The Anatomy of a DUI 

An Overview of Alcohol

DUI Defense Attorney 

In the last article I discussed procedures relating 

to the first clue of the Horizontal Gaze 

Nystagmus (HGN) test – Lack of Smooth 

Pursuit. In this article I will continue the 

discussion with the procedures for the second 

clue – “Distinct and Sustained Nystagmus 

at Maximum Deviation.” 

Clue #2: the second clue the officer will 

check for when performing the HGN test 

is “Distinct and Sustained Nystagmus at 

Maximum Deviation” - the involuntary 

jerking of the eye when the eye is held at the 

edge of the subject’s field of vision. Note that 

people will exhibit a slight jerking of the eye 

at maximum deviation even when they have 

no alcohol in their system because the ocular 

nerves naturally want to bring the eye back 

to the center position. However this should 

not be evident for more than a few seconds. 

When a person has alcohol in their system at 

a level of .08% or more, the jerking at the extreme 

will be larger, more pronounced, and 

sustained lasting for more than four seconds, 

and easily observable. Thus the key here is 

distinct and sustained jerking of the eyes at 

maximum deviation. 

Remember the instructions given to the subject 

by the officer were “keep your head still 

and follow this stimulus with your eyes only” 

and “continue following the stimulus with 

your eyes until told to stop.” 

The procedure for this clue is as follows: 

beginning with the stimulus positioned at 

center of the subject’s nose, beginning with 

the subject’s left eye, the officer will move the 

stimulus to the right at a speed of 2 seconds 

until the eye has gone as far to the side as 

possible (maximum deviation). Usually, no 

white will be showing in the corner of the 

eye. Then the officer will hold the stimulus 

(and thus the eye) at that position for a 

minimum of four seconds, and observe the 

eye for distinct and sustained nystagmus. 

Then, the officer will move the stimulus back 

to the left all the way across the suspect’s 

face to check the right eye (again a speed of 

2 seconds), holding the stimulus and eye as 

far to the side as possible, again holding that 

position for a minimum of four seconds to 

observe if distinct and sustained nystagmus 

is present in the right eye. The procedure 

should then be repeated for a total of two 

passes across the suspect’s face for this part 

of the test. 

Again, the timing is important. First, the 

speed of moving the stimulus is important 

because studies have shown that if the officer 

moves the stimulus too fast, the officer will 

actually induce or cause the nystagmus to 

occur. If the officer causes the nystagmus by 

moving the stimulus too fast, the conclusion 

that the nystagmus is caused by alcohol or 

drugs in the body is compromised.

cannot include all the “right” things to 

do or say - because often there is no one 

“right” answer to every situation you might 

encounter. 

The world needs to become an ally to 

transgender people, and your actions will 

help change the culture, making society a 

better, safer place for transgender people 

- and for all people (trans or not) who do 

not conform to gender expectations. 

Did you know? 

You can’t tell if someone is transgender 

just by looking. 

Don’t make assumptions about a transgender 

person’s sexual orientation. 

If you don’t know what pronouns to use, 

listen first. 

These and other questions are quite personal. 

Don’t ask a transgender person to 

explain their world if you have not taken 

the time to educate yourself first.

FRANCISCO VARGAS, ARTIST, ACTIVIST 

The film, “Equal Rights Documentary”, was 

produced, directed, and edited by Francisco 

Vargas. It brings to light the continuing 

struggle, and some of the victories, in the 

struggle for equality among LGBT people. 

This film was entered in the 2010 Palm 

Springs Short Film Festival. It is one example 

of how Francisco Vargas has used his 

creative abilities to illuminate the legitimacy 

of gay and bi people. 

Francisco Vargas came to the United States 

in 1985. Painting and drawing has been a 

natural part of his existence since he was 

a small boy. In Santiago, Chili,where he 

grew up, he created posters and graphics 

for corporate companies and boutiques. 

He was discouraged by some of the repression 

and restrictions in the political life of 

Chili. He moved to New York City to be a 

student at Parsons School. While completing 

his degree at Parsons, he worked at the 

New York Art Institute where he eventually 

became a member of the faculty. He was 

also a faculty member of Briarcliff College 

NY and of the Chub Institute of NYC. He 

taught: cinematography, video production, 

digital film, computer applications and 

graphic design. He also became an advisor 

and initiator of the LGBT Club at the Art 

Institute. 

In 2012, he moved to Palm Springs with 

Tom his husband of 30 years. Here, Francisco 

has collaborated with Roy Smith, also 

an artist, to open the Smith-Vargas Gallery 

at 1003 N. Palm Canyon Drive in Palm 

Springs. The web site of the Gallery exhibits 

the cinematic design creativity of Fancisco 

as seen in the animated front page, which 

incorporates the figure art of Roy Smith 

with the colorful landscape painting of 

Francisco. 

