1 Introduction<br />
1.1 Background<br />
ENVIRON Australia Pty Ltd (ENVIRON) was engaged by <strong>Port</strong> <strong>of</strong> <strong>Brisbane</strong> Pty Ltd (PBPL) to<br />
prepare a <strong>Soil</strong> <strong>Disposal</strong> <strong>Plan</strong> to assist PBPL and its leaseholders with the disposal <strong>of</strong> soil<br />
generated through activities on PBPL land.<br />
The <strong>Soil</strong> <strong>Disposal</strong> <strong>Plan</strong> has been prepared in general accordance with contaminated land<br />
management guidelines published or endorsed by the Queensland Department <strong>of</strong><br />
Environment and Heritage Protection (DEHP).<br />
1.2 Objectives<br />
The objective <strong>of</strong> the <strong>Soil</strong> <strong>Disposal</strong> <strong>Plan</strong> is to provide a system for the disposal <strong>of</strong> soil that is<br />
protective <strong>of</strong> port assets, meets regulatory requirements and adopts best practice principles<br />
by:<br />

Describing a protocol to appropriately dispose <strong>of</strong> disposal soils from <strong>Port</strong> lands;<br />

2 Background Information<br />
2.1 Site Details and Setting<br />
<strong>Port</strong> <strong>of</strong> <strong>Brisbane</strong> comprises Fisherman Islands, <strong>Port</strong> Gate, <strong>Port</strong> West, Lytton, Pinkenba,<br />
Bulwer Island and Colmslie Precincts. The majority <strong>of</strong> precincts are located adjacent to<br />
environmentally sensitive marine environments.<br />
Land use (as opposed to ‘wet areas’) at the port falls into two main categories:<br />
<br />
<br />
PBPL owned land comprises either vacant land awaiting development / redevelopment,<br />
or land used for PBPL related activities; or<br />
Land leased to tenants (leaseholders) for industrial / commercial activities where the<br />
majority have undergone specific development for a lease holder’s own activities.<br />
2.1.1 Regulatory Background<br />
<strong>Port</strong> <strong>of</strong> <strong>Brisbane</strong> became a privately owned company in 2011 known as <strong>Port</strong> <strong>of</strong> <strong>Brisbane</strong> Pty<br />
Ltd (PBPL). As such, the PBPL is not now wholly responsible for port related planning<br />
decisions as it is not a government owned body. Historical arrangements with other<br />
Queensland Government entities have therefore been reviewed and protocols updated<br />
accordingly.<br />
Historically some PBPL owned land has been subject to activities which may have caused<br />
contamination either from tenant industrial land use, waste disposal or the inclusion <strong>of</strong> port<br />
land on the EMR as a result <strong>of</strong> land reclamation activities using dredged material. A<br />
Contaminated Land Environmental Baseline Review is presently in progress across all port<br />
owned lands to enable characterisation <strong>of</strong> soil and groundwater contamination with a<br />
completion date <strong>of</strong> 2013. PBPL maintain a corresponding environmental baseline database<br />
for all PBPL land.<br />
Some sites within the PBPL estate are listed on the Environmental Management Register<br />
(EMR) or the Contaminated Land Register (CLR). Historically, soil disposal between lots and<br />
lease areas has not been documented across <strong>Port</strong> lands. PBPL recognise that this practice<br />
could result in the spread <strong>of</strong> soils impacted by potentially contaminating activities.<br />
Further, Section 424 <strong>of</strong> the Environmental Protection Act 1994 (EP Act)) requires that a<br />
permit be obtained from DEHP before the removal <strong>of</strong> contaminated soil from land that is<br />
registered on the EMR or CLR. The guidelines further state:<br />
Application for a disposal permit must be made before removal <strong>of</strong> contaminated soil from a<br />
site that is recorded on the EMR or CLR:<br />
as part <strong>of</strong> a Remedial Action <strong>Plan</strong> approved by DoE [DEHP];<br />
from a site which has been or is being used for a Notifiable Activity;<br />
when contamination is discovered on a site which has not been used for a Notifiable<br />
Activity; and<br />

when contaminated soil is being removed for <strong>of</strong>f-site treatment.<br />
Sites are identified on the registers by Lot and Registered <strong>Plan</strong> numbers and be an<br />
individual Lot or a number <strong>of</strong> Lots.<br />
In addition to the regulatory requirements for soil movement, the tracking <strong>of</strong> soils on PBPL<br />
land that is not listed on the EMR or CLM is considered Best Practice.<br />

