Hard to believe, but you learn as you grow. The Law enforcement Community like any other Community have few bad apples. Corruptions they call it in Asia also in mexico city. It is what it is to protect Law Enforcement Officers and their families and their friends. Sure when we have to call them to protect us and our friends and our families from the bad guys too. It took me a long time before i learned about police corruptions. most of my friends were great people who made great cops. I knew none before 2000. I begin to understand what a rogue cop at the same time what is a felony about 2000 and 2002. it took me 2 years to comprehend that there are bad cops........i filed my first complaint in 2000 against a cop gone bad who ruin my family. Do not be afraid, and never trade any fear with integrity to your community...Always remember what go around come back around. I find out from my studies that 100 of 100 cases of bad cops complaints get really worth with or without traders.

According to The Guardian, some of <strong>the</strong><br />

England fans, many of <strong>the</strong>m bare chested,<br />

also chanted “sit down if you hate <strong>the</strong><br />

French”.<br />

Video footage has been posted <strong>on</strong>line<br />

showing ugly scenes of England fans<br />

pelting objects into <strong>the</strong> streets in old town,<br />

Marseille, showering <strong>the</strong> police with bottles<br />

and throwing chairs out of cafes.<br />

According to newspaper reports, flares were<br />

also lit as officers deployed tear gas in an<br />

effort to disperse <strong>the</strong> troublemakers. <str<strong>on</strong>g>Police</str<strong>on</strong>g><br />

later charged at fans as bottles were<br />

thrown.<br />

Some England fans claimed that <strong>the</strong>y were<br />

provoked by Russian and French fans, and<br />

<strong>the</strong> acti<strong>on</strong>s of French police. The violence in<br />

Marseille is now in its third day.<br />

The vast majority of EU migrants and<br />

visitors in Britain are law abiding and<br />

upstanding citizens. Most EU migrants in<br />

<strong>the</strong> UK are in gainful employment, paying<br />

taxes, giving more to <strong>the</strong> country than <strong>the</strong>y<br />

take, spending most of <strong>the</strong>ir earnings here,<br />

and making a positive c<strong>on</strong>tributi<strong>on</strong> to<br />

Britain.<br />

For reas<strong>on</strong>s that many cannot rati<strong>on</strong>ally<br />

comprehend, Brexiteers appear not to<br />

like EU migrants. They want to stop <strong>the</strong>m<br />

coming to Britain, or at least to make it<br />

much more difficult. Even though those<br />

EU migrants c<strong>on</strong>tribute so much to<br />

Britain, and even though <strong>the</strong>ir numbers<br />

are small (just 5% of <strong>the</strong> populati<strong>on</strong>.)<br />

No doubt this weekend many French people<br />

will also feel that <strong>the</strong>y d<strong>on</strong>’t want British<br />

people going <strong>the</strong>re, being violent and<br />

damaging <strong>the</strong>ir town.<br />

When rioting England football fans shout,<br />

“f**k off Europe, we’re all voting out” <strong>the</strong>ir<br />

French hosts may well wish to resp<strong>on</strong>d “Au<br />

Revoir”.<br />

But <strong>the</strong>re are many of us in Britain who<br />

d<strong>on</strong>’t want to say ‘Au Revoir’ to France or to<br />

Europe. We d<strong>on</strong>’t relate to <strong>the</strong> acti<strong>on</strong>s or<br />

sentiments of just some England fans – no<br />

doubt a very small minority – causing<br />

trouble in France this weekend.<br />

We sincerely hope that Britain will still<br />

be a member of <strong>the</strong> EU, and still good<br />

allies with our European neighbours.<br />

Brackney set off in pursuit of a<br />

suspected drunk driver, chasing his<br />

black Mazda Miata down rural<br />

Arkansas roads at speeds of nearly<br />

100 miles per hour. When <strong>the</strong><br />

sports car finally came to rest in a<br />

ditch, Brackney opened fire at <strong>the</strong><br />

rear window and repeatedly struck<br />

<strong>the</strong> driver, 41-year-old James<br />

Ahern, in <strong>the</strong> back. The gunshots<br />

killed Ahern.<br />

Prosecutors charged Brackney with<br />

fel<strong>on</strong>y manslaughter. But he<br />

eventually entered a plea to a lesser<br />

charge and could ultimately be left<br />

with no criminal record.<br />

How <strong>the</strong> analysis was d<strong>on</strong>e: The 54 criminal<br />

prosecuti<strong>on</strong>s were identified by Bowling Green<br />

State University criminologist Philip M. Stins<strong>on</strong><br />

and The Washingt<strong>on</strong> Post. Cases were culled<br />

from news reports, grand jury announcements<br />

and news releases from prosecutors. For<br />

individual cases, reporters obtained and<br />

reviewed thousands of pages of court records,<br />

police reports, grand jury indictments, witness<br />

testim<strong>on</strong>y and video recordings. Dozens of<br />

prosecutors and defense attorneys in <strong>the</strong><br />

cases were interviewed, al<strong>on</strong>g with legal<br />

experts, officers who were prosecuted and<br />

surviving relatives of <strong>the</strong> shooting victims.<br />

Now, he serves as <strong>the</strong> police chief in<br />

a small community 20 miles from<br />

<strong>the</strong> scene of <strong>the</strong> shooting.<br />

Brackney is am<strong>on</strong>g 54 officers<br />

charged over <strong>the</strong> past decade for<br />

fatally shooting some<strong>on</strong>e while <strong>on</strong><br />

duty, according to an analysis by<br />

The Washingt<strong>on</strong> Post and<br />

researchers at Bowling Green State<br />

University. This analysis, based <strong>on</strong> a<br />

wide range of public records and<br />

interviews with law enforcement,<br />

judicial and o<strong>the</strong>r legal experts,<br />

sought to identify for <strong>the</strong> first time<br />

every officer who faced charges for<br />

such shootings since 2005. These<br />

represent a small fracti<strong>on</strong> of <strong>the</strong><br />

thousands of fatal police shootings<br />

that have occurred across <strong>the</strong><br />

country in that time.<br />

In an overwhelming majority of <strong>the</strong><br />

cases where an officer was charged,<br />

<strong>the</strong> pers<strong>on</strong> killed was unarmed. But<br />

it usually took more than that.<br />

When prosecutors pressed charges,<br />

The Post analysis found, <strong>the</strong>re were<br />

typically o<strong>the</strong>r factors that made <strong>the</strong><br />

case excepti<strong>on</strong>al, including: a victim<br />

shot in <strong>the</strong> back, a video recording<br />

of <strong>the</strong> incident, incriminating<br />

testim<strong>on</strong>y from o<strong>the</strong>r officers or<br />

allegati<strong>on</strong>s of a coverup.<br />

Forty-three cases involved at least<br />

<strong>on</strong>e of <strong>the</strong>se four factors. Nineteen<br />

cases involved at least two.<br />

In <strong>the</strong> most recent incident, officials<br />

in North Charlest<strong>on</strong>, S.C., filed a<br />

murder charge Tuesday against a<br />

white police officer, Michael T.<br />

Slager, for gunning down an<br />

apparently unarmed black man. A<br />

video recording showed Slager<br />

repeatedly shooting <strong>the</strong> man in <strong>the</strong><br />

back as he was running away.<br />

“To charge an officer in a fatal<br />

shooting, it takes something so<br />

egregious, so over <strong>the</strong> top that it<br />

cannot be explained in any rati<strong>on</strong>al<br />

way,” said Philip M. Stins<strong>on</strong>, a<br />

criminologist at Bowling Green who<br />

studies arrests of police. “It also has<br />

to be a case that prosecutors are<br />

willing to hang <strong>the</strong>ir reputati<strong>on</strong> <strong>on</strong>.”<br />

