25° Let <strong>de</strong>man<strong>de</strong>s en vertu <strong>de</strong>s règles 23 et<br />
21 doivent être présentées au juge en chef, en<br />
chambre, à neuf heures du matin, le vendredi ou<br />
en tout autre temps qu'il déterminera.<br />
CHAPITRE<br />
Rôle .spécial<br />
VIII<br />
20' Peuvent être inscrites sur le role spécial<br />
les causes suivantes:<br />
1. Les actions dans lesquelles la partie défen<strong>de</strong>resse<br />
a fait défaut <strong>de</strong> comparaître sur faits et<br />
articles.<br />
La motion alin <strong>de</strong> tenir les faits et articles pour<br />
avérél <strong>de</strong> même que l'inscription pour jugement<br />
peuvent être soumises en même temps;<br />
2. Les actions sur compte, billet, chèque, lettre<br />
<strong>de</strong> change, reconnaissance <strong>de</strong> <strong>de</strong>tte ou autre<br />
document, dans lesquelles la défense est une<br />
dénégation générale;<br />
3. Les actions entre locateurs et locataires,<br />
lorsqu'il s'agit <strong>de</strong> logement d'habitation et que<br />
Is réclamation est uniquement fondée sur loyer<br />
dû et dommage résultant <strong>de</strong> perte <strong>de</strong> loyer.<br />
27° Peuvent être également inscrites sur ce<br />
rôle spécial, avec l'autorisation du juge en chef,<br />
ou d'un officier nommé pur lui à cette fin, sur<br />
motion <strong>de</strong> l'une <strong>de</strong>s parties et après avis à la<br />
partie adverse, les causes suivantes:<br />
1. Les actions sur compte, billet, chèque, lettre<br />
<strong>de</strong> change, reconnaissance <strong>de</strong> <strong>de</strong>tte ou autres<br />
documents, dans lesquelles la défense ne semble<br />
pas sérieuse ou paraît avoir été faite uniquement<br />
pour obtenir du délai;<br />
2. Les actions en exécution d'une clause <strong>de</strong><br />
dation en paiement ou en exécution d'une clause<br />
résolutoire et les actions hypothécaires, lorsque<br />
la défense est une dénégation générale, ne semble<br />
pas sérieuse ou paraît avoir été faite uniquement<br />
pour obtenir du délai ;<br />
3. Les actions entre locateurs et locataires dans<br />
les cas autres que ceux prévus à l'alinéa 3 <strong>de</strong> la<br />
règle 20».<br />
28° Les <strong>de</strong>man<strong>de</strong>s pour fixer une cause au<br />
rôle spécial peuvent être présentées à l'officier<br />
nommé par le juge en chef les lundi et mardi <strong>de</strong><br />
chaque semaine entre dix heures du matin et<br />
midi ou en tout autre temps déterminé par le<br />
juge en chef.<br />
CHAPITRE<br />
IX<br />
('our <strong>de</strong> pratique<br />
29° IVC juge en chef fixe le nombre <strong>de</strong> divisions<br />
<strong>de</strong> la Cour <strong>de</strong> pratique et y distribue les causes.<br />
30° Avis <strong>de</strong> présentation <strong>de</strong> toute procédure<br />
doit être donné pour 10 heures du matin à la<br />
mile 31, d'où elle sera référée à la division<br />
appropriée. Afin d'être mise au rôle, toute<br />
procédure signifiée avec avis <strong>de</strong> présentation doit<br />
être déposée au greffe au plus tard la veille <strong>de</strong> la<br />
«late mentionnée dans l'avis.<br />
31° Toute procédure, où ni l'un ni l'autre <strong>de</strong>s<br />
avocats n'est présent lors du <strong>de</strong>uxième appel du<br />
rôle, sera continuée FINE die.<br />
32 Toute procédure qui a déjà été continuée<br />
trois fois et qui n'a pu procé<strong>de</strong>r sans raison<br />
sérieuse sera continuée sine die.<br />
33° lorsqu'une procédure a été continuée MIM<br />
die en vertu <strong>de</strong> la règle 32, elle ne reviendra pas<br />
au rôle sans la permission du juge en chef sur<br />
<strong>de</strong>man<strong>de</strong> écrite.<br />
25. Applications umler rules 23 and 24 shall<br />
be presented to the chief justice, in chambers, at<br />
nine o'clock of the forenoon on Friday, or at<br />
such other hour and day as he may fix.<br />
CHAPTER<br />
Special roll<br />
VIII<br />
20. There may l>e inscribed on the -PENAL<br />
roll the following cases:<br />
1. Actions in which the <strong>de</strong>fendant has ma<strong>de</strong><br />
<strong>de</strong>fault to appear on articulated facts.<br />
The motion to have the facts held to be admitted<br />
as well as the inscription for judgment may<br />
l>e submitted at the same time;<br />
2. Actions on account, promissory note,<br />
cheque, bill of exchange, acknowledgement of<br />
in<strong>de</strong>btedness or other document, in which the<br />
plea is a general <strong>de</strong>nial;<br />
3. Actions between landlord ami tenant<br />
involving a dwelling where the claim is solely<br />
f«>r rental due and damages resulting from loss<br />
of rental.<br />
27. There may also be inscribed on the<br />
special roll, with the authorization of the chief<br />
justice or officer appointed by him for this purpos.<br />
on motion by one of the parties after notice<br />
to the adverse party, the following cases:<br />
1. Actions on account, note, cheque, bill of<br />
exchange, acknowledgment of in<strong>de</strong>btedness or<br />
other document, in which the plea does not seem<br />
to be serious and appears to have been filed<br />
solely in or<strong>de</strong>r to obtain <strong>de</strong>lay ;<br />
2. Actions in execution of a clause of dation<br />
en paiement or of a resolutory clause or hypothecary<br />
actions when the plea is a general <strong>de</strong>nial or<br />
appears to have been filed solely in or<strong>de</strong>r to<br />
obtain <strong>de</strong>lay ;<br />
3. Actions between landlord and tenant other<br />
than those covered bv sub-paragraph 3 of rule<br />
26.<br />
28. Applications to have a case fixed on the<br />
special roll shall be presented to the officer<br />
appointed by the chief justice on Mondays and<br />
Tuesdays of each week between 10 a.m. and<br />
noon, or at such other hour and day as may be<br />
fixed by the chief justice.<br />
CHAPTER<br />
IX<br />
Practice court<br />
29° The chief justice shall <strong>de</strong>termine the<br />
number of divisions of the Practice Court and<br />
the distribution of cases therein.<br />
30. Notice of presentation of every proceeding<br />
must be given for 10 a.m. in room 31 from which<br />
it will be referred to the appropriate division.<br />
To be inclu<strong>de</strong>d on the roll every proceeding<br />
served with a notice of presentation must be<br />
filed in court not later than the day preceding<br />
the date mentioned in the notice.<br />
31. Any proceeding where neither of the<br />
advocates is present at the second calling of the<br />
roll will be continued sine die.<br />
32. Any proceeding which has already been<br />
continued theree times and which without a<br />
serious reason does not proceed will be continued<br />
sine die.<br />
33. When a proceeding has been continued<br />
sine die in virtue of rule 32, it shall not reappear<br />
on the roll without the permission of the chief<br />
justice upon written application.
