located in a parking lot, locked but with no keys. The family states that<br />

it is believed that she may have met with James Snovelle before her<br />

disappearance. He was found in Coffey County, KS 5 days later, but<br />

committed suicide before he could be questioned.<br />

funds for long-term projects.<br />

I<br />

live in Southeast Oklahoma and need<br />

to know what to expect when my son is<br />

sued for an accident. He was involved<br />

in an accident the cops say was his fault<br />

and sent the other driver to the hospital and<br />

totaled both cars. Thank goodness he is<br />

only slightly shook up. There is no evidence<br />

he was drinking or texting when the accident<br />

occurred. We are not rich, but are buying a<br />

house and I have two trucks I lease to a major<br />

truckload carrier and I drive one locally.<br />

My son has insurance, but just the state<br />

minimum. Am I exposed in any way and can<br />

they get my house and trucks?<br />

Everything depends on the facts of the<br />

case. Who owns the car he was driving.<br />

How old is your son? Are your trucks<br />

incorporated? How is your house titled and<br />

how much equity do you have in it? Will<br />

the other driver live and if so what are his<br />

injuries?<br />

In order to be sued, there has to be damages<br />

and it appears there are property damages<br />

here with the totaled cars and personal<br />

damages with the other driver hurt and in the<br />

hospital. Let me give you a simple explanation<br />

of the laws of Oklahoma as they relate<br />

to damages, but everyone needs to keep in<br />

mind that each state has different law and<br />

rules for damages.<br />

Damages Recoverable in a Personal Injury<br />

Action in Oklahoma are governed primarily by<br />

23 O.S. §§ 3, 4, 5, and 9. In particular, a jury is<br />

allowed to consider a plaintiff’s physical pain<br />

and suffering, past and future; mental pain and<br />

suffering, past and future; age, physical condition<br />

and nature and extent of injuries; whether the<br />

injuries are permanent; any physical impairment;<br />

disfigurement; impairment of earning capacity,<br />

loss of earnings and time; and the reasonable expenses<br />

of the necessary medical care, treatment<br />

and services, past and future in fixing the amount<br />

of a plaintiff’s damages.<br />

While each side bears its own attorney fees in<br />

a personal injury action, that is not the case for<br />

claims of property damage. The prevailing party<br />

in claims for negligent injury to property is entitled<br />

to a reasonable attorney fee. The practical<br />

effect of this law is that defendants often attempt<br />

to resolve the property damage aspect of a case<br />

early.<br />

As set forth previously, in Oklahoma the<br />

damages recoverable in wrongful death actions<br />

are specifically listed in 12 O.S. §§ 1<strong>05</strong>3 and<br />

1<strong>05</strong>5.<br />

Oklahoma has adopted a multi-tiered system<br />

for assessing punitive damages. Actions for<br />

breach of duty or obligation (other than contract)<br />

may include claims of punitive damages for sake<br />

of example and for punishment based upon the<br />

following criteria: the seriousness of the hazard<br />

to the public arising from defendant’s misconduct;<br />

the profitability of the misconduct to the<br />

defendant; the duration of the misconduct and<br />

any concealment of it; the degree of the defendant’s<br />

awareness of the hazard and its excessiveness;<br />

the attitude and conduct of the defendant<br />

upon discovery of misconduct or hazard; in cases<br />

involving corporations or other entities, the number<br />

and level of employees involved in causing<br />

or concealing the misconduct; and the financial<br />

condition of the defendant.<br />

Tier I requires the jury to find by clear and<br />

convincing evidence of conduct amounting to<br />

reckless disregard for the rights of others, or that<br />

an insurer has recklessly disregarded its duty to<br />

deal fairly and act in good faith with its insured.<br />

Exemplary damages in Category 1 may not exceed<br />

either $100,000.00 or the amount of actual<br />

damages awarded, whichever is greater.<br />

Tier II involves the jury finding by clear<br />

and convincing evidence that a defendant acted<br />

intentionally and with malice towards others,<br />

or that an insurer intentionally and with malice<br />

breached its duty to deal fairly and act in good<br />

faith with its insured. Damages in Category II<br />

may not exceed the greater of $500,000.00, twice<br />

the amount of actual damages awarded, or the increased<br />