But even in <strong>the</strong>se most extreme<br />

instances, <strong>the</strong> majority of <strong>the</strong><br />

officers whose cases have been<br />

resolved have not been c<strong>on</strong>victed,<br />

The Post analysis found.<br />

And when <strong>the</strong>y are c<strong>on</strong>victed or<br />

plead guilty, <strong>the</strong>y’ve tended to get<br />

little time behind bars, <strong>on</strong> average<br />

four years and sometimes <strong>on</strong>ly<br />

weeks. Jurors are very reluctant to<br />

punish police officers, tending to<br />

view <strong>the</strong>m as guardians of order,<br />

according to prosecutors and<br />

defense lawyers.<br />

The definiti<strong>on</strong> of “officers” used in<br />

<strong>the</strong> analysis extends bey<strong>on</strong>d local<br />

police to all government law<br />

enforcement pers<strong>on</strong>nel who are<br />

armed, including sheriff’s deputies<br />

and correcti<strong>on</strong>s officers. The<br />

analysis included some shootings<br />

that officers described as accidental.<br />

There is no accurate tally of all <strong>the</strong><br />

cases of police shootings across <strong>the</strong><br />

country, even deadly <strong>on</strong>es. The FBI<br />

maintains a nati<strong>on</strong>al database of<br />

fatal shootings by officers but does<br />

not require police departments to<br />

keep it updated.<br />

Over <strong>the</strong> past year, a series of<br />

c<strong>on</strong>troversial police killings of<br />

unarmed victims — including<br />

Michael Brown in Fergus<strong>on</strong>, Mo.,<br />

Tamir Rice in Cleveland and Eric<br />

Garner <strong>on</strong> Staten Island — has<br />

raised questi<strong>on</strong>s over what it takes<br />

for officers to face criminal charges.<br />

Often, <strong>the</strong> public is divided over<br />

whe<strong>the</strong>r <strong>the</strong> police went too far.<br />

Only in rare cases do prosecutors<br />

and grand juries decide that <strong>the</strong><br />

killing cannot be justified.<br />

Such cases include a Michigan state<br />

trooper who shot and killed an<br />

unarmed homeless man in Detroit<br />

as he was shuffling toward him, <strong>the</strong><br />

man’s pants down past his knees.<br />

The incident was captured <strong>on</strong> video,<br />

and <strong>the</strong> officer, who said he thought<br />

<strong>the</strong> man had a gun, was charged<br />

with sec<strong>on</strong>d-degree murder. A jury<br />

accepted <strong>the</strong> officer’s account and<br />

found him not guilty. He remains<br />

<strong>on</strong> <strong>the</strong> job.<br />

They also include a police officer in<br />

Darlingt<strong>on</strong> County, S.C., who was<br />

charged with murder after he<br />

chased an unarmed man wanted for<br />

stealing a gas grill and three U-Haul<br />

trailers into <strong>the</strong> woods, shooting<br />

him in <strong>the</strong> back four times. A jury,<br />

believing that he feared for his life,<br />

found him not guilty.<br />

Two Atlanta plainclo<strong>the</strong>s officers<br />

opened fire and killed a 92-year-old<br />

woman during a mistaken drug raid<br />

<strong>on</strong> her home. As <strong>the</strong>y pried <strong>the</strong> bars<br />

off her fr<strong>on</strong>t door, she fired a single<br />

warning shot with an old revolver.<br />

The police resp<strong>on</strong>ded by smashing<br />

<strong>the</strong> door down and shooting at her<br />

39 times. One of <strong>the</strong> officers tried to<br />

disguise <strong>the</strong>ir error by planting bags<br />

of marijuana in her basement. The<br />

two officers pleaded guilty and<br />

received unusually stiff sentences of<br />

six and 10 years in a federal pris<strong>on</strong>.<br />

A rap musician, Killer Mike, wrote a<br />

s<strong>on</strong>g to memorialize <strong>the</strong> death of<br />

this African American grandmo<strong>the</strong>r<br />

at <strong>the</strong> hands of white officers,<br />

comparing her killing to “<strong>the</strong> dream<br />

of King when <strong>the</strong> sniper took his<br />

life.”<br />

After <strong>the</strong> death of Michael Brown<br />

last summer, c<strong>on</strong>cerns about racism<br />

in policing have exploded in public<br />

debate, in particular whe<strong>the</strong>r white<br />

officers use excessive force when<br />

dealing with minorities and<br />

whe<strong>the</strong>r <strong>the</strong> criminal justice system<br />

protects <strong>the</strong> victims’ rights.<br />

Am<strong>on</strong>g <strong>the</strong> officers charged since<br />

2005 for fatal shootings, more than<br />

three-quarters were white. Twothirds<br />

of <strong>the</strong>ir victims were<br />

minorities, all but two of <strong>the</strong>m<br />

black.<br />

Nearly all o<strong>the</strong>r cases involved black<br />

officers who killed black victims. In<br />

<strong>on</strong>e o<strong>the</strong>r instance, a Latino officer<br />

fatally shot a white pers<strong>on</strong> and in<br />

ano<strong>the</strong>r an Asian officer killed a<br />

black pers<strong>on</strong>. There were a total of<br />

49 victims.<br />

Identifying <strong>the</strong> exact role of race in<br />

fatal shootings and prosecuti<strong>on</strong>s is<br />

difficult. Often, prosecutors<br />

pursued charges against a backdrop<br />

of protests accusing police of<br />

racism. Race was also a factor in<br />

court when federal prosecutors<br />

stepped in and filed charges against<br />

officers for allegedly violating <strong>the</strong><br />

victims’ civil rights. Six officers, all<br />

white, faced federal civil rights<br />

charges for killing blacks.<br />

In interviews with more than 20<br />

prosecutors across <strong>the</strong> country, <strong>the</strong>y<br />

said that race did not factor into<br />

<strong>the</strong>ir decisi<strong>on</strong>s to bring charges<br />

against officers. The prosecutors<br />

said <strong>the</strong>y pursued cases based <strong>on</strong><br />

<strong>the</strong> legal merits.<br />

But defense lawyer Doug Friesen,<br />

who represented a white officer<br />

c<strong>on</strong>victed in 2013 for fatally<br />

shooting an unarmed black man,<br />

said that “it would be naive” for<br />

prosecutors to say race isn’t a<br />

c<strong>on</strong>siderati<strong>on</strong>.<br />

“Anytime you have politicians that<br />

have to make charging decisi<strong>on</strong>s,<br />

realistically that is part of <strong>the</strong>ir<br />

decisi<strong>on</strong>-making process,” Friesen<br />

said. “They are asking <strong>the</strong>mselves,<br />

‘Is <strong>the</strong>re going to be rioting out in<br />

<strong>the</strong> streets?’ ”<br />

Brackney, 32, recalled in an<br />

interview that he believed Ahern<br />

was about to back his car up and<br />

run over him. The engine was<br />

racing and <strong>the</strong> backup lights<br />

flashed, Brackney said.<br />

A video, captured by a camera<br />

mounted <strong>on</strong> his cruiser’s<br />

dashboard, indicated that <strong>the</strong> sports<br />

car was not moving when <strong>the</strong> officer<br />

opened fire. The existence of that<br />

video was <strong>the</strong> key reas<strong>on</strong> why<br />

prosecutors decided to bring<br />

charges, <strong>the</strong>y said.<br />

“In my mind, it was <strong>the</strong> third time<br />

he tried to run me over,” Brackney<br />

said in an interview with The Post.<br />

“His right hand came up in this<br />

sweeping moti<strong>on</strong>, and I thought he<br />

was going for a gun. I d<strong>on</strong>’t know<br />

what a jury would have believed —<br />

and that’s <strong>the</strong> problem. There was<br />

this risk, so entering a plea, I<br />

viewed it as a business decisi<strong>on</strong>.”<br />

After pleading to a reduced charge<br />

of negligent homicide, a<br />

misdemeanor, Brackney served 30<br />

days in jail as part of a plea<br />

agreement. The judge deferred <strong>the</strong><br />

c<strong>on</strong>victi<strong>on</strong>, and if Brackney fulfills<br />

<strong>the</strong> terms of his probati<strong>on</strong>, <strong>the</strong> case<br />

