Ipswich Plastic Bag Ban
By Stewart Lytle, Reporter
–––––––––––––––––
IPSWICH – Amid all the discussion among town leaders last week about budgets
and taxes, five high school students stood up to tell their elders it was time to make
their town cleaner and healthier by banning the ubiquitous single-serve plastic bags
and Styrofoam plates, cups and containers.
The students, one senior and four juniors, made well-researched arguments that
the plastic bags handed out by many retailers and the Styrofoam cups of coffee and
containers so common in fast food restaurants and gas stations are harmful to the
environment and personal health.
The 12th article on the Ipswich Town Meeting agenda not only passed
unanimously, but about half of the audience that packed into the high school’s
performing arts center gave the students a standing ovation.
Three of the students, Claire McElwain, Claire Werner and Jillian Wall, the senior
in the team, fought to ban plastic bags. Charlotte Howe and Continued on page 3
More Waterfront Condos Coming
By Stewart Lytle, Reporter
NEWBURYPORT – With the exploding housing market here the pace of building long
discussed townhouses on the Merrimack River waterfront here is quickening.
This is not another story about the latest plans by the Newburyport Redevelopment
Authority to build residences on the public waterfront near downtown. Nor is it about the
New England Development’s plans to build a hotel, shops and maybe residences on its land
between the river and Merrimac Street.
Private developers are turning waterfront properties into expensive townhouse units upriver
away from the downtown waterfront which draws the opposition from the Committee for
an Open Waterfront. Being built are townhouses and condominiums on private land that
is subject only to planning, zoning and conservation regulations and of Continued on page 3
WEST NEWBURY — In what he called his first community policing action
here, Police Chief Art Reed unveiled a new painted fresco of the town seal in the
police headquarters lobby.
Painted by Pentucket Arts Academy senior Jennifer Nelson, the fresco is a
collaboration between the police department and Pentucket Regional High
School. It was dedicated in memory of the late Rowley Police Chief Charles
Hardy, who died in 1973 in a car crash while on duty.
The town seal was originally donated by Fred Hardy, the nephew of Chief
Charles Hardy and owner of Hardy’s Auto Body of Rowley, specializing in the
building, repairing, and custom painting of autos, motorcycles, trikes, boats, and
houseboats.
Chief Scott Dumas represented Rowley at the dedication.
The fresco will adorn the entryway of the West Newbury Public Safety
Complex, which houses the police and fire departments, as well as the emergency (L to R) Officer Eric Forni, Rowley Chief Scott Dumas, Fred Hardy, West
The Pettengill House would like to thank the author, Tammy Flanders Hetrick, Kayleigh Delback and Caffe di
Siena, and Beth and John Sayre-Scibona Community for their collaborative efforts in Connections
raising $235.00 for The Pettengill House.
A volunteer and teacher in our local school, an author and a local business all coming together unexpectedly to
support a local nonprofit!
It didn’t start out as a fundraiser. Local residents Beth and John Sayre-Scibona met the author while in Vermont
and arranged for her visit to read from Business her book Stella Rose at Caffe Spotlight
di Siena in Newburyport. Before the event,
John served as tour guide while Beth excused herself to purchase milk for The Pettengill House’s Saturday Night
Meal Program. Curious, the author asked about the program. Beth, a fifth grade teacher at Salisbury Elementary
School, explained
Real Estate
For her volunteer role. The Saturday Night Meal Program began in 1997 when a group of volunteers
Sale
came together to provide hot meals for people in the community who were • in For need. Last year Sale over 2,500 meals
were delivered. Beth, a volunteer who coordinates getting milk for the program, collects money from the SES staff
so that she and John can purchase and deliver an average of 30 gallons of milk a month to the meal program.
Touched by this information and the clients it supports, Hetrick
proceeds from her book
sales that day would be donated. In addition, thanks to Caffe di Siena, she was able to leave additional books
behind and all purchased there would be donated as well.
