In 2004, <strong>the</strong> act gave rise to SEDA by merg<strong>in</strong>g Ntsika, NAMA Trust, and <strong>the</strong> Community PPP.<br />
Implications for SEDA and poultry cooperatives: The National Small Bus<strong>in</strong>ess Act gave rise to SEDA and <strong>in</strong><br />
do<strong>in</strong>g so set out a number <strong>of</strong> objectives which aim to assist <strong>the</strong> development and competitiveness <strong>of</strong> small<br />
bus<strong>in</strong>esses <strong>in</strong>clud<strong>in</strong>g cooperatives.<br />
3.2.2.<br />
<strong>Cooperatives</strong> Act (No 15 <strong>of</strong> 2005)<br />
The <strong>Cooperatives</strong> Act was developed to replace <strong>the</strong> Agricultural <strong>Cooperatives</strong> Act <strong>of</strong> 1991, <strong>in</strong> order<br />
to address all cooperatives <strong>in</strong> all spheres <strong>of</strong> <strong>the</strong> economy. The act was developed <strong>in</strong> order to provide<br />
for <strong>the</strong> formation and registration <strong>of</strong> cooperatives and deal with o<strong>the</strong>r matters associated with <strong>the</strong><br />
development and operations <strong>of</strong> cooperative enterprises. Accord<strong>in</strong>g to <strong>the</strong> cooperatives Act (No 15<br />
<strong>of</strong> 2005) <strong>the</strong> act was developed <strong>in</strong> order to:<br />

ensure that <strong>in</strong>ternational cooperative pr<strong>in</strong>ciples are recognised and implemented <strong>in</strong> <strong>the</strong><br />
Republic <strong>of</strong> South Africa<br />
enable cooperatives to register and acquire a legal status separate from <strong>the</strong>ir members<br />
facilitate <strong>the</strong> provision <strong>of</strong> targeted support for emerg<strong>in</strong>g cooperatives, particularly those<br />
owned by women and black people.<br />
The act also <strong>in</strong>tends to achieve <strong>the</strong> follow<strong>in</strong>g: (Department <strong>of</strong> Trade and <strong>Industry</strong> [<strong>the</strong> dti], 2005:12-<br />

promote <strong>the</strong> development <strong>of</strong> susta<strong>in</strong>able cooperatives that comply with cooperative<br />
pr<strong>in</strong>ciples, <strong>the</strong>reby <strong>in</strong>creas<strong>in</strong>g <strong>the</strong> number and variety <strong>of</strong> economic enterprises (emerg<strong>in</strong>g)<br />
operat<strong>in</strong>g <strong>in</strong> <strong>the</strong> formal economy<br />
encourage persons and groups who subscribe to values <strong>of</strong> self-reliance and self-help, and<br />
who choose to work toge<strong>the</strong>r <strong>in</strong> democratically controlled enterprises, to register<br />
cooperatives <strong>in</strong> terms <strong>of</strong> <strong>the</strong> <strong>Cooperatives</strong> Act, 2005<br />
enable such cooperative enterprises to register and acquire a legal status separate from<br />
<strong>the</strong>ir members<br />