will be dismissed.<br />

“No <strong>on</strong>e wants to take a life, but at<br />

<strong>the</strong> end of <strong>the</strong> day, I realize that I’m<br />

<strong>the</strong> <strong>on</strong>e who got to go home,” he<br />

said, adding, “I wouldn’t change<br />

what I did.”<br />

He was fired by <strong>the</strong> Bella Vista<br />

<str<strong>on</strong>g>Police</str<strong>on</strong>g> Department, where he<br />

worked at <strong>the</strong> time, but was given<br />

ano<strong>the</strong>r chance by <strong>the</strong> city of<br />

Sulphur Springs, Ark. Two years<br />

ago, city officials hired him to run<br />

<strong>the</strong> police department, where he<br />

manages a force of four officers who<br />

spend much of <strong>the</strong>ir time patrolling<br />

quiet streets and arresting smalltime<br />

drug dealers.<br />

<strong>the</strong> race of <strong>the</strong> charged officer was<br />

white. Of those, two-thirds shot and<br />

killed a black pers<strong>on</strong>. In n<strong>on</strong>e of <strong>the</strong><br />

cases did a black officer fatally shoot a<br />

white pers<strong>on</strong>.<br />

Most of <strong>the</strong> time,<br />

prosecutors d<strong>on</strong>’t press charges<br />

against police — even if <strong>the</strong>re are<br />

str<strong>on</strong>g suspici<strong>on</strong>s that an officer has<br />

committed a crime. Prosecutors<br />

interviewed for this report say it<br />

takes compelling proof that at <strong>the</strong><br />

time of <strong>the</strong> shooting <strong>the</strong> victim<br />

posed no threat ei<strong>the</strong>r to <strong>the</strong> officer<br />

or to bystanders.<br />

Jay Hodge, a former South Carolina<br />

prosecutor, said <strong>the</strong> questi<strong>on</strong> boils<br />

down to this: Can <strong>the</strong> evidence<br />

disprove <strong>the</strong> officer’s story that he<br />

was defending himself or protecting<br />

<strong>the</strong> public. Hodge recounted <strong>on</strong>e<br />

case he had prosecuted in which a<br />

sheriff’s deputy said he had opened<br />

fire <strong>on</strong> an unarmed suspect who<br />

grabbed for his gun. The autopsy<br />

report, Hodge said, told a different<br />

story.<br />

“You d<strong>on</strong>’t shoot some<strong>on</strong>e in <strong>the</strong><br />

back four times and <strong>the</strong>n claim selfdefense,”<br />

he said. “They can’t be<br />

going for a gun if <strong>the</strong>y are running<br />

away.”<br />

In half <strong>the</strong> criminal cases identified<br />

by The Post and researchers at<br />

Bowling Green, prosecutors cited<br />

forensics and autopsy reports that<br />

showed this very thing: unarmed<br />

suspects who had been shot in <strong>the</strong><br />

back.<br />

Not that l<strong>on</strong>g ago, police had wide<br />

latitude to shoot fleeing fel<strong>on</strong>s. But<br />

a 1985 Supreme Court decisi<strong>on</strong><br />

changed that. In Tennessee v.<br />

Garner, <strong>the</strong> justices ruled that it was<br />

not justifiable for officers to shoot<br />

simply to prevent a suspect’s<br />

escape. The suspect had to pose a<br />

significant threat of death or serious<br />

harm to ei<strong>the</strong>r law enforcement or<br />

innocent bystanders for <strong>the</strong><br />

shooting to be legally justified.<br />

In a third of <strong>the</strong> cases where officers<br />

faced charges, prosecutors<br />

introduced videos into evidence,<br />

saying <strong>the</strong>y showed <strong>the</strong> slain<br />

suspects had posed no threat at <strong>the</strong><br />

moment <strong>the</strong>y were killed. The<br />

videos were often shot from<br />

cameras mounted <strong>on</strong> <strong>the</strong><br />

dashboards of patrol cars, standard<br />

equipment for most police<br />

departments.<br />

In nearly a quarter of <strong>the</strong> cases, an<br />

officer’s colleagues turned <strong>on</strong> him,<br />

giving statements or testifying that<br />

<strong>the</strong> officer opened fire even though<br />

<strong>the</strong> suspect posed no danger at <strong>the</strong><br />

time.<br />

Such testim<strong>on</strong>y carries almost<br />

unequalled weight with judges and<br />

juries because police officers are<br />

c<strong>on</strong>sidered highly credible<br />

eyewitnesses as well as experts in<br />

<strong>the</strong> proper use of force, according to<br />

prosecutors and defense attorneys.<br />

<str<strong>on</strong>g>More</str<strong>on</strong>g>over, because officers so rarely<br />

cross <strong>the</strong> “thin blue line” to testify<br />

against a colleague, <strong>the</strong>ir evidence<br />

can be especially powerful.<br />

And in 10 cases, or about a fifth of<br />

<strong>the</strong> time, prosecutors alleged that<br />

officers ei<strong>the</strong>r planted or destroyed<br />

evidence in an attempt to ex<strong>on</strong>erate<br />

<strong>the</strong>mselves — a str<strong>on</strong>g indicati<strong>on</strong>,<br />

prosecutors said, that <strong>the</strong> officers<br />

<strong>the</strong>mselves recognized <strong>the</strong> shooting<br />

was unjustified.<br />

It was late <strong>on</strong>e South Carolina<br />

evening 10 years ago, when<br />

Darlingt<strong>on</strong> County Sheriff’s Deputy<br />

Tim Roberts<strong>on</strong> finally caught up<br />

with William Sheffield, a 45-yearold<br />

white man wanted for stealing a<br />

gas grill and three hauling trailers.<br />

Under <strong>the</strong> dim porch light of a<br />

mobile home, Roberts<strong>on</strong>, who is<br />

white, urged <strong>the</strong> man to surrender,<br />

forcing him to spread his hands<br />

against <strong>the</strong> cab of his GMC pickup<br />

truck.<br />

But as Roberts<strong>on</strong> prepared to put<br />

<strong>the</strong> handcuffs <strong>on</strong>, <strong>the</strong> suspect<br />

