Information<br />

Port Control is manned 24 hours a day and is equipped with the latest radar and<br />

communications equipment, on VHF Channel 14.<br />

Marina staff can be contacted on VHF Channel 80, when entering the Royal <strong>Harbour</strong>. During<br />

the summer period the marina staff will allocate a suitable berth for you. During the winter<br />

period you will be instructed to take any vacant berth, unless they are marked ‘Reserved’.<br />

Inner Marina used by permanent berth holders, with access approximately two hours<br />

each side of high water.<br />

Western Marina is found on the left hand side as you enter the Royal <strong>Harbour</strong> Marina,<br />

used by permanent berth holders and visitors.<br />

Eastern Marina is found directly ahead as you enter the Royal <strong>Harbour</strong> Marina, used by<br />

fishing, angling and visiting boats.<br />

Security is 24 hours with CCTV surveillance.<br />

Live on board vessels only with written consent of the <strong>Harbour</strong> Master<br />

Tradesmen working in the <strong>Harbour</strong> All tradesmen working for hire on boats within the<br />

Royal <strong>Harbour</strong> Marina must have insurance and a licence, available from the harbour office.<br />

Ramsgate Royal<br />

<strong>Harbour</strong> Marina<br />

Thanet District Council is the owner and operator of the stunning<br />

Royal <strong>Harbour</strong> Marina which was developed in 1976. The Gold<br />

Anchor Award complex now offers 700 finger moorings, serviced<br />

by first class amenities and security, in a picturesque and historic<br />

harbour setting outshining many Mediterranean marinas.<br />

Situated on the South East tip of England, the Royal <strong>Harbour</strong><br />

Marina offers an unrivalled location with 24 hour access to our<br />

Outer Marina. Our position, just 35 miles from the French coast<br />

and with sheltered, but challenging waters immediately outside<br />

the harbour, offers a great experience and location for mariners.<br />

To enhance our status as the premier marina in the South East,<br />

we are constantly improving our customer services and facilities<br />

which include a 40 tonne “Wise” boat hoist, chandlery, sail loft<br />

and slipways. In addition to these services, we also provide a<br />

fuel barge that supplies petrol and diesel 365 days a year, a<br />

Port Control centre which is manned 24 hours a day, equipped<br />

with the latest radar and communication equipment listening<br />

on VHF channel 14, CCTV security and free WIFI access in the<br />

marina.<br />

We enjoy close links with the Royal Temple Yacht Club, overlooking<br />

the Royal <strong>Harbour</strong> and Marina. The club hosts a higher number of<br />

visiting yachts than any other in the country and is well known for<br />

its great hospitality. Visiting yachtsmen are warmly welcomed<br />

and may use all facilities, including accommodation and<br />

dining. In addition the club runs its own Navigation School and<br />

has an international reputation for hosting world and national<br />

championships. The hugely popular Ramsgate Regatta<br />

Week takes place each year and is a testament to the club’s<br />

experience in this field.<br />

Water and electricity<br />

240volt/16amp electricity is available on all berths, together with a fresh<br />

water supply.<br />

Amenities<br />

The facilities, which are accessible by key-code 24 hours per day,<br />

include showers, toilets and coin operated laundry facilities.<br />

Trolleys<br />

Coin operated trolleys are available at the bottom of the walkways.<br />

Please be considerate to others by returning the trolleys to the allocated<br />

area.<br />

Boat Hoist<br />

A 40 tonne boat hoist is available by appointment via the harbour office.<br />

Fuel<br />

Both diesel and petrol are available. (Summer hours 0700-1900. Winter<br />

hours 0800-1800)<br />

Rubbish and recycling collection<br />

A number of large bins and bottle banks are located around the harbour<br />

area. We ask that all domestic rubbish be placed in the bins provided.<br />

Bunkering<br />

Is NOT PERMITTED in the inner harbour.<br />

Waste Oil/Oily Water<br />

The disposal facility for both waste oil and oily water is located in the<br />

boat park.<br />

Outer marina mooring<br />

Inner marina permanent berth holders are permitted to use the outer<br />

marina visitor pontoons without charge for up to two tides, if you are<br />

unable to get back to your own berth because the gates are closed or<br />

you need to take your boat to the outer marina before the gates close.<br />

This period will only be extended while your vessel is unable to move or<br />

be towed due to bad weather. Should you require assistance to be towed<br />

back to your berth please contact the duty Dockmaster on 01843 572110<br />

or on VHF channel 80. There may be a charge for this service.<br />

Car parking<br />

Marked parking areas can be found on the crosswall, where a valid<br />

parking permit should be displayed. Any vehicle found illegally parked<br />

will be subject to a fixed penalty parking fine.<br />

Rubbish and Recycling Collection<br />

Please ensure that you dispose of all waste and recycling in the<br />

appropriate facilities provided within the marina.<br />

It is imperative that no refuse, sewage or waste oil be thrown overboard.<br />

Slipways<br />

Are available in the inner marina and there is one close to the East marina, with a maximum weight of<br />

