The Anatomy of a DUI<br />

An Overview of Alcohol<br />

In the last article I discussed procedures relat<strong>in</strong>g<br />

to the first clue of the Horizontal Gaze<br />

Nystagmus (HGN) test – Lack of Smooth<br />

Pursuit. In this article I will cont<strong>in</strong>ue the<br />

discussion with the procedures for the second<br />

clue – “Dist<strong>in</strong>ct and Susta<strong>in</strong>ed Nystagmus<br />

at Maximum Deviation.”<br />

Clue #2: the second clue the officer will<br />

check for when perform<strong>in</strong>g the HGN test<br />

is “Dist<strong>in</strong>ct and Susta<strong>in</strong>ed Nystagmus at<br />

Maximum Deviation” - the <strong>in</strong>voluntary<br />

jerk<strong>in</strong>g of the eye when the eye is held at the<br />

edge of the subject’s field of vision. Note that<br />

people will exhibit a slight jerk<strong>in</strong>g of the eye<br />

at maximum deviation even when they have<br />

no alcohol <strong>in</strong> their system because the ocular<br />

nerves naturally want to br<strong>in</strong>g the eye back<br />

to the center position. However this should<br />

not be evident for more than a few seconds.<br />

When a person has alcohol <strong>in</strong> their system at<br />

a level of .08% or more, the jerk<strong>in</strong>g at the extreme<br />

will be larger, more pronounced, and<br />

susta<strong>in</strong>ed last<strong>in</strong>g for more than four seconds,<br />

and easily observable. Thus the key here is<br />

dist<strong>in</strong>ct and susta<strong>in</strong>ed jerk<strong>in</strong>g of the eyes at<br />

maximum deviation.<br />

Remember the <strong>in</strong>structions given to the subject<br />

by the officer were “keep your head still<br />

and follow this stimulus with your eyes only”<br />

and “cont<strong>in</strong>ue follow<strong>in</strong>g the stimulus with<br />

your eyes until told to stop.”<br />

The procedure for this clue is as follows:<br />

beg<strong>in</strong>n<strong>in</strong>g with the stimulus positioned at<br />

center of the subject’s nose, beg<strong>in</strong>n<strong>in</strong>g with<br />

the subject’s left eye, the officer will move the<br />

stimulus to the right at a speed of 2 seconds<br />

until the eye has gone as far to the side as<br />

possible (maximum deviation). Usually, no<br />

white will be show<strong>in</strong>g <strong>in</strong> the corner of the<br />

eye. Then the officer will hold the stimulus<br />

(and thus the eye) at that position for a<br />

m<strong>in</strong>imum of four seconds, and observe the<br />

eye for dist<strong>in</strong>ct and susta<strong>in</strong>ed nystagmus.<br />

Then, the officer will move the stimulus back<br />

to the left all the way across the suspect’s<br />

face to check the right eye (aga<strong>in</strong> a speed of<br />

2 seconds), hold<strong>in</strong>g the stimulus and eye as<br />

far to the side as possible, aga<strong>in</strong> hold<strong>in</strong>g that<br />

position for a m<strong>in</strong>imum of four seconds to<br />

observe if dist<strong>in</strong>ct and susta<strong>in</strong>ed nystagmus<br />

is present <strong>in</strong> the right eye. The procedure<br />

should then be repeated for a total of two<br />

passes across the suspect’s face for this part<br />

of the test.<br />

Aga<strong>in</strong>, the tim<strong>in</strong>g is important. First, the<br />

speed of mov<strong>in</strong>g the stimulus is important<br />

because studies have shown that if the officer<br />

moves the stimulus too fast, the officer will<br />

actually <strong>in</strong>duce or cause the nystagmus to<br />

occur. If the officer causes the nystagmus by<br />

mov<strong>in</strong>g the stimulus too fast, the conclusion<br />

that the nystagmus is caused by alcohol or<br />

drugs <strong>in</strong> the body is compromised.<br />

Of course, this list is not exhaustive and<br />

cannot <strong>in</strong>clude all the “right” th<strong>in</strong>gs to<br />

do or say - because often there is no one<br />

“right” answer to every situation you might<br />

encounter.<br />

The world needs to become an ally to<br />

transgender people, and your actions will<br />

help change the culture, mak<strong>in</strong>g society a<br />

better, safer place for transgender people<br />

- and for all people (trans or not) who do<br />

not conform to gender expectations.<br />

Did you know?<br />

You can’t tell if someone is transgender<br />

just by look<strong>in</strong>g.<br />

Don’t make assumptions about a transgender<br />

person’s sexual orientation.<br />

If you don’t know what pronouns to use,<br />

listen first.<br />

These and other questions are quite personal.<br />

Don’t ask a transgender person to<br />

expla<strong>in</strong> their world if you have not taken<br />

the time to educate yourself first.<br />

AdamsArtExpose’<br />

FRANCISCO VARGAS, ARTIST, ACTIVIST<br />

The film, “Equal Rights Documentary”, was<br />

produced, directed, and edited by Francisco<br />

Vargas. It br<strong>in</strong>gs to light the cont<strong>in</strong>u<strong>in</strong>g<br />

struggle, and some of the victories, <strong>in</strong> the<br />

struggle for equality among LGBT people.<br />

<strong>This</strong> film was entered <strong>in</strong> the <strong>20</strong>10 <strong>Palm</strong><br />