lunged to <strong>the</strong> right, turned and <strong>the</strong>n<br />

tried to grab <strong>the</strong> deputy’s gun,<br />

Roberts<strong>on</strong> recounted in an<br />

interview with The Post. Roberts<strong>on</strong>,<br />

who said he feared for his life, fired<br />

two shots. Sheffield broke away and<br />

ran for <strong>the</strong> woods. Roberts<strong>on</strong> gave<br />

chase, opening fire again. According<br />

to prosecutors, <strong>the</strong> deputy gunned<br />

down <strong>the</strong> unarmed suspect in <strong>the</strong><br />

back.<br />

“There was no threat because <strong>the</strong>re<br />

was no <strong>on</strong>e around who could get<br />

hurt. There was a trail of shell<br />

casings that showed <strong>the</strong> deputy<br />

chased him and shot at him as he<br />

ran away,” said J.R. Joyner, <strong>the</strong> lead<br />

prosecutor in <strong>the</strong> case. “One shot<br />

was point-blank — an executi<strong>on</strong><br />

shot.”<br />

Joyner said <strong>the</strong> forensics evidence<br />

was “<strong>the</strong> str<strong>on</strong>gest of any case in my<br />

career.”<br />

Prosecutors successfully indicted<br />

Roberts<strong>on</strong> <strong>on</strong> a murder charge,<br />

citing <strong>the</strong> law that bars an officer<br />

from shooting a fleeing suspect in<br />

<strong>the</strong> back.<br />

But at trial, jurors would go <strong>on</strong> to<br />

acquit Roberts<strong>on</strong>, believing his<br />

account that he was forced to fire<br />

<strong>the</strong> final, fatal shots because <strong>the</strong><br />

suspect turned back during <strong>the</strong><br />

chase, attacked him and grabbed for<br />

his gun a sec<strong>on</strong>d time. Roberts<strong>on</strong><br />

would keep his job at <strong>the</strong> sheriff’s<br />

department and be put in charge of<br />

training deputies in firearms and<br />

use of force.<br />

In Cleveland, Officer Michael Brelo,<br />

who is white, was indicted for<br />

killing a pair of black suspects after<br />

a grand jury reviewed a wide range<br />

of evidence, including nearly two<br />

dozen video recordings from<br />

dashboard cameras, traffic cameras<br />

and surveillance cameras mounted<br />

at businesses and a school.<br />

The deadly encounter began when<br />

<strong>the</strong> pair, Timothy Russell, 43, and<br />

Malissa Williams, 30, drove past<br />

<strong>the</strong> Cleveland police headquarters<br />

<strong>on</strong> a November night in 2012 and<br />

<strong>the</strong>ir Chevy Malibu fatefully<br />

backfired. Officers mistook <strong>the</strong><br />

sound for gunfire and went in<br />

pursuit. So<strong>on</strong>, 62 police vehicles<br />

were chasing <strong>the</strong> Chevy through city<br />

streets at speeds of up to 110 mph.<br />

The cameras captured <strong>the</strong> furious<br />

pursuit with officers’ Dodge<br />

Chargers rocketing past repeated<br />

red lights and weaving through<br />

traffic at breakneck speed, tires<br />

squealing as panicked drivers<br />

peeled <strong>on</strong>to <strong>the</strong> shoulders.<br />

The suspects, later found to be<br />

under <strong>the</strong> influence of drugs, came<br />

to a stop in a middle school parking<br />

lot. Eleven officers got out of <strong>the</strong>ir<br />

cars and formed a semicircle<br />

around <strong>the</strong> Chevy, court records<br />

show. Although two police radio<br />

broadcasts had reported that <strong>the</strong><br />

pair was unarmed, according to<br />

transmissi<strong>on</strong>s compiled by state<br />

investigators, <strong>the</strong> officers opened<br />

fire, shooting 139 times.<br />

Brelo himself fired 34 shots at <strong>the</strong><br />

car and <strong>the</strong>n climbed <strong>on</strong>to <strong>the</strong> hood<br />

of <strong>the</strong> Chevy and fired 15 more<br />

times “at close range” through <strong>the</strong><br />

windshield, state investigati<strong>on</strong><br />

records show.<br />

In a statement to investigators with<br />

<strong>the</strong> Ohio attorney general’s office,<br />

Brelo did not deny firing <strong>the</strong> shots<br />

but said he believed gunfire was<br />

coming from inside <strong>the</strong> vehicle.<br />

“I’ve never been so afraid in my<br />

life,” he said. “I thought my partner<br />

and I would be shot and that we<br />

were going to be killed.”<br />

A grand jury indicted Brelo <strong>on</strong> two<br />

counts of voluntary manslaughter,<br />

saying he acted in a “fit of rage” and<br />

“under <strong>the</strong> influence of sudden<br />

passi<strong>on</strong>.”<br />

A lawyer for Brelo, whose trial<br />

began M<strong>on</strong>day, declined to<br />

comment.<br />

Stins<strong>on</strong>, <strong>the</strong> Bowling Green<br />

criminologist, said it is often <strong>the</strong><br />

case that questi<strong>on</strong>able police<br />

shootings are an act of passi<strong>on</strong>.<br />

Sometimes, he said, <strong>the</strong> encounters<br />

start with something as simple as a<br />

traffic stop and escalate when<br />

some<strong>on</strong>e fails to obey <strong>the</strong> officer’s<br />

directi<strong>on</strong>s.<br />

“They are used to giving commands<br />

and people obeying,” said Stins<strong>on</strong>,<br />

who previously worked as a police<br />

officer. “They d<strong>on</strong>’t like it when<br />

people d<strong>on</strong>’t listen to <strong>the</strong>m, and<br />

things can quickly become violent<br />

when people d<strong>on</strong>’t follow <strong>the</strong>ir<br />

orders.”<br />

in Gary, Ind., fatally shot a black 16-<br />

year-old robbery suspect in <strong>the</strong> back<br />

of <strong>the</strong> neck after <strong>the</strong> fleeing teen<br />

climbed a fence to escape, court<br />

records show.<br />

Although Smith turned out to be<br />

unarmed, it took jurors <strong>on</strong>ly two<br />

hours of deliberati<strong>on</strong> to acquit<br />

Randolph. Randolph could not be<br />

reached for comment.<br />

“Jurors tend to be sympa<strong>the</strong>tic<br />

toward police officers,” said<br />

Randolph’s attorney, Scott King.<br />

“For every movie like ‘Training<br />

Day,’ <strong>the</strong>re are 10 movies where<br />

cops are underpaid, hard-working,<br />

struggling against insurmountable<br />

odds and <strong>on</strong> <strong>the</strong> side of good.”<br />

Prosecutors charged Randolph with<br />

reckless homicide.<br />

But when <strong>the</strong> case went to trial, his<br />

attorney told jurors that Randolph<br />

had felt threatened by <strong>the</strong> 6-foot,<br />

200-pound teenager, Vince Smith<br />

Jr. Twice during <strong>the</strong> chase,<br />

Randolph said in a depositi<strong>on</strong>,<br />

Smith turned around to c<strong>on</strong>fr<strong>on</strong>t<br />

him, both times reaching into <strong>the</strong><br />

fr<strong>on</strong>t pocket of his black hooded<br />

sweatshirt. He said he thought <strong>the</strong><br />

teen was going for a gun.<br />

The outcome of Randolph’s case is<br />

more <strong>the</strong> rule than <strong>the</strong> excepti<strong>on</strong><br />