fve tonnes. You may book via the harbour office or the duty Dockmaster.<br />

Pets<br />

Further to Thanet District Council’s decision to remove Byelaw 44 there is a requirement to give notice<br />

to the Government of their intentions. In this interim period customers are being permitted to bring their<br />

pets to Ramsgate, providing that, the animal has come from a UK port of departure. Should a customer<br />

wish to bring a pet from mainland Europe they should make use of the ‘Pet Passport’ scheme. The<br />

nearest point of entry for this is via the ferry operations at Dover port. Customers are reminded that<br />

animals must be kept on a lead and fouling of any area will not be tolerated.<br />

Weather forecasts<br />

Local area weather forecasts are displayed on a daily basis at the marina office.<br />

Byelaws<br />

Thanet District Council, in exercise of the powers conferred on it by Section 83 of the <strong>Harbour</strong>s, Docks<br />

and Piers Clauses Act 1847, as incorporated in to Section 3(2) of the Ramsgate Corporation Act 1934,<br />

are subject to the Regulations of Ramsgate <strong>Harbour</strong> Byelaws, a copy of which are available from the<br />

harbour office.<br />

Health & Safety<br />

We comply with Health and Safety Executive legislation and have a strong health and safety culture at<br />

the Port of Ramsgate.<br />

Visiting Boats – Payment Terms<br />

1. It is the responsibility of the vessel owner* to notify the council of their arrival in the marina providing<br />

adequate identification, address and details of the vessel.<br />

2. At that time they should state the expected duration of their stay and pay the appropriate charges.<br />

Visiting craft are not entitled to any credit arrangements unless they can show written approval of the<br />

<strong>Harbour</strong> Master.<br />

3. Appropriate charges based on per 24 hours or part thereof / per week / per 28 days<br />

4. The council has a possessory lien on the vessel until all sums payable are paid.<br />

5. Any visiting craft found not to have paid or not willing to pay or whatever reason may be moved to a<br />

location chosen by the council and will not be released until full payment of the accrued charges in<br />

accordance with the tariff has been received by the council.<br />

6. Any vessel leaving without paying their harbour charges in full will be invoiced an additional charge for<br />

leaving without paying in full in addition to any sums outstanding. Any invoices remaining unpaid will be<br />

collected via the council’s recovery section.<br />

*Owner shall include lawful owner, charterer, master or agency, or any other person for the time being lawfully in charge,<br />

other than the council, of a vessel.<br />

The recommended track for small vessels is the south of the<br />

buoyed channel, there is a holding ground to the south of the<br />

southern breakwater should you need to wait before entering the<br />

harbour.<br />

The tide sets across the harbour entrance in a NE’ly / SW’ly<br />

direction with the north going tide running from about 1¼ hours<br />

to HW to four hours after HW.<br />

Entry and exit procedure<br />

Ramsgate Port Control should be contacted on VHF Channel<br />

14 on approaching and before leaving the port. The marina<br />

staff may be contacted on VHF Channel 80 whilst in the Royal<br />

<strong>Harbour</strong>. To obtain lock gate information contact the Dock Office<br />

