REGULAR MEETING August 13, 2012 MAYOR AND BOROUGH COUNCIL MEETING NO. 20 PAGE NO. 8 WHEREAS, the Chief Financial Officer of the Borough of South River has provided a certification in writing as to the availability of adequate funds for the awarding of the contract described herein. NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the Mayor and Council of the Borough of South River, in the County of Middlesex, the State of New Jersey : 1. That Gary M. Schwartz, Esq. is hereby appointed to defend a Verified Petition filed by Acapulco Tropicana Bar regarding special conditions attached to license number 1223- 33-031-004 for a fee not to exceed $3,500.00 and his previous actions in this matter are hereby ratified. 2. This contract is awarded without competitive bidding as a professional service under the provisions of the Local Public Contracts Law (N.J.S. 40A:11-5 (1) (1) since this contract is for services performed by a person authorized by law to practice a recognized profession and it was not possible to obtain competitive bidding. 3. A copy or summary of this Resolution shall be published in the official newspaper of the Borough of South River within ten (10) days of its passage. DATED: AUGUST 13, 2012 /s/ Jim Hutchison Councilmember /s/ Thomas Roselli Councilmember ROLL CALL VOTE YEAS: Roselli, Trzeciak, Vaughn, Hutchison NAYS: None ABSENT: Farren, Guindi RES: 2012-243 AUGUST 13, 2012 RESOLUTION WHEREAS, there exists the need for the purchase of three (3) new Police Vehicles by the Borough of South River in the County of Middlesex of the State of New Jersey; and WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:11-11 et seq.) permits a contracting unit to purchase goods and services under any contract or contracts for such goods and services entered into by the lead agency in a joint purchasing agreement; and WHEREAS, it appears that the goods and services to be purchased pursuant to this resolution at the price and upon the terms and conditions provided therein, are subject to a contract or contracts for such goods and services entered into on behalf by the Cranford Police Cooperative Pricing System; and

NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the Mayor and Council of the Borough of South River, in the County of Middlesex and the State of New Jersey as follows: 1. The appropriate Borough Officials are hereby authorized to sign those documents necessary for the purchase of three (3) 2013 Ford Police Interceptor Sedans under contract no. 11-314 of the Cranford Police Cooperative Pricing System from Warnock Fleet 175 Route 10 East Hanover, NJ 07936-0524 2. This contract is awarded without competitive bidding pursuant to the provision of N.J.S.A. 40A:11-11(5) payable in three (3) lease payments of $28,327.89 each to Ford Motor Credit Company. 3. Said resolution is now of record and on file in the Office of the Borough Clerk and available for public inspection.