and dem<strong>on</strong>strates <strong>the</strong> daunting task<br />

facing prosecutors in those rare<br />

instances when <strong>the</strong>y do charge<br />

officers in c<strong>on</strong>necti<strong>on</strong> with fatal<br />

shootings.<br />

Of <strong>the</strong> 54 officers who were charged<br />

for fatally shooting some<strong>on</strong>e while<br />

<strong>on</strong> duty over <strong>the</strong> past decade, 35<br />

have had <strong>the</strong>ir cases resolved. Of<br />

those, a majority — 21 officers —<br />

were acquitted or saw <strong>the</strong>ir charges<br />

dropped.<br />

Jurors usually see <strong>the</strong> officer as “<strong>the</strong><br />

good party in <strong>the</strong> fight,” said David<br />

Harris, a University of Pittsburgh<br />

law professor and expert in police<br />

use of force. “To get <strong>the</strong>m to buy<br />

into a story where <strong>the</strong> officer is <strong>the</strong><br />

bad guy goes fundamentally against<br />

everything <strong>the</strong>y believe.”<br />

Most jurors, experts say, view<br />

officers as those who enforce laws,<br />

not break <strong>the</strong>m. And unlike<br />

civilians, police officers are allowed,<br />

even expected, to use force.<br />

“It’s a questi<strong>on</strong> of whe<strong>the</strong>r it was<br />

too much force,” Harris said. “It’s a<br />

very flexible standard that has to be<br />

interpreted in every case. All this<br />

makes it very difficult to c<strong>on</strong>vict an<br />

officer.”<br />

Most laws that apply to <strong>on</strong>-duty<br />

shootings require jurors to<br />

essentially render a verdict <strong>on</strong> <strong>the</strong><br />

officer’s state of mind: Was <strong>the</strong><br />

officer truly afraid for his life or <strong>the</strong><br />

lives of o<strong>the</strong>rs when he fired his<br />

weap<strong>on</strong>? Would a reas<strong>on</strong>able officer<br />

have been afraid?<br />

That’s what Clay Rogers says he was<br />

asked to do when he served as a<br />

juror for <strong>the</strong> 2009 trial of a<br />

Hartford, C<strong>on</strong>n., narcotics officer<br />

charged with fatally shooting a<br />

fleeing black suspect.<br />

“It’s difficult to prove an officer is<br />

not justified bey<strong>on</strong>d a reas<strong>on</strong>able<br />

doubt, because you almost have to<br />

get inside <strong>the</strong>ir head to know what<br />

he was thinking and feeling,”<br />

Rogers said in an interview with<br />

The Post.<br />

The officer, Robert Lawlor, who is<br />

white, had fired five shots at a car as<br />

it sped away. Two bullets struck a<br />

passenger, 18-year-old Jash<strong>on</strong><br />

Bryant, in <strong>the</strong> back of <strong>the</strong> head,<br />

killing him.<br />

The officer testified before a grand<br />

jury that he had initially<br />

approached <strong>the</strong> car, a black Nissan<br />

Maxima, because it matched <strong>the</strong><br />

descripti<strong>on</strong> of a vehicle used in a<br />

homicide. He said he opened fire at<br />

<strong>the</strong> car because he believed that<br />

Bryant had a gun and that <strong>the</strong><br />

vehicle was barreling toward<br />

ano<strong>the</strong>r officer.<br />

Although no weap<strong>on</strong> was found,<br />

Rogers said he and his fellow jurors<br />

had to take seriously <strong>the</strong> officer’s<br />

claim that he believed his life and<br />

that of his partner were in jeopardy.<br />

crack,” Rogers recounted. “You had<br />

an officer using deadly force, but he<br />

was up against dangerous drug<br />

dealers. It worked.”<br />

The jury acquitted Lawlor.<br />

His attorney, Michael Georgetti,<br />

said in an interview that he worked<br />

to build what he sees as a natural<br />

alliance between jurors and officers<br />

to win <strong>the</strong> case. “You d<strong>on</strong>’t get<br />

people <strong>on</strong> a jury with a criminal<br />

record,” Georgetti said. “If a police<br />

officer says stop, <strong>the</strong>y stop. They<br />

d<strong>on</strong>’t put <strong>the</strong>ir car in drive and<br />

speed away.”<br />

Rogers said <strong>the</strong> jury was also<br />

influenced by <strong>the</strong> tough questi<strong>on</strong>s<br />

directed at <strong>the</strong> car’s driver <strong>on</strong> <strong>the</strong><br />

witness stand. The officer’s attorney<br />

grilled <strong>the</strong> driver about his criminal<br />

past, bringing up <strong>the</strong> cocaine found<br />

in <strong>the</strong> car and marijuana he had in<br />

his jacket <strong>on</strong> <strong>the</strong> day of <strong>the</strong> incident.<br />

“The way <strong>the</strong> defense made it look<br />

was <strong>the</strong>re were <strong>the</strong>se two gangsters<br />

out <strong>the</strong>re, riding around, and selling<br />

As hard as it is for<br />

prosecutors to win a c<strong>on</strong>victi<strong>on</strong> or<br />

an admissi<strong>on</strong> of guilt, it’s even<br />

harder to persuade a judge or jury<br />

to give an officer significant pris<strong>on</strong><br />

time.<br />

For <strong>the</strong> nine officers c<strong>on</strong>victed in<br />

state prosecuti<strong>on</strong>s, sentences<br />

ranged from six m<strong>on</strong>ths to seven<br />

years, The Post analysis shows. One<br />

of <strong>the</strong> o<strong>the</strong>r cases, <strong>the</strong> shooting<br />

death of <strong>the</strong> 92-year-old woman in<br />

Atlanta, was taken up by federal<br />

prosecutors, who added civil rights<br />

violati<strong>on</strong>s to manslaughter charges<br />

and w<strong>on</strong> stiffer sentences,<br />

ultimately sending <strong>the</strong> two<br />

c<strong>on</strong>victed officers to pris<strong>on</strong> for six<br />

and 10 years.<br />

Six of <strong>the</strong> officers who faced state<br />

prosecuti<strong>on</strong>s were c<strong>on</strong>victed after<br />

going to trial. On average, <strong>the</strong>y got 3<br />

1/2 years.<br />

But prosecutors were eager at times<br />

to dispense with cases without a<br />

trial by negotiating a plea<br />

agreement. Winning a c<strong>on</strong>victi<strong>on</strong><br />

against an officer is tough. And <strong>the</strong><br />

cases can come with bruising<br />

headlines and strained relati<strong>on</strong>s<br />

with <strong>the</strong> very police department<br />

that prosecutors rely <strong>on</strong> daily to<br />

help build o<strong>the</strong>r criminal cases.<br />

In at least six cases, lawyers for <strong>the</strong><br />

officers were able to get <strong>the</strong> charges<br />

reduced, resulting in lighter<br />

sentences. These cases included<br />

c<strong>on</strong>victi<strong>on</strong>s as well as instances in<br />

which judges deferred c<strong>on</strong>victi<strong>on</strong>s<br />

and put officers <strong>on</strong> probati<strong>on</strong> for<br />

<strong>the</strong>ir acti<strong>on</strong>s. These officers <strong>on</strong><br />

