strong>of</strong> <strong>the</strong> <strong>City</strong><br />

Mayor, entitled, “Intensifying <strong>the</strong> collection <strong>of</strong> garbage fees and providing <strong>the</strong><br />

guidelines for <strong>the</strong> barangay based collection system pursuant to Section 32, Chapter<br />

VII <strong>of</strong> Tax Ordinance No. 2001-001 as amended by Tax Ordinance 2003-03”, which<br />

directly provides <strong>the</strong> barangays <strong>the</strong> authority for <strong>the</strong> collection <strong>of</strong> garbage fees. The<br />

tax ordinance provides that <strong>the</strong> collection scheme employed by <strong>the</strong> barangays shall<br />

entitle <strong>the</strong>m to a 30% share from <strong>the</strong> garbage fees collected, which will be utilized by<br />

<strong>the</strong> barangay to support <strong>the</strong> Barangay Solid Waste Management Program. To provide<br />

ano<strong>the</strong>r form <strong>of</strong> collection within <strong>the</strong> barangays for <strong>the</strong> same purpose through a<br />

barangay ordinance would duplicate <strong>the</strong> fees to be collected from <strong>the</strong> constituents.<br />

c. The prohibited acts including <strong>the</strong> fines and penalties as provided for under Chapter XI<br />

<strong>of</strong> <strong>the</strong> proposed format for <strong>the</strong> barangay ordinance are already provided for in<br />

Republic Act 9003. (Item 13, 12 <strong>March</strong> 2012 Agenda)<br />

“Resolution approving <strong>the</strong> conduct <strong>of</strong> a fund raising activity and livelihood to augment funds for <strong>the</strong><br />

construction <strong>of</strong> pathway at Purok 6, Military Cut-Off Barangay through RPQ Rides and Amusement<br />

and allowing Ricky P. Quiroz operator to conduct such activity at Convention Center ground, within<br />

<strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> barangay.”<br />

The Committee on Employment, Livelihood, Cooperatives, Handicapped and<br />

Differently Abled Persons recommends approval <strong>of</strong> <strong>the</strong> above resolution subject to <strong>the</strong> condition <strong>of</strong><br />

<strong>the</strong> submission <strong>of</strong> <strong>the</strong> following requirements:<br />

a. Brief project proposal detailing <strong>the</strong> activities to be undertaken during <strong>the</strong> activity;<br />

b. Diagram and size/s <strong>of</strong> <strong>the</strong> fun rides and amusement to be installed;<br />

a. No gambling will be allowed specially for minors;<br />

b. Maintain cleanliness <strong>of</strong> <strong>the</strong> area;<br />

c. Responsible for <strong>the</strong> peace and order in <strong>the</strong> area including <strong>the</strong> deployment <strong>of</strong><br />

<strong>the</strong> Barangay Tanod or hiring <strong>of</strong> Security Guard;<br />

d. As per agreement, <strong>the</strong> management will be held responsible for <strong>the</strong> vicinity<br />

<strong>of</strong> <strong>the</strong> Convention Center.<br />

In addition, RPQ Rides and Amusement shall undertake to submit and subject all fun rides<br />

and amusement equipment to <strong>the</strong> <strong>City</strong> Engineering Office for <strong>the</strong> periodic inspection <strong>of</strong> and report <strong>of</strong><br />

<strong>the</strong> state and condition <strong>of</strong> <strong>the</strong> equipment.<br />

In <strong>the</strong> absence <strong>of</strong> <strong>the</strong> above requirements attached and duly submitted to <strong>the</strong> <strong>Council</strong>, <strong>the</strong><br />

approval, if granted during <strong>the</strong> instance <strong>of</strong> <strong>the</strong> <strong>City</strong> <strong>Council</strong> Session, shall remain ineffective until<br />

compliance shall have been met before <strong>the</strong> fund raising and livelihood activity shall commence<br />

operation. Violations <strong>of</strong> any <strong>of</strong> <strong>the</strong> foregoing conditions hereto set forth and <strong>of</strong> applicable city<br />

ordinances shall be sufficient cause for <strong>the</strong> immediate stoppage <strong>of</strong> <strong>the</strong> activity upon lawful order <strong>of</strong><br />

<strong>the</strong> <strong>City</strong> Government <strong>of</strong> <strong>Baguio</strong>.<br />