3 When does the <strong>Soil</strong> <strong>Disposal</strong> <strong>Plan</strong> apply?<br />
The <strong>Soil</strong> <strong>Disposal</strong> <strong>Plan</strong> applies to any soil proposed to be excavated within land owned by<br />
PBPL, irrespective <strong>of</strong> volume, leaseholder, location or purpose. Different categories <strong>of</strong> soil<br />
movement are managed through the plan as described in the following.<br />
1) <strong>Soil</strong> movements between the lease areas.<br />
2) Movement <strong>of</strong> soil <strong>of</strong>f PBPL Land from lease areas listed on the EMR or CLR.<br />
3) Movement <strong>of</strong> soil <strong>of</strong>f PBPL Land from lease areas not listed on the EMR or CLR.<br />
Movement <strong>of</strong> soil from one PBPL Lot to another PBPL Lot is considered the same as moving<br />
soil <strong>of</strong>f PBPL land and the same approval process applies.<br />
This plan does not apply to on-going placement <strong>of</strong> dredged material associated with port<br />
reclamation works specified under ERA 16.<br />
The <strong>Soil</strong> <strong>Disposal</strong> <strong>Plan</strong> does not provide regulatory context for the development or activity<br />
that will result in the generation <strong>of</strong> the excavated soil. In some instances planning<br />
requirements for a particular development or activity may be required in conjunction with the<br />
requirements <strong>of</strong> this plan.<br />
The <strong>Soil</strong> <strong>Disposal</strong> <strong>Plan</strong> applies prior to the commencement <strong>of</strong> soil excavation and<br />
should be consulted and followed as part <strong>of</strong> the planning process for the<br />
development or activity.<br />

5 <strong>Leaseholder</strong> <strong>Disposal</strong> Requirements<br />
5.1 Introduction<br />
This document has been provided to you, the <strong>Leaseholder</strong>, to assist with the <strong>of</strong>f-site disposal<br />
<strong>of</strong> excavated soil from your leasehold. The guidance provided is in accordance with the<br />
Department <strong>of</strong> Environment and Resource Management (now DEHP) Draft <strong>Guide</strong>lines for<br />
Assessment and Management <strong>of</strong> Contaminated Land in Queensland (1998) and Section 424<br />
<strong>of</strong> the EP Act (1994) which requires that a permit be obtained from DEHP before the removal<br />
<strong>of</strong> contaminated soil from land that is registered on the EMR or CLR as described in Section<br />
2.1.1.<br />
In addition to the regulatory requirements for soil movement, PBPL also require tracking <strong>of</strong><br />
soils on PBPL land that is not listed on the EMR or CLM. This requirement forms part <strong>of</strong> the<br />
PBPL site management procedures.<br />
5.2 What does this mean to the <strong>Leaseholder</strong>?<br />
All soils to be moved between or within Lots (including between leased areas) are<br />
required to be assessed.<br />
The process <strong>of</strong> assessment is outlined in Section 6.1.<br />
<strong>Soil</strong> movement between lease areas for sites regardless <strong>of</strong> listing on the EMR or CLR.<br />
The leaseholder must obtain approval from PBPL prior to moving soil.<br />
<strong>Soil</strong> movement <strong>of</strong>f PBPL lands from lease areas listed on the EMR or CLR.<br />
The leaseholder must obtain from DEHP a <strong>Disposal</strong> Permit, prior to the removal <strong>of</strong><br />
contaminated soil from land that is recorded on the EMR or CLR. <strong>Disposal</strong> Permits are<br />
issued for a specified volume <strong>of</strong> soil and stipulate the place <strong>of</strong> disposal and any conditions<br />
relating to soil removal, treatment and disposal.<br />
<strong>Soil</strong> movement <strong>of</strong>f PBPL lands from lease areas not listed on the EMR or CLR.<br />
The leaseholder must obtain approval from PBPL prior to moving soil. Should the soil<br />
assessment conclude that the soils are contaminated, the soil movement will be regulated<br />
under the EP Act and requires a disposal permit as described for sites listed on the EMR or<br />
CLR below.<br />
The EP Act (1994) states the following:<br />
In accordance with section 424 <strong>of</strong> the EP Act, a person removing and disposing <strong>of</strong><br />
contaminated soil from land which is recorded on the Environmental Management Register<br />
(EMR) or Contaminated Land Register (CLR) to an <strong>of</strong>f-site location must obtain a disposal<br />
permit from the department. <strong>Disposal</strong> permits enable appropriate and legal disposal and<br />
tracking <strong>of</strong> contaminated soil or materials.<br />

