The Ana<strong>to</strong>my of a DUI<br />

An Overview of Alcohol<br />

DUI Defense At<strong>to</strong>rney<br />

In <strong>the</strong> last article I began discussing <strong>the</strong><br />

Horizontal Gaze Nystagmus (HGN) test, and<br />

I outlined <strong>the</strong> first part of <strong>the</strong> test which is in<br />

essence a mini “medical” evaluation <strong>to</strong> make<br />

sure that <strong>the</strong> HGN test can be administered<br />

<strong>to</strong> <strong>the</strong> subject. If <strong>the</strong> subject’s eyes cannot<br />

track <strong>to</strong>ge<strong>the</strong>r equally, or <strong>the</strong> pupils were<br />

of different sizes, or resting nystagmus was<br />

present, this would be an indication that <strong>the</strong><br />

subject has some sort of medical condition<br />

and <strong>the</strong> HGN test should not be administered<br />

<strong>to</strong> <strong>the</strong> subject. Once it is determined<br />

that <strong>the</strong> subject’s eyes track <strong>to</strong>ge<strong>the</strong>r equally,<br />

<strong>the</strong> pupils of both eyes are <strong>the</strong> same size, and<br />

that <strong>the</strong> subject has no resting nystagmus,<br />

<strong>the</strong> administration of <strong>the</strong> HGN test can<br />

proceed.<br />

Remember <strong>the</strong> instructions given <strong>to</strong> <strong>the</strong><br />

subject by <strong>the</strong> officer are as follows:<br />

(1) “I am going <strong>to</strong> check your eyes.”<br />

(2) “Keep your head still and follow this<br />

stimulus with your eyes only.”<br />

(3) “Keep following <strong>the</strong> stimulus with your<br />

eyes until I tell you <strong>to</strong> s<strong>to</strong>p.”<br />

Clue #1: Lack of Smooth Pursuit.<br />

The stimulus (pen light, finger, etc.) is placed<br />

approximately 12-15 inches from <strong>the</strong> suspect’s<br />

nose and slightly elevated above eye<br />

level<br />

Beginning with <strong>the</strong> stimulus centered with<br />

<strong>the</strong> subject’s nose, <strong>the</strong> officer will check <strong>the</strong><br />

suspect’s left eye by moving <strong>the</strong> stimulus <strong>to</strong><br />

his right, moving <strong>the</strong> stimulus smoothly,<br />

at a speed that requires approximately two<br />

seconds <strong>to</strong> bring <strong>the</strong> suspect’s eye as far<br />

<strong>to</strong> <strong>the</strong> side as it can go. While moving <strong>the</strong><br />

stimulus <strong>to</strong> <strong>the</strong> right, <strong>the</strong> officer is taught <strong>to</strong><br />

watch <strong>the</strong> suspect’s left eye and determine<br />

whe<strong>the</strong>r it is able <strong>to</strong> follow <strong>the</strong> stimulus<br />

smoothly. The eye of an alcohol free person<br />

will usually (but not always) follow <strong>the</strong> stimulus<br />

smoothly, like a marble rolling across a<br />

smooth pane of glass, or windshield wipers<br />

moving across a wet windshield. If <strong>the</strong> eye<br />

begins <strong>to</strong> “bounce” as it follows <strong>the</strong> stimulus,<br />

this is a clue that <strong>the</strong> subject may have been<br />

drinking alcohol or taken some o<strong>the</strong>r drug.<br />

The bounce is slight, like a marble rolling on<br />

sandpaper, or a windshield wiper moving<br />

across a dry windshield.<br />

Once <strong>the</strong> officer has reached <strong>the</strong> far<strong>the</strong>st<br />

point <strong>to</strong> <strong>the</strong> side, <strong>the</strong> officer will reverse<br />

direction and move <strong>the</strong> stimulus all <strong>the</strong> way<br />

<strong>to</strong> his left, back across subject’s face checking<br />

<strong>to</strong> see if <strong>the</strong> right eye pursues <strong>the</strong> stimulus<br />

smoothly. Once at <strong>the</strong> far<strong>the</strong>st point <strong>to</strong><br />

