Ipswich Plastic Bag Ban<br />

IPSWICH – Amid all the discussion among town leaders last week about budgets<br />

and taxes, five high school students stood up to tell their elders it was time to make<br />

their town cleaner and healthier by banning the ubiquitous single-serve plastic bags<br />

and Styrofoam plates, cups and containers.<br />

The students, one senior and four juniors, made well-researched arguments that<br />

the plastic bags handed out by many retailers and the Styrofoam cups of coffee and<br />

containers so common in fast food restaurants and gas stations are harmful to the<br />

environment and personal health.<br />

The 12th article on the Ipswich Town Meeting agenda not only passed<br />

unanimously, but about half of the audience that packed into the high school’s<br />

performing arts center gave the students a standing ovation.<br />

Three of the students, Claire McElwain, Claire Werner and Jillian Wall, the senior<br />

More Waterfront Condos Coming<br />

NEWBURYPORT – With the exploding housing market here the pace of building long<br />

discussed townhouses on the Merrimack River waterfront here is quickening.<br />

This is not another story about the latest plans by the Newburyport Redevelopment<br />

Authority to build residences on the public waterfront near downtown. Nor is it about the<br />

New England Development’s plans to build a hotel, shops and maybe residences on its land<br />

between the river and Merrimac Street.<br />

Private developers are turning waterfront properties into expensive townhouse units upriver<br />

away from the downtown waterfront which draws the opposition from the Committee for<br />

an Open Waterfront. Being built are townhouses and condominiums on private land that<br />

WEST NEWBURY — In what he called his first community policing action<br />

here, Police Chief Art Reed unveiled a new painted fresco of the town seal in the<br />

police headquarters lobby.<br />

Painted by Pentucket Arts Academy senior Jennifer Nelson, the fresco is a<br />

collaboration between the police department and Pentucket Regional High<br />

School. It was dedicated in memory of the late Rowley Police Chief Charles<br />

Hardy, who died in 1973 in a car crash while on duty.<br />

The town seal was originally donated by Fred Hardy, the nephew of Chief<br />

Charles Hardy and owner of Hardy’s Auto Body of Rowley, specializing in the<br />

building, repairing, and custom painting of autos, motorcycles, trikes, boats, and<br />

houseboats.<br />

Chief Scott Dumas represented Rowley at the dedication.<br />

raising $235.00 for The Pettengill House.<br />

A volunteer and teacher in our local school, an author and a local business all coming together unexpectedly to<br />

support a local nonprofit!<br />

It didn’t start out as a fundraiser. Local residents Beth and John Sayre-Scibona met the author while in Vermont<br />

and arranged for her visit to read from Business her book Stella Rose at Caffe Spotlight<br />

di Siena in Newburyport. Before the event,<br />

John served as tour guide while Beth excused herself to purchase milk for The Pettengill House’s Saturday Night<br />

Meal Program. Curious, the author asked about the program. Beth, a fifth grade teacher at Salisbury Elementary<br />

School, explained<br />

For her volunteer role. The Saturday Night Meal Program began in 1997 when a group of volunteers<br />

so that she and John can purchase and deliver an average of 30 gallons of milk a month to the meal program.<br />

volunteers who show up each month Pets, to cook, prepare Animals, and deliver meals to those in need. Plus The dedicated service<br />

Dear Editor,<br />

Pundits and ‘experts’ say Trump must do this and Trump must do that to unify the Republican party. I have a<br />

news flash for them. The Donald won. He beat the best we have while running an anti establishment campaign. It<br />

is they, the entrenched career politicians that need to change their stripes and get with the program of the people.<br />

We learned this time around for the first time, at least for me the voters don’t pick our nominee. The delegates<br />

pick the delegates and they pick the nominee. What a sweet deal. The power brokers pick our candidate and we<br />

have nothing to say about it. It is time to clear out the cesspool in Washington and replace it with patriots who<br />