average did about 2 1/2 years<br />

behind bars.<br />

Ant<strong>on</strong>io Taharka, a former police<br />

officer in Savannah, Ga., fatally shot<br />

a probati<strong>on</strong> violator as he<br />

scrambled over a fence, trying to<br />

escape arrest. He ended up<br />

spending three m<strong>on</strong>ths in a county<br />

jail.<br />

The grand jury that indicted<br />

Taharka <strong>on</strong> voluntary manslaughter<br />

charges, which can bring up to 20<br />

years in pris<strong>on</strong>, said <strong>the</strong> officer had<br />

killed <strong>the</strong> suspect “while acting<br />

solely as <strong>the</strong> result of a sudden,<br />

violent and irresistible passi<strong>on</strong>.”<br />

But members of <strong>the</strong> local African<br />

American community rallied<br />

around Taharka, recalled former<br />

prosecutor David Lock, who had<br />

presented <strong>the</strong> case to <strong>the</strong> grand<br />

jury. “He was an African American<br />

officer and was beloved,” Lock said.<br />

“There was more of an outcry about<br />

why he was being charged versus<br />

why not.” At <strong>the</strong> same time, Lock<br />

said, <strong>the</strong>re was little public<br />

sympathy for <strong>the</strong> 41-year-old<br />

victim, Anth<strong>on</strong>y Smashum, a black<br />

man who had a l<strong>on</strong>g rap sheet,<br />

including c<strong>on</strong>victi<strong>on</strong>s for rape and<br />

assault.<br />

Lock said he believes <strong>the</strong>se factors<br />

delayed <strong>the</strong> prosecuti<strong>on</strong> and<br />

ultimately c<strong>on</strong>tributed to lessening<br />

<strong>the</strong> charge against Taharka.<br />

Chatham County District Attorney<br />

Meg Heap, who replaced Lock in<br />

<strong>the</strong> elected post, downgraded <strong>the</strong><br />

charges from voluntary<br />

manslaughter, agreeing that<br />

Taharka could plead guilty instead<br />

to <strong>the</strong> less-serious charge of<br />

involuntary manslaughter, which<br />

carries a maximum of 10 years.<br />

Heap said in an interview that <strong>the</strong><br />

lesser charge was a better fit for <strong>the</strong><br />

facts of <strong>the</strong> case. But she said her<br />

office made no promises about a<br />

reduced sentence, leaving that up to<br />

<strong>the</strong> judge.<br />

At sentencing in 2009, Superior<br />

Court Judge John E. Morse Jr. said<br />

he had to strike “<strong>the</strong> most delicate<br />

balance.” In assessing <strong>the</strong> fatal<br />

incident, he said, “All I can glean<br />

from what I have read and heard up<br />

to this particular point is that it was<br />

Morse ordered Taharka to spend<br />

three m<strong>on</strong>ths in jail and nine<br />

m<strong>on</strong>ths c<strong>on</strong>fined to his home except<br />

when he was working. If he follows<br />

<strong>the</strong> terms of his probati<strong>on</strong> of nine<br />

years, his record will be wiped<br />

trial this summer <strong>on</strong> charges of<br />

voluntary manslaughter arising<br />

from a fatal encounter with Ferrell’s<br />

s<strong>on</strong> in September 2013.<br />

It was well after midnight when<br />

J<strong>on</strong>athan Ferrell, 24, a former<br />

Florida A&M football defensive<br />

back, crashed his Toyota Camry,<br />

rolling it into a ditch, according to<br />

<strong>the</strong> police report. Dazed, he kicked<br />

out <strong>the</strong> rear window, crawled from<br />

<strong>the</strong> vehicle and made his way to a<br />

nearby house to seek helps.<br />

But when he started banging <strong>on</strong> <strong>the</strong><br />

door, <strong>the</strong> woman who lived <strong>the</strong>re<br />

panicked and called 911. The<br />

officers who resp<strong>on</strong>ded to <strong>the</strong> call<br />

told investigators that <strong>the</strong>y believed<br />

that Ferrell was a threat, records<br />

show. When Ferrell, who was black,<br />

did not follow <strong>the</strong>ir orders to get <strong>on</strong><br />

<strong>the</strong> ground, Kerrick, who is white,<br />

shot him 10 times, police officials<br />

said.<br />

After <str<strong>on</strong>g>Police</str<strong>on</strong>g> Chief Rodney M<strong>on</strong>roe<br />

saw <strong>the</strong> 15-sec<strong>on</strong>d dashcam video of<br />

<strong>the</strong> incident, he arrested Kerrick<br />

within <strong>the</strong> day, saying <strong>the</strong> officer<br />

“did not have a lawful right to<br />

discharge his weap<strong>on</strong> during this<br />

encounter.”<br />

Kerrick’s attorney Michael Green<br />

said <strong>the</strong> video tells a different story.<br />

“Officer Kerrick did his job that<br />

night. Although <strong>the</strong> shooting was a<br />

tragedy, it was justified,” Green<br />

said. “On <strong>the</strong> video, you hear <strong>the</strong><br />

officer telling him multiple times to<br />

trial, I think you’ll find folks who<br />

Georgia Ferrell worries that jurors<br />

will believe that account. As<br />

some<strong>on</strong>e who has pers<strong>on</strong>al reas<strong>on</strong>s<br />

to hold most police in high regard,<br />

she recognizes how difficult it is to<br />

c<strong>on</strong>vict and punish an officer.<br />

“Society has put it into our heads<br />

that <strong>the</strong> officer is always right,” she<br />

said. “That has to change.”<br />

dem<strong>on</strong>strate, <strong>the</strong> lines between internati<strong>on</strong>al<br />

and domestic threats are closer than many<br />

police officers may realize.<br />

turns out, though, that police officers <strong>on</strong> <strong>the</strong><br />

beat do have opportunities to assist efforts<br />

against internati<strong>on</strong>al terrorism.<br />

an attempt to finance a series of terrorist<br />

bombings of military bases and houses of<br />

worship around Los Angeles by <strong>the</strong> radical<br />

Islamic group Jamiyyat Ul-Islam Is-Saheeh.<br />

In some cases, as in Los Angeles, police<br />

officers working local cases can uncover links<br />

Focus <strong>on</strong> Training<br />

To shift this mindset so officers see a bigger<br />

picture of fighting terrorism requires <strong>on</strong>e thing:<br />

enhanced training.<br />

<str<strong>on</strong>g>Police</str<strong>on</strong>g> departments should seek out<br />

c<strong>on</strong>tinuous training about <strong>the</strong> current state of<br />

internati<strong>on</strong>al terrorism and <strong>the</strong> indicators beat<br />

officers <strong>on</strong> U.S. streets might see. Nearby<br />

field offices of federal agencies can offer<br />

support, often at no cost to <strong>the</strong> local<br />

department. These agencies could provide:<br />

crucial for <strong>the</strong>se same officers to act as extra<br />

eyes and ears for <strong>the</strong> various federal agencies<br />

that investigate terrorism cases. This does not<br />

really require any new skills from officers; <strong>the</strong>y<br />

are <strong>on</strong> <strong>the</strong> lookout for suspicious activity just<br />

as <strong>the</strong>y normally would be, but with a<br />

heightened cognizance of <strong>the</strong> terrorist threat.<br />

This eyes and ears strategy can be highly<br />

effective, as officers typically have unimpeded<br />

access when patrolling high-potential targets<br />

such as airports, seaports, bus/subway<br />

terminals, churches, schools, shopping malls,<br />

U.S. landmarks, sports arenas, hospitals, and<br />

tourist attracti<strong>on</strong>s.<br />

Officers also daily patrol <strong>the</strong> same roads that<br />

terrorists use to travel and transport materials<br />

to be used in <strong>the</strong>ir attacks. Fur<strong>the</strong>r, if terrorists<br />

are seeking to avoid detecti<strong>on</strong> by living and<br />

planning <strong>the</strong>ir attacks in rural areas where<br />

counterterrorism efforts are not heavily<br />

c<strong>on</strong>centrated, local officers are <strong>the</strong> most likely<br />

to encounter <strong>the</strong>m.<br />

In fact, <strong>the</strong> Bureau of Justice Statistics says<br />

local police officers outnumber federal agents<br />

by a ratio of almost 10:1. Local officers are<br />

<strong>the</strong>refore far more likely than federal<br />

counterterrorism agents to encounter<br />

suspicious activity that could be related to<br />

terrorism. It also means <strong>the</strong>y will be <strong>the</strong> first to<br />

resp<strong>on</strong>d should an attack occur.<br />

Increasing <strong>the</strong>ir awareness of <strong>the</strong> potential to<br />

encounter internati<strong>on</strong>al terrorism while <strong>on</strong> <strong>the</strong>ir<br />

daily beats will help local officers fight<br />

internati<strong>on</strong>al crimes as well as domestic <strong>on</strong>es.<br />