Since <strong>the</strong> supposed intended date <strong>of</strong> <strong>the</strong> fund raising/livelihood activity is on January 9,<br />

2012 – February 9, 2012 which is already behind schedule, <strong>the</strong> committee suggests, for an<br />

unextendible period <strong>of</strong> one (1) month, that it be moved to January 16 – February 16, 2012 upon<br />

compliance <strong>of</strong> <strong>the</strong> above.<br />

Moreover, after <strong>the</strong> livelihood activity is concluded, Military Cut-Off Barangay shall<br />

submit a comprehensive post-activity report, to include an audited financial report, one week<br />

immediately after <strong>the</strong> activity.<br />

Finally, Military Cut-Off Barangay is directed to strictly comply with <strong>the</strong> provisions<br />

embodied in Trade Fair Ordinance <strong>of</strong> <strong>19</strong>94 as amended by Ordinance No. 10, series <strong>of</strong> <strong>19</strong>98.<br />

submitting <strong>the</strong>ir position paper regarding <strong>the</strong> implementation <strong>of</strong> Ordinance Nr. 61, series <strong>of</strong><br />

The Committee on Laws recommends that <strong>the</strong> Clean Air Monitoring Unit (CAMU), under<br />

<strong>the</strong> <strong>City</strong> Environment and Parks Management Office, to strictly observe <strong>the</strong> following in <strong>the</strong><br />

implementation <strong>of</strong> Ordinance 61, series <strong>of</strong> 2008 “The Clean Air Ordinance <strong>of</strong> <strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Baguio</strong>”, to<br />

wit:<br />

1. After <strong>the</strong> first apprehension wherein <strong>the</strong> vehicle is found to have violated <strong>the</strong> ordinance,<br />

<strong>the</strong> same shall not be apprehended for <strong>the</strong> same violation within a period <strong>of</strong> forty five<br />

(45) days in order to give <strong>the</strong> owner/operator sufficient time to make necessary repair,<br />

adjustment, or calibration.<br />

2. The owner/driver <strong>of</strong> <strong>the</strong> vehicle, even after apprehended by <strong>the</strong> Roadside Inspection,<br />

Testing and Monitoring Team (RITMT) for apparent violation <strong>of</strong> <strong>the</strong> ordinance based<br />

on <strong>the</strong> roadside testing shall not pay any fine until after validation <strong>of</strong> <strong>the</strong> alleged<br />

Memorandum <strong>of</strong> Agreement entered into by and between KAFAGWAYAN Philippines,<br />

represented by Hon. Mauricio G. Domogan, <strong>City</strong> Mayor, <strong>Baguio</strong> <strong>City</strong>, regarding <strong>the</strong>ir<br />

intention to adopt <strong>the</strong> Lower Wright Park children’s playground at Lualhati Barangay.<br />

The Committee on Laws recommends confirmation <strong>of</strong> <strong>the</strong> above stated<br />

a. Barangay Ordinance Numbered 03, series <strong>of</strong> 2011, <strong>of</strong> Manuel Roxas Teachers’ Camp<br />

Barangay entitled, “An ordinance amending Section 4 <strong>of</strong> <strong>City</strong> Ordinance No. 09, series <strong>of</strong> 2008<br />

(penalties required for <strong>the</strong> violation on registration, vaccination and control <strong>of</strong> dogs).”<br />

(NOTE: Section 4 <strong>of</strong> <strong>City</strong> Ordinance Nr. 09, s. 2008 reads, “Section 4 <strong>of</strong> Ordinance Nr. 82, series <strong>of</strong> <strong>19</strong>48,<br />

as amended by Ordinance Nr. 61, series <strong>of</strong> <strong>19</strong>93, is hereby fur<strong>the</strong>r amended to read as follows:<br />

“Sec. 4. Penalty. A violation <strong>of</strong> Section 3 here<strong>of</strong> shall cause <strong>the</strong> immediate impounding <strong>of</strong> said<br />

animals including <strong>the</strong> vehicles used to transport <strong>the</strong>m by <strong>the</strong> police who shall take over <strong>the</strong> said animals to<br />