financial benefit derived by the defendant<br />

or insurer as a direct result of the conduct causing<br />

the injury to the plaintiff and other persons.<br />

This category permits the trial court to reduce<br />

any award for punitive damages by the amount<br />

which the court finds the defendant or insurer<br />

has previously paid as a result of other punitive<br />

damage verdicts in the State of Oklahoma for the<br />

same conduct.<br />

Tier III is used when the jury finds by clear<br />

and convincing evidence that a defendant acted<br />

intentionally and with malice towards others or<br />

an insurer intentionally and with malice breached<br />

its duty to deal fairly and act in good faith with<br />

its insured, coupled with a finding by the Court<br />

on the record, out of the presence of the jury,<br />

that there is evidence beyond a reasonable doubt<br />

that the defendant or insurer acted intentionally<br />

and with malice and engaged in life-threatening<br />

conduct to humans. If such a finding is made,<br />

the jury can assess exemplary damages in any<br />

amount it deems appropriate.<br />

Oklahoma public policy looks with disfavor<br />

upon coverage by insurance companies of punitive<br />

damages. However, an exception exists<br />

where an insured’s liability for punitive damages<br />

is vicariously imposed due to the misdeeds of its<br />

representative. The Oklahoma Supreme Court<br />

has allowed an exception permitting punitive<br />

damages to be insurable when the basis of liability<br />

is not negligent hiring, training or retention,<br />

but is rather truly respondeat superior. However,<br />

it must be determined on a case-by-case basis.<br />

Applying your facts to the law results in the<br />

following. Damages will be recoverable in this<br />

accident from your son. The plaintiff’s estate<br />

can even sue for wrongful death if the plaintiff<br />

dies. You son’s basic insurance may not be<br />

enough to cover both personal and property damage<br />

so the court could find he owes money to the<br />

plaintiff.<br />

If you son is still a minor, under 18 years old,<br />

then you can be held liable for his actions and<br />

can expect to be named in the suit. If he is an<br />

adult, 18 and over, then you will not be sued unless<br />

the car was in your name or if incorporated<br />

in your trucking corporation listed as an asset.<br />

If it is in the corporation’s name then they can<br />

go after your trucks. If it is in your name, then<br />

they can go after your house and corporations<br />

since you own them. They may not go after<br />

your house if you have so little equity in it that it<br />

would not be cost effective to try to get it.<br />

As far as punitive damages, you have not<br />

given sufficient information to make that call.<br />

OOIDA Asks FMCSA<br />

to Extend Deadline<br />

for National Registry<br />

of Certified Medical<br />

Examiners<br />

The Owner-Operator Independent<br />

Drivers Association has requested that the<br />

Federal Motor Carrier Safety Administration<br />

extend the registration deadline for Certified<br />

Medical Examiners. As of this time, there is a<br />

shortage of medical examiners that have been<br />

accepted in to the new national registry.<br />

“It’s a source of concern for us that there<br />

are so few examiners registered so far,” said<br />

OOIDA Executive Vice President Todd Spencer.<br />

“And it also should be a source<br />

of serious concern for the agency.”<br />

Approximately 25 percent of the<br />

goal of 40,000 medical examiners<br />

has been reached with only six<br />

weeks to go before the enforcement<br />

deadline. OOIDA is concerned<br />

that some truck drivers will not be<br />

able to become recertified before<br />

their current certification expires. Those who<br />

are able to find an examiner on the national<br />

registry and schedule an appointment to be<br />

certified may face much greater costs and<br />

burdens. The artificial shortage of examiners<br />

could mean that many drivers will have to<br />

drive a few hundred miles out of their way to<br />

complete their certification. Fewer examiners<br />

could also lead to longer wait times for drivers<br />

and no opportunities for walk-ins.<br />

In May 2012, FMCSA established a National<br />

Registry of Certified Medical Examiners<br />

and set the number at 40,000 medical<br />

examiners to be registered by the compliance<br />

date of May 21, 20<strong>14</strong>. As of today, the total<br />

number of registered medical examiners is a<br />

little more than 10,000.<br />

Truckers to Post<br />

Proposed ELD Rule<br />