If you want to live on the<br />

Merrimack River waterfront, there<br />

will soon be lots of opportunities.<br />

Berkeley Investments and<br />

First Republic Development will<br />

complete this fall a long-stalled<br />

project to build nine two- and<br />

three-bedroom condos adjacent to<br />

Cashman Park. The project is also<br />

converting an <strong>18</strong>th century barn<br />

into a 10th condo.<br />

Eric Ekman, the Berkeley<br />

vice president for development,<br />

declined to say how much the<br />

condos would sell for. He referred<br />

the question to his broker who did<br />

not return calls and whose web site<br />

says only that the townhomes “are<br />

coming soon.”<br />

A stone’s throw upriver, Chart<br />

House Development is proposing<br />

to the city’s Zoning Board of<br />

Appeals that it be allowed to build<br />

11 condos on the waterfront at the<br />

Newburyport Yacht Club. Its next<br />

hearing is scheduled for June 14.<br />

The members-only yacht club,<br />

established in 2001, includes a<br />

club house and marina. The marina<br />

features three sheltered, deepwater<br />

docks that can accommodate 192<br />

slips. The club house amenities<br />

include a pool and restrooms with<br />

hot showers. Annual membership<br />

The property, bought by the<br />

current owners in 1980, stores<br />

boats in the winter on 96 double<br />

decker racks. The proposal is to<br />

tear down the racks and dilapidated<br />

buildings to make room for threestory<br />

townhouses. The yacht<br />

club and some boat storage will<br />

continue.<br />

“The rack storage operation,<br />

although clearly a marine use,<br />

is really not the ideal use in a<br />

residential neighborhood,” said<br />

James Lagoulis, owner of the<br />

yacht club. The club uses heavy<br />

equipment to haul and launch<br />

boats all week, but particularly on<br />

summer weekend. “This is not an<br />

ideal fit with a family marina,” he<br />

said.<br />

The club got into the boat<br />

storage business when it found<br />

that running a summer yacht club<br />

was not financially viable, he said.<br />

In the 1980s, he won approval<br />

to build 17 residences on the<br />

property, but the housing market<br />

crashed and killed those plans, he<br />

said.<br />

Today, his only option to selling<br />

off an acre of the five-acre tract for<br />

townhouses is to add a third level<br />

of racks for more boat storage.<br />

approves the ordinance. Fines<br />

go from a warning to $50 for<br />

the first offense to $100 for each<br />

subsequent offenses.<br />

The bans will make Ipswich one<br />

of a growing number of towns<br />

and cities, including Hamilton<br />

and Newburyport, who have<br />

taken steps to rid their landscape<br />

of the plastic bags and Styrofoam.<br />

Newburyport approved the ban<br />

on plastic bags, while Hamilton<br />

has banned both.<br />

Lori LaFrance, who taught<br />

all five students in a class on<br />

environmental sustainability last<br />

year, said they went from being<br />

timid in September to being “a<br />

force to be reckoned with.”<br />

The five young women were<br />

named the runner up in the New<br />

England states for the President’s<br />

LaFrance said the five students<br />

learned first hand how town<br />

government works. They first<br />

approached the town Board of<br />

Health for its support. Then they<br />

asked the School Committee,<br />

followed by requests for support<br />

to the Town Manager, the Finance<br />

Committee and the Board of<br />

Selectmen. They won the support<br />

of each town board and manager<br />

Robin Crosbie.<br />

To the Town Meeting, they<br />

argued that the ban would<br />

have little negative impact on<br />

the town’s economy. It would<br />

make the town, whose economy<br />

depends on visitors, cleaner with<br />

fewer eyesores. And they argued<br />

that because Styrofoam may cause<br />

cancer and plastic bags can end<br />

up in the food supply, the town<br />

residents would be healthier.<br />

we expected.”<br />

hear such informative, yet politely<br />

presented arguments.<br />

The only objection to the ban<br />

came from a woman who asked if<br />

she was going to buy biodegradable<br />

dog poop bags.<br />

“Yes,” McElwain told her.<br />

“But you can get them in a big<br />

box at Shaw’s, and they are not<br />

expensive.”<br />

The team surveyed businesses<br />

in Ipswich about the bans. Of<br />

50 businesses asked about plastic<br />

bags, 42 supported it, the students<br />

said.<br />

Of 28 restaurants and retailers<br />

surveyed, 10 said they use<br />

Styrofoam. Some were already<br />

planning to move to other<br />

products, Howe and Restuccia<br />

said.<br />

When asked what businesses<br />

opposed the plastic bag ban,<br />

McElwain said it was better not to<br />

single out any businesses.<br />

Whittier Home Opens for the 20<strong>16</strong> Season<br />

The Whittier Home & Museum<br />

at 86 Friend St. in Amesbury<br />

opened its doors to the public for<br />

tours of the Museum on Saturday,<br />

May 7th, 20<strong>16</strong>. The house where<br />

John Greenleaf Whittier, beloved<br />

Quaker poet, abolitionist and<br />

crusader for social justice lived and<br />

wrote during his adult life is on the<br />

register of National Historic Places.<br />

The tours, conducted by docents<br />

trained by Susan Herman, senior<br />

docent and historian at the Whittier<br />

