that the LR Haryana, through his UO No. jk- Hkk- fo- 3515 /2008/207 dated 

22.02.2008 has intimated that the Notification carrying the said amendment in the 

DFR has been sent for publication in the Extra Ordinary Gazette of Government 

of Haryana on 20.02.2008 and the same shall be published in the Gazette 

Extraordinary dated 20.02.2008. A copy each in Hindi and English of the said 

Notification is being sent to you to serve as a ready reference in the meanwhile. 

2. Accordingly, it would be lawful to act in accordance with the provisions of 

this amendment with effect from 20.02.2008 and you are required to take note of 

the same for strict compliance. 

3. The above facts and decisions may please be brought to the notice of all 

concerned for ever strict compliance.

ORDER 

No. 44/135/05-05 B&R (W) Dated, Chandigarh, the 23.04.2008. 

In partial super cession of all the earlier instructions in this regard to the 

extend included hereinafter and subject to the conditions laid in these 

instructions, the Governor of Haryana is pleased to direct that the following 

guidelines of procedures be followed meticulously in the matters of tendering in 

the Department of Public Works (B&R) Department, Haryana in order to 

streamline the procedures while making them ____ in respect of various aspects 

of tendering in Engineering Departments: 

A) NOTICE PERIOD: 

i) Subject to the other procedures prescribed hereinafter in these 

instructions, the time frame for the tender notices shall be as prescribed 

below: 

1. Work upto Rs. 5 lacs: 7 days, with additional 2 days for circulation 

of notices. There would be no mandatory requirement for the 

advertisement to be issues. 

2. Work above Rs. 5 lacs but net exceeding Rs. 25 lacs: 3 weeks, with 

additional ___ days for publication of appropriate advertisement in 

newspapers. 

3. Works above Rs. 25 lacs: 3 weeks with additional 7 days for 

publication of appropriate advertisement in newspapers. 

B) ADVERTISEMENT PROCEDURE: 

i) Works up to Rs. 5 lacs: Tender notices properly alongwith NIT 

should be exhibited on Notice Boards of the Circle concerned. 

Note: In exceptional __ of emergency for works costing up to Rs. 2 

lacs, a committee of concerned Executive Engineer, Sub-Divisional 

Engineer and Divisional Accountant/Head Clerk may take spot

quotations and take decision there __ subject to approvals while 

informing the concerned Chief Engineer and Superintending 

Engineer within 24 hours the reasons thereof and soliciting the expost-facto 

approval of the Superintending Engineer thereupon. 

ii) WORKS COSTING ABOVE Rs. 5 LACS but no exceeding Rs. 25 

Lacs: Advertisement must be issued at least in two newspapers: 

one regional English or regional English newspaper having 

circulation in the receipt and __ Hindi regional newspaper. 

Iii) WORKS COSTING ABOVE RS. 2 LAC: Advertisement must be 

____ regional, and one Hindi regional. 

C) GENERAL INSTRUCTIONS: 

a) In case of all tenders costing above Rs. 5 lacs, tender notices, 

tenser forms and DNIT would be hoisted on the Web-sites of the 

State Government and the department and would be downloadable 

from these wbsites to be user by the interested bidders. 

b) The department would devise a general tender from which can be 

used by inserting relevant details for submitting bids unless 

mentioned expressly to be otherwise the tender notice. 

c) Executive Engineer concerned would, as far as possible, try to club 

tenders so as to minimize the expenditure on advert sements. 

d) Executive Engineer concerned shall send a copy of all 

advertisements to the concerned Divisional Commissioner, deputy 

Commissioner, and District Public Relations Officer. 

D) VALIDITY PERIOD OF TENDERS: 

i) Validity of tenders should be as under: 

1. Works costing up to Rs. 10 lacs: 45 days. 

2. Works costing above Rs.10 lacs: 90 days. 

ii) In cases where technical bids and financial bids are obtained 

separately, clarifications, if required, from the bidder in respect of tender 

shall be obtained within 34 days of oening of tender and financial bid still

e opened only thereafter on the date and times specified ___ in tender 

notice or by way of written communication to all bidders. 

E) OPENING OF TENDERS: 

i) Subject to the conditions mentioned hereinafter, in all the cases, 

the due date and time of receipt and opening of tenders, alongwith 

venues, shall be clearly stated in the tender notices. 

ii) The tender Opening Committee shall open tenders in the presence 

of such of the badder or, as the case may be, their authorized 

representative who may choose to be present. The Committee shall 

obtain signature of all the Udders or their authority I representative, 

in whose presence tender is opened. The Committee shall 

announced rates and other ___ features, if any, quoted by each 

bidder one by one. The cuttings/ over-writing shall be authenticated 

by all members of the Committee on the spot and in the essence of 

the bidders/ their authorized representatives who are present. 