The Owner-Operator Independent Drivers<br />

Association is reaching out to all truckers<br />

to encourage them to post comments on a<br />

proposed rule to mandate electronic logging<br />

devices.<br />

OOIDA will be drafting comments on behalf<br />

of anyone that would be forced to operate<br />

under ELDs if the proposal turns<br />

into a final rule, as well as smallbusiness<br />

truckers, which make up<br />

the majority of trucking businesses.<br />

The Federal Motor Carrier Safety<br />

Administration announced an open<br />

comment period, which began once<br />

the proposal was published in the<br />

Federal Register on Friday, March<br />

28. It will last for 60 days.<br />

OOIDA says the proposed rule as written<br />

will not improve highway safety, does not<br />

fully address the issue of driver harassment<br />

and does not fulfill the requirements by Congress<br />

outlined in the highway bill.<br />

“The agency must address the serious<br />

safety issue of how EOBRs are used to harass<br />

and coerce truck drivers into continuing to<br />

drive regardless of driving conditions, such<br />

as bad weather, congested traffic or simply<br />

if the driver is too tired to drive,” said Todd<br />

Spencer, OOIDA executive vice president.<br />

“FMCSA has yet to show any direct correla-<br />

tion between ELD use and reduced crashes<br />

or any other kind of safety benefit,” said<br />

Spencer.<br />

The Association further notes that<br />

FMCSA is moving forward with a rulemaking<br />

before collecting data from truckers on an<br />

important survey of how ELDs enable driver<br />

harassment by motor carriers, and while a<br />

study, “Evaluating the Potential Safety Benefits<br />

of Electronic Onboard Recorders,” has<br />

yet to be completed.<br />

“Instead of waiting until this vital research<br />

is done, the agency is basing much of<br />

the estimated benefits of this proposal on data<br />

from only five motor carriers, despite the fact<br />

that there are 500,000 trucking companies<br />

across the country,” points out Spencer.<br />

“The annual cost of this rulemaking is,<br />

by FMCSA’s own numbers, greater than<br />

$1.5 billion, yet the actual safety benefit of<br />

the proposal represents less than 25 percent<br />

of its cost. The bulk of the savings used by<br />

FMCSA to justify their rule comes not from<br />

safety benefits, but from the contention that<br />

truckers will save 4.5 minutes each per day<br />

recording their duty status. Given the fact<br />

that trucking is largely a “pay-by-mile”<br />

industry and that FMCSA rules already cap<br />

the amount of time that a driver can operate<br />

a vehicle in a 24-hour period, it is hard to see<br />

how such a “savings” should even play a role<br />

in the agency’s analysis, much less form the<br />

majority of its benefit justification.”<br />

Congress required electronic logging<br />

devices to record not only a driver’s driving<br />

time, but also record-of-duty status, known as<br />

RODS. In the proposed rule, the agency admits<br />

there is no known device that is capable<br />

of automatically recording a driver’s duty<br />

status throughout a work day.<br />

“The agency would like everyone to believe<br />

this rule is simply a switch from paper<br />

to electronic with no unintended consequences,”<br />

said Spencer. “But in reality, they can’t<br />

answer the simple question about whether<br />

the use of an electronic log on its own would<br />

actually make the highways safer and what<br />

problems they will cause in terms of reduced<br />

safety and problems with efficient freight<br />

SAYING GOODBYE TO A DEAR<br />

TRUCKING FRIEND<br />

The Louisville Truck Show (MATS) is<br />

over for another year. It was a great show! It’s<br />

always a pleasure to speak to so many fine<br />

owner-operators. It’s like a reunion each year:<br />

We get to see so many people that we talk to<br />

over the phone, but never get to meet until we<br />

all come together in Louisville.<br />

If you’re in the trucking industry and<br />

have never been to this show, you are doing<br />

yourself an injustice! As you depart from this<br />

show, you should feel great about yourself<br />

and being involved in such a wonderful industry.<br />

It’s been my life for 46 years, with the<br />

past 37 of them spent<br />

building engines for<br />

owner-operators.<br />

Did you know that<br />

from the time a raw<br />

material comes out of<br />

the ground, is manufactured<br />

into a finished<br />

product, and is available<br />

for sale, that it has been<br />

hauled on a truck at<br />

LEAST 7 times? When<br />