on VHF Channel 14.<br />

Signal lights on the East Pier control movements in and out<br />

of the Royal <strong>Harbour</strong> and in the approach channel.<br />

of the inner marina.<br />

THREE VERTICAL RED LIGHTS indicate that a vessel may<br />

not enter the approach channel or the inner marina, or leave<br />

the outer harbour.<br />

THREE VERTICAL GREEN LIGHTS indicate that a vessel<br />

may enter the approach channel or the inner marina, or leave<br />

the outer harbour.<br />

FLASHING ORANGE LIGHT indicates a ferry movement is in<br />

progress, no vessel should enter the approach channel or<br />

leave the Royal <strong>Harbour</strong>.<br />

Please note that there are frequent movements of large vessels<br />

taking place and small craft are advised to keep clear of such<br />

traffic.<br />

Historic<br />

Ramsgate<br />

Ramsgate is justifiably proud of its status as the only<br />

Royal <strong>Harbour</strong> in the UK and can trace its history back<br />

261 years when, following the Great Storm, Parliament<br />

passed an act giving approval for construction of a new<br />

<strong>Harbour</strong>. King George IV granted its Royal designation<br />

in 1821 in appreciation of the town’s hospitality when he<br />

embarked, with the Royal Squadron, from Ramsgate<br />

for Hanover. To show their appreciation, the townsfolk<br />

and trustees of the harbour constructed the Obelisk at<br />

<strong>Harbour</strong> Parade.<br />

Ramsgate Royal <strong>Harbour</strong> has played an important<br />

role throughout recent history. It was one of the main<br />

embarkation harbours during the Napoleonic wars,<br />

resulting in many of Ramsgate’s streets being named<br />

to commemorate the association with this period in<br />

its history, including the harbour’s main thoroughfare,<br />

Military Road. The promenades and crescents that<br />

overlook the harbour are reminiscent of this rich period<br />

in Ramsgate’s history too and their fine architecture<br />

provide a stunning backdrop to the marina.<br />

Smack Boys<br />

The Sailors’ Church and <strong>Harbour</strong> Mission, close by<br />

the foot of Jacob’s Ladder was built in 1878 by Canon<br />

Eustace Brenan, vicar of the nearby Christ Church. He<br />

saw the need for spiritual guidance and physical help for<br />

the men and boys who made up the crews of the sailing<br />

smacks who fished out of Ramsgate in the nineteenth<br />

century. It was dangerous, arduous work, especially for<br />

the young apprentices who were called Smack Boys.<br />

When the apprentices were ashore, they were provided<br />

with some comfort in the rooms above the church and<br />

later, in the Smack Boys Home next door.<br />

Smack Boys continued<br />

The use of the Home slowly changed to receiving sailors that had been rescued, mostly<br />

from wrecks on the Goodwin Sands. Later some 3,300 survivors of the First World War<br />

are known to have been fed, clothed, sheltered and medically treated there.<br />

Today the church offers the visitor a quiet place for rest, reflection and prayer. Visitors<br />

can enjoy the small collection of model ships and paintings and during the summer<br />

months refreshments are provided by church members.<br />

Services are held every Sunday afternoon between June and September, Sea Sunday<br />

in July as well as a special service at Christmas are celebrated. Seafarers are especially<br />

welcome to join the Ramsgate community.<br />

Operation Dynamo<br />

In WWII during May and June 1940 Operation Dynamo was launched and an odd<br />

assortment of yachts, motor cruisers, fishing boats and other small craft assembled in<br />

Ramsgate, before crossing to Dunkirk to ferry men from the beaches to waiting ships.<br />

These “Little Ships”, like the men waiting on the beaches, were under constant attack<br />

from German aircraft and guns, and of 765 vessels involved in the operation, almost a<br />

third were lost. Despite heavy losses the valiant “Little Ships” assisted in the rescue of<br />

309,739 troops, around 40,000 of whom were landed at Ramsgate. Today, one of the<br />

boats used in the evacuation is kept in the marina and the harbour was proud to host<br />

the 50th, 60th, 65th, 70th, 75th anniversary celebrations.<br />

Clock House<br />

Built by some of the most eminent civil engineers and architects of the early nineteenth<br />

century, the Clock House, on the harbour quayside is an exhibit in itself. It is also site<br />

of the unique Ramsgate Meridian, from which the town’s own particular Mean Time, 5<br />

minutes 41 seconds ahead of Greenwich, was calculated.<br />

Maritime Museum<br />

Situated in the Clock House on the east crosswall, Ramsgate Maritime Museum focuses<br />

strongly on Ramsgate and its immediate environs, with a brief introduction to the rest<br />

of the region’s maritime past. The Museum building is an exhibit in its own right, being<br />

the product of some of the most eminent civil engineers and architects of the early<br />

19th century. The Clock House is also the site of the unique Ramsgate Meridian -<br />

from which its own particular Mean Time - 5 mins 41 secs ahead of Greenwich- was<br />

calculated! There are four galleries of exhibits telling the maritime history of the area with<br />

permanent displays on the development of the <strong>Harbour</strong>, Navigation, Fishing, Lifeboats<br />

and Shipwrecks. A fifth area, the Gallery Room, is now an exhibition space which is host<br />

to ever changing displays and events, including visiting local artists at work.<br />

Out and About<br />

in Thanet<br />

The museum’s historic vessels, include the famous Dunkirk Little Ship “Sundowner” and<br />

Steam Tug “Cervia”, which is undergoing an impressive restoration, gradually returning<br />

this handsome tug to her former glory. Visitors can marvel at her massive triple expansion<br />

engine, which can be seen running under steam during special events. For full details on<br />

Ramsgate<br />

Ramsgate’s town centre, set in a delightful pedestrian precinct and catering for the most<br />

discerning shoppers with popular retail outlets. Everything is on offer, from antiques,<br />

fashion and kitchenware to fresh local produce and supermarket delivery service to your<br />

vessel in the marina. Meanwhile, when you feel the need for a little pampering, beauty<br />

salons, hairstylists and pavement cafés offer a relaxing and welcome break.<br />

Ramsgate has its own award-winning beach with safe swimming for families. Fringing<br />

the beach, which offers all the traditional family attractions, you will find pavement cafés<br />

and bars and a delectable Italian ice cream parlour.<br />

In the evening you will be spoilt for choice for dinner or drinks.<br />

The waterfront and surrounding town is home to a number of<br />

nationally renowned restaurants - many specialising in local produce, fish and seafood.<br />

