Preparation and Consideration of Exempt and
Self-Assessable Development/Works Proposals
Development of Brisbane Core Port Land under the Brisbane Port Land Use Plan 2010 (LUP) can be broadly classified
as ‘Exempt,’ ‘Self-Assessable,’ ‘Assessable’ or ‘Prohibited.’
This fact sheet explains ‘Exempt’ and ‘Self-Assessable’ development (under the LUP), the development proposal
review process and the requirements to obtain Port of Brisbane Pty Ltd (PBPL) consent for proposals.
(The requirements for Assessable development approvals are explored in the accompanying fact sheet - ‘Preparation and Assessment
of ‘Assessable’ development/works proposals’.)
Introduction to ‘Exempt’ and ‘Self-assessable’ development proposals
Exempt Development is consistent with the LUP’s
Precinct Plan and, under the LUP, does not require a
development permit.
This type of development is generally of a minor nature
and may include, for example:
communications and telecommunications
infrastructure
signage (other than billboards)
minor building works
monitoring facilities
reconfiguring a lot by lease for core port or transport
infrastructure
emergency works for safe port operations and
environmental protection.
While a permit is not required for Exempt development,
PBPL must still provide consent for works.
Self-Assessable Development is consistent with the LUP’s
Precinct Plan and the relevant LUP codes. Failure to
demonstrate compliance with the relevant codes will
trigger a higher level of assessment (i.e. ‘Assessable’
Development) which will require a formal application to
the Department of Infrastructure and Planning.
Examples of Self-Assessable Development will vary
depending on which LUP precinct the proposed
development is located. However, they are generally
developments typically expected on Brisbane Core
Port Land.
PBPL will grant its consent to Self-Assessable
Development after compliance has been demonstrated
with the applicable precinct and LUP codes.
When development does not comply with these codes,
it will be determined as ‘Assessable’ and will require
assessment by the Department of Infrastructure and
Planning via the provisions of the Sustainable Planning
Act 2009.
PBPL has also developed ‘Technical Guidelines’ that must be
referred to when formulating development/work proposals.
They outline the various port specific and technical
considerations unique to our environmental setting.
Exempt and Self-Assessable Development/Works Proposals Fact Sheet
Preparing a development proposal
Development proposals require careful preparation so
that, once lodged, the assessment process can occur in a
timely manner.
PBPL and, in some cases, the relevant external agencies
will closely review each proposal – hence the importance
of providing the right amount of technical, design and
environmental management detail.
PBPL employs urban planners and environmental specialists
to assist with the preparation of your development
proposals.
To determine if your development is Exempt, Self-
Assessable or Assessable, and to discuss the relevant
application requirements, arrange a prelodgement meeting
by contacting our planning and environment team.
The application process
Having tailored and lodged your Exempt or
Self-Assessable development proposal, based on
the advice from our planning and environment team,
your application will be reviewed by a range of PBPL
specialists (e.g. planners, environmental officers,
engineers, commercial and property managers) in
accordance with the process outlined in Figure 1.
PBPL aim to finalise the review for Exempt
development within five business days and
Self-Assessable development within 50% of the
Integrated Development Assessment System timelines
as defined – for equivalent development proposals – in
the Sustainable Planning Act 2009.