You will find Francisco working in the gallery, 

as his studio, creating paintings with 

a unique depth. He achieves this by using 

a clear glaze, sprayed on between layers of 

brush painting. The mission of Smith-Vargas 

Gallery is to “Open a venue for artists 

to articulate their self-image, self-reflection, 

and self expression - and to expand the sensibility 

of beauty to the community.” 

Francisco is a treasured asset to the broad 

community of Coachella Valley, Palm 

Springs, and especially to the LGBT community. 

His eclectic creativity is demonstrated 

in the various activities of his participation, 

from creating art, to advocating 

for human rights. The two pieces of art 

created by Francisco, shown in this article, 

represent, first, an ink drawing produced as 

a young student in Chili, and now incorporated 

in the painting, titled, “closet”. 

This depicts the frustration and restrictions 

he felt of not being able to express his creativity 

and sexuality. The second painting 

titled, “Out”, illustrates a figure with raised 

arms, embracing the freedom and elation of 

emancipated self expression.

Laverne Cox , an American actress, producer

role as a transgender prison inmate in the 

Netflix series “Orange Is the New Black.” She 

is the first openly transgender person to be

magazine.

California Desert Chorale (CDC) will be 

presenting their 15th Annual Scholarship 

Competition to hear local high school 

seniors and community college students 

perform and compete for scholarships. 

Artistic Director, Tim Bruneau will oversee 

the competition along with judges Charles 

Herrera, Laura Stave and Louie Salcido. 

The competition will be held Sunday, 

January 24 at 1:00p.m, Taylor Hall, Palm 

Desert Community Presbyterian Church. 

Admission is FREE with donations gratefully

Established in 2002 to offer scholarships 

to local high school and community college 

singers who demonstrate exceptional 

vocal ability, the California Desert Chorale 

Scholarship program has helped fourteen 

young singers continue their vocal

The monetary awards are sent directly to 

the winning students’ college to assist in 

defraying the cost of their continuing vocal

amount of time, the officer may see nystagmus, 

but he cannot say that it was distinct 

(very obvious) and that it was sustained 

(lasting). Thus holding the eye in the maximum 

deviation position for a minimum of 

4 seconds is essential. 

Finally, if the officer fails to complete two 

passes and only does one pass, then he has 

no opportunity to rule out a false positive. 

The purpose of the second pass is to ensure 

that what the officer thinks he observed 

in the eyes on the first pass is really there 

by confirming it on the second pass. For 

instance, let’s say on the first pass the officer 

believed he observed distinct and sustained 

nystagmus at maximum deviation present 

in the right eye. On the second pass he 

should be able to confirm the distinct and 

sustained nystagmus at maximum deviation 

in the eyes. If he does not, then it’s not to 

be counted as a clue. Thus the second pass 

is essential!

clue of the Horizontal Gaze Nystagmus test 

- onset of nystagmus prior to 45 degrees.

So, are you a star yet? Are you famous and 

rich? After destroying many relationships I 

would assume you are up there with Jennifer 

Lopez, except you’re Jenny OFF your Block 

and not Jenny from the Block. Oh, you’re not? 

Why is that? Didn’t your evil plan work? I see 

you have all these bookings? No wait, that’s 

not you. Well, you have other projects? No, 

not you. Well then what was all that manipulating 

for years for? Destroying friendships 

and bonds for? You must have had a purpose 

and a reason? Oh, did it back fire? Well, the 

karma train is just pulling up. You have a 

long ride of negative karma coming your way. 

Toot! Toot! All aboard! 

I don’t read reviews posted by internet 

people. Why do I care what some grumpy, 

petty, bitchy, unsatisfied queen cares about 

anything? If I want to judge something I’ll do 

it on my own. No one can tell me what I like 

and don’t like other than myself. 

It’s interesting to hear what I am saying or 

doing from the said DEAD people. How 

would they know? They are dead to me! So, 

use common sense or your own sense next 

time you want to know any truth. Don’t be a 

victim.

You reap what you sow! And you have been 

sowing, so you will be a reaping! You deserve 

it and everyone you brought down because I 

don’t forgive as easy. Once you broke my trust 

you are DEAD to me. There have been a lot 

of deaths. By being said dead to, it means you 

don’t exist. I don’t care about you, think about 

you, see you, hear you, you are pretty much 

DEAD. Six feet under and stinking. You are 

deteriorating. If there ever was an ounce of 

humanity in you it is a thing of the past. 

So, what ever happened to humanity? I blame 

the internet, social media, Television especially 

Hollywood and reality shows. Instant fame 

and egos. Being rich and famous for doing 

nothing. A world of lazy, egotistical assholes. 

Lucky me. I feel I was born in the wrong 

period of time; I like life when it was simpler 

and I think giving people and open forum to 

express their opinions is a bad idea. Especially 

narrow minded, uneducated people.