<strong>the</strong> proper authorities. The <strong>City</strong> Veterinarian, <strong>the</strong> Pound Keeper, Barangay Tanods, Barangay Officials or<br />

any authorized <strong>of</strong>ficer shall likewise have <strong>the</strong> authority to impound said animals. The animal shall be<br />

enumerated. Violators who commit <strong>the</strong> acts punished herein shall in addition suffer a fine <strong>of</strong> not more than<br />

ten thousand pesos (P10,000.00) and/or imprisonment for six months upon discretion <strong>of</strong> <strong>the</strong> court.<br />

Violation <strong>of</strong> Section 1 here<strong>of</strong> shall suffer a fine <strong>of</strong> not more than one thousand pesos<br />

(P1,000.00) and/or imprisonment <strong>of</strong> not more than six months upon <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> court..<br />

Fur<strong>the</strong>rmore, any <strong>of</strong>ficials or employees charged with <strong>the</strong> duties <strong>of</strong> implementing this<br />

Ordinance who shall willfully fail or neglect or refuse without any valid reason to perform <strong>the</strong>ir duties shall<br />

likewise suffer <strong>the</strong> penalty provided for violation <strong>of</strong> Section 1 and in addition <strong>the</strong>reto shall be subjected to<br />

disciplinary action as may be provided for by existing laws and regulations.”)<br />

b. Barangay Ordinance Numbered 04, series <strong>of</strong> 2011, <strong>of</strong> Manuel Roxas Teachers’ Camp<br />

Barangay entitled, “An ordinance amending <strong>the</strong> penalties in violation <strong>of</strong> <strong>City</strong> Ordinance No. 572,<br />

series <strong>of</strong> <strong>19</strong>73, Section 1 and <strong>City</strong> Ordinance No. 498, series <strong>of</strong> <strong>19</strong>69, Section 1 to be imposed within<br />

<strong>the</strong> barangay.”<br />

(NOTE: [a] Section 1 <strong>of</strong> Ordinance No. 572, s. <strong>19</strong>73 reads, “It shall be unlawful for any person/s to spit or<br />

expectorate, urinate, throw, leave or scatter pieces <strong>of</strong> paper, peelings, cigarette buts, or any kind <strong>of</strong> refuse,<br />

in public place such as parks, streets, plazas, gardens, lagoons or lakes, roads, canals, alleys, fences,<br />

walls, and inside public or o<strong>the</strong>r buildings or enclosures which are open to <strong>the</strong> public, except in receptacles<br />

that may be provided for <strong>the</strong> purpose”;<br />

[b] Section 1 <strong>of</strong> Ordinance No. 498, s. <strong>19</strong>69 reads, “It shall be unlawful for any lawful owner and or actual<br />

occupants <strong>of</strong> any property, land, house, building, tenement or construction <strong>of</strong> whatsoever nature and kind<br />

directly abutting a public street, road alley and or sidewalk to deliberately neglect <strong>the</strong> promotion and<br />

maintenance <strong>of</strong> cleanliness and sanitation <strong>of</strong> <strong>the</strong> premises or area/s <strong>of</strong> such streets, road alley and or<br />

sidewalk directly bounded by his property, land, house, building, tenement or construction.”)<br />

The Committee on Laws recommends to return <strong>the</strong> above stated barangay ordinances,<br />

without <strong>City</strong> <strong>Council</strong> approval, considering that <strong>the</strong> Sangguniang Barangay <strong>of</strong> Manuel Roxas<br />

Teacher’s Camp acted beyond its powers and authority in amending <strong>City</strong> Ordinance No. 09, series <strong>of</strong><br />

2008, <strong>City</strong> Ordinance No. 572, series <strong>of</strong> <strong>19</strong>73 and <strong>City</strong> Ordinance No. 498, series <strong>of</strong> <strong>19</strong>69.<br />

The power to amend a city ordinance is within <strong>the</strong> scope <strong>of</strong> powers <strong>of</strong> <strong>the</strong> Sangguniang<br />

Panlungsod. Moreover, a barangay ordinance cannot amend a city ordinance. (Item 35, 12 <strong>March</strong><br />

1. 2nd Indorsement dated 08 June 2009 <strong>of</strong> Hon. Isabelo B. Cosalan, Jr., returning Resolution<br />

No. 030, series <strong>of</strong> 2009, <strong>of</strong> Lower Magsaysay Barangay, entitled “Resolution approving <strong>the</strong><br />

construction <strong>of</strong> stalls at a designated area at Tabora Park/Sinkhole for <strong>the</strong> establishment <strong>of</strong><br />