It’s a wonderful story of how volunteers in action speak louder than words!
We also want to extend our gratitude to the teachers at SES for their continued donations as well as all the
volunteers who show up each month Pets, to cook, prepare Animals, and deliver meals to those in need. Plus The dedicated service
of many volunteers makes a big difference in our local communities.
Dear Editor,
Pundits and ‘experts’ say Trump must do this and Trump must do that to unify the Republican party. I have a
news flash for them. The Donald won. He beat the best we have while running an anti establishment campaign. It
is they, the entrenched career politicians that need to change their stripes and get with the program of the people.
We learned this time around for the first time, at least for me the voters don’t pick our nominee. The delegates
pick the delegates and they pick the nominee. What a sweet deal. The power brokers pick our candidate and we
have nothing to say about it. It is time to clear out the cesspool in Washington and replace it with patriots who
put our country first.
If you want to live on the
Merrimack River waterfront, there
will soon be lots of opportunities.
Berkeley Investments and
First Republic Development will
complete this fall a long-stalled
project to build nine two- and
three-bedroom condos adjacent to
Cashman Park. The project is also
converting an 18th century barn
into a 10th condo.
Eric Ekman, the Berkeley
vice president for development,
declined to say how much the
condos would sell for. He referred
the question to his broker who did
not return calls and whose web site
says only that the townhomes “are
coming soon.”
A stone’s throw upriver, Chart
House Development is proposing
to the city’s Zoning Board of
Appeals that it be allowed to build
11 condos on the waterfront at the
Newburyport Yacht Club. Its next
hearing is scheduled for June 14.
The members-only yacht club,
established in 2001, includes a
club house and marina. The marina
features three sheltered, deepwater
docks that can accommodate 192
slips. The club house amenities
include a pool and restrooms with
hot showers. Annual membership
More Waterfront Condos Coming
is $2,300.
The property, bought by the
current owners in 1980, stores
boats in the winter on 96 double
decker racks. The proposal is to
tear down the racks and dilapidated
buildings to make room for threestory
townhouses. The yacht
club and some boat storage will
continue.
“The rack storage operation,
although clearly a marine use,
is really not the ideal use in a
residential neighborhood,” said
James Lagoulis, owner of the
yacht club. The club uses heavy
equipment to haul and launch
boats all week, but particularly on
summer weekend. “This is not an
ideal fit with a family marina,” he
said.
The club got into the boat
storage business when it found
that running a summer yacht club
was not financially viable, he said.
In the 1980s, he won approval
to build 17 residences on the
property, but the housing market
crashed and killed those plans, he
said.
Today, his only option to selling
off an acre of the five-acre tract for
townhouses is to add a third level
of racks for more boat storage.
Ipswich Plastic Bag Ban
Continued from page 1 recognition,” said Claire
Carly Restuccia proposed banning McElwain.
Styrofoam products.
The bans, the students explained,
will go into effect one year after
the Massachusetts attorney general
approves the ordinance. Fines
go from a warning to $50 for
the first offense to $100 for each
subsequent offenses.
The bans will make Ipswich one
of a growing number of towns
and cities, including Hamilton
and Newburyport, who have
taken steps to rid their landscape
of the plastic bags and Styrofoam.
Newburyport approved the ban
on plastic bags, while Hamilton
has banned both.
Lori LaFrance, who taught
all five students in a class on
environmental sustainability last
year, said they went from being
timid in September to being “a
force to be reckoned with.”
The five young women were
named the runner up in the New
England states for the President’s
LaFrance said the five students
learned first hand how town
government works. They first
approached the town Board of
Health for its support. Then they
asked the School Committee,
followed by requests for support
to the Town Manager, the Finance
Committee and the Board of
Selectmen. They won the support
of each town board and manager
Robin Crosbie.
To the Town Meeting, they
argued that the ban would
have little negative impact on
the town’s economy. It would
make the town, whose economy
depends on visitors, cleaner with
fewer eyesores. And they argued
that because Styrofoam may cause
cancer and plastic bags can end
up in the food supply, the town
residents would be healthier.