In normal circumstances, when work is being conducted to remediate a site, an application<br />
for a disposal permit will not be considered until a site investigation report has been<br />
assessed. When a Notifiable Activity continues on a site and disposal <strong>of</strong> contaminated soil<br />
becomes necessary, a site investigation report is not required.<br />

The following section provides a step by step guide for the assessment <strong>of</strong> soils for disposal<br />
and for obtaining the relevant approvals. The process is illustrated by the flowchart below.<br />
6.1 STEP 1 - PBPL Notification<br />
Notify PBPL <strong>of</strong> the intent to dispose soils <strong>of</strong>f lease area, using FORM A in Annex A.<br />
Form A requires a proposed sampling plan <strong>of</strong> soils to be disposed. Step 2 (Section 6.2<br />
below) presents a sampling program guide that will be adequate for most sites. Variations to<br />
this program may occur for sites not listed on the EMR or CLR which either have no known<br />
history <strong>of</strong> contamination or have known contaminating activities.<br />
PBPL may in these circumstances require the leaseholder to modify the sampling program<br />
to address potential contamination. Depending on the complexity <strong>of</strong> potential contaminants<br />
PBPL may require that the sampling program be reviewed by an appropriately qualified<br />
person as defined in Section 6.2.1.<br />
6.2 STEP 2 – <strong>Guide</strong> to assessing soils for movement <strong>of</strong>f lease area<br />
Contamination <strong>of</strong> soils to be disposed may have occurred from historical site activities,<br />
current site activities, infilling/landfilling and contamination from surrounding sites. The<br />
following information is provided to assist with undertaking an assessment for soils that are<br />
to be disposed <strong>of</strong>f site. The guide to assessing soils through investigation are applicable to<br />
all PBPL leases whether on the EMR, CLR and non-listed sites.<br />
6.2.1 Appropriately Qualified Person<br />
For sites where a DEHP <strong>Disposal</strong> Permit is sought, soil investigation are to be undertaken by<br />
an appropriately qualified person. Depending on site complexities for non-listed sites, PBPL<br />
may also request that investigations be undertaken by an appropriately qualified person.<br />
An appropriately qualified person is as defined in Appendix 6 <strong>of</strong> the Department <strong>of</strong><br />
Environment Draft <strong>Guide</strong>lines for the Assessment and Management <strong>of</strong> Contaminated Land<br />
in Queensland(1998). A copy is included in Annex B.<br />

6.2.2 <strong>Soil</strong> Sampling<br />
The soil investigation must include the following:<br />

The collection and analysis <strong>of</strong> a suitable number <strong>of</strong> soil samples from the material to be<br />
disposed <strong>of</strong>f site at a minimum sampling frequency <strong>of</strong> 1 per 50m3. This frequency is<br />
based on the Department <strong>of</strong> Environment Draft <strong>Guide</strong>lines for the Assessment and<br />
Management <strong>of</strong> Contaminated Land in Queensland(1998).<br />
The analysis <strong>of</strong> samples at a NATA accredited laboratory for chemicals <strong>of</strong> concern<br />
identified at the site, refer to Section 6.2.3;<br />
Comparison <strong>of</strong> the laboratory results against the relevant guidelines to assess the<br />
suitability for the soil to remain on PBPL land, see Section 6.2.4;<br />
6.2.3 Analytes<br />
Samples should be analysed for the following contaminants <strong>of</strong> concern. Variations to the<br />
analyte list can be sought from and/or required by PBPL.<br />