<strong>the</strong> left side, <strong>the</strong> officer will <strong>the</strong>n move <strong>the</strong><br />

stimulus back <strong>the</strong> center. Again, <strong>the</strong> speed<br />

of <strong>the</strong> stimulus as it is being moved is crucial;<br />

movement of <strong>the</strong> stimulus should take<br />

approximately two seconds from <strong>the</strong> center<br />

out <strong>to</strong> <strong>the</strong> right side, two seconds back <strong>to</strong> <strong>the</strong><br />

center, and ano<strong>the</strong>r two seconds from <strong>the</strong><br />

center out <strong>to</strong> <strong>the</strong> left side, and ano<strong>the</strong>r two<br />

seconds back <strong>to</strong> <strong>the</strong> center. Once a complete<br />

pass (movement <strong>to</strong> both sides and back <strong>to</strong><br />

center) <strong>the</strong> procedure is <strong>to</strong> be repeated again,<br />

thus two complete passes are <strong>to</strong> be made<br />

across <strong>the</strong> subjects face.<br />

AROPTIMISM AND ART FOR <strong>2016</strong><br />

The art world has helped <strong>to</strong> define many of <strong>the</strong><br />

major issues during <strong>the</strong> past year. Topics, such<br />

as Black Lives Matter, ISIS, income inequality<br />

and marriage equality have been engaged and<br />

portrayed in various art media.<br />

Marriage equality has been passed by <strong>the</strong><br />

Supreme Court. There are several cute and<br />

emotional examples of art showing gay and lesbian<br />

love. However <strong>the</strong> struggle for rights and<br />

equality still continues in <strong>the</strong> <strong>LGBT</strong> community.<br />

Issues that are still prevalent include: gay<br />

violence, gay bashing, as we have just witnessed<br />

in <strong>Palm</strong> <strong>Springs</strong> over <strong>the</strong> past few months;<br />

Employment discrimination is still out <strong>the</strong>re in<br />

subtle and overt examples; Poverty, especially<br />

among young gay and lesbian people who are<br />

shunned by <strong>the</strong>ir families and communities is<br />

prevalent; Health care among <strong>LGBT</strong> people is a<br />

problem, with many not reporting health issues<br />

as a result of discrimination, in some communities.<br />

David Wojnarowicz - 1954 -1993, was a prolific<br />

gay New York, artist, working in various media,<br />

including: painting, pho<strong>to</strong>graphy, and film was<br />

also an aids activist. He created a pho<strong>to</strong>stat,<br />

drawing with text in 1990. It is still relevant<br />

<strong>to</strong>day regarding <strong>LGBT</strong> acceptance. The piece,<br />

which is one of 10 prints, is displayed at <strong>the</strong><br />

Whitney Museum of American Art. This is<br />

shown below, consisting of a drawing of a<br />

young boy, assumed <strong>to</strong> be from a pho<strong>to</strong>graph<br />

of Wojnarowicz. The work which was untitled,<br />

is subtitled, “One Day This Kid”. The size<br />

restriction in <strong>the</strong> reproduction below does not<br />

allow <strong>the</strong> reader <strong>to</strong> read <strong>the</strong> text. Quoted are<br />

a few lines <strong>to</strong> provide you with a feel for <strong>the</strong><br />

“One day this kid will come <strong>to</strong> know something<br />

that causes a sensation equivalent <strong>to</strong> <strong>the</strong> separation<br />

kid will reach a point where he senses a division<br />

that isn’t ma<strong>the</strong>matical. One day this kid will<br />

find something in his mind and body and soul<br />

that makes him hungry... One day this kid will<br />

do something that causes men who wear uniforms<br />

of priests and rabbis, men who inhabit<br />

certain s<strong>to</strong>ne buildings, <strong>to</strong> call for his death....<br />

Or one day this kid will talk. When he begins<br />

<strong>to</strong> talk, men who develop a fear of this kid will<br />

attempt <strong>to</strong> silence him with strangling, fists,<br />

prison, suffocation, rape, intimidation, drugging,<br />

ropes, guns, laws menace, raving gangs....<br />

Doc<strong>to</strong>rs will pronounce this kid curable as if his<br />

brain were a virus....All this will begin <strong>to</strong> happen....<br />

when he discovers he desires <strong>to</strong> place his<br />

naked body against <strong>the</strong> body of ano<strong>the</strong>r boy.”<br />