Government agencies as diverse as <strong>the</strong><br />

Centers for Disease C<strong>on</strong>trol and Preventi<strong>on</strong><br />

(CDC) and <strong>the</strong> Department of Homeland<br />

A group of reputati<strong>on</strong>-management experts<br />

has banded toge<strong>the</strong>r to create a program to<br />

help law enforcement agencies better<br />

manage <strong>the</strong>ir social media engagement and<br />

improve <strong>the</strong>ir percepti<strong>on</strong>s with people and<br />

within communities. The so-called<br />

“Coptics” program developed by <strong>the</strong> Hetty<br />

Group draws from best practices employed<br />

by large companies that already have seen<br />

<strong>the</strong> value in being active members of social<br />

media to tell <strong>the</strong>ir stories and address issues<br />

that if not handled properly could blow up<br />

into big c<strong>on</strong>troversies, said Florence Chung,<br />

founder of <strong>the</strong> Hetty Group. “We believe<br />

that if you aren’t telling your story, <strong>the</strong><br />

world will,” said Ms. Chung. “And <strong>the</strong><br />

world often doesn’t know <strong>the</strong> facts.”<br />

Shann<strong>on</strong> Wilkins<strong>on</strong>, chief executive of<br />

reputati<strong>on</strong>-management firm Reputati<strong>on</strong><br />

Communicati<strong>on</strong>s, said that although many<br />

people in law enforcement have stayed away<br />

from social media out of fear or because<br />

<strong>the</strong>y prefer to stay out of <strong>the</strong> spotlight, doing<br />

so <strong>on</strong>ly cedes <strong>the</strong> c<strong>on</strong>versati<strong>on</strong> to <strong>the</strong>ir<br />

critics and o<strong>the</strong>rs who aren’t representing<br />

<strong>the</strong>ir viewpoints. For law enforcement<br />

agencies or companies wanting to get more<br />

active in social media, Ms. Wilkins<strong>on</strong> said<br />

<strong>the</strong>y need to ask <strong>the</strong>mselves two questi<strong>on</strong>s:<br />

“How do we want to be perceived and by<br />

what audience? And how are we currently<br />

perceived and by whom?” Bill Carmody, a<br />

digital marketing expert and chief executive<br />

of <strong>the</strong> firm Trepoint, said by teaching law<br />

enforcement how to be part of <strong>the</strong> digital<br />

c<strong>on</strong>versati<strong>on</strong>, and giving <strong>the</strong>m tools to<br />

properly engage <strong>the</strong>ir audiences, will allow<br />

for departments to get involved in<br />

discussi<strong>on</strong>s before <strong>the</strong>y go viral. Through<br />

better engagement, when incidents do occur,<br />

law enforcement will be in a better positi<strong>on</strong><br />

to resp<strong>on</strong>d in real time because “that’s<br />

where <strong>the</strong> c<strong>on</strong>versati<strong>on</strong> is happening,” he<br />

said. “Your brand is being shaped by social<br />

media if you’re not shaping it yourself.”<br />

Matt Horace, a former law enforcement<br />

official who now serves as a law<br />

enforcement analyst <strong>on</strong> CNN, said whe<strong>the</strong>r<br />

it’s a law enforcement agency or a big<br />

corporati<strong>on</strong>, an organizati<strong>on</strong> needs to know<br />

how to manage a crisis and <strong>the</strong><br />

communicati<strong>on</strong>s surrounding it. And a key<br />

part of that is engaging <strong>on</strong> social media,<br />

knowing what’s being said and interacting in<br />

a way that is au<strong>the</strong>ntic and not in a way that<br />

seems disingenuous or that will erode trust.<br />

“This can’t be a stunt,” he said.<br />

All levels of Thai society suffer from<br />

endemic corrupti<strong>on</strong>. Even<br />

though Thailand has <strong>the</strong> legal<br />

framework and a range of instituti<strong>on</strong>s<br />

to effectively counter<br />

corrupti<strong>on</strong>, companies may regularly<br />

encounter bribery or o<strong>the</strong>r corrupt<br />

practices. Ousted former Prime<br />

Minister Yingluck recently went <strong>on</strong><br />

trial for negligence and o<strong>the</strong>r<br />

offences related to <strong>the</strong> allegedly<br />

corrupt implementati<strong>on</strong> of a rice<br />

subsidy scheme that reportedly cost<br />

<strong>the</strong> state USD 16 billi<strong>on</strong>. The Organic<br />

Law <strong>on</strong> Counter<br />

Corrupti<strong>on</strong> criminalises corrupt<br />

practices of public officials and<br />

corporati<strong>on</strong>s. The Thai Penal<br />

Code criminalises active and passive<br />

bribery of public officials by pers<strong>on</strong>s<br />

operating in <strong>the</strong> public or private<br />

sector but excludes facilitati<strong>on</strong><br />

payments. Anti-corrupti<strong>on</strong> legislati<strong>on</strong><br />

is inadequately enforced, and<br />

facilitati<strong>on</strong> payments and gifts are<br />

comm<strong>on</strong> in practice.<br />

Judicial System<br />

Corrupti<strong>on</strong> in <strong>the</strong> judiciary is<br />

a significant risk for businesses<br />

operating in Thailand. The legal system<br />

does not functi<strong>on</strong> as a deterrence to<br />

corrupti<strong>on</strong> and litigants sometimes<br />

influence judgments through extra-legal<br />

means, including bribes (ICS 2015).<br />

Only few public officials have been<br />

effectively prosecuted <strong>on</strong> corrupti<strong>on</strong><br />

charges, which have led to a decrease<br />

in public trust in <strong>the</strong> judiciary (BTI 2014).<br />

Twenty percent of surveyed citizens feel<br />

that <strong>the</strong> judiciary is corrupt (GCB 2013).<br />

Even though <strong>the</strong> process can be slow at<br />

times, <strong>the</strong> judiciary is generally efficient<br />

in enforcing property and c<strong>on</strong>tractual<br />

rights (ICS 2015). With an average of<br />

449 days, enforcing a c<strong>on</strong>tract takes<br />

less time and is much less costly than<br />

elsewhere in <strong>the</strong> regi<strong>on</strong> (DB 2015).<br />

Companies need to be aware that<br />

decisi<strong>on</strong>s by foreign courts are not<br />

recognised by <strong>the</strong> local courts, and thus<br />

cannot be enforced. Disputes that need<br />

to be settled and recognised by <strong>the</strong><br />

court, have to go through <strong>the</strong> Thai<br />

justice system (ICS 2015). The military<br />

established a junta called <strong>the</strong> Nati<strong>on</strong>al<br />

Council for Peace and Order after a<br />

coup d'état, and suspended <strong>the</strong><br />

c<strong>on</strong>stituti<strong>on</strong> (HRR 2014). The judiciary<br />

retained its functi<strong>on</strong>s, but can be<br />

overridden by <strong>the</strong> NCPO in order to<br />

defend nati<strong>on</strong>al security (HRR 2014).<br />

The military junta has set up military<br />

courts that severely infringe civil rights,<br />

as <strong>the</strong>y operate in secret fashi<strong>on</strong> and<br />

lack independence (HRW, May 2015).<br />

Thailand is a signatory to<br />

<strong>the</strong> Internati<strong>on</strong>al Centre for <strong>the</strong><br />