Werner told the crowd who
gathered in the school’s Performing
Arts Center about a turtle that
Environmental Youth Award. washed up on a Cape Cod beach
They will be honored by the U.S.
Environmental Protection Agency
on May 23rd at the high school
and again by the legislature at the
State House in Boston on May
27.
“It is nice to have some
with three pounds of plastic bags
in it.
When the town moderator
Tom Murphy raised the question
of whether the town should
require stores to charge a fee to
customers who wanted to use
better use,” he said.
Craig Pessina with Chart House
Development is proposing to build
three-story townhouses, called
the Townhouses at Newburyport
Yacht Club. The living room on
the second floor would have a
deck overlooking the river. The
master bedroom on the third floor
would have a balcony to enjoy the
river views, according to the plans
presented to the city.
First Republic’s Newburyport
Landing will feature luxury condos
with about 2,500 square feet. They
will have two or three bedrooms
in each and have great views of
the Merrimack River from inside
the units and on decks and patios
outside.
Newburyport Landing is also
renovating three long-empty
houses on Merrimac Street next
to the Towle Building into five
residences. Two of the units in one
of the houses on Merrimac Street
will be sold as affordable housing.
One of the houses, believed to
him that the attorney general has
ruled that towns cannot require
stores to charge their customers
a fee. Murphy could barely stifle
a smile at Werner’s confident and
informative response.
Other speakers supported the
bans, saying it was refreshing to
hear such informative, yet politely
presented arguments.
The only objection to the ban
came from a woman who asked if
she was going to buy biodegradable
dog poop bags.
“Yes,” McElwain told her.
“But you can get them in a big
box at Shaw’s, and they are not
expensive.”
The team surveyed businesses
in Ipswich about the bans. Of
50 businesses asked about plastic
bags, 42 supported it, the students
said.
Of 28 restaurants and retailers
surveyed, 10 said they use
Styrofoam. Some were already
planning to move to other
products, Howe and Restuccia
said.
When asked what businesses
opposed the plastic bag ban,
McElwain said it was better not to
single out any businesses.
“Good answer,” Murphy said.
FULL MOON AND FOLKLORE
HIKE
Join us for a hike under the Full
Flower Moon. Saturday, May 21| 8-
10PM. The Algonquin tribes named this
moon for the abundance of wild flowers
starting to bloom this time of year. Other
Native American tribes called this moon
Mother’s Moon, Milk Moon, and Corn
Planting Moon; temperatures are warm
enough for animals to safely bear their
young, and with a near end to late frosts,
planting can begin. We’ll share other facts
and folklore around a bonfire at the end
of our hike, so brush up on your lunar
KAYAK FOX CREEK WITH
PICNIC
Join us as we kayak the winding
waters that meander through the marsh
between the Ipswich River and Essex
Bay. Sunday, May 22| 11AM-2PM. We’ll
start our adventure at Steep Hill Beach,
then paddle into the Ipswich River to
Fox Creek, traveling through the oldest
man-made tidewater canal in the United
States! As we wind our way through the
marsh, we’ll be on the lookout for herons,
egrets, and other shore birds -- with
luck we’ll spot an osprey hunting for its
Whittier Home Opens for the 2016 Season
The Whittier Home & Museum
at 86 Friend St. in Amesbury
opened its doors to the public for
tours of the Museum on Saturday,
May 7th, 2016. The house where
John Greenleaf Whittier, beloved
Quaker poet, abolitionist and
crusader for social justice lived and
wrote during his adult life is on the
register of National Historic Places.
The tours, conducted by docents
trained by Susan Herman, senior
docent and historian at the Whittier
Home include six rooms inside the
house, the Victorian Garden and
the Summer Kitchen located to the
rear of the garden. The tours are
rich in narrative of life in the 1800’s,
covering the years leading up to the
Civil War and Whittier’s role as a
Quaker, abolitionist and peaceful
activist during those turbulent times.