it’s all said and done,<br />

75% of the cost paid for<br />

goods sold is a result of<br />

transportation costs. We<br />

will always need trucks<br />

and diesel fuel!<br />

Well it’s now 9 p.m.,<br />

on April 7, and I just got the dreaded phone<br />

call that one of my best Colorado friends has<br />

passed away. Tom Waldow was a psychiatric<br />

social worker form Wisconsin who moved to<br />

Farser, Colorado in 1973. With tears in my<br />

eyes, I have to tell you he was a great man:<br />

He home-schooled his children and purchased<br />

his first dump truck in 1998 while he was<br />

building a new home because he did not like<br />

where the dump truck drivers were dumping<br />

the dirt. That same year, he and his daughter,<br />

Aila, started Waldow and Daughter Trucking.<br />

One of his trucks has a 330 hp DD3<br />

Detroit, and he was told that nothing could<br />

be done to this engine to make it perform. It<br />

had a lot of miles on the engine, so we took<br />

a gamble and gave her some fuel: That little<br />

330 hp Detroit came to life with some ECM<br />

tuning and then the addition of a Pittsburgh<br />

Power Box. Tom’s son,<br />

Nick, is in the excavation<br />

business. Tom<br />

would haul his excavator<br />

up Rabbit Ears Pass<br />

with the box on power<br />

level 6, which means<br />

this little 330hp Detroit<br />

is putting out about 700<br />

hp. Tom would get so<br />

excited that he would<br />

call me while he was on<br />

that mountain to thank<br />

me for giving him the<br />

horsepower and tell me<br />

how wonderful it was to<br />

drive that old Freightliner!<br />

I’m sure God will<br />

have a high performance set of wings waiting<br />

for you, Tom!<br />

MADE IN THE USA<br />

Please help yourself and your truck by<br />

installing our “Made In the USA” crankshaft<br />

damper and mercury-filled engine balancer on<br />

the front of your engine every 500,000 miles<br />

or 10 years; whichever comes first. Crankshaft<br />

dampers DO wear out and will tear you<br />

truck apart, resulting in broken air compressor<br />

brackets, alternator brackets, flywheel bolts,<br />

flywheel housing bolts, springs out of the<br />

clutch disc, input shafts<br />

of transmissions, camshafts,<br />

accessory drive<br />

shafts, and, of course,<br />

crankshafts can all break<br />

from a worn-out, internally hardened damper.<br />

These dampers are filled with silicone and a<br />

large steel ring that moves every time an injector<br />

fires. I have written about this so many<br />

times, yet every day we get phone calls from<br />

owner-operators whose trucks are vibrating,<br />

especially under a pull. Even at the Louisville<br />

Truck Show I spoke with many of you who<br />

have over 1 million miles on your original<br />

damper. You are hurting yourself and your<br />

truck, because these vibrations travel right<br />

up through your seat and into Ours are made<br />

by the inventor of the liquid-filled crankshaft<br />

damper. “Made in the USA” still means<br />

something to us at Pittsburgh Power Inc.<br />

Emissions Testing: The EPA has requested<br />

that parts made for 2007 and older engines be<br />

tested on an engine dyno, so we are complying<br />

with their demands and are getting our<br />

engine dyno set up for the testing. We have<br />

tested many of our parts on the Taylor chassis<br />

dyno and they have LOWERED emissions<br />

per horsepower! By mid-May, we will be able<br />

to verify our test results on the engine dyno.<br />

Soon, every performance part that leaves our<br />

facility will be emissions compliant.<br />

Road King shocks,<br />

OPS-1 By-Pass oil filter,<br />

the Lipe Clutch, stainless<br />

water pipes, Bendix<br />

disc brakes, weed burner exhaust, Fleet-Air<br />

Filter, and the Oil Trap. The engine will have<br />

the ported and ceramic-coated exhaust manifold,<br />

a 15% larger performance Micro-Blue<br />

Turbocharger, our HEAVY 56-pound highperformance<br />

crankshaft Torsional Vibration<br />

Damper, our mercury-filled engine balancer<br />

by Balance Masters, a custom Pittsburgh<br />

Power-programmed ECM, balanced pistons<br />

and connecting rods, and all the rest are genuine<br />

Detroit parts.<br />

We expect the price of this truck, which<br />

is being purchased by Jeff and Kathy Wolter,<br />

to wind up in the range of $182,000 to<br />

$190,000. We also are expecting the Signature<br />

Glider to be capable of 9+ mpg and<br />

produce somewhere north of 600 flywheel<br />

horsepower, even despite its factory 500 hp<br />

Detroit programming, as a result of all of<br />

the performance upgrades and Micro-Blued<br />