Spr<strong>in</strong>gs Short Film Festival. It is one example<br />

of how Francisco Vargas has used his<br />

creative abilities to illum<strong>in</strong>ate the legitimacy<br />

of gay and bi people.<br />

Francisco Vargas came to the United States<br />

<strong>in</strong> 1985. Pa<strong>in</strong>t<strong>in</strong>g and draw<strong>in</strong>g has been a<br />

natural part of his existence s<strong>in</strong>ce he was<br />

a small boy. In Santiago, Chili,where he<br />

grew up, he created posters and graphics<br />

for corporate companies and boutiques.<br />

He was discouraged by some of the repression<br />

and restrictions <strong>in</strong> the political life of<br />

Chili. He moved to New York City to be a<br />

student at Parsons School. While complet<strong>in</strong>g<br />

his degree at Parsons, he worked at the<br />

New York Art Institute where he eventually<br />

became a member of the faculty. He was<br />

also a faculty member of Briarcliff College<br />

NY and of the Chub Institute of NYC. He<br />

taught: c<strong>in</strong>ematography, video production,<br />

digital film, computer applications and<br />

graphic design. He also became an advisor<br />

and <strong>in</strong>itiator of the LGBT Club at the Art<br />

Institute.<br />

In <strong>20</strong>12, he moved to <strong>Palm</strong> Spr<strong>in</strong>gs with<br />

Tom his husband of 30 years. Here, Francisco<br />

has collaborated with Roy Smith, also<br />

an artist, to open the Smith-Vargas Gallery<br />

at 1003 N. <strong>Palm</strong> Canyon Drive <strong>in</strong> <strong>Palm</strong><br />

Spr<strong>in</strong>gs. The web site of the Gallery exhibits<br />

the c<strong>in</strong>ematic design creativity of Fancisco<br />

as seen <strong>in</strong> the animated front page, which<br />

<strong>in</strong>corporates the figure art of Roy Smith<br />

with the colorful landscape pa<strong>in</strong>t<strong>in</strong>g of<br />

Francisco.<br />

You will f<strong>in</strong>d Francisco work<strong>in</strong>g <strong>in</strong> the gallery,<br />

as his studio, creat<strong>in</strong>g pa<strong>in</strong>t<strong>in</strong>gs with<br />

a unique depth. He achieves this by us<strong>in</strong>g<br />

a clear glaze, sprayed on between layers of<br />

brush pa<strong>in</strong>t<strong>in</strong>g. The mission of Smith-Vargas<br />

Gallery is to “Open a venue for artists<br />

to articulate their self-image, self-reflection,<br />

and self expression - and to expand the sensibility<br />

of beauty to the community.”<br />

Francisco is a treasured asset to the broad<br />

community of Coachella Valley, <strong>Palm</strong><br />

Spr<strong>in</strong>gs, and especially to the LGBT community.<br />

His eclectic creativity is demonstrated<br />

<strong>in</strong> the various activities of his participation,<br />

from creat<strong>in</strong>g art, to advocat<strong>in</strong>g<br />

for human rights. The two pieces of art<br />

created by Francisco, shown <strong>in</strong> this article,<br />

represent, first, an <strong>in</strong>k draw<strong>in</strong>g produced as<br />

a young student <strong>in</strong> Chili, and now <strong>in</strong>corporated<br />

<strong>in</strong> the pa<strong>in</strong>t<strong>in</strong>g, titled, “closet”.<br />

<strong>This</strong> depicts the frustration and restrictions<br />

he felt of not be<strong>in</strong>g able to express his creativity<br />

and sexuality. The second pa<strong>in</strong>t<strong>in</strong>g<br />

titled, “Out”, illustrates a figure with raised<br />

arms, embrac<strong>in</strong>g the freedom and elation of<br />

emancipated self expression.<br />

Before I cont<strong>in</strong>ue last <strong>week</strong>s column I just want to friends and so everyone banded together to help,<br />

give a shout out to the Desert Daily Guide. <strong>This</strong> and <strong>in</strong> do<strong>in</strong>g so everyone found common ground.<br />

Last <strong>week</strong> I started writ<strong>in</strong>g about how the Leather<br />

scene, it does scare me a little.<br />

Laverne Cox , an American actress, producer<br />

and LGBT advocate is well known for her<br />

role as a transgender prison <strong>in</strong>mate <strong>in</strong> the<br />