The Loop Bus Service:<br />

‘The Thanet Loop’ is one of the most frequent services in the UK, running on average<br />

every seven minutes and operates seven days a week, from early morning until late<br />

evening. This inexpensive service can be picked up from the marina and provides<br />

excellent connections between Ramsgate, Broadstairs and Margate.<br />

Broadstairs<br />

Just ten minutes by car, or if you prefer a 30 minute cliff top stroll away, is the picturesque<br />

and unspoilt town of Broadstairs. With its roots firmly in the past Broadstairs has changed<br />

little in character since Charles Dickens lived and worked at Bleak House. Today though,<br />

it offers the discerning visitor a sophisticated choice of restaurants and bars, many of<br />

them fronting Viking Bay, the town’s beach. Throughout the summer months you can<br />

enjoy firework displays, the annual Dickens Week in June and during August, the famous<br />

Broadstairs Folk Festival fills the town with performers and visitors.<br />

Margate<br />

Margate is one of the oldest seaside resorts dating back three<br />

centuries. Signs of change are everywhere, particularly in the<br />

newly established café culture. The town has also attracted the<br />

attention of the contemporary arts scene and is the home for the<br />

new Turner Contemporary gallery which opened in April 2011. The<br />

Old Town adjacent to the gallery site has become the focus for a<br />

massive regeneration programme focusing on cultural industry<br />

and is now home to some fascinating and unique businesses.<br />

Its long sandy beaches, clean seas and magnificent skies<br />

attracted Turner and many others to paint here. There are a<br />

number of events that take place every year during the Summer<br />

with free performances on the seafront Piazza.<br />

Dreamland<br />

This theme park hosting heritage and vintage rides, including<br />

the famous Grade II scenic railway, is a must for thrill seekers.<br />

Thanet’s beautiful beaches<br />

Thanet has 26 miles of coastline and 15 sandy bays or beaches<br />

that pleat and fold their way around the coast from Minnis Bay<br />

in the north to Pegwell Bay in the south.<br />

Our award winning bays hold the promise of great days spent<br />

sunbathing and swimming with nothing to mark the time,<br />

except the rise and fall of the tide. Or, on those days when<br />

you are feeling more active you will find a fantastic range of<br />

choices all around our coast including:<br />

The 28-mile circular Viking Coastal Trail is one of the most<br />

attractive leisure cycle routes in Kent, taking in some spectacular<br />

With pick-ups from the Marina, the Thanet Loop bus service,<br />

running every ten minutes, will give you easy access to the new<br />

town centre, Westwood Cross where you will find leading High<br />

as major supermarkets, restaurants, casino and multiplex cinema.<br />

Canterbury<br />

Just 16 miles from Thanet and easily accessible by train,<br />

car or bus is the historic city of Canterbury. With its medieval<br />

cathedral, architecture and well developed shopping centre,<br />

it has a world wide appeal and attracts thousands of visitors<br />

from abroad and the UK.<br />

Sandwich<br />

Set on the River Stour, five miles south of Ramsgate <strong>Harbour</strong><br />

and three miles upstream of Pegwell Bay is Sandwich, one<br />

of the oldest members of the Cinque Ports. It is one of the<br />

most historic towns in the country, with the street plan having<br />

changed little since the time of Doomsday in 1086.<br />

the town quay, whilst deep draft yachts should only enter the<br />

river at the top of the tide. Beyond the Toll Bridge, which can<br />

Fordwich, 12 miles upstream with air draft restrictions<br />

London and beyond<br />

If you want to let the train take the strain then the High Speed<br />

rail line will connect you to London and beyond in just over an hour.<br />

centre of London. Take the well signposted A299 Thanet<br />

development by implementing the following environmental policy, with the aim of<br />

minimising the environmental impact of operations.<br />

Help Us to Achieve Our Commitment to Promote Best Environmental<br />

Practice in the Operation of Our Marina<br />

(Version 1.0)<br />

To ensure that all hazardous wastes are disposed of correctly:<br />

• Dispose of all waste oils and oily water in the appropriate containers at the dedicated<br />

waste facility in the boat park.<br />

• Ensure that all batteries deposited in the appropriate area the marina (If in doubt ask<br />

a member of staff).<br />

To minimise waste going to landfill and to recycle wherever possible:<br />

• Reduce, re-use and recycle. Use the recycle facilities provided in the marina.<br />

To use resources sustainably:<br />

• Consider electric or bio-diesel engines, water lubricated stern glands or vegetable oils.<br />

