Sauf dans les cas prévus à l'article 61 du Co<strong>de</strong><br />
do Procédure civile, cet acte porte la signature<br />
manuscrite <strong>de</strong> l'avocat, ou du notaire dans les<br />
,as ou ce <strong>de</strong>rnier est autorisé à. représenter une<br />
partis OU <strong>de</strong> la partie elle-même si elle n'est pas<br />
représentée.<br />
;i° Chaque inventaire <strong>de</strong>s pièces est signé par<br />
l'avoeat ou le notaire dans les cas ou il est autorisé<br />
à représenter une partie ou pur la partie<br />
elle-même si elle n'est pas tenue <strong>de</strong> se faire représenter.<br />
Il énumère toutes les pièces qui l'accompagnent,<br />
porte le numéro <strong>de</strong> la cause et le nom<br />
<strong>de</strong>s parties et donne la date, la nature et le numéro<br />
<strong>de</strong> chaque pièce.<br />
4° Le numéro <strong>de</strong> chaque pièce est précédé<br />
d'une lettre-indice spéciale à chaque partie, et<br />
qui sert jusqu'à la fin <strong>de</strong> l'enquête. Il n'y a qu'une<br />
seule série <strong>de</strong> numéros.<br />
5° Le protonotaire, lorsqu'il reçoit un acte <strong>de</strong><br />
procédure ou une pièce, les numérote et les<br />
date au dos sous son paraphe.<br />
0° Toute requête énonce les faits et moyens<br />
invoqués à son soutien; elle doit être accompagnée<br />
d'un affidavit si les faits n'apparaissent pas<br />
au dossier.<br />
7° Un dossier ne peut être consulté qu'en présence<br />
du protonotaire. Si ce <strong>de</strong>rnier est empêché<br />
d'assister, il exige <strong>de</strong> cette consultation une<br />
reconnaissance écrite qui <strong>de</strong>vra rester au dossier.<br />
CHAPITRE<br />
III<br />
Du protonotaire, <strong>de</strong>s registres,<br />
in<strong>de</strong>x et fichiers<br />
8° Sauf dans le district <strong>de</strong> Montréal et sans<br />
restreindre les obligations créées par <strong>de</strong>s lois<br />
spéciales, le protonotaire doit tenir:<br />
a) Un registre chronologique <strong>de</strong>s exemplaires<br />
<strong>de</strong>s brefs contenant:<br />
1. Les noms, adresses et qualités du <strong>de</strong>man<strong>de</strong>ur<br />
et du défen<strong>de</strong>ur et, s'il y en a plusieurs, l'indication<br />
qu'il y en a d'autres;<br />
2. Lu date du dépôt <strong>de</strong> l'exemplaire du href<br />
el son numéro;<br />
•'L Le nom et l'adresse du procureur;<br />
4. La nature <strong>de</strong> la <strong>de</strong>man<strong>de</strong>;<br />
b) Un in<strong>de</strong>x <strong>de</strong>s <strong>de</strong>man<strong>de</strong>urs et <strong>de</strong>s défen<strong>de</strong>urs;<br />
c) Un in<strong>de</strong>x <strong>de</strong>s élections <strong>de</strong> domicile:<br />
d) Une liste <strong>de</strong>s délibérés;<br />
c) Un registre <strong>de</strong>s procédures après jugement<br />
contenant :<br />
1. Le numéro <strong>de</strong> la cause;<br />
2. Les noms <strong>de</strong>s parties en commençant par<br />
celui du débiteur;<br />
3. Le montant à prélever;<br />
4. La date du jugement;<br />
5. La date <strong>de</strong> tout interrogatoire du défen<strong>de</strong>ur<br />
ou d'un tiers;<br />
6. La nature <strong>de</strong> tout bref <strong>de</strong>mandé;<br />
7. La date <strong>de</strong> l'émission du bref et celle <strong>de</strong> son<br />
rapport;<br />
8. Le nom du procureur du créancier;<br />
9. Les ordonnances rendues <strong>de</strong>puis l'émission<br />
du bref d'exécution ou <strong>de</strong> saisie-arrêt;<br />
10. Les oppositions à la saisie produites ou les<br />
contestations <strong>de</strong> saisie-arrêt;<br />
f) Un plumitif contenant:<br />
