Des activités de vulgarisation du droit et de sensibilisation
de la population ont également été menées.
Depuis juillet 2006 RCN Justice & Démocratie développe
un programme axé sur la prévention et la gestion des
conflits fonciers en Ituri. Dans le cadre du projet 2008-
2009, RCN Justice & Démocratie poursuit ses actions grâce
au financement de la Délégation de la Commission Européenne
en RDC.
L’objectif est de participer à la restauration du sentiment
de justice au sein de la population en Ituri et de
renforcer la paix sociale dans cette région par une meilleure
résolution des conflits fonciers.
Dans cette perspective et afin d’offrir à la population
une plus grande sécurité juridique, un travail d’appui aux
institutions judiciaires, administratives et coutumières est
entrepris.
RCN Justice & Démocratie s’est également engagé dans
des actions de vulgarisation et de sensibilisation auprès de
la population et des déplacés.
Southern Sudan
« To reinforce the linkages
between judicial system and society »
The conflict in Southern Sudan has an intractable record
for being one of the longest conflicts in Africa. Ravaged
by twenty one years of civil war, it is clearly one of the
least developed regions in the world.
The advent of peace was marked with the signing of the
Comprehensive Peace Agreement in 2005 (CPA) between
the Government of Sudan represented by the ruling National
Congress Party (NCP) and the Sudan People’s Liberation
Movement/ Army. The CPA provides Southern Sudan
with autonomy under its own six year interim constitution.
Power and wealth sharing between the NCP and
SPLM/A was extensively negotiated. In 2011, six and a half
years after signing the CPA, there will be a referendum
where Southern Sudan may elect either to remain united
with the North or be independent.
The implementation of the CPA is constantly challenged
by disputes and disagreements on issues such as demarcation
of borders in certain areas, failure to meet deadlines
on redeployment of armed forces, disagreement on the
Abyei boundary commission report and wealth and revenue
sharing.
In addition to this, use and occupation of land and resources,
the steady stream of returnees into Southern Sudan,
weak institutional structures have continued to pose
a threat to the smooth implementation of the CPA.
The CPA has led to the process of establishing the Government
of Southern Sudan (GOSS). Although GOSS has
the will and determination to establish stable social, economic
and political structures, it presently faces a statebuilding
exercise of enormous proportions.
The justice system of Southern Sudan is no exception.
Legal capacity and resource constraints are manifested by
the almost complete absence of an effectively functioning
infrastructure, as well as by shortage of well trained lower
level judges, prosecutors, and support staff.
At present, legal and judicial personnel with good working
knowledge of English language and conversant with
common law legal system is sorely lacking.
The primary objective of RCN J&D in Southern Sudan is
to contribute to an effectively functioning Southern Sudanese
justice system by improving the competences of justice
actors and reinforce operational capacity of the justice
system.
To this end, RCN Justice & Démocratie is presently training
judges, prosecutors and legal support staff from across
the ten provinces of Southern Sudan. Further, RCN J&D
provides logistical support that assist justice actors in going
about the work they have been trained to carry out
during RCN J&D’s training sessions.
Justice and rule of law form the very basis of a society.
The lower level judicial institutions are often the primary
point of access to justice for the people.
Therefore, RCN J&D mostly focuses its training programmes
on the county court judges and prosecutors.
