The Anatomy of a DUI 

An Overview of Alcohol

DUI Defense Attorney 

In the last article I began discussing the 

Horizontal Gaze Nystagmus (HGN) test, and 

I outlined the first part of the test which is in 

essence a mini “medical” evaluation to make 

sure that the HGN test can be administered 

to the subject. If the subject’s eyes cannot 

track together equally, or the pupils were 

of different sizes, or resting nystagmus was 

present, this would be an indication that the 

subject has some sort of medical condition 

and the HGN test should not be administered 

to the subject. Once it is determined 

that the subject’s eyes track together equally, 

the pupils of both eyes are the same size, and 

that the subject has no resting nystagmus, 

the administration of the HGN test can 

proceed. 

Remember the instructions given to the 

subject by the officer are as follows: 

(1) “I am going to check your eyes.” 

(2) “Keep your head still and follow this 

stimulus with your eyes only.” 

(3) “Keep following the stimulus with your 

eyes until I tell you to stop.” 

Clue #1: Lack of Smooth Pursuit. 

The stimulus (pen light, finger, etc.) is placed 

approximately 12-15 inches from the suspect’s 

nose and slightly elevated above eye 

level 

Beginning with the stimulus centered with 

the subject’s nose, the officer will check the 

suspect’s left eye by moving the stimulus to 

his right, moving the stimulus smoothly, 

at a speed that requires approximately two 

seconds to bring the suspect’s eye as far 

to the side as it can go. While moving the 

stimulus to the right, the officer is taught to 

watch the suspect’s left eye and determine 

whether it is able to follow the stimulus 

smoothly. The eye of an alcohol free person 

will usually (but not always) follow the stimulus 

smoothly, like a marble rolling across a 

smooth pane of glass, or windshield wipers 

moving across a wet windshield. If the eye 

begins to “bounce” as it follows the stimulus, 

this is a clue that the subject may have been 

drinking alcohol or taken some other drug. 

The bounce is slight, like a marble rolling on 

sandpaper, or a windshield wiper moving 

across a dry windshield. 

Once the officer has reached the farthest 

point to the side, the officer will reverse 

direction and move the stimulus all the way 

to his left, back across subject’s face checking 

to see if the right eye pursues the stimulus 

smoothly. Once at the farthest point to 

the left side, the officer will then move the 

stimulus back the center. Again, the speed 

of the stimulus as it is being moved is crucial; 

movement of the stimulus should take 

approximately two seconds from the center 

out to the right side, two seconds back to the 

center, and another two seconds from the 

center out to the left side, and another two 

seconds back to the center. Once a complete 

pass (movement to both sides and back to 

center) the procedure is to be repeated again, 

thus two complete passes are to be made 

across the subjects face.

AROPTIMISM AND ART FOR 2016 

The art world has helped to define many of the 

major issues during the past year. Topics, such 

as Black Lives Matter, ISIS, income inequality 

and marriage equality have been engaged and 

portrayed in various art media. 

Marriage equality has been passed by the 

Supreme Court. There are several cute and 

emotional examples of art showing gay and lesbian 

love. However the struggle for rights and 

equality still continues in the LGBT community. 

Issues that are still prevalent include: gay 

violence, gay bashing, as we have just witnessed 

in Palm Springs over the past few months; 

Employment discrimination is still out there in 

subtle and overt examples; Poverty, especially 

among young gay and lesbian people who are 

shunned by their families and communities is 

prevalent; Health care among LGBT people is a 

problem, with many not reporting health issues 

as a result of discrimination, in some communities. 

David Wojnarowicz - 1954 -1993, was a prolific 

gay New York, artist, working in various media, 

including: painting, photography, and film was 

also an aids activist. He created a photostat, 

drawing with text in 1990. It is still relevant 

today regarding LGBT acceptance. The piece, 

which is one of 10 prints, is displayed at the 

Whitney Museum of American Art. This is 

shown below, consisting of a drawing of a 

young boy, assumed to be from a photograph 

of Wojnarowicz. The work which was untitled, 

is subtitled, “One Day This Kid”. The size 

restriction in the reproduction below does not 

allow the reader to read the text. Quoted are 

a few lines to provide you with a feel for the 

substance of the text. You may find the complete 

text in Whitney.org, looking under David 

Wojnarowicz, as follows: 

“One day this kid will come to know something 

that causes a sensation equivalent to the separation 

of the earth form its axis....One day this 

kid will reach a point where he senses a division 

that isn’t mathematical. One day this kid will 

find something in his mind and body and soul 

that makes him hungry... One day this kid will 

do something that causes men who wear uniforms 

of priests and rabbis, men who inhabit 

certain stone buildings, to call for his death.... 

Or one day this kid will talk. When he begins 

to talk, men who develop a fear of this kid will 

attempt to silence him with strangling, fists, 

prison, suffocation, rape, intimidation, drugging, 

ropes, guns, laws menace, raving gangs.... 

Doctors will pronounce this kid curable as if his 

brain were a virus....All this will begin to happen.... 

when he discovers he desires to place his 

naked body against the body of another boy.”

officers will move the stimulus too fast, or 

only doing one pass instead off the required 

two passes, or will only check one eye. 

Why is the speed important? Because 

studies have shown that if the officer moves 

the stimulus too fast, the officer will actually 

induce or cause the nystagmus to occur. If 

the officer causes the nystagmus by moving 

the stimulus too fast, the conclusion that 

the nystagmus is caused by alcohol or drugs 

in the body is false. Thus the timing is 

important! 

If the officer fails to complete two passes 

and only does one pass, then he has no 

opportunity to rule out a false positive. The 

purpose of the second pass is to ensure 

that what the officer thinks he observed on 

the first pass is really there by confirming 

it on the second pass. For instance, let’s

A guy is sitting at home when he hears a knock at the door. He opens the door and sees a

JERSEY’S JOURNAL by Jersey Shore 

Social Media is the death of humanity. It’s 

an excuse to bully people while remaining 

anonymous. If you ask me, it just makes 

you a coward. Not to mention said bully. 

Do you really need to bash others so you 

feel better about yourself? Well, I guess 

you do because everyone seems to be 

doing it. What I find interesting is that it 

appears to be the “people” that have been 

bullied in school or beyond. Well, if you 

were/are a victim of bullying, why would 

you do it to someone else? 

I find that my name is being dragged 

through the mud, so they look innocent 

and perfect. It’s the people who have 

known me for a while who suddenly say, 

Jersey did that? Well, Jersey DIDN’T do 

that and you should know because you’ve 

know Jersey for multiple years. Jersey is 

an open book and because a talentless 

hack and walking coat hanger on stage 

says it, you believe them? Where are your 

balls? Your opinion? Your intuition? Your 

morals and own thought process? Man up 

and be your own person and not a follower. 

I have another soon to be ex friend who 

dabbles with the enemy. Someone leaving 

all options open to join the Shit team and 

dump me for something “better” after 

all I’ve given. They always seem to figure 

it out way to late that it doesn’t get any 

better than me. Well that stops now. I am 

fair, honest, too honest, and respectful 

and drama free. If you can’t deal with that 

then walk away before I show you the 

door.
