Defenders of Wildlife is a national,<br />

nonprofit membership organization<br />

Defenders of Wildlife’s 2015 Conservation<br />

Report Card measures the commitment<br />

of U.S. senators and representatives to<br />

wildlife and habitat conservation during the first<br />

session of the 114th Congress. It tells you at a<br />

glance how well your elected representatives are<br />

safeguarding our natural heritage for our children<br />

and grandchildren.<br />

This report card reviews 11 Senate votes on<br />

legislation with serious implications for wildlife<br />

and habitat such as ending federal protections for<br />

some species safeguarded under the Endangered<br />

Species Act (ESA), selling off America’s public<br />

lands, creating obstacles to national monument<br />

designations, starving environmental funding,<br />

overturning waterway protection, and preventing<br />

action on climate change.<br />

The report card also covers 12 votes by the<br />

House of Representatives on legislation with<br />

conservation consequences, including ending<br />

federal protections for gray wolves and northern<br />

long-eared bats protected under the ESA, promoting<br />

damaging logging in our national forests, using<br />

the California drought as an excuse to undermine<br />

endangered species protection, and removing a<br />

legislative rider waiving certain environmental<br />

reviews for grazing permits on federal land.<br />

1 Undermining Citizen Enforcement<br />

of the Endangered Species Act<br />

The Senate rejected an amendment that would have<br />

discouraged citizen enforcement of the Endangered<br />

Species Act (ESA) by restricting plaintiffs’ ability<br />

to recover litigation costs when they prevail in<br />

court. (January 21, 2015, Roll Call No. 7)<br />

5 Stripping Wilderness Protection<br />

Based on Congressional Inaction<br />

The Senate rejected an amendment that would<br />

have removed wilderness protection for wilderness<br />

study areas if Congress did not permanently<br />

designate the lands as wilderness within one<br />

year. (January 28, 2015, Roll Call No. 39)<br />

2 Limiting the Designation of Public Land<br />

The Senate rejected an amendment that would<br />

have made it more difficult to safeguard public<br />

lands through protective land designations.<br />

6 Mandating the Approval of the Keystone<br />

Xl Pipeline<br />

The Senate passed a bill that would assure<br />

approval of the Keystone XL tar sands pipeline.<br />

3 Removing Necessary Endangered Species Act<br />

Protections for the Threatened Lesser<br />

Prairie-Chicken<br />

The Senate rejected an amendment that would<br />

have removed vital federal protections for the lesser<br />

prairie-chicken—an imperiled southwestern bird<br />

that the U.S. Fish and Wildlife Service (FWS)<br />

listed as “threatened” under the ESA in May<br />

2014. (January 28, 2015, Roll Call No. 35)<br />

4 Creating Obstacles to National Monument<br />

Designations<br />

The Senate rejected an amendment that would<br />

have expressed a “sense of Congress” that<br />

all future national monument designations<br />

by the president be invalid unless approved<br />

by the state governor and state legislature.<br />

(January 28, 2015, Roll Call No. 37)<br />

7 Selling Off America’s Public Lands<br />

The Senate passed an amendment that would<br />

authorize the sale, transfer or exchange of<br />

federal lands to state and local governments<br />

that, in turn, could sell the lands for use<br />

in harmful resource extraction activities.<br />

8 Prioritizing Economic Considerations Over<br />

Conservation Science in Endangered Species<br />

Act Determinations<br />

The Senate passed an amendment that would<br />

potentially allow FWS to inject economic<br />

considerations into the process for listing<br />

species under the ESA—a process Congress<br />

previously said should be based only on the<br />

best available science and biological factors.<br />

The Senate passed a budget resolution for 2016<br />

that would continue damaging funding cuts for<br />

programs that protect the environment and natural<br />

10 Overturning Waterway Protections<br />

The Senate agreed to a resolution to<br />

overturn the Obama administration’s water<br />

rule under the Congressional Review Act.<br />

11 Preventing Action on Climate Change<br />

The Senate passed a resolution that would<br />

permanently block the Clean Power Plan,<br />

preventing the biggest step the United States<br />

has ever taken to address climate change and<br />

threatening our environment and our future.<br />

over grazing permits on land already damaged by<br />

have invalidated three harmful provisions in<br />

the underlying Interior appropriations bill<br />

that remove, weaken or prevent Endangered<br />

Species Act protections for the endangered<br />

gray wolf, the threatened northern longeared<br />

bat and the imperiled sage-grouse.<br />

Protecting Elephants at Risk From Poaching<br />

The House rejected an amendment that would<br />

have removed harmful language from the<br />

Interior appropriations bill, blocking efforts<br />

by the U.S. Fish and Wildlife Service to<br />

stop the illegal ivory trade within the United<br />

States and the associated poaching of African<br />

elephants. (July 8, 2015, Roll Call No. 405)<br />

Blocking Protection of Our National Monuments<br />

The House passed an amendment that would<br />

prevent the president from protecting many<br />

national treasures by blocking national<br />

monument designations in certain local<br />

The House passed a bill that would promote<br />

high-risk logging on our public forests at<br />

in Endangered Species Act Decisions<br />

The House passed an amendment that would<br />

give water contractors more influence than<br />

other stakeholders in the ESA process for<br />

a federal irrigation project in Oregon and<br />

California. (July 16, 2015, Roll Call No. 444)<br />

Using the California Drought as an Excuse for<br />

Undermining Endangered Species Protections<br />

The House passed a bill that that would override<br />

ESA protections in the California Bay-Delta,<br />

shut down the San Joaquin River Restoration<br />

Program, preempt state water law and undermine<br />

other environmental safeguards in the Bay-<br />

Delta. (July 16, 2015, Roll Call No. 447)<br />

Removing Arbitrary Project Approval Timelines<br />

for Projects that Would Impact Threatened<br />

would have prevented the implementation<br />