6.2.4 <strong>Guide</strong>lines<br />
Relevant <strong>Guide</strong>lines are described in Appendix 9 <strong>of</strong> The Department <strong>of</strong> Environment Draft<br />
<strong>Guide</strong>lines for the Assessment and Management <strong>of</strong> Contaminated Land in<br />
Queensland(1998), which provides investigation threshold levels for contaminants in soil,<br />
including environmental investigation levels and health-based investigation levels in various<br />
sensitivity exposure settings. A copy <strong>of</strong> these guidelines is included in Annex C <strong>of</strong> this<br />
document.<br />
The most relevant exposure setting for PBPL leaseholders is Exposure Setting F:<br />
Commercial/ Industrial.<br />
In addition, analysis for Total Petroleum Hydrocarbons (TPH) should be included. For initial<br />
screening, and in the absence <strong>of</strong> guidelines for TPH listed in Annex C, the following TPH<br />
concentrations should also be used as screening levels to assess the significance <strong>of</strong><br />

6.2.5 Reporting<br />
6.2.5.1 For soil movement between lease areas and soil movement <strong>of</strong>f PBPL<br />
land not regulated under the EP Act.<br />
Reports should be prepared in accordance with the Draft <strong>Guide</strong>lines for the Assessment and<br />
Management <strong>of</strong> Contaminated Land in Queensland, (1998).<br />
The report is to include;<br />
1) Details <strong>of</strong> the proposed excavation location including property description and<br />
address;<br />
2) Details <strong>of</strong> the expected volume <strong>of</strong> material;<br />
3) Details <strong>of</strong> the chemical characteristics <strong>of</strong> the material including analysis as described<br />
in Section 6.2.<br />
4) Details <strong>of</strong> the receiving site.<br />
6.2.5.2 For soil movement <strong>of</strong>f PBPL land for lease areas listed on EMR or CLR<br />
and/or regulated under EP Act<br />
In accordance with Section 424 <strong>of</strong> the EP Act, applications for a DEHR <strong>Disposal</strong> Permit<br />
should be lodged on the Application for <strong>Disposal</strong> Permit form available from DEHR, and<br />
accompanied by:<br />

written agreement from the owner <strong>of</strong> the disposal site to accept the contaminated<br />
soil, stating any conditions to be placed on the soil disposal;<br />
information which demonstrates the contaminated soil may be accepted under<br />
licence conditions issued under the EP Act;<br />
a copy <strong>of</strong> the Certificate <strong>of</strong> Title <strong>of</strong> the site from which soil is to be removed;<br />
a copy <strong>of</strong> the Certificate <strong>of</strong> Title <strong>of</strong> the site receiving the contaminated soil (if the soil<br />
is not going to a local government-administered landfill);<br />
copies <strong>of</strong> all laboratory reports for contaminated soil analyses (one laboratory<br />
sample/50m 3 soil is considered a minimum for stockpile sampling) and leachate<br />
testing results;<br />
a plan showing the location <strong>of</strong> sampling sites in relation to the contamination source;<br />
and<br />
a completed Notification <strong>of</strong> Land form (if the site from which the soil is being removed<br />
is not listed on the Environmental Management Register or Contaminated Land<br />
Register).<br />
Application for a DEHP <strong>Disposal</strong> Permit forms can be found in Appendix 12 <strong>of</strong> the Draft<br />
<strong>Guide</strong>lines for the Assessment and Management <strong>of</strong> Contaminated Land in Queensland<br />
(1998). A copy is included in Annex D.<br />

