<strong>Preparation</strong> <strong>and</strong> <strong>Consideration</strong> <strong>of</strong> <strong>Exempt</strong> <strong>and</strong><br />
<strong>Self</strong>-Assessable Development/Works Proposals<br />
Development <strong>of</strong> <strong>Brisbane</strong> Core <strong>Port</strong> L<strong>and</strong> under the <strong>Brisbane</strong> <strong>Port</strong> L<strong>and</strong> Use Plan 2010 (LUP) can be broadly classified<br />
as ‘<strong>Exempt</strong>,’ ‘<strong>Self</strong>-Assessable,’ ‘Assessable’ or ‘Prohibited.’<br />
This fact sheet explains ‘<strong>Exempt</strong>’ <strong>and</strong> ‘<strong>Self</strong>-Assessable’ development (under the LUP), the development proposal<br />
review process <strong>and</strong> the requirements to obtain <strong>Port</strong> <strong>of</strong> <strong>Brisbane</strong> Pty Ltd (PBPL) consent for proposals.<br />
(The requirements for Assessable development approvals are explored in the accompanying fact sheet - ‘<strong>Preparation</strong> <strong>and</strong> Assessment<br />
<strong>of</strong> ‘Assessable’ development/works proposals’.)<br />
Introduction to ‘<strong>Exempt</strong>’ <strong>and</strong> ‘<strong>Self</strong>-assessable’ development proposals<br />
<strong>Exempt</strong> Development is consistent with the LUP’s<br />
Precinct Plan <strong>and</strong>, under the LUP, does not require a<br />
development permit.<br />
This type <strong>of</strong> development is generally <strong>of</strong> a minor nature<br />
<strong>and</strong> may include, for example:<br />
communications <strong>and</strong> telecommunications<br />
infrastructure<br />
signage (other than billboards)<br />
minor building works<br />
monitoring facilities<br />
reconfiguring a lot by lease for core port or transport<br />
infrastructure<br />
emergency works for safe port operations <strong>and</strong><br />
environmental protection.<br />
While a permit is not required for <strong>Exempt</strong> development,<br />
PBPL must still provide consent for works.<br />
<strong>Self</strong>-Assessable Development is consistent with the LUP’s<br />
Precinct Plan <strong>and</strong> the relevant LUP codes. Failure to<br />
demonstrate compliance with the relevant codes will<br />
trigger a higher level <strong>of</strong> assessment (i.e. ‘Assessable’<br />
Development) which will require a formal application to<br />
the Department <strong>of</strong> Infrastructure <strong>and</strong> Planning.<br />
Examples <strong>of</strong> <strong>Self</strong>-Assessable Development will vary<br />
depending on which LUP precinct the proposed<br />
development is located. However, they are generally<br />
developments typically expected on <strong>Brisbane</strong> Core<br />
<strong>Port</strong> L<strong>and</strong>.<br />
PBPL will grant its consent to <strong>Self</strong>-Assessable<br />
Development after compliance has been demonstrated<br />
with the applicable precinct <strong>and</strong> LUP codes.<br />
When development does not comply with these codes,<br />
it will be determined as ‘Assessable’ <strong>and</strong> will require<br />
assessment by the Department <strong>of</strong> Infrastructure <strong>and</strong><br />
Planning via the provisions <strong>of</strong> the Sustainable Planning<br />
Act 2009.<br />
PBPL has also developed ‘Technical Guidelines’ that must be<br />
referred to when formulating development/work proposals.<br />
They outline the various port specific <strong>and</strong> technical<br />
considerations unique to our environmental setting.<br />

Preparing a development proposal<br />
Development proposals require careful preparation so<br />
that, once lodged, the assessment process can occur in a<br />
timely manner.<br />
PBPL <strong>and</strong>, in some cases, the relevant external agencies<br />
will closely review each proposal – hence the importance<br />
<strong>of</strong> providing the right amount <strong>of</strong> technical, design <strong>and</strong><br />
environmental management detail.<br />
PBPL employs urban planners <strong>and</strong> environmental specialists<br />
to assist with the preparation <strong>of</strong> your development<br />
proposals.<br />
To determine if your development is <strong>Exempt</strong>, <strong>Self</strong>-<br />
Assessable or Assessable, <strong>and</strong> to discuss the relevant<br />
application requirements, arrange a prelodgement meeting<br />
by contacting our planning <strong>and</strong> environment team.<br />
The application process<br />
Having tailored <strong>and</strong> lodged your <strong>Exempt</strong> or<br />
<strong>Self</strong>-Assessable development proposal, based on<br />
the advice from our planning <strong>and</strong> environment team,<br />
your application will be reviewed by a range <strong>of</strong> PBPL<br />
specialists (e.g. planners, environmental <strong>of</strong>ficers,<br />
engineers, commercial <strong>and</strong> property managers) in<br />
accordance with the process outlined in Figure 1.<br />
PBPL aim to finalise the review for <strong>Exempt</strong><br />
development within five business days <strong>and</strong><br />
<strong>Self</strong>-Assessable development within 50% <strong>of</strong> the<br />
Integrated Development Assessment System timelines<br />
as defined – for equivalent development proposals – in<br />
the Sustainable Planning Act 2009.<br />