• Ensure wood is sourced from responsibly managed forests.<br />

To ensure that the waters are clean and healthy to sustain wildlife:<br />

• Ensure the legal limit for hydrocarbon discharges into water is maintained (1 drop<br />

per 2 litres of water or 15mg/litre).<br />

• Detergents may disperse oil from the water surface and reduce the visual impact, but<br />

they can be toxic to aquatic life in themselves.<br />

• Chose environmentally sensitive cleaning products and detergents which do not<br />

contain chlorine, bleach, ammonia and phosphates. These are all harmful to the<br />

environment. Use fresh water or non-toxic alternatives for your onboard sinks,<br />

showers and washing machines. Most heavy duty cleaning products contain<br />

chemicals which disrupt the natural reproduction cycle of fish.<br />

• Check bilge water for contaminants prior to pumping, and to use an oil absorbent<br />

sock if any are found.<br />

• Ensure loose items, packaging and waste are secure and can not be blown or roll<br />

over the side. If items end up in the water, retrieve them.<br />

To minimise disturbance to wildlife and damage to habitats:<br />

• When going ashore, use recognised landing places. Shallow sea beds and<br />

shoreline habitats are often diverse habitats for flora and fauna, nesting birds and<br />

other breeding species.<br />

• Find out if the area you are visiting is protected, and why. Dropping and dragging<br />

your anchor may be damaging vulnerable species and habitats.<br />

• If you spot whales or dolphins, maintain a constant speed and direction. They will be<br />

more likely to come over and play in your bow wave.<br />

• Use environmentally friendly anti-fouling products; avoid those which contain toxic<br />

copper compounds. Use water based paints wherever possible or those containing<br />

a low VOC (volatile organic compound)<br />

• Contribute and support the EU Habitats and Birds Directive through the<br />

TERMS & CONDITIONS<br />

Ramsgate Royal <strong>Harbour</strong> Marina is owned and operated by Thanet<br />

District Council.<br />

1. Definitions “The Council” shall mean Thanet District Council. “The<br />

Marina” shall include any area of the Council’s estate on land or on<br />

water (including the boat park and any area on or beneath the surface<br />

of the water) and any other facility provided by the Council for use as<br />

harbour facilities.<br />

The “Owner” shall include a lawful owner, charterer, master or agency<br />

or any other person for the time being lawfully in charge (other than the<br />

Council) of a vessel berthed within the Marina.<br />

“The <strong>Harbour</strong> Master” shall include Port Control and all persons acting<br />

with the authority of the Council and fulfilling the role of <strong>Harbour</strong> Master.<br />

2. Entirety These Terms & Conditions should be read in their entirety.<br />

3. Arrival It is the Owner’s responsibility to notify the Council of his<br />

arrival at the Marina forthwith and to provide the Council with adequate<br />

identification and details of any vessel or other items of property<br />

belonging to the Owner brought into the Marina.<br />

4. Acceptance Entry into the Marina indicates recognition and<br />

acceptance of these Terms & Conditions which govern use of the<br />

Marina and set out the obligations that the Owner must observe when<br />

using the Marina. Upon acceptance of the Owner’s application for a<br />

berth within the Marina, the Council will grant the Owner a licence,<br />

upon these Terms & Conditions, to use such berth as is from time<br />

to time allocated to the Owner by the Council. Without prejudice<br />

to the requirement on the Owner to apply for a berth, the current<br />

Royal <strong>Harbour</strong> Marina Schedule of Fees and Charges will apply with<br />

immediate effect in respect of the Owner’s use of the marina.<br />

5. <strong>No</strong>n-Exclusive Use <strong>No</strong>thing in these Terms & Conditions shall<br />

entitle the Owner to the exclusive use of a particular berth and no<br />

estate, right or interest therein shall be implied or deemed to be granted<br />

hereunder. Under no circumstances does any form of Landlord and<br />

Tenant relationship arise under these Terms & Conditions in relation to<br />

the use of any berth within the Marina.<br />

6. Assignment A licence granted to the Owner for the use of a<br />

specified berth within the Marina (“the berth”) is personal to the Owner<br />

and shall relate to a named vessel (“the vessel”). The Owner shall not<br />

lend sublet, assign or transfer the berth any other person nor shall the<br />

Owner use the berth for any other vessel unless the Owner has the<br />

Council’s prior written consent.<br />

7. Council use of Berth The Council reserves the right to use or let<br />

out the berth whenever the vessel is absent and without refunding the<br />

berth licence fee. The Owner undertakes to give the Council at lease<br />

24 hours prior notice of intention to return to the Marina, failing which<br />

the Council accepts no liability should there not be a suitable alternative<br />

berth available upon the Owner’s return, this being without prejudice to<br />

the Owner’s obligation to pay the berth licence fee.<br />

8. Live On-Board Restrictions Except with the prior written consent<br />

of the Council by the <strong>Harbour</strong> Master, no person shall use or permit<br />

the use of the vessel in the Marina as the only or main place of abode<br />

of any person and, without prejudice to the foregoing, no person shall<br />

use or permit the use of the vessel as accommodation for more than<br />

21 consecutive days nor for more than one 180 days in total in any<br />

calendar year.<br />

9. <strong>No</strong>tify Changes The Owner shall keep the Council informed<br />

in writing of any change in the name of the vessel or change of the<br />

address, telephone number or other details of the Owner.<br />

10. Vacating the Owner is required to give 28 days written notice to the<br />

Council before vacating the berth. Failure to do so may incur additional<br />

charges (see “Recalculating of Charges Upon <strong>No</strong>tice” at paragraph 35).<br />