Barangay <strong>Council</strong> livelihood project”, for referral to <strong>the</strong> Committee on Public Works.<br />

(NOTE: The above Barangay Resolution <strong>of</strong> Lower Magsaysay was previously referred to <strong>the</strong> Committee<br />

The Committee on Public Works recommends <strong>the</strong> grant <strong>of</strong> request <strong>of</strong> Lower Magsaysay Barangay<br />

<strong>Council</strong> embodied in its Barangay Resolution Numbered 030, series <strong>of</strong> 2009, approving <strong>the</strong> construction <strong>of</strong> stalls<br />

at a designated area at Tabora Park/Sinkhole for <strong>the</strong> establishment <strong>of</strong> Barangay <strong>Council</strong> livelihood project, it<br />

appearing that upon inspection <strong>of</strong> <strong>the</strong> area, <strong>the</strong> construction <strong>of</strong> stalls would not impede pedestrian traffic from T.<br />

Alonzo Street to Lower Magsaysay Avenue, and vice versa, <strong>the</strong> lane between <strong>the</strong>se two roads after <strong>the</strong> stalls have<br />

been constructed being wide enough to provide comfortable and convenient pedestrian access to and from <strong>the</strong> two<br />

roads.<br />

2. Letter dated 21 June 2005 <strong>of</strong> Atty. Juan B. Valdez, Counsel for Ms. Natividad P. Nisce, requesting that a<br />

resolution be enacted by <strong>the</strong> Honorable <strong>City</strong> <strong>Council</strong> to use <strong>the</strong> lot <strong>of</strong> Ms. Nisce, located along Magsaysay Road,<br />

as a public market wherein stalls <strong>of</strong> semi-permanent type may be erected to be leased to <strong>the</strong> public.<br />

The Committee on Market, Trade and Commerce recommends that <strong>the</strong> above letter be NOTED for<br />

being moot and academic. The request was made on June 21, 2005.<br />

For number 1 only, <strong>the</strong> Committee on Laws recommends favorable review <strong>of</strong> <strong>the</strong> above<br />

stated barangay resolution <strong>of</strong> Lower Magsaysay Barangay and adopts <strong>the</strong> Committee Report <strong>of</strong> <strong>the</strong><br />

<strong>the</strong> final survey plan <strong>of</strong> lot at Poliwes Barangay indicating <strong>the</strong> lot number, area and <strong>the</strong> name <strong>of</strong><br />

claimants in compliance to survey authority issued by <strong>the</strong> CENR Officer and in accordance with <strong>the</strong><br />

general conditions stated by <strong>the</strong> <strong>City</strong> Housing and Urban Development Board under PR. No. 101-<br />

1011-10-04-212.<br />

The Committee on Urban Planning, Lands and Housing recommends APPROVAL <strong>of</strong><br />

<strong>the</strong> subdivision plan <strong>of</strong> that portion <strong>of</strong> Poliwes Barangay, <strong>Baguio</strong> <strong>City</strong> as above submitted.<br />

Barangay Resolution No. 25, series <strong>of</strong> 2011, <strong>of</strong> Lucnab Barangay entitled, “A Barangay <strong>Council</strong><br />

Resolution condemning <strong>the</strong> forest arson and <strong>the</strong> building <strong>of</strong> houses without permit within Lucnab<br />

watershed committed by John Dos and fur<strong>the</strong>r requesting Honorable <strong>City</strong> Mayor Mauricio G.<br />

Domogan and Honorable Vice Mayor Daniel T. Fariñas to instigate an investigation as well as<br />

coordination with <strong>the</strong> <strong>City</strong> Health Office, <strong>the</strong> Office <strong>of</strong> <strong>the</strong> Public Order and Safety Division, <strong>the</strong><br />

Regional Training School-Philippine Public Safety Training College (RTS-PPSTC), <strong>the</strong> Department<br />

<strong>of</strong> Environment and Natural Resources (DENR), <strong>the</strong> National Telecommunications Communications<br />

and <strong>the</strong> Rotary Club (Rotary) <strong>of</strong> <strong>Baguio</strong> for <strong>the</strong>ir guidance.”<br />

The Committee on Human Rights, Justice, Public Protection and Safety, Peace and<br />

