Section "B" Part "B" CONCERNANT des modifications au décret relatif à l'industrie et aux métiers de la construction dans la région dc Montréal. CONCERNING amendments of the decree relating to the construction industry and trades in the region of Montreal. ATTENDU QUE, conformément aux dispositons de la Loi dc la convention collective (Statuts refondus de Québec 19-11, chapitre 163 et amendements), et pour donner suite à une requête qui lui a été présentée, le Ministre du Travail a donné avis dc son intention de soumettre à l'appréciation et à la décision du Lieutenant-Gouverneur en Conseil certaines modifications à la section "A" du décret numéro 314 du 27 mars 1957, relatif à l'industrie et aux métiers de la construction dans la région de Montréal; ATTENDU QUE ledit avis a été publié dans la Gazette officielle dc Québec, édition du 11 mai 1957; ATTENDU QUE, conformément aux dispositions de ladite Loi, les parties contractantes à la convention collective de travail rendue obligatoire par ledit décret ont également présenté au Ministre du Travail une requête à l'effet de soumettre à l'appréciation et à la décision du Lieutenant- Gouverneur en Conseil certaines modifications à ce décret; ATTENDU QUE ladite requête a été publiée dans la Gazette officielle de Québec, édition du 25 mai 1957; ATTENDU Qu'aucune objection n'a été formulée contre l'approbation des modifications proposées; IL EST ORDONNÉ, en conséquence, sur la proposition de l'honorable Ministre du Travail: QUE ledit décret, numéro 314, soit modifié comme suit: 1° Le paragrahpe "rf" de la section 2 du titre Premier est remplacé par le suivant: "d) Aux opérations de camionnage visées par le décret numéro 913 du 16 juin 1948 et ses amendements, à l'exception des chauffeurs de camion employés directement par un entrepreneur pour son propre service." 2° Le paragraphe "c" de l'article 17 du Titre Troisième est remplacé par le suivant: "c) Quarante (40) heures par semaine, aucune limite à la durée journalière de travail sinon qu'elle doit se terminer à 5.00 p.m. le vendredi pour tout couvreur et couvreur à l'aide de membrane rapportée (autre que les ajusteurs de métal en feuille) et tout journalier faisant partie d'une équipe employée aux travaux de couverture." Le nouvel article VH-A suivant est ajouté à ladite section "A" du chapitre deuxième, concernant des dispositions spéciales et complémentaires relatives aux métiers de plombier, poseur d'appareils de chaujjage, mécanicien en tuyauterie et soudeur en tuyauterie: "VII-A. Apprentissage des Soudeurs en Tuyauterie: 1° La durée de l'apprentissage est de trois (3) ans, doit deux (2) ans à titre d'apprenti et un (1) an à titre de compagnon junior, WHEREAS, pursuant to the provisions of the collective Agreement Act (Revised Statutes of Quebec 1941, chapter 163 and amendments), and to give effect to a petition submitted, to him, the Minister of Labour has given notice of his intention to submit to the consideration and decision of the Lieutenant-Governor in Council some amendments to section "A" of the decree No. 314 of March 27, 1957, relating to the construction industry and trades in the region of Montreal; WHEREAS the said notice has been published in the Quebec Official Gazette, issue of Mav 11, 1957; WHEREAS, pursuant to the provisions of the said Act, the contracting parties to the collective labour agreement rendered obligatory by the said decree have also petitioner! the Minister of Labour to submit to the consideration and decision of the Lieutenant-Governor in Council some amendments to the said decree; WHEREAS the petition was published in the Quebec Official Gazette, issue of May 25, 1957; WHEREAS no objection has been made against the approval of the proposed amendments; IT IS ORDERED, therefore, on the receommendation of the Honourable the Minister of Labour. THAT the said decree, No. 314, be amended as follows: 1. Subsection "d" of section 2 of the First Title is replace by the following: "d) Trucking operations governed by decree No. 913 of June 16, 1948, and its amendments, except for truckdrivers employed directly by a contractor for his own work". 2. Subsection "c" of article 17 of the Third Title is replaced by the following: "c) Forty (40) hours per week, with no limit for daily hours other than 5.00 p.m. on Friday for roofers and built-up membrane roofers (other than sheet metal erectors) and labourers working in roofing crews". The following new article VII-A is added to the said Section "A" of the Second Chapter concerning the special and complementary porvisions respecting the trades of plumber, steamfitter pipe welder and pipe mechanic: "VII-A. Apprenticeship of pipe welders: 1. The duration of apprenticeship shall be three (3) years, two (2) of which in the capacity of apprentice and one (1) in the capacity of junior journeyman.