11. Vessel Sale Within seven days of any sale or transfer of the<br />

vessel, the Owner shall notify the Council of the name and address<br />

of the purchaser or transferee as the case may be and provide a copy<br />

of the Bill of Sale or Transfer to the Council. The Owner shall notify<br />

the purchaser or transferee that the permission to use the berth is not<br />

assignable and shall ensure that the terms of sale state that a new<br />

application to the Council needs to be made for use of the berth. Until<br />

such time as such application has been accepted by the Council, the<br />

Owner shall continue to be liable under these Terms & Conditions.<br />

12. Payment The Owner shall pay any valid invoice submitted in<br />

respect of the berth or any other goods and service provided by the<br />

Council upon receipt of the invoice unless other terms have been<br />

expressly agreed in writing. Payment shall be deemed to be made<br />

when cleared into the Council’s account.<br />

13. Interest The Council reserves the right to charge interest at 2%<br />

above NatWest base rate on invoices remaining outstanding over 30<br />

days after the date of the invoice.<br />

14. Unpaid Accounts Any accounts remaining unpaid at the end of 60<br />

days after the same shall be due may be referred to the Council’s Debt<br />

Recovery Section and the costs of any proceedings or bailiffs charges<br />

will be added to the outstanding debt and recovered accordingly.<br />

15. Lien The Council shall have a lien upon the vessel until all sums<br />

payable by the Owner to the Council in respect of the vessel have been<br />

paid and the Council expressly reserves the right to claim a possessory<br />

lien upon the vessel in respect of any money claim.<br />

16. Termination The Council shall have the right (without prejudice<br />

to any other rights in respect of breaches of these Terms & Conditions<br />

by the Owner) to terminate the licence granted to the Owner in the<br />

following manner in the event of any breach by the Owner of any of<br />

these Terms & Conditions or of any failure by the Owner to make any<br />

payment due to the Council. If the breach is capable of remedy or the<br />

Owner has failed to make any such payment, the Council may serve<br />

notice on the Owner specifying the breach or the failure to pay and<br />

requiring him to remedy the breach or pay the amount due within 14<br />

days.<br />

17. Power to Remove If the Owner fails to remedy such breach or<br />

pay the amount due within 14 days or if the breach is not capable of<br />

remedy, the Council may service notice requiring the Owner to remove<br />

the vessel from the Marina with 14 days. Such notice shall be served<br />

on the Owner by affixing it on the vessel or by posting it by recorded<br />

delivery to the Owner’s last known address.<br />

If the Owner shall fail to remove the vessel within 14 days (whether<br />

under this condition or otherwise) the Council shall be entitled:-<br />

(i) to charge the Owner at the Visitors Rate as published in the current<br />

Royal <strong>Harbour</strong> Marina Schedule of Fees & Charges between the date of<br />

termination and removal of the vessel from the Marina, and<br />

(ii) at the Owner’s expense and risk (save in respect of loss or damage<br />

caused by the Council’s negligence during such removal), to relocate<br />

the vessel within the Marina or remove the vessel from the berth and<br />

thereupon secure it elsewhere in some other storage area within the<br />

Marina and thereafter to charge the Owner with all costs arising out<br />

of such relocation or removal including alternative berthing, handling<br />

and storage fees.<br />

18. The Council’s Obligations Cease upon Termination Any<br />

obligation of the Council towards the vessel ends upon the expiry or<br />

lawful termination of the licence.<br />

19. Liability The Council accepts no responsibility for loss of or damage<br />

to any other vessel or items of property belonging to the Owner left at<br />

the Marina without its express consent save as may be implied by law.<br />

20. Power of Sale Where payments are overdue in respect of the<br />

vessel, the provisions of the Torts (interference with Goods) Act 1977<br />

which confers power of sale upon bailees in the circumstances set<br />

out in the Act shall apply. Sale of the vessel shall not take place until<br />

statutory notice has been given to the Owner or the Council has taken<br />

reasonable steps to trace the Owner in accordance with the Act.<br />

21. Abandoned Items the provisions of section 41 of the Local<br />

Government (Miscellaneous Provisions) Act 1892 shall apply in relation<br />

to abandoned items.<br />

Where the vessel or any other item of property belonging to the Owner<br />

are abandoned at the Marina and the Council has taken reasonable<br />

steps to trace the Owner and serve him with a notice requiring him to<br />

collect the vessel or other items of property within one month of the<br />

date of the notice and the Owner has failed to comply with the said<br />

notice, title shall vest in the Council who shall be entitled to dispose of<br />

