The “New Legislative Framework” (N.L.F. Decision<br />

768/2008) sets out a common framework for the<br />

marketing of products.<br />

We briefly focus on the obligations and<br />

responsibilities of some Economic Stakeholders.<br />

Importers of Personal <strong>Protective</strong> Equipment<br />

are responsible:<br />

• to import only compliant products in the EU,<br />

• to verify the conformity assessment procedure,<br />

• to ensure the presence of technical<br />

documentation,<br />

• to verify the markings and documents,<br />

• to indicate the name and address of the<br />

responsible importer,<br />

• to ensure the presence of user instructions in the<br />

correct linguistic version,<br />

• to identity suppliers and clients,<br />

• to cooperate with market surveillance,<br />

• to take corrective measures for non-compliant<br />

products and<br />

• to notify authorities when products on the market<br />

is non-compliant which poses a risk to consumer<br />

or end user.<br />

Distributors of Personal <strong>Protective</strong> Equipment have<br />

the obligation:<br />

• to act co-responsible,<br />

• to verify the markings and documents,<br />

• to ensure the presence of user instructions in the<br />

correct linguistic version<br />

• to identity suppliers and clients<br />

• to cooperate with market surveillance<br />

• to take corrective measures for non-compliant<br />

products<br />

• to notify authorities when products on the market<br />

is non-compliant which poses a risk to consumer<br />

or end user.<br />

Market surveillance can shift from ‘product controls’<br />

to ‘company audits’ for importers and distributors.<br />

NLF Regulation 768/2008 gives a new push<br />

towards effective market surveillance relating<br />

to the marketing of products. Communication of<br />

the existence of Market Surveillance Authorities,<br />

responsibilities, contact details and annual market<br />

surveillance programs to the EU Commission, other<br />

Member States and to the public will lead to a better<br />

cooperation between authorities and a higher level<br />

of transparency. Appropriate and efficient checks<br />

on the characteristics of products by customs<br />

should stop non-conforming products to enter the<br />

community market.<br />

The earlier in the supply chain a non-conforming product is stopped, the easier and<br />