Home include six rooms inside the<br />

house, the Victorian Garden and<br />

the Summer Kitchen located to the<br />

rear of the garden. The tours are<br />

rich in narrative of life in the <strong>18</strong>00’s,<br />

covering the years leading up to the<br />

Civil War and Whittier’s role as a<br />

Quaker, abolitionist and peaceful<br />

activist during those turbulent times.<br />

Numerous documents, pictures,<br />

furniture and artifacts are on display,<br />

and many have been professionally<br />

restored after incurring water<br />

damage in early 2015. Christina<br />

Bryant, president of the Whittier<br />

Home notes that, “it is well worth<br />

the price of admission alone just to<br />

see the excellent restoration work<br />

that has been done throughout the<br />

Museum.”<br />

EXPLORERS<br />

This is a new series of hands-on nature<br />

classes for 4 and 5-year-old children (and<br />

their caregivers). Sign up for individual<br />

sessions or the entire series! Some sessions<br />

will be held at the refuge visitor center,<br />

while others will be conducted on the<br />

refuge at the parking lot 1 visitor contact<br />

station. The theme of these classes will be<br />

“spring events in nature” (e.g., plants and<br />

animals adjust to the warming weather<br />

and migrating birds return from their<br />

wintering grounds). The series of classes<br />

will include making and keeping a journal<br />

and doing nature-related crafts/projects<br />

to bring home. On these Monday, May<br />

When it is time to sell, a<br />

REALTOR® will present the seller<br />

with a contract that allows that real<br />

estate agency exclusive rights to list,<br />

market and sell your home. Within<br />

this contract are some important<br />

items that sellers should be aware<br />

of.<br />

Price and Terms of Sale<br />

You and your REALTOR®<br />

presumably have sat down and<br />

reviewed what your home is worth in<br />

the current market. Your REALTOR®<br />

should have shown you comparable<br />

homes in the area of yours. He or<br />

she should also be basing the price<br />

of your home on comparable sales,<br />

not just homes that are listed for<br />

sale. Most sellers have a general<br />

idea of what their home is worth by<br />

keeping track of other sales in town.<br />

Please, please, please do not take this<br />

portion lightly; the theory of “we<br />

can always come down in price” isn’t<br />

a great strategy. Your home is only<br />

“new” to the market once.<br />

In addition to the price, you will<br />

disclose what personal property, if<br />

any, goes with the house when you<br />

sell it. Personal property is anything<br />

that is not attached or fixed to the<br />

home, such as washers, dryers or<br />

refrigerators<br />

You may have items that are<br />

attached to the home and considered<br />

“real property”. For example you<br />

may have a door knocker that has<br />

been passed down from generation<br />

to generation, since the door<br />

knocker is attached to the house,<br />

it is considered “real property” and<br />

a buyer would expect it to go with<br />

the house. We include a separate<br />

sheet listing inclusions/exclusions<br />

for a seller to check off that we make<br />

available to potential buyers.<br />

Commission<br />

While I do really love my job, I<br />

have a mortgage as well so when<br />

completing the listing agreement,<br />

you and your REALTOR® will agree<br />

on the amount of the real estate<br />

commission. The listing contract<br />

also specifies when the commission<br />

is earned. It should read if and when<br />

a sale is recorded at the Registry of<br />

Deeds regardless of who buys the<br />

home.<br />

If there is a real estate agency that<br />

represents the buyer in the sale, the<br />

Multiple Listing Service (MLS)<br />

Your listing contract specifies<br />

whether or not the house will be<br />

listed with the local Multiple Listing<br />

Service (MLS). The MLS is where<br />

other REALTORS® see your home,<br />

and their web site populates to<br />

dozens of other web sites like Zillow<br />

and Realtor.com automatically.<br />

It makes little sense not to list in<br />

MLS.<br />

Agency Duties of a Listing Agent<br />

Real estate agents are more than just<br />

salespeople. We have a duty, called a<br />

“fiduciary duty to our clients”. This<br />

means the agent is responsible to act<br />

in the best interests of their client.<br />

We aren’t simply selling an object,<br />

we have a responsibility to our client.<br />

The person behind the counter at a<br />

convenience store has no fiduciary<br />

duty to Phillip Morris when selling<br />

a pack of cigarettes. We not only<br />

have this duty but a Code of Ethics<br />

as well.<br />

The listing contract will specify<br />

that your REALTOR® is acting as<br />

a “seller’s agent.” This means that,<br />

in the sale of your house, they are<br />

working for you. However, there<br />

may be times when your agent has<br />

a client who wants to buy your<br />

home. If your agent also represents<br />

the buyer, the listing contract<br />

should specify that they provide an<br />

additional disclosure that details<br />

whether they continue to act as your<br />

agent or assume the duties of a dual<br />

agent.<br />

Lockbox<br />

A lockbox is a basically a padlock<br />

with a key inside to your home<br />

can be placed. Only someone with<br />

a combination can get into the<br />