or sell any such vessel or other property. Where the Council is satisfied<br />

after reasonable enquiry that it is impossible to serve the Owner with<br />

such a notice, title shall vest in the Council six months after the vessel or<br />

other items of property have been abandoned by the Owner.<br />

22. Indemnity The Owner shall indemnify the Council against all loss,<br />

damage, costs, claims or proceedings incurred by or instituted against<br />

the Council, its servants or agents which may be caused by the vessel or<br />

other items of property belonging to the Owner within the Marina or by<br />

the Owner’s servants, agents, crew, guests or subcontractors, except<br />

to the extent that such loss, damage, costs, claims or proceedings may<br />

be caused by the negligence or wilful act of the Council, its authorised<br />

officers, servants or agents.<br />

23. Insurance The Owner shall maintain third party insurance in<br />

respect of himself and the vessel his crew for the time being and his<br />

agents, visitors, guests and subcontractors in a sum of not less than<br />

£3,000,000 or such other sum as the Council may from time to time<br />

direct in respect of accident or damage and, in respect of the vessel,<br />

adequate salvage insurance. Such insurance shall be affected and<br />

maintained in an insurance office of repute and the Owner shall keep<br />

the Council provided with a copy of the current Certificate of Insurance<br />

throughout the licence period. The Council reserves the right to<br />

implement at the Owner’s expense third party only insurance in the<br />

event of non-compliance with this condition.<br />

24. Manner of Berthing The Owner shall berth the vessel in such<br />

manner and position as the Council may require and the vessel shall be<br />

provided with all necessary warps and fenders by the Owner.<br />

25. Manner of Manoeuvring The Owner, when entering or leaving or<br />

manoeuvring the vessel in the Marina, shall do so at such speed and<br />

in such manner as not to endanger or inconvenience other vessels in<br />

the Marina.<br />

26. Respect for Others The Owner shall not use any noisy noxious<br />

or objectionable engines radios or other apparatus or machinery within<br />

the Marina so as to cause any nuisance or annoyance to the Council or<br />

to any other users of the Marina or to any other person residing in the<br />

vicinity of the Marina and the Owner undertakes for himself, his guests<br />

and any other person the vessel that they shall not behave in such a<br />

way as to offend as aforesaid. Halyards and other rigging shall be<br />

secured so as not to cause such nuisance or annoyance.<br />

27. Fire Precautions The Owner shall take all necessary precautions<br />

against the outbreak of fire in or upon the vessel and the Owner shall<br />

observe all statutory and local regulations and orders of the Council<br />

relative to fire prevention. The Owner shall provide and maintain at least<br />

one fire extinguisher of a governmentally approved or BSI standard type<br />

and size in or on the vessel fit for immediate use in case of fire.<br />

28. Byelaws The Owner shall in all things with respect to this<br />

Agreement and the use of the Marina abide by and perform the<br />

byelaws, rules and regulations in force in respect of the Marina.<br />

29. Disclaimer – Vessels and Property The Council shall not be<br />

liable whether in contract tort or otherwise for any loss, theft or any<br />

other damage of whatsoever nature caused to the vessel or any<br />

other item of property belonging to the Owner or to any other person<br />

claiming through the Owner except to the extent that such loss, theft or<br />

damage may be caused by the negligence or wilful act of the Council,<br />

its authorised officers, servants or agents.<br />

30. Business Use <strong>No</strong> part of the Marina or of the vessel while situated<br />

therein shall be used by the Owner for any commercial purposes except<br />

where the Owner is expressly authorised to do so by the Council.<br />

31. Work on Vessel <strong>No</strong> work shall be carried out at the berth other<br />

than routine maintenance or minor running repairs to the vessel. Works<br />

carried out shall not cause a nuisance or annoyance to other users of<br />

the Marina. All other works shall be carried out in the boat park or at<br />

a berth or place within the Marina designated by the harbour Master<br />

for that purpose.<br />

32. Contractors Prior to commencing any work on the vessel, any<br />

contractors entering the Marina shall contact the <strong>Harbour</strong> Master,<br />

complete an application for a Permit to Work, provide proof of third<br />

party liability insurance over to a minimum of £5,000,000 (or such sums<br />

as determined by the Council from time to time), have such application<br />

approved by the <strong>Harbour</strong> Master, and pay the appropriate fee. Where<br />

such work is to be carried out on the vessel, the Owner’s written<br />

permission must be provided to the <strong>Harbour</strong> Master beforehand.<br />