Settlement of Investment Disputes.<br />

<str<strong>on</strong>g>Police</str<strong>on</strong>g><br />

Corrupti<strong>on</strong> is pervasive in Thailand's<br />

police sector. It has a reputati<strong>on</strong> of<br />

being <strong>the</strong> most corrupt instituti<strong>on</strong> in <strong>the</strong><br />

country, partly due to its entanglement<br />

in politics and a patr<strong>on</strong>age system (The<br />

Guardian, Nov. 2014). <str<strong>on</strong>g>Police</str<strong>on</strong>g> impunity is<br />

reported to be a problem (HRR 2014),<br />

and companies c<strong>on</strong>sider <strong>the</strong>m to be<br />

fairly unreliable (GCR 2014-2015).<br />

Following <strong>the</strong> August terrorist attacks in<br />

Bangkok, an investigati<strong>on</strong> was<br />

launched into <strong>the</strong> Thai immigrati<strong>on</strong><br />

police, as suspects had crossed <strong>the</strong><br />

border with fake passports in exchange<br />

for bribes (Sputniknews, Sept. 2015).<br />

Public Services<br />

Companies should take note of<br />

corrupti<strong>on</strong> risks when acquiring public<br />

services in Thailand. Irregular<br />

payments, bribes and especially gifts<br />

are comm<strong>on</strong>ly exchanged (GCR 2014-<br />

2015). Due to its frequency, forty-eight<br />

percent of surveyed Thais expect<br />

financial losses from bribery and<br />

corrupti<strong>on</strong> (pwc 2014). This can be<br />

attributed partly to low wages of public<br />

officials, and partly to a cultural<br />

inclinati<strong>on</strong> to accept gifts as a natural<br />

part of doing business (ICS 2015).<br />

Facilitati<strong>on</strong> payments to civil servants<br />

are comm<strong>on</strong> to <strong>the</strong> extent that if<br />

companies refuse to make such<br />

payments, <strong>the</strong>y may create a<br />

competitive disadvantage relative to<br />

o<strong>the</strong>r firms in <strong>the</strong> same field (ICS 2015).<br />

Inefficient government bureaucracy and<br />

political instability make for fertile<br />

ground for corrupti<strong>on</strong>, and present<br />

obstacles to doing business (GCR 2014-<br />

2015). Starting a business takes <strong>on</strong><br />

average 27 days and is significantly less<br />

costly than <strong>the</strong> regi<strong>on</strong>al average (DB<br />

2015).<br />

The Licensing Facilitati<strong>on</strong> Act (unofficial<br />

English versi<strong>on</strong>) came recently into<br />

force. It targets red tape and corrupti<strong>on</strong><br />

by providing a <strong>on</strong>e-stop shop service<br />

through an informati<strong>on</strong> center <strong>on</strong> public<br />

services that deals with licensing<br />

procedures and complaints against state<br />

agencies. Fur<strong>the</strong>r, a website and a<br />

hotline are established, that are said to<br />

be available in English in <strong>the</strong> future<br />

(Thai Visa News, July 2015).<br />

Exposing <strong>the</strong> major split <strong>on</strong> immigrati<strong>on</strong> policy<br />

<strong>the</strong> Andrew Marr Show yesterday: 'There has<br />

been a huge amount of immigrati<strong>on</strong> over <strong>the</strong> last<br />

10 years and people are understandably<br />

'I think it should be reduced and it should be<br />

reduced by making sure we have <strong>the</strong> skills in<br />

America and Caribbean focus of<br />

INTERPOL meeting<br />

WILLEMSTAD, Curaçao – Addressing <strong>the</strong> global<br />

problem of Latin American and Caribbean drug crime<br />

and its links to o<strong>the</strong>r serious crimes, particularly<br />

migrant smuggling and human trafficking, was <strong>the</strong><br />

focus of INTERPOL’s third annual Project Fortaleza<br />

meeting held in <strong>the</strong> Curaçao capital.<br />

Project Fortaleza provides Latin American and<br />

Caribbean law enforcement with <strong>the</strong> skills and<br />

services <strong>the</strong>y need to address <strong>the</strong> threat of organized<br />

crime. These include gang watch lists, intelligence<br />

officer networks, regi<strong>on</strong>ally coordinated police<br />

operati<strong>on</strong>s and crime analysis, as well as access to<br />

INTERPOL’s wide range of criminal databases and<br />

capabilities.<br />

Bringing toge<strong>the</strong>r 100 participants from 23 countries,<br />

<strong>the</strong> three-day (6 – 8 September) joint INTERPOL-<br />

Curaçao Justice Ministry meeting called for law<br />

enforcement across <strong>the</strong> regi<strong>on</strong> to increase its use of<br />

INTERPOL networks and capabilities, particularly Red<br />

Notices, to boost <strong>the</strong> identificati<strong>on</strong> and arrest of<br />

criminals across Latin America and <strong>the</strong> Caribbean.<br />

“Although Latin American organized crime groups are<br />

typically known for trafficking drugs, <strong>the</strong>y are<br />

increasingly diversifying to more global crime such as<br />

arms smuggling, human trafficking and ec<strong>on</strong>omic<br />

crime,” commented Nels<strong>on</strong> Navarro, Curaçao’s<br />

Justice Minister, resp<strong>on</strong>sible for law enforcement in<br />

Curaçao.<br />

“Law enforcement can <strong>on</strong>ly address <strong>the</strong>se challenges<br />

by also acting globally. Project Fortaleza addresses<br />

organized crime tactically and across <strong>the</strong> full<br />

spectrum of crime areas to ensure an all-inclusive,<br />

regi<strong>on</strong>al approach,” he added.<br />

“Enabling officers from so many Latin America and<br />

Caribbean countries to come toge<strong>the</strong>r in this way<br />

gives <strong>the</strong>m a unique opportunity to share <strong>the</strong>ir<br />

investigative experiences and collectively identify <strong>the</strong><br />

most suitable methods for tackling regi<strong>on</strong>al organized<br />

crime,” said Curaçao <str<strong>on</strong>g>Police</str<strong>on</strong>g> Chief Mauricio Sambo.<br />

“Crime is evolving very quickly and it is <strong>on</strong>ly by<br />

working toge<strong>the</strong>r through organizati<strong>on</strong>s like<br />

INTERPOL, and with <strong>on</strong>e ano<strong>the</strong>r as a regi<strong>on</strong>, that we<br />

can realistically tackle existing and evolving crime<br />

threats. Fortaleza reinforces <strong>the</strong> regi<strong>on</strong>’s ability to<br />

detect, track, report and prohibit <strong>the</strong> flow of illicit<br />

goods al<strong>on</strong>g existing and new trafficking routes, which<br />

helps our police forces safeguard our nati<strong>on</strong>al borders<br />

and security,” he added.<br />

The Head of INTERPOL’s Nati<strong>on</strong>al Central Bureau<br />

(NCB) in Curacao, Norbert Minguel, highlighted<br />

Curacao’s efforts to streng<strong>the</strong>n nati<strong>on</strong>al bordersecurity<br />

procedures by integrating INTERPOL’s stolen<br />

and lost travel document database into its airport and<br />

harbour border management systems, and described<br />

how INTERPOL’s global policing capabilities for<br />

enhanced traveller screening will help prevent <strong>the</strong><br />

movement of criminals.<br />

Hosted by NCB Curacao, <strong>the</strong> Fortaleza meeting was<br />

coordinated with INTERPOL’s General Secretariat<br />

headquarters INTERPOL’s Criminal Organizati<strong>on</strong>s<br />

and Drugs Sub-Directorate.<br />

game-changer for law enforcement in this regi<strong>on</strong>,”<br />

added Mr de Gracia.<br />