1. IXÏ numéro <strong>de</strong> chaque cause;<br />
2. Les noms <strong>de</strong>s parties suivant les dispositions<br />
<strong>de</strong>s articles 114 et 115 C.P.;<br />
3. La nature du bref et la date du dépôt <strong>de</strong><br />
l'exemplaire;<br />
Except in the case provi<strong>de</strong>d by article 01 of<br />
the Co<strong>de</strong> of Civil Procedure! every document<br />
must beaf the handwritten signature of the<br />
advocate or of the notary, in the ease where a<br />
notary is authorized to represent a party, or the<br />
signature of the party if such party is not represented.<br />
3. Each list of exhibits is signed by the lawyer<br />
or the notary, in cases where he is authorized to<br />
represent a party, or by the party himself when<br />
he is not obliged to have himself represented. It<br />
enumerates all the exhibits attached to it,<br />
bears the number of the case and the name of the<br />
parties and gives the date, the nature and the<br />
number of each exhibit.<br />
4. The number of each exhibit is prece<strong>de</strong>d by<br />
an in<strong>de</strong>ntifying letter attributed to each party,<br />
which shall IK- used until the end of the hearing.<br />
There shall la* only one series of numbers.<br />
5. The prothonotary, when be receives a<br />
pleading or an exhibit, numbers it and endorses<br />
the date thereon over his initials.<br />
0. Every (notion must set out the facts and<br />
grounds urged in support thereof; it must be<br />
supported by an affidavit if the facts do not<br />
appear from the record.<br />
7. A court record may IH> consulted only in the<br />
presence of the prothonotary. If the prothonotary<br />
is unable to l>e present during such consultation<br />
there must be obtained a written aeknowlogdmont<br />
of it. which must remain in the record.<br />
CHAPTER<br />
III<br />
The Prothonotary's Registers<br />
and In<strong>de</strong>xes<br />
8. Except in the district of Montreal and<br />
without restricting the obligations created by<br />
special laws, the prothonotary shall keep:<br />
(a) A chronological register of the copies of<br />
the writs containing:<br />
1. The names, addresses and qualities of the<br />
plaintiff and of the <strong>de</strong>fendant, and if there be<br />
several, a mention that there are others;<br />
2. The date of the <strong>de</strong>posit of the copy of the<br />
writ and its number;<br />
3. The name and address of the attorney;<br />
4. The nature of the action;<br />
(6) An in<strong>de</strong>x of plaintiffs and <strong>de</strong>fendants;<br />
(c) An in<strong>de</strong>x of the election of domicile;<br />
(d) A list of the cases taken un<strong>de</strong>r advisement;<br />
ie) A register of proceedings after judgment<br />
containing:<br />
1. The number of the case;<br />
2. The names of the parties, beginning with the<br />
<strong>de</strong>btor's;<br />
3. The amount to be levied;<br />
4. The date of the judgment;<br />
5. The date of any examination of the <strong>de</strong>btor<br />
or of a third party;<br />
6. The nature of any writ requested;<br />
7. The date of its issue and that of its return;<br />
8. The name of the creditor's attorney;<br />
9. The judgments given since the issue of the<br />
writ of execution or of attachment;<br />
10. The oppositions produced to the seizure<br />
or the contestations of attachments;<br />
(/) A plumitif containing:<br />
1. The number of each case;<br />
2. The names of the parties in accordance with<br />
the provisions of articles 114 and 115 CP.;<br />
3. The nature of the writ and the date on which<br />
the copy was <strong>de</strong>posited;