Any major works, for example shot blasting or sand sweeping of<br />

the hull or superstructure will require written consent which may be<br />

granted following receipt of a method statement and risk assessment.<br />

Contractors are bound by the byelaws and all other regulations relevant<br />

to the Marina and should show consideration for other Marina users.<br />

The Council reserves the right at its sole discretion to refuse to permit<br />

contractors to enter upon and work within the Marina.<br />

33. Services All services and facilities are provided at the Owner’s<br />

risk and are subject to availability. Application should be made to<br />

the <strong>Harbour</strong> Master. The Council undertakes to use all reasonable<br />

endeavours to provide services as requested but accepts no<br />

responsibility for delays or cancellations or any subsequent losses or<br />

increased costs or inconvenience howsoever arising therefrom. The<br />

Council reserves the right to withhold charge or cancel services.<br />

34. The Council’s Right to Act on Safety Grounds If in the <strong>Harbour</strong><br />

Master’s opinion such act be necessary for the safety of the vessel or<br />

for the safety of other users of the Marina or for the vessels or for the<br />

safety of the Marina plant or equipment, the Council shall have the right<br />

to moor, re-berth, move, board, enter or carry out any emergency work<br />

on the vessel and except to the extent that such mooring, re-berthing,<br />

movement, boarding, entering or emergency work arises from the<br />

negligence of the Council, its authorised officers, servants or agents,<br />

the Council’s reasonable charges in relation thereto shall be paid by<br />

the Owner.<br />

35. Recalculation of Charges Upon <strong>No</strong>tice The fees and charges<br />

payable by the Owner may be increased or decreased or the basis<br />

for determination of the fees and charges payable may be varied from<br />

time to time by the Council. Upon the Owner giving not less than 28<br />

days notice of departure in writing and having been a licence holder<br />

for at least the previous 12 months, the Council shall recalculate the<br />

fees and charges payable on the pro rata day by day basis or, if lower,<br />

the amount that would have been paid according to the Visitors Rate<br />

as published in the current Royal harbour Marina Schedule of Fees<br />

and Charges. Additionally, if the Owner has been a licence holder for<br />

less than 12 months, the pro rata day by day element above will be<br />

recalculated upwards at the summer and winter rates, insofar as they<br />

apply, up to a maximum of the amount that would be payable if the<br />

original licence term ran to completion, unless application of the Visitors<br />

Rate shall be lower, in which case that may be used. Additionally,<br />

summer and winter rate licences shall be recalculated on a pro rata day<br />

by day basis subject to a minimum term of 120 days being payable,<br />

unless application of the Visitors Rate shall be lower. For vessels on the<br />

old under 7 metre rate, no pro rata reduction will be made other than<br />

to Visitor Rate if that is lower. Settlement discounts will be cancelled<br />

in the event of early termination. Additionally, western outer marina<br />

licences shall be recalculated on a pro rata day by day basis subject<br />

to a minimum term of nine months being payable, unless application of<br />

the Visitors Rate shall be lower.<br />

36. Disclaimer – Injury or Damage to Person or Property All<br />

persons using the Marina or its facilities for whatever purposes and<br />

whether by invitation or otherwise do so at their own risk unless any<br />

injury or damage to person or property sustained within the Marina or<br />

facilities was caused by or resulted form the negligence or wilful act of<br />

the Council, its authorised officers, servants or agents.<br />

37. Refuse / Waste / Sewage <strong>No</strong> refuse, waste oil or sewage shall<br />

be thrown overboard or left or disposed of in any way within the Marina<br />

other than in the receptacles provided by the Council or by removal<br />

from the Marina.<br />

38. Tender & dinghies Tender, dinghies and rafts shall be stowed<br />

aboard the vessel unless a berth is separately provided and licensed<br />

to the Owner.<br />

39. Motor Vehicles & Parking Motor vehicles shall only be brought<br />

into the Marina with the express consent of the <strong>Harbour</strong> Master and<br />

shall be positioned or parked as may be direct by the <strong>Harbour</strong> Master<br />

and the Owner shall pay any charge that may be required.<br />

40. <strong>No</strong> item to be Left on Marina <strong>No</strong> items of boats gear, fittings<br />

or equipment, supplies, store or the like shall be left upon any part of<br />

the Marina.<br />

41. Vessel Name to be Clearly Shown The Owner shall ensure that<br />

at all times the name of the vessel is clearly shown thereon, including<br />

when left unattended in the boat park.<br />

42. Alterations of Terms & Conditions The Council reserves<br />

the right to alter these Terms & Conditions annually or by giving one<br />

month’s prior written notice to the Owner.<br />

43. Vessels in Boat Park The resident’s rate will be applied to the<br />

number of vessels in the boat park that is equal to or less than the<br />

number of permanent berths per customer in the Inner and/or Outer<br />

Marinas. Additional vessels within the Boat Park will incur the visitor<br />

rate.<br />

44. Under the Data Protection Act (1998) We may share your<br />

personal data with relevant enforcement agencies for the prevention<br />

and/or detection of crime.<br />