Numerous documents, pictures,
furniture and artifacts are on display,
and many have been professionally
restored after incurring water
damage in early 2015. Christina
Bryant, president of the Whittier
Home notes that, “it is well worth
the price of admission alone just to
see the excellent restoration work
that has been done throughout the
Museum.”
The House Museum is open to
the public for guided tours every
Saturday from May through October,
11:00am to 4:00pm. Special tours
e Town Common
can be arranged by calling the
The Annual Plant & Bake Sale is
scheduled for Saturday, May 28th,
from 9:00am until 1:00pm. (Rain
date is May 29th). This event is
open to the public and will be held
in the garden. There will be many
unique plants and herbs to be
purchased, dug up and potted by
Whittier Home members. The Bake
sale, also held in the garden, will
feature the traditional homemade
pies, cookies, sweet and savory
breads with coffee, lemonade or
water to quench your thirst. But
this year will highlight the new and
exciting addition of “John’s Jams”!
Coastal Connections of Amesbury
will donate 48 jars of Kimball’s jam
which will bear a creatively designed
label as tribute to the poet who so
loved the fruit trees and grape arbor
that grew in his garden. Who could
resist the temptation of breakfast
with Kimball’s jam on toast with
Mr. Whittier in attendance?? Don’t
miss this fun event at the Whittier
A Summer Read program is
planned in conjunction with the
Amesbury Public Library to read
and discuss the mystery novel,
“Delivering the Truth”, written
by Whittier Home member and
Amesbury resident, Edith Maxwell.
We hope that many students as well
as adults will read the book which
was set in 1888 Amesbury, and
features John Greenleaf Whittier in
its cast of characters!
For
Sale
When it is time to sell, a
REALTOR® will present the seller
with a contract that allows that real
estate agency exclusive rights to list,
market and sell your home. Within
this contract are some important
items that sellers should be aware
of.
Price and Terms of Sale
You and your REALTOR®
presumably have sat down and
reviewed what your home is worth in
the current market. Your REALTOR®
should have shown you comparable
homes in the area of yours. He or
she should also be basing the price
of your home on comparable sales,
not just homes that are listed for
sale. Most sellers have a general
idea of what their home is worth by
keeping track of other sales in town.
Please, please, please do not take this
portion lightly; the theory of “we
can always come down in price” isn’t
a great strategy. Your home is only
“new” to the market once.
In addition to the price, you will
disclose what personal property, if
any, goes with the house when you
sell it. Personal property is anything
that is not attached or fixed to the
home, such as washers, dryers or
refrigerators
You may have items that are
attached to the home and considered
“real property”. For example you
may have a door knocker that has
been passed down from generation
to generation, since the door
knocker is attached to the house,
it is considered “real property” and
a buyer would expect it to go with
the house. We include a separate
sheet listing inclusions/exclusions
for a seller to check off that we make
available to potential buyers.
Commission
While I do really love my job, I
have a mortgage as well so when
completing the listing agreement,
you and your REALTOR® will agree
on the amount of the real estate
commission. The listing contract
also specifies when the commission
is earned. It should read if and when
a sale is recorded at the Registry of
Deeds regardless of who buys the
home.
Details of a Listing Contract
Sports • Sports • Sports
By John McCarthy, Rowley Realty
If there is a real estate agency that
represents the buyer in the sale, the
Pets, Animals, Plus
seller’s real estate agency will give a
portion of the commission to that
company. This should be spelled
Health out on the listing agreement & Fitness
as well.
Listing Period
The start and end of the contract
with your real estate agency.
Multiple Listing Service (MLS)
Your listing contract specifies
whether or not the house will be
listed with the local Multiple Listing
Service (MLS). The MLS is where
other REALTORS® see your home,
and their web site populates to
dozens of other web sites like Zillow
and Realtor.com automatically.