Immediately after opening of all the tenders, the Committee shall 

draw minutes of the meeting in a permanent Register hereinafter 

called as Tender Register. All members of the Committee and other 

relevant officials present shall sign the minutes. 

iii) With respect to the opening of tenders: 

1. Tenders to Rs. 10 crores will be received in the office of he 

concerned Executive Engineer and opened on the same day. 

2. Tenders ___ Rs. 1 crore and up to Rs. 6 crores will be received in 

the offices of Superintending Engineer & Executive Engineer. 

These tenders would be opened in the office of the Superintending 

Engineer, if the headquarters of Executive Engineer is located 

within 45 km from the head quarters of Superintending Engineer, 

the tenders would be opened in the office of the Superintending 

Engineer on the closing date. However, timings may be adjusted 

depending upon the distance. If the headquarter of Executive

Engineer is located beyond 45 km from the headquarters of the 

Superintending Engineer, the tenders would be opened on the 

working day immediately following the losing late. 

3. Tenders above Rs. 5 crore will be received in the offices of the 

concerned Chief Engineer, Superintending Engineer and Executive 

Engineer. Tenders would be opened in the office of the Chief 

Engineer concerned on the same day f head-quarters of the 

Superintending Engineer and Executive Engineer are located within 

45km of Chandigarh. If the head-quarter are located beyond 45 km 

of Chandigarh, tenders would be opened the working days 

immediately following the closing date. 

F) COMMITTEE FOR RECEIPT AND OPENING OF TENDERS : 

i) The following committee would receive and open tenders: 

1. Tenders upto Rs. 1 crore: The concerned Executive 

Engineer and Sub Divisional Engineer, Head Clerk, and 

Divisional Accountant of the division concerned. 

2. Tenders above Rs. 1 crore but not exceeding Rs. 5 core: 

the concerned Superintending Engineer, Executive 

Engineer, Superintendent and Section Officers/Account of 

the Circle. 

3. Tenders above Rs. 5 crore: Superintending Engineer 

(Head Quarters) or in his absence any officer not below the 

rank of Superintending Engineer generally or specifically 

authorized by the concerned Chief Engineer, Executive 

Engineer (Head Quarters) or in his absence any officer not 

below the rank of Executive Engineer generally or 

specifically authorized by the concerned Chief Engineer 

concerned, Executive Engineer concerned and the Chief 

Accounts Officer or one of the Accounts Officer in the 

Engineer-in-Chief’s office. 

G) POWERS FOR NEGOTIATIONS

Respective negotiations Committees would ___ the subject to 

following compliances: 

A. Negotiations, wherever required, shall be required shall be earrled 

our to the committee authorized hereinafter and never by an 

individual _______members and officials present to ___ the 

committee. Negotiations should not be delegated to any 

subordinate authority as representative. 

B. Following shall constitute the respective negotiations Committee: 

1. For tenders to be decided by the Executive Engineer: the 

concerned Executive Engineer, Sub Divisional Engineer, Head 

Clerk and Divisional Accounts officers. 

2. For tenders to the decided by the Superintending Engineers: 

The concerned Superintending Engineer, Executive Engineer, 

Superintendent ___ Officer/Account of the Circle. 

3. For tenders to be decided by the Chief Engineer: Concerned 

Chief Engineer, concerned Superintending Engineer and Chief 

Accounts officer/one Accounts office. (head Quarters). 

4. For the tenders to be decided by Tender allotment Committee: 

Tender Allotment committee. 

2. These guidelines, however, shall not be deemed to have amended any 

procedural compliance otherwise prescribed for the process of e- 

tending. 

3. This issues with he concurrence of Finance Department conveyed 

through their U.O. No. 4179-3 FICW/2007, dated 21.11.2007.

Uniformity in tendering process: requisite guidelines. 

Sir, 

I am directed to address you on the subject noted above and to say 

that with the objective of introducing uniformity in the process of tendering, a 

committee with the chief Secretary in the Chair was constituted by the 

Government and its recommendations were accepted by the Government at the 

level of Chief Minister. The Department f PWD (B&R) acted as the nodal 

department in this aspect. Accordingly, the Order that is appended to this letter 

has been issued by the Government and he same may kindly be considered for 

strict compliance. 

2. It must be taken careful note of that any laxity in strict compliance 

of these instructions would invite appropriate disciplinary actions including 

appropriate commensurate entries in the Annual confidential Report. 

3. The import of this decision may also kindly be brought to the notice 

of all concerned for strict adherence while dealing with such matters in future.
