6.3 STEP 3 Approvals<br />

6.3.1 <strong>Soil</strong> movement between PBPL lease areas<br />

<strong>Soil</strong> movement within a PBPL Lot is regulated by PBPL and approval from PBPL is required<br />

prior to the transport or movement/disposal <strong>of</strong> soil from the lease site to another PBPL site.<br />

Submit the report in the format outlined in Section 6.2.5 to PBPL. PBPL will provide written<br />

approval within 10 days <strong>of</strong> the submitted report.<br />

6.3.2 <strong>Soil</strong> movement <strong>of</strong>f PBPL lands from lease areas not listed on the EMR or<br />

CLR.<br />

The leaseholder must obtain approval from PBPL prior to moving soil. Should the soil<br />

assessment conclude that the soils are contaminated, the soil movement will be regulated<br />

under the EP Act and requires a disposal permit as described for sites listed on the<br />

EMR/CLR.<br />

6.3.3 <strong>Soil</strong> movement <strong>of</strong>f PBPL lands from lease areas listed on the EMR or<br />

CLR.<br />

The leaseholder must obtain approval from PBPL prior to moving soil in addition to<br />

application for a disposal permit to DEHP. The application for a <strong>Disposal</strong> Permit is submitted<br />

to DEHP. Section 424 <strong>of</strong> the EP Act states:<br />

(3) The administering authority must decide the application within 10 business days after<br />

receiving it.<br />

(4) In making its decision whether to grant or refuse an application for a disposal permit, or<br />

the conditions <strong>of</strong> the permit, the administering authority must consider the standard criteria.<br />

(5) The administering authority must within 8 business days after making its decision —<br />

(a) if the decision is to grant the application—give the applicant the permit; and<br />

(b) if the decision is to grant the application but to impose conditions on the permit—give<br />

the applicant an information notice about the decision to impose the conditions; or<br />

(c) if the decision is to refuse the application—give the applicant an information notice<br />

about the decision.<br />

(6) If the administering authority fails to make a decision about an application for a disposal<br />

permit within the time it is required to make a decision on the application, the failure is taken<br />

to be a decision by the authority to refuse the application at the end <strong>of</strong> the time.<br />

(7) A disposal permit takes effect from the day <strong>of</strong> its issue, or a later day stated in it, and<br />

continues in force for the term stated in it.<br />

(8) This section does not apply if the person is removing and disposing <strong>of</strong> the soil under a<br />

remediation notice.<br />