It makes little sense not to list in
MLS.
Agency Duties of a Listing Agent
Real estate agents are more than just
salespeople. We have a duty, called a
“fiduciary duty to our clients”. This
means the agent is responsible to act
in the best interests of their client.
We aren’t simply selling an object,
we have a responsibility to our client.
The person behind the counter at a
convenience store has no fiduciary
duty to Phillip Morris when selling
a pack of cigarettes. We not only
have this duty but a Code of Ethics
as well.
The listing contract will specify
that your REALTOR® is acting as
a “seller’s agent.” This means that,
in the sale of your house, they are
working for you. However, there
may be times when your agent has
a client who wants to buy your
home. If your agent also represents
the buyer, the listing contract
should specify that they provide an
additional disclosure that details
whether they continue to act as your
agent or assume the duties of a dual
agent.
Lockbox
A lockbox is a basically a padlock
with a key inside to your home
can be placed. Only someone with
a combination can get into the
lockbox and access the key to your
home.
The listing contract specifies
whether you allow a lockbox or not.
It is locked into place, usually on the
. Carpentry . Masonry . Landscaping . Roofing . Basements . Water Entry
. All Phases of Construction . Commercial/Residential
. All Maintenance Work . All Types of Restorations
. Free Initial Consultation . Project Management
front door and cannot be removed.
Only other agents can access the key
that is located within the lockbox.
This is not something that we will
ask of our sellers. You have hired us
to represent your home, and we will
always accompany buyers on visits.
In Conclusion
You are certainly welcome at any
point to take a step back and ask
that your attorney review this for
you. Please don’t hesitate to ask
your REALTOR® for an explanation
on any portion. We are looking
to represent you in the best light
possible not put you in the dark
right off the bat.
ARIES (March 21 to April 19)
A once-harmonious relationship
appears to be hitting some sour
notes. Spend some time together to
see why things have gone off-key.
(c) 2015 King Features Syndicate, Inc. What you learn might surprise you.
TAURUS (April 20 to May 20) You
feel a need to make some changes. Good -- you can do it on a small
scale (some new clothes, for example), or go big and redecorate your
home and/or office.
GEMINI (May 21 to June 20) Control your tendency toward early
boredom. A situation in your life might be taking a long time to
develop, but patience pays off. Stay with it.
CANCER (June 21 to July 22) You might feel that you’re on an
emotional roller coaster this week. Don’t fret; just ride it out and let
things settle down. A Pisces shows understanding.
LEO (July 23 to August 22) Do something different for once -
- compromise. A stubborn stand on an important issue proves
counterproductive. You need to be open to new ideas.
VIRGO (August 23 to September 22) A friend offers advice that
you perceive as an act of betrayal. But before you turn against the
messenger, pay attention to the message.
LIBRA (September 23 to October 22) A year of riding an emotional
pogo stick finally settles down. Use this calmer period to restore
frayed relationships and to pursue new opportunities.
SCORPIO (October 23 to November 21) Your words can sting, so
be careful how you respond to a friend’s actions. A calm approach
could produce some surprising facts.
SAGITTARIUS (November 22 to December 21) Be careful about
whose secrets you’re being asked to keep. They could impose an
unfair burden on a straight arrow like you.
CAPRICORN (December 22 to January 19) While you prefer
taking the tried-and-true course in life, be adventurous this week
and accept a challenge that can open new vistas.
AQUARIUS (January 20 to February 18) Your strong sense of
justice helps you deal with a job- or school-related situation. Stay
with your principles. A Sagittarius emerges as a supporter.
PISCES (February 19 to March 20) You need to build a stronger
on-the-job support system to convince doubting colleagues that your
innovative proposals are workable.
BORN THIS WEEK: You might not say much, but you’re capable
of extraordinary achievements. You are a loyal friend and a devoted
family person.
Health & Wellness
By J. Peter St. Clair, DMD
Generally, people have
“insurance” to protect the most
important things in their lives.