Unfortunately many officers will not perform<br />

this part of <strong>the</strong> test correctly; many<br />

officers will move <strong>the</strong> stimulus <strong>to</strong>o fast, or<br />

only doing one pass instead off <strong>the</strong> required<br />

two passes, or will only check one eye.<br />

Why is <strong>the</strong> speed important? Because<br />

studies have shown that if <strong>the</strong> officer moves<br />

<strong>the</strong> stimulus <strong>to</strong>o fast, <strong>the</strong> officer will actually<br />

induce or cause <strong>the</strong> nystagmus <strong>to</strong> occur. If<br />

<strong>the</strong> officer causes <strong>the</strong> nystagmus by moving<br />

<strong>the</strong> stimulus <strong>to</strong>o fast, <strong>the</strong> conclusion that<br />

<strong>the</strong> nystagmus is caused by alcohol or drugs<br />

in <strong>the</strong> body is false. Thus <strong>the</strong> timing is<br />

important!<br />

If <strong>the</strong> officer fails <strong>to</strong> complete two passes<br />

and only does one pass, <strong>the</strong>n he has no<br />

opportunity <strong>to</strong> rule out a false positive. The<br />

purpose of <strong>the</strong> second pass is <strong>to</strong> ensure<br />

that what <strong>the</strong> officer thinks he observed on<br />

<strong>the</strong> first pass is really <strong>the</strong>re by confirming<br />

it on <strong>the</strong> second pass. For instance, let’s<br />

say on <strong>the</strong> first pass <strong>the</strong> officer believed he<br />

observed a lack of smooth pursuit in both<br />

eyes. On <strong>the</strong> second pass he should see <strong>the</strong><br />

lack of smooth pursuit again in <strong>the</strong> eyes. If<br />

he does not, <strong>the</strong>n it’s not <strong>to</strong> be counted as a<br />

clue. Thus <strong>the</strong> second pass is essential!<br />

A guy is sitting at home when he hears a knock at <strong>the</strong> door. He opens <strong>the</strong> door and sees a<br />

snail on <strong>the</strong> porch. He picks up <strong>the</strong> snail and throws it as far as he can. Three years later<br />

JERSEY’S JOURNAL by Jersey Shore<br />

Social Media is <strong>the</strong> death of humanity. It’s<br />

an excuse <strong>to</strong> bully people while remaining<br />

anonymous. If you ask me, it just makes<br />

you a coward. Not <strong>to</strong> mention said bully.<br />

Do you really need <strong>to</strong> bash o<strong>the</strong>rs so you<br />

feel better about yourself? Well, I guess<br />

you do because everyone seems <strong>to</strong> be<br />

doing it. What I find interesting is that it<br />

appears <strong>to</strong> be <strong>the</strong> “people” that have been<br />

bullied in school or beyond. Well, if you<br />

were/are a victim of bullying, why would<br />

you do it <strong>to</strong> someone else?<br />

I find that my name is being dragged<br />

through <strong>the</strong> mud, so <strong>the</strong>y look innocent<br />

and perfect. It’s <strong>the</strong> people who have<br />

known me for a while who suddenly say,<br />

Jersey did that? Well, Jersey DIDN’T do<br />

that and you should know because you’ve<br />

know Jersey for multiple years. Jersey is<br />

an open book and because a talentless<br />

hack and walking coat hanger on stage<br />

says it, you believe <strong>the</strong>m? Where are your<br />

balls? <strong>Your</strong> opinion? <strong>Your</strong> intuition? <strong>Your</strong><br />

morals and own thought process? Man up<br />

and be your own person and not a follower.<br />

I have ano<strong>the</strong>r soon <strong>to</strong> be ex friend who<br />

dabbles with <strong>the</strong> enemy. Someone leaving<br />

all options open <strong>to</strong> join <strong>the</strong> Shit team and<br />

dump me for something “better” after<br />

all I’ve given. They always seem <strong>to</strong> figure<br />

it out way <strong>to</strong> late that it doesn’t get any<br />

better than me. Well that s<strong>to</strong>ps now. I am<br />

fair, honest, <strong>to</strong>o honest, and respectful<br />

and drama free. If you can’t deal with that<br />

<strong>the</strong>n walk away before I show you <strong>the</strong><br />

door.<br />
