3.00. Toutefois si le temps accordé excè<strong>de</strong> une<br />
(1) heure pur semuine et pur employé, le temps<br />
accordé sera payé au tuux effect il* majoré <strong>de</strong> 50%,<br />
en argent ou en temps.<br />
5. Jours fériés et payés:<br />
5.01 Les jours suivunts sont <strong>de</strong>s jours fériés<br />
et payés, à condition que l'employé ne s'absente<br />
pas sans raison valable le jour ouvrable qui<br />
précè<strong>de</strong> OU qui suit immédiatement le jour férié.<br />
a) le Premier Jour <strong>de</strong> l'An;<br />
b) le len<strong>de</strong>main du Premier Jour <strong>de</strong> l'An:<br />
c) la Saint-Jean-Baptiste;<br />
d) la Confédération;<br />
e) la Fête du Travail;<br />
/) le Jour d'Actions <strong>de</strong> (îrAces;<br />
g) le Jour <strong>de</strong> Noël;<br />
//) le len<strong>de</strong>main du Jour <strong>de</strong> Noël.<br />
5.02 Si un jour férié tombe un dimanche ou un<br />
lundi, aucune rémunération ne sera accordée.<br />
5.03 Tout travail exécuté un jour férié entraîne<br />
une majoration <strong>de</strong> 50% du taux <strong>de</strong> salaire<br />
effectif.<br />
5.04 Si un jour <strong>de</strong> fête chômé tombe un vendredi,<br />
le jour précé<strong>de</strong>nt sera considéré comme un<br />
vendredi pour les heures <strong>de</strong> début et <strong>de</strong> cessation<br />
du travail.<br />
5.05 Durant la pério<strong>de</strong> <strong>de</strong> Noël, le travail peut<br />
se continuer jusqu'à 9 p.m. les trois (3) jours<br />
ouvrables précédant la veille <strong>de</strong> Noël.<br />
G. Vacaturs payées:<br />
ti.01 Les employés <strong>de</strong> moins d'un (1) an «le<br />
service seront payés selon les dispositions <strong>de</strong><br />
l'ordonnance <strong>de</strong> la Commission du salaire<br />
minimum.<br />
0.02 Les employés qui ont été au service du<br />
même magasin pendant un (1) an ou plus, ont<br />
droit à une semaine <strong>de</strong> vacance payée.<br />
0.03 LeS employés choisissent la date <strong>de</strong> leurs<br />
vacances par ordre d'ancienneté.<br />
0.04 Les dimanches et jour <strong>de</strong> fêtes ne doivent<br />
pas être considérés comme <strong>de</strong>s jours <strong>de</strong> vacances<br />
payées.<br />
0.05 Le salaire pour la pério<strong>de</strong> <strong>de</strong>s vacances<br />
doit être payé au salarié avant son départ pour<br />
ses vacances.<br />
0.00 La pério<strong>de</strong> donnant droit aux vacances<br />
s'étend du 1er mai d'une année au 30 avril <strong>de</strong><br />
l'année suivante.<br />
7. Uniformes:<br />
7.01 Si l'employeur exige le port d'un uniforme,<br />
<strong>de</strong> tabliers ou autres vêtements spéciaux*<br />
le coût <strong>de</strong> location et <strong>de</strong> l'entretien seront entièrement<br />
payés par l'employeur.<br />
8. Privilèges ou avantages:<br />
5.01 Les employés auront droit à <strong>de</strong>ux pério<strong>de</strong>s<br />
<strong>de</strong> repos <strong>de</strong> dix (10) minutes chacune par jour.<br />
L'employeur conservant le privilège <strong>de</strong> les distribuer<br />
selon les circonstances.<br />
8.02 Aucune <strong>de</strong>s dispositions du décret ne<br />
peut être interprétée <strong>de</strong> façon à faire perdre aux<br />
employés les privilèges ou avantages auxquels<br />
ils ont droit présentement, même s'ils ne sont<br />
pas stipulés dans le décret.<br />
8.03 Tout employé qui bénéficie <strong>de</strong> taux <strong>de</strong><br />
salaires supérieurs à ceux qui sont prévus dans<br />
le présent décret ne subira pas <strong>de</strong> diminution <strong>de</strong><br />
salaire à l'occasion <strong>de</strong> l'entrée en vigueur du<br />
décret.<br />
9. Expérience:<br />
9.01 L'employeur doit reconnaître l'expérience<br />
acquise et le temps d'apprentissage fait précé<strong>de</strong>mment<br />
dans un établissement <strong>de</strong> même nature,<br />
et l'employé bénéficier <strong>de</strong>s avantages que lui<br />
accor<strong>de</strong> son temps d'apprentissage ou ses années<br />
d'expérience dans la même ligne, pourvu que<br />

5. General holidays with pay:<br />
5.01 The following days are general holidays<br />

(c) St. John the Baptist Day;<br />

(h) December 26th.<br />
5.02 When a general holiday falls on a Sunday<br />
or a Monday, they shall not be paid.<br />
5.03 Time and one half shall be paid for work<br />
performed on a general holiday.<br />
5.04 When a general holiday falls on a Friday,<br />
the previous dny shall be consi<strong>de</strong>red as Friday,<br />
in so far as hours of work are concerned.<br />
5.05 On the three working days prior to<br />
Christmas Eve, work mav be exten<strong>de</strong>d until<br />
9:00 p.m.<br />
0. Vacation with pay:<br />
0.01 Employees with less than one (1) year's<br />
service shall be paid according to the provisions<br />
of the pertinent ordinance of the Minimum<br />
Wage Commission.<br />
0.02 Employees who have one (1) or more<br />
year's service in the same store shall be entitled<br />
to one week's vacation with pay.<br />
0.03 Employees shall choose their vacation<br />
dates according to seniority.<br />
6.04 Sundays and holidays shall not be consi<strong>de</strong>red<br />
as vacation days with pay.<br />
0.05 Vacation pay shall be given an employee<br />
before his leaving on vacation.<br />
6.06 The period entitling an employee t<br />
vacations runs from May 1st of one year to<br />
April 30th of the next.<br />
7. Uniforms:<br />
7.01 Should an employer request the wearing<br />
of uniforms, aprons or special dress, their rental<br />
and maintenance costs shall be entirely borne<br />
by him.<br />
8. Benefits:<br />
8.01 Employees shall be entitled to two 10-<br />
minute rest periods per day; the employer<br />
reserves the right to schedule them according<br />
to circumstances.<br />
8.02 No provision in this <strong>de</strong>cree may he<br />
interpreted so as to strip employees of their<br />
present benefits, eventhough such benefits are<br />
not specified in this <strong>de</strong>cree.<br />
8.03 Every employee who is now receiving<br />
wage rates higher than those provi<strong>de</strong>d for in this<br />
<strong>de</strong>cree shall not receive a cut in wages when this<br />
<strong>de</strong>cree comes into force.<br />
9. Experience:<br />
9.01 Employers shall recognize the experience<br />
gained and the apprenticeship time previously<br />
served in a similar establishment. Employees<br />
shall be entitled to all the benefits entailed by<br />
his apprenticeship time or years of experience<br />
in the same type of work, provi<strong>de</strong>d that they