Whether it is medical, dental,
car, life, disability, home owners
or trip insurance, most of us rely
on this coverage should we need
it.
We are quick to say, “What does
my insurance cover?” sometimes
before we even contemplate what
is in our best interest…..or, who
has our best interest in mind.
One thing is for sure – insurance
companies are looking to pay out
the minimum possible.
Patients will sometimes balk at
treatment not covered by their
dental insurance. Dentists will
often hear, “Just do what my
insurance covers. I don’t want
anything extra.” In fact, a recent
ADA poll showed that a lack of
dental insurance was the No. 1
reason most patients gave for not
visiting a dentist. So, here are just
a few frequent questions patients
often ask about dental insurance.
Why doesn’t my insurance
cover all of the costs for my
dental treatment?
I know you don’t really want
to hear it but - dental insurance
isn’t really “insurance” (defined
Brighter Smiles...
as a payment to cover the cost
of a loss) at all. It is a monetary
benefit, typically provided by an
employer, to help their employees
pay for routine dental treatment.
“Dental Insurance” is, always has
been, and always will be, only
designed to cover a portion of the
total cost.
But my plan says that my
exams and other procedures are
covered at 100%.
That 100 percent is usually
what the insurance carrier allows
as payment towards a procedure,
not what your dentist may
actually charge. Dentist’s fees are
usually a reflection of the level
and quality of care in a particular
office. Some cost more, some cost
less, depending on the costs of
running their office, how much
they pay their staff, the materials
they use, etc. An employer
usually selects a plan with a list of
payments that corresponds to its
desired premium cost per month.
Therefore, there may be a portion
not covered by your benefit plan,
depending on who you choose to
see.
Why is there an annual
maximum on what my plan
will pay?
Although most maximum
amounts have not changed in
30+ years, a maximum limit is
your insurance carrier’s way of
controlling payments. Dental
plans are different from medical
plans, in that dentistry is needed
Am I Covered?
frequently. Medical emergencies
are rare. It is your dentist’s
responsibility to recommend
what you need, not just what
your insurance covers.
If my insurance won’t pay for
this treatment, why should I
have it done?
It is a mistake to let your benefits
be your sole consideration when
you make decisions about dental
treatment. People who have lost
their teeth often say that they
would pay any amount of money
to get them back. Your smile,
facial attractiveness, ability to
chew and enjoy food, and general
sense of well-being are dependent
on your teeth.
Other than complaining to
Where Are Medicare Hospital Ratings?
If you had been hoping to go
to the Centers for Medicare and
Medicaid Services website and
take a look at its new hospital
ratings, you’ll be disappointed.
It doesn’t exist yet. The very day
before the site was to launch, it
was delayed.
It seems that Congress, along
with the hospital industry, pushed
to stop the launch in its tracks.
For the survey, hospitals are rated
for more than 100 measures
of care, but the information is
often confusing. (Or perhaps
they’re afraid the information
will make them look bad.) For
example, hospitals objected to
a Medicare patient death rate
being known to women trying
to choose a hospital for having
a baby. Another objection was
that a hospital’s death rate might
be because the patients are low
income.
Hospitals called 60 senators and
more than 200 representatives
and asked for the delay so the
information can be reassembled.
We have ratings on CMS for
various patient surveys, and
those are of value. The higher
the number of stars, the lower
the death and readmission rates.
We have a star rating system for
nursing homes -- covering health
inspections, staffing, quality
measures and more. There’s one
for Home Health Compare that
includes a patient survey rating.
The new rating system for
overall hospital quality was meant
to make the information about
hospitals easier to understand,
with over 60 of the measurements
being condensed into the star
system, with ratings from one to
five stars.
Initially the CMS told
Congress that the website would
be running by July. Now they’ve
backtracked and say it might be
after July if they’re still working
on the data.
If you want to view the other
ratings, go online to cms.gov and
put ratings in the search box.