Netflix series “Orange Is the New Black.” She<br />

is the first openly transgender person to be<br />

nom<strong>in</strong>ated for an Emmy Award for act<strong>in</strong>g<br />

and the first to appear on the cover of Time<br />

magaz<strong>in</strong>e.<br />

Bullied as a child for be<strong>in</strong>g fem<strong>in</strong><strong>in</strong>e. Cox<br />

begged for dance lessons, which she began<br />

<strong>in</strong> third grade. She went on to earn a BFA <strong>in</strong><br />

dance from Marymount Manhattan College.<br />

nystagmus is both dist<strong>in</strong>ct and susta<strong>in</strong>ed. If<br />

the eyes are held <strong>in</strong> that position for a lesser<br />

amount of time, the officer may see nystagmus,<br />

but he cannot say that it was dist<strong>in</strong>ct<br />

(very obvious) and that it was susta<strong>in</strong>ed<br />

(last<strong>in</strong>g). Thus hold<strong>in</strong>g the eye <strong>in</strong> the maximum<br />

deviation position for a m<strong>in</strong>imum of<br />

4 seconds is essential.<br />

F<strong>in</strong>ally, if the officer fails to complete two<br />

passes and only does one pass, then he has<br />

no opportunity to rule out a false positive.<br />

The purpose of the second pass is to ensure<br />

that what the officer th<strong>in</strong>ks he observed<br />

<strong>in</strong> the eyes on the first pass is really there<br />

by confirm<strong>in</strong>g it on the second pass. For<br />

<strong>in</strong>stance, let’s say on the first pass the officer<br />

believed he observed dist<strong>in</strong>ct and susta<strong>in</strong>ed<br />

nystagmus at maximum deviation present<br />

<strong>in</strong> the right eye. On the second pass he<br />

should be able to confirm the dist<strong>in</strong>ct and<br />

susta<strong>in</strong>ed nystagmus at maximum deviation<br />

<strong>in</strong> the eyes. If he does not, then it’s not to<br />

be counted as a clue. Thus the second pass<br />

is essential!<br />

tested a large group of people up to 96<br />

years old. He found that just 10 m<strong>in</strong>utes<br />

of conversation with a friend worked just<br />

as well as elderly activities <strong>in</strong>volv<strong>in</strong>g bra<strong>in</strong><br />

games, like crossword puzzles to strengthen<br />

the memory.<br />

“In our study, socializ<strong>in</strong>g was just as effective<br />

as more traditional k<strong>in</strong>ds of mental exercise<br />

<strong>in</strong> boost<strong>in</strong>g memory and <strong>in</strong>tellectual<br />

performance,” he said. So elderly should<br />

have plenty of time to socialize. It not only<br />

will help with memory, but also depression<br />

and lonel<strong>in</strong>ess.<br />

Why is that? Didn’t your evil plan work? I see<br />

you have all these book<strong>in</strong>gs? No wait, that’s<br />

not you. Well, you have other projects? No,<br />

not you. Well then what was all that manipulat<strong>in</strong>g<br />

for years for? Destroy<strong>in</strong>g friendships<br />

and bonds for? You must have had a purpose<br />

and a reason? Oh, did it back fire? Well, the<br />

karma tra<strong>in</strong> is just pull<strong>in</strong>g up. You have a<br />

long ride of negative karma com<strong>in</strong>g your way.<br />

I don’t read reviews posted by <strong>in</strong>ternet<br />

people. Why do I care what some grumpy,<br />

petty, bitchy, unsatisfied queen cares about<br />

anyth<strong>in</strong>g? If I want to judge someth<strong>in</strong>g I’ll do<br />

it on my own. No one can tell me what I like<br />

and don’t like other than myself.<br />

It’s <strong>in</strong>terest<strong>in</strong>g to hear what I am say<strong>in</strong>g or<br />

do<strong>in</strong>g from the said DEAD people. How<br />

would they know? They are dead to me! So,<br />

use common sense or your own sense next<br />

time you want to know any truth. Don’t be a<br />

victim.<br />

So, what ever happened to humanity? I blame<br />

the <strong>in</strong>ternet, social media, Television especially<br />

Hollywood and reality shows. Instant fame<br />

and egos. Be<strong>in</strong>g rich and famous for do<strong>in</strong>g<br />

noth<strong>in</strong>g. A world of lazy, egotistical assholes.<br />

Lucky me. I feel I was born <strong>in</strong> the wrong<br />

period of time; I like life when it was simpler<br />

and I th<strong>in</strong>k giv<strong>in</strong>g people and open forum to<br />

express their op<strong>in</strong>ions is a bad idea. Especially<br />

narrow m<strong>in</strong>ded, uneducated people.<br />