Pour fins de ce calcul, tout le travail supplémentaire doit être considéré comme du travail régulier. 2° Une surveillance des apprentis doit être exercée par l'autorité compétente. L'autorité compétente est définie comme suit: Deux représentants des employeurs, un représentant de chacune des unions concernées et un professeur attaché aux cours du jour. En ce qui concerne les examens pour les apprentis, lesdits examens sont sous la surveillance de l'autorité compétente telle que ci-haut définie, en tenant compte, toutefois, qu'à chaque examen un professeur doit alterner. 3° Tout apprenti-soudeur doit s'inscrire à un Centre d'Apprentissage des Métiers du Bâtiment et y faire un stage préliminaire de six (0) mois ou environ 1,000 heures, avant de pouvoir se procureur un carnet d'apprentissage dans ledit métier de soudure à l'arc et/ou oxyacétylène. "Sont exempts de cette obligation les élèves qui se sont spécialisés en soudure dans une des écoles relevant du Ministère du bien-être social et de la jeunesse, selon la loi 5 Geo. VI, c. 48, a.l. Un crédit d'apprentissage proportionné à leurs études et aux résultats qu'ils y ont obtenus doit leur être accordé". 4° A la fin de son entraînement régulier au Centre, l'apprenti-soudeur est appelé à subir une épreuve théorique et pratique (test) devant un Bureau d'Examinateurs dûment assigné, qui verra à lui accorder un crédit d'apprentissage proportionné aux résidtats obtenus et à son record d'atelier. 5° Tout apprenti-soudeur doit posséder un carnet d'apprentissage dans lequel doivent être inscrits régulièrement ses heures de travail et les crédits obtenus, inscrits en lettres et en chiffres. Ce carnet est émis par la Commission d'Apprentissage, sur recommendation du Bureau des Examinateurs et sous le juridiction du comité paritaire. 6° Pour être admis au Centre d'Aprentissage îles Métiers du Bâtiment, le candidat doit être âgé de pas moinsde 18 ans et de pas plus de 25 ans. 7° Le carnet d'apprentissage est renouvelable tous les ans, avant le 1er avril. ~^ 8° L'apprentissage préliminaire au Centre doit comporter un entraînement général de base dans le métier de la soudure de tuyauterie, sans qu'il soit fait mention pour le moment d'une spécialité (arc ou oxyacétylène) dans ledit métier. Toute autre disposition pourra être apportée au programme de base après une entente entre les diverses parties intéressées. 9° L'employeur a droit à un apprenti poulies deux premiers compagnons soudeurs, sur le chantier même, et il ne peut employer, sur le chantier, plus d'un (1) apprenti par cinq (5) compagnons additionnels. 10 Salaires minima: Par heure Apprenti de 1ère année SI .00 Apprenti de 2ième année 1.25 Compagnon junior 1.60 11° Le Bureau des Examinateurs du Comité paritaire doit accorder aux élèves des écoles spécialisées de la province, écoles techniques '•t écoles d'arts et métier, un crédit proportionné la durée de leurs études et au résultat de leurs examens. 12° La présente réglementation ne s'applique pas aux soudeurs de réservoir à haute pression assujettis à la Loi des appareils sous pression, (S.R.Q. 1941, chapitre 177 et à ses règlements)." For the purpose of this calculation, all overtime shall be considered as regular time. 2. Apprenticeship shall be controlled by the authority having jurisdiction. The authority having jurisdiction is defined as follows: Two representatives of employers, one representative of each one of the unions concerned and one teacher giving day courses. As ragrds apprentices' examinations, they shall be passed under the supervision of the authority having juridiction but the teachers shall take turns, each one giving but one examination. 3. Every apprentice welder shall register with a Building Trades Training Centre and serve therein a preliminary period of six (6) months or about 1,000 hours before obtaining an apprenticeship booklet in the said arc and/or oxyacétylène welding trade. "The foregoing provision shall not apply to apprentices who specialized in welding in a school under the jurisdiction of the Youth and Social Welfare Department, in pursuance of Act 5 Geo. VI, c. 48, a.l. They shall be given an apprenticeship credit based on the length and results of their studies". 4. Upon completion of his regular training at the Centre, the apprentice welder shall be called upon to pass a theoretical and practical test before a Board of Examiners duly appointed which shall given him all apprenticeship credit based on the results obtained and his shop record. 5. Every apprentice welder shall hold an apprenticeship booklet in which his hours of work and the credits obtained shall be inscribed regularly, the figures being entered in letters and numerals. Such booklet shall be issued by the apprenticeship Commission upon recommendation of the Board of Examiners and under the jurisdiction of the Parity Committee. 6. To be admitted to the Building Trades Training Centre, a candidate shall not be less than 18 nor more than 25 years old. 7. The apprenticeship booklet shall be renewed every year, before April 1. 8. The preliminary training at the Centre shall comprise a general basic training in the pipe welding trade without specializing for the time being (arc or oxyacétylène). The basic training programme may be modified upon agreement of the parties concerned. 9. The employer is entitled to one apprentice for the first two journeymen welders on a job and he may not have, on a job, more than one apprentice to each five additional journeymen. 10. Wages: Per hour 1st year apprentice SI. 00 2nd year apprentice 1.25 Junior journeyman 1.60 11. The Boarh of Examiners of the Parity Committee shall grant to pupils of specialized schools of the Province and of technical and trade schools a credit based on the duration of their studies and on the result of their examinations. 12. The present provisions do not apply to high pressure container welders governed by the Pressure Vessels Act (R.S.Q. 1941, chapter 177, and its regulations)." (Document "B" annexed to the Order).