Order, after an inspection <strong>of</strong> <strong>the</strong> site, <strong>the</strong> following were observed:<br />

a. The fire covered approximately two thousand (2,000) square meters <strong>of</strong> <strong>the</strong> forest area;<br />

b. After <strong>the</strong> fire occurred, potato plants were introduced <strong>the</strong>rein;<br />

c. New shanties were constructed at <strong>the</strong> watershed including <strong>the</strong> area near <strong>the</strong> creek;<br />

thus, <strong>the</strong>re exists <strong>the</strong> possibility <strong>of</strong> <strong>the</strong> creek being contaminated by human waste.<br />

Wherefore, premises considered, <strong>the</strong> Honorable <strong>City</strong> Mayor Mauricio G. Domogan is<br />

requested to form a committee that would investigate <strong>the</strong> forest fire and <strong>the</strong> introduction <strong>of</strong> shanties<br />

in <strong>the</strong> said area.<br />

Hon. Erdolfo V. Balajadia, Member <strong>of</strong> <strong>the</strong> Committee, signified “Why not ask <strong>the</strong> Police,<br />

CEPMO and <strong>the</strong> POSD to conduct an investigation with <strong>the</strong> end in view <strong>of</strong> filing cases against those<br />

who are responsible for <strong>the</strong> alleged arson. Fur<strong>the</strong>r, recommend for <strong>the</strong> demolition <strong>of</strong> informal settlers<br />

in <strong>the</strong> watershed.”<br />

Hon. Nicasio S. Palaganas, Member <strong>of</strong> <strong>the</strong> Committee, signified “I suggest if <strong>the</strong> 1 or 2 days<br />

investigation finds that crimes have been committed in this case, <strong>the</strong> shanties be immediately demolished<br />

Proposed Resolution Nr. PR 0112-11 <strong>of</strong> Hon. Betty Lourdes F. Tabanda “Requesting <strong>the</strong> <strong>City</strong><br />

Buildings and Architecture Office to conduct a physical/structural status inspection with<br />

recommendations <strong>of</strong> all day care centers in <strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Baguio</strong>.”<br />

The Committee on Human Rights, Justice, Public Protection and Safety, Peace and<br />

Order recommends APPROVAL <strong>of</strong> <strong>the</strong> aforementioned proposed resolution taking into<br />

consideration <strong>the</strong> letter <strong>of</strong> Engr. Oscar V. Flores, <strong>City</strong> Government Department Head II, <strong>City</strong><br />

Honorable Secretary Ramon J. P. Paje, Department <strong>of</strong> Environment and Natural Resources to cause<br />

<strong>the</strong> finalization <strong>of</strong> <strong>the</strong> special guidelines for <strong>Baguio</strong> <strong>City</strong> with clarity and in coordination with <strong>the</strong><br />

Local Government <strong>of</strong> <strong>Baguio</strong> to avoid possible legal and o<strong>the</strong>r complexities that may arise relative to<br />

<strong>the</strong> acceptance and processing <strong>of</strong> applications for free patent and <strong>the</strong> subsequent issuance <strong>of</strong> patent<br />

in <strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Baguio</strong> pursuant to RA 10023.”<br />

a. Than an inspection Team to ascertain <strong>the</strong> occupancy <strong>of</strong> settlers including <strong>the</strong> inventory <strong>of</strong><br />

qualified under RFPA, shall be created to be composed <strong>of</strong> <strong>the</strong> members <strong>of</strong> <strong>the</strong> <strong>City</strong><br />

Housing and Urban Development Board and <strong>the</strong> Barangay <strong>Council</strong>. This team shall be <strong>the</strong><br />

authorized entity to issue <strong>the</strong> necessary certification that an applicant is indeed in actual<br />

occupation <strong>of</strong> <strong>the</strong> subject property for ten (10) or more years.<br />

b. That no subdivision <strong>of</strong> approved plans <strong>of</strong> pending TSA or MSA applications shall be done<br />

for <strong>the</strong> purpose <strong>of</strong> converting <strong>the</strong> same to RFPA.<br />

c. That <strong>the</strong> required certification as to whe<strong>the</strong>r <strong>the</strong> applied lot falls within a residential zone<br />

Letter dated 09 February 2012 <strong>of</strong> Hon. Mauricio G. Domogan, <strong>City</strong> Mayor, <strong>Baguio</strong> <strong>City</strong>, suggesting<br />

