propusieran nuevos cambios a la sección 215 de la Ley Patriota, en los que el gobierno no continuara la
recolección de metadatos 935 .
520. Según la información divulgada por el Estado los primeros cambios se habrían hecho
efectivos en febrero 2014 936 . En relación con el segundo paso de la transición, el 27 de marzo el Presidente
anunció que el gobierno no debería continuar la recolección masiva de metadatos telefónicos y que esta
información debería mantenerse en las compañías telefónicas, con un mecanismo legal que permita al
gobierno obtener los datos a través de órdenes individuales emitidas por la Corte de Inteligencia de Vigilancia
Extranjera [Foreign Intelligence Surveillance Court] (FISC) 937 . Al respecto, anunció que para estos cambios
puedan ser efectivos sería necesario la adopción de nueva legislación, por lo que instó al Congreso a
sancionarlos mediante ley 938 . En esa oportunidad el Presidente anunció que en tanto no se cuente con nueva
legislación, autorizaría al Departamento de Justicia a solicitar una reautorización del programa por otros 90
días 939 . La última orden de la FISC autorizando el programa fue emitida el 4 de diciembre de 2014 y expiraría
el 27 de febrero de 2015 940 .
521. El 22 de mayo, la Cámara de los Representantes del Congreso de los Estados Unidos aprobó
con 303 votos a favor y 121 en contra the U.S.A. Freedom Act, con el objetivo de poner fin al programa de
recolección masiva de metadatos telefónicos de personas en los Estados Unidos bajo la sección 215 de la Ley
Patriota 941 . Otra versión de este proyecto de Ley [S.2685 USA Freedom Act] fue introducida en el senado por
el senador Patrick Leahy de Vermont. En noviembre, la Oficina Ejecutiva del Presidente emitió un
comunicado en el que reiteró su fuerte apoyo al proyecto de ley que se discute en el senado e instó al
Congreso a aprobarla. Al respecto, explicó que “el Proyecto S. 2685 se construye cuidadosamente sobre la
base del buen trabajo realizado por la Cámara de Representantes y se ha ganado el apoyo de los defensores
de los derechos civiles y de privacidad, así como del sector privado, incluyendo importantes miembros de la
comunidad tecnológica”. Enfatizó que sin la aprobación de este proyecto, “las importantes facultades del
Estado que son adecuadamente reformadas en esta legislación podrían expirar el próximo verano” 942 . El 18
de noviembre, el Senado no había llegado a un acuerdo sobre una moción para proceder con la consideración
de la S.2685 USA Freedom Act 943 .