lockbox and access the key to your<br />

home.<br />

The listing contract specifies<br />

whether you allow a lockbox or not.<br />

It is locked into place, usually on the<br />

Generally, people have<br />

“insurance” to protect the most<br />

important things in their lives.<br />

Whether it is medical, dental,<br />

car, life, disability, home owners<br />

or trip insurance, most of us rely<br />

on this coverage should we need<br />

it.<br />

We are quick to say, “What does<br />

my insurance cover?” sometimes<br />

before we even contemplate what<br />

is in our best interest…..or, who<br />

has our best interest in mind.<br />

One thing is for sure – insurance<br />

companies are looking to pay out<br />

the minimum possible.<br />

Patients will sometimes balk at<br />

treatment not covered by their<br />

dental insurance. Dentists will<br />

often hear, “Just do what my<br />

insurance covers. I don’t want<br />

anything extra.” In fact, a recent<br />

ADA poll showed that a lack of<br />

dental insurance was the No. 1<br />

reason most patients gave for not<br />

visiting a dentist. So, here are just<br />

a few frequent questions patients<br />

often ask about dental insurance.<br />

Why doesn’t my insurance<br />

cover all of the costs for my<br />

dental treatment?<br />

I know you don’t really want<br />

to hear it but - dental insurance<br />

isn’t really “insurance” (defined<br />

as a payment to cover the cost<br />

of a loss) at all. It is a monetary<br />

benefit, typically provided by an<br />

employer, to help their employees<br />

pay for routine dental treatment.<br />

“Dental Insurance” is, always has<br />

been, and always will be, only<br />

designed to cover a portion of the<br />

total cost.<br />

But my plan says that my<br />

exams and other procedures are<br />

covered at 100%.<br />

That 100 percent is usually<br />

what the insurance carrier allows<br />

as payment towards a procedure,<br />

not what your dentist may<br />

actually charge. Dentist’s fees are<br />

usually a reflection of the level<br />

and quality of care in a particular<br />

office. Some cost more, some cost<br />

less, depending on the costs of<br />

running their office, how much<br />

they pay their staff, the materials<br />

they use, etc. An employer<br />

usually selects a plan with a list of<br />

payments that corresponds to its<br />

desired premium cost per month.<br />

Therefore, there may be a portion<br />

not covered by your benefit plan,<br />

depending on who you choose to<br />

see.<br />

Why is there an annual<br />

maximum on what my plan<br />

will pay?<br />

Although most maximum<br />

amounts have not changed in<br />

30+ years, a maximum limit is<br />

your insurance carrier’s way of<br />

controlling payments. Dental<br />

plans are different from medical<br />

plans, in that dentistry is needed<br />

frequently. Medical emergencies<br />

are rare. It is your dentist’s<br />

responsibility to recommend<br />

what you need, not just what<br />

your insurance covers.<br />

If my insurance won’t pay for<br />

this treatment, why should I<br />

have it done?<br />

It is a mistake to let your benefits<br />

be your sole consideration when<br />

you make decisions about dental<br />

treatment. People who have lost<br />

their teeth often say that they<br />

would pay any amount of money<br />

to get them back. Your smile,<br />

facial attractiveness, ability to<br />

chew and enjoy food, and general<br />

sense of well-being are dependent<br />

on your teeth.<br />

Where Are Medicare Hospital Ratings?<br />

If you had been hoping to go<br />

to the Centers for Medicare and<br />

Medicaid Services website and<br />

take a look at its new hospital<br />

ratings, you’ll be disappointed.<br />

It doesn’t exist yet. The very day<br />

before the site was to launch, it<br />

was delayed.<br />

It seems that Congress, along<br />

with the hospital industry, pushed<br />

to stop the launch in its tracks.<br />

For the survey, hospitals are rated<br />

for more than 100 measures<br />

of care, but the information is<br />

often confusing. (Or perhaps<br />

they’re afraid the information<br />

will make them look bad.) For<br />

example, hospitals objected to<br />

a Medicare patient death rate<br />

being known to women trying<br />

to choose a hospital for having<br />

a baby. Another objection was<br />

that a hospital’s death rate might<br />

be because the patients are low<br />

income.<br />

Hospitals called 60 senators and<br />

more than 200 representatives<br />

and asked for the delay so the<br />

information can be reassembled.<br />

We have ratings on CMS for<br />

various patient surveys, and<br />

those are of value. The higher<br />

the number of stars, the lower<br />

the death and readmission rates.<br />

We have a star rating system for<br />

nursing homes -- covering health<br />

inspections, staffing, quality<br />

measures and more. There’s one<br />

for Home Health Compare that<br />

includes a patient survey rating.<br />

The new rating system for<br />

overall hospital quality was meant<br />

to make the information about<br />

hospitals easier to understand,<br />

with over 60 of the measurements<br />

being condensed into the star<br />

system, with ratings from one to<br />

five stars.<br />

Initially the CMS told<br />

Congress that the website would<br />

be running by July. Now they’ve<br />

backtracked and say it might be<br />

after July if they’re still working<br />

on the data.<br />