<strong>the</strong> following guidelines to be considered for <strong>the</strong> use <strong>of</strong> <strong>the</strong> Ten Commandments monument including<br />

its facilities pursuant to Resolution Numbered 382, series <strong>of</strong> 2011:<br />

1. Permit to use <strong>the</strong> said facilities for more than one hour must be secured from <strong>the</strong><br />

Mayor’s Office, except for walk in visitors/guests;<br />

2. The amount <strong>of</strong> Php ____ shall be collected as users’/permit fee to defray expenses for<br />

electricity, water and maintenance;<br />

3. For record purposes, all visitors, guests and participants <strong>of</strong> programs within <strong>the</strong><br />

building must register at <strong>the</strong> main floor <strong>of</strong> <strong>the</strong> building;<br />

4. Order and cleanliness inside and outside <strong>the</strong> building must be maintained at all times;<br />

6. Cooking, smoking, gambling and taking <strong>of</strong> alcoholic drinks are not allowed inside <strong>the</strong><br />

In addition, Nicole and Nico Amusement Center shall undertake to submit and subject all<br />

fun rides and amusement equipment to <strong>the</strong> <strong>City</strong> Engineering Office for <strong>the</strong> periodic inspection and<br />

report <strong>of</strong> <strong>the</strong> state and condition <strong>of</strong> <strong>the</strong> equipment.<br />

Fur<strong>the</strong>r, Military Cut-Off Barangay is directed to secure a letter from <strong>the</strong> authorized<br />

<strong>of</strong>ficial/s <strong>of</strong> Quezon Elementary School interposing no objection for <strong>the</strong> use <strong>of</strong> <strong>the</strong> school grounds as<br />

additional documentary attachment to <strong>the</strong> resolution.<br />

Violations <strong>of</strong> any <strong>of</strong> <strong>the</strong> foregoing conditions hereto set forth and <strong>of</strong> applicable city<br />

ordinances shall be sufficient cause for <strong>the</strong> immediate stoppage <strong>of</strong> <strong>the</strong> activity upon lawful order <strong>of</strong><br />

<strong>the</strong> <strong>City</strong> Government <strong>of</strong> <strong>Baguio</strong>.<br />

Since <strong>the</strong> supposed intended date <strong>of</strong> <strong>the</strong> fund raising/livelihood activity is from <strong>March</strong> 1,<br />

2012 - April 30, 2012 which is already behind schedule, <strong>the</strong> committee suggests, for an unextendible<br />

period <strong>of</strong> two (2) months, that it be moved to <strong>March</strong> 16 - May 15, 2012 upon compliance <strong>of</strong> <strong>the</strong><br />

above.<br />

Moreover, after <strong>the</strong> livelihood activity is conducted, Military Cut-Off Barangay shall<br />

submit a comprehensive post-activity report, to include an audited financial report, one week<br />

immediately after <strong>the</strong> activity.<br />

Vice Mayor Daniel T. Fariñas, requesting that <strong>the</strong> amusement tax be waived for <strong>the</strong> event <strong>of</strong><br />

URCC <strong>Baguio</strong> IV dubbed “Battlegrounds” on February 18, 2012 at <strong>the</strong> <strong>Baguio</strong> Convention<br />

Center. This was NOTED during <strong>the</strong> 20 February 2012 Regular Session.)<br />

The Committee on Ways and Means and Finance, Cluster B, reiterates its previous<br />

recommendation for APPROVAL <strong>of</strong> <strong>the</strong> foregoing request and that <strong>the</strong> necessary ordinance in<br />

relation <strong>the</strong>reto be APPROVED on First Reading dispensing with <strong>the</strong> Second and Final Readings.<br />

66. Committee Report Nr. CR 0118-12<br />

Barangay Resolution No. 25, series <strong>of</strong> 2010, <strong>of</strong> Honeymoon-Holy Ghost Barangay entitled, “A<br />

resolution <strong>of</strong> nonacceptance and objection <strong>of</strong> implemented renovation <strong>of</strong> waiting shed at<br />

Honeymoon-Holy Ghost Barangay.”<br />

The Committee on Barangay Affairs recommends that <strong>the</strong> matter be RETURNED to<br />

