OF DOCUMENTS IN CRIMINAL MATTERS
Küreselleşme ile birlikte sermayenin ve insanların
dolaşımının artması, devletleri bazı muhakeme işlemlerini
yerine getirmek için işbirliği yapmaya zorlamaktadır. Sınır
aşan karmaşık suç ağlarının ortaya çıkması, bir suç
hakkında aynı anda birden fazla devletin yargı yetkisine
sahip olduğunu ileri sürmesi, delillerin çeşitli devletlerde
dağınık olarak bulunması, bir devlette hakkında hüküm
verilen kişinin başka bir devlete gitmesi nedeniyle hükmün
infazında güçlükler yaşanması gibi özel durumlara gittikçe
daha fazla rastlanması, tebligat ya da ifade alma gibi rutin
işlemler yanında arama, el koyma, video konferans ya da
iletişimin tespiti gibi nitelikli muhakeme işlemlerinin
ikmali, soruşturma ve kovuşturmaların aktarılması veya
infazın devri gibi konularda da adlî yardımlaşma talebinde
bulunma ihtiyacının artmasına ve adlî yardımlaşmanın
kapsamının genişlemesine neden olmuştur.
Genel Müdürlüğümüz adına bu denli geniş bir
çalışma sahasında ihtiyaç duyulan çok yönlü ve hassas
çalışma, Ceza İstinabe ve Tebligat Bürosu tarafından
yerine getirilmektedir. Büroda hâlen bir müdür, üç şef ve
yirmi sekiz memur, Türk adlî mercilerinden yabancı devlet
adlî mercilerine ya da yabancı devlet adlî mercilerinden
Türk adlî mercilerine gönderilen cezaî konularda adlî
yardımlaşma taleplerinin mevzuatımıza ve uluslararası
taahhütlerimize uygunluklarının değerlendirilmesi,
ülkemiz adına mütekabiliyet ilkesinin takip edilmesi ile
taleplerin yerine getirilmesinin sağlanması için on altı
tetkik hâkimine sekretarya ve arşivleme hizmeti
vermektedir. Bahse konu görevleri itibarıyla Büro, Genel
Müdürlüğümüzün en fazla evrak kabul ve ikmal eden
birimidir.

Much-needed versat le and sens t ve works on such
a vast field of study are comm ss oned by the Bureau of
Mutual Ass stance and Serv ce of Summons n Cr m nal
Matters, on behalf of our General D rectorate. At
present, a un t head, three ch efs and twenty-e ght
personnel are serv ng for s xteen judges for conduct ng
secretar al and arch ve works on outgo ng MLA
requests from Turk sh jud c al author es and ncom ng
MLA requests from fore gn jud c al bod es concern ng
the r compl ance w th Turk sh leg slat on and Turkey's
nternat onal comm tments, follow ng up the pr nc ple
of rec proc ty on behalf of our country and execut on of
the requests. W th regard to afore-ment oned
competence, the Bureau s the h ghest document
rece v ng and execut ng un t of our General D rectorate.