Honeymoon-Holyghost Barangay and so with all o<strong>the</strong>r barangays where similar waiting sheds were<br />

constructed ad had submitted similar resolutions, for <strong>the</strong> new set <strong>of</strong> barangay <strong>of</strong>ficials to study <strong>the</strong><br />

said resolutions and for <strong>the</strong>m to come up with <strong>the</strong>ir own recommendations regarding <strong>the</strong> said matter<br />

so that <strong>the</strong> committee be updated. The said updated recommendations to be submitted to <strong>the</strong><br />

Barangay Affairs Committee will be <strong>the</strong> basis for action on <strong>the</strong> issue.<br />

<strong>the</strong> whole year round.”<br />

The Committee on Tourism, Special Events, Parks and Playgrounds<br />

recommends that <strong>the</strong> above proposed resolution be APPROVED.<br />

The Committee on Laws recommends favorable review <strong>of</strong> <strong>the</strong> above stated<br />

Letter dated 20 February 2012 <strong>of</strong> Ms. Leonora B. Guinid, et al., requesting an<br />

investigation whe<strong>the</strong>r or not Mr. Marianito Bagbagen Jr. has complied with Resolution No.<br />

010, s. 2011 as <strong>the</strong> project contractor for <strong>the</strong> development <strong>of</strong> Block 4, <strong>Baguio</strong> <strong>City</strong> Market.<br />

(NOTE: Resolution No. 010, s. 2011 resolved that <strong>the</strong> plans and specification relative to <strong>the</strong><br />

development <strong>of</strong> Block 4, <strong>Baguio</strong> <strong>City</strong> Public Market be submitted to <strong>the</strong> <strong>City</strong> <strong>Council</strong> and that<br />

<strong>the</strong> contract relative to that development must first be confirmed by <strong>the</strong> <strong>City</strong> <strong>Council</strong> before it<br />

will proceed.)<br />

(NOTE: [a] Section 32 B <strong>of</strong> Tax Ordinance 2000-001 as amended by Tax Ordinance 2003-<br />

03 reads, “The <strong>City</strong> Treasurer may deputize <strong>the</strong> Barangay Treasurers, when and where<br />

possible, to collect from private residences/households and apartment houses <strong>the</strong> garbage<br />

fees herein imposed. Deputized Barangay Treasurers may collect only from private<br />

residents/households and apartment residents, and not from business proprietors.<br />

Barangays collecting garbage fees from <strong>the</strong>ir constituents are entitled to 30%<br />

share <strong>of</strong> <strong>the</strong> collection and additional share as incentive for 80%, 90% and 100% collections.<br />

A discount <strong>of</strong> 10% shall be given to taxpayers who are prompt and up-to-date in <strong>the</strong> payment<br />

<strong>of</strong> <strong>the</strong>ir garbage fees. A 10% surcharge and 1% interest per month on <strong>the</strong> fees to be paid<br />

shall be collected for failure to pay <strong>the</strong> said fees within <strong>the</strong> prescribed period.<br />

Billing will be done quarterly, but payment should be made on or before <strong>the</strong> 20 th<br />

day <strong>of</strong> <strong>the</strong> month following.”<br />

Officer and Chairperson, BAC for Infrastructure, forwarding <strong>the</strong> request <strong>of</strong> Punong<br />

Barangay Romulo L. Wayway, Honeymoon-Holyghost Barangay, for <strong>the</strong> cancellation and<br />

revision <strong>of</strong> <strong>the</strong> old plan <strong>of</strong> <strong>the</strong>ir proposed satellite market from concrete to temporary stalls.<br />

The Bids and Awards Committee is <strong>of</strong> <strong>the</strong> view that <strong>the</strong> Honorable August Body’s approval is<br />

indispensable for its implementation considering that <strong>the</strong> impediment is a road right-<strong>of</strong>-way.<br />

[b] Undated letter <strong>of</strong> former Punong Barangay Charles P. Ancheta Sr., Honeymoon-<br />

Holyghost Barangay to Hon. Vice Mayor Daniel T. Fariñas, certifying that <strong>the</strong> proposed site for<br />

<strong>the</strong> establishment <strong>of</strong> a satellite market at Honeymoon-Holyghost Barangay is not a part <strong>of</strong> <strong>the</strong><br />

barangay road right-<strong>of</strong>-way. This was forwarded to <strong>the</strong> Committee on Market, Trade and<br />

Commerce on 09 February 2010.)<br />