6.3 STEP 3 Approvals<br />
6.3.1 <strong>Soil</strong> movement between PBPL lease areas<br />
<strong>Soil</strong> movement within a PBPL Lot is regulated by PBPL and approval from PBPL is required<br />
prior to the transport or movement/disposal <strong>of</strong> soil from the lease site to another PBPL site.<br />
Submit the report in the format outlined in Section 6.2.5 to PBPL. PBPL will provide written<br />
approval within 10 days <strong>of</strong> the submitted report.<br />
6.3.2 <strong>Soil</strong> movement <strong>of</strong>f PBPL lands from lease areas not listed on the EMR or<br />
CLR.<br />
The leaseholder must obtain approval from PBPL prior to moving soil. Should the soil<br />
assessment conclude that the soils are contaminated, the soil movement will be regulated<br />
under the EP Act and requires a disposal permit as described for sites listed on the<br />
EMR/CLR.<br />
6.3.3 <strong>Soil</strong> movement <strong>of</strong>f PBPL lands from lease areas listed on the EMR or<br />
CLR.<br />
The leaseholder must obtain approval from PBPL prior to moving soil in addition to<br />
application for a disposal permit to DEHP. The application for a <strong>Disposal</strong> Permit is submitted<br />
to DEHP. Section 424 <strong>of</strong> the EP Act states:<br />
(3) The administering authority must decide the application within 10 business days after<br />
receiving it.<br />
(4) In making its decision whether to grant or refuse an application for a disposal permit, or<br />
the conditions <strong>of</strong> the permit, the administering authority must consider the standard criteria.<br />
(5) The administering authority must within 8 business days after making its decision —<br />
(a) if the decision is to grant the application—give the applicant the permit; and<br />
(b) if the decision is to grant the application but to impose conditions on the permit—give<br />
the applicant an information notice about the decision to impose the conditions; or<br />
(c) if the decision is to refuse the application—give the applicant an information notice<br />
about the decision.<br />
(6) If the administering authority fails to make a decision about an application for a disposal<br />
permit within the time it is required to make a decision on the application, the failure is taken<br />
to be a decision by the authority to refuse the application at the end <strong>of</strong> the time.<br />
(7) A disposal permit takes effect from the day <strong>of</strong> its issue, or a later day stated in it, and<br />
continues in force for the term stated in it.<br />
(8) This section does not apply if the person is removing and disposing <strong>of</strong> the soil under a<br />
remediation notice.<br />

6.4 STEP 4 <strong>Soil</strong> Movement Tracking and Final Reporting<br />
<strong>Soil</strong> movement as part <strong>of</strong> disposal, is to be undertaken using the following <strong>Soil</strong> Movement<br />
Tracking Protocol. The minimum protocol to be followed is outlined below. DEHP <strong>Disposal</strong><br />
Permits may include additional conditions that will require incorporation on a site specific<br />
basis.<br />
1. Approval for disposal between lease areas or <strong>of</strong>f PBPL land, has been received from<br />
either PBPL and/or DEHP as relevant;<br />
2. The reason for the soil disposal is documented;<br />
3. The location <strong>of</strong> the soils for excavation and disposal have been marked on a plan;<br />
4. The grave site for disposal soils has been identified and receival personnel have been<br />
made aware <strong>of</strong> the disposal timeframe.<br />
5. Trucks used in transport <strong>of</strong> disposal soils are licenced for the transport, as required.<br />
6. Truck volumes, registration and transport times are logged during the transport.<br />
7. The final disposal site is shown on a plan including depth <strong>of</strong> placement and any<br />
covering or surface layers placed.<br />
8. Completion <strong>of</strong> reporting and submission to PBPL in accordance with the reporting<br />
requirements <strong>of</strong> this <strong>Plan</strong>.<br />
9. A standard <strong>Disposal</strong> <strong>of</strong> <strong>Soil</strong> Record (Form B) is attached in Annex A and may be<br />
used as the minimum level <strong>of</strong> recording required.<br />

7 Definitions and Explanatory Notes<br />
Definitions for terms used in the <strong>Soil</strong> <strong>Disposal</strong> <strong>Plan</strong> are provided below.<br />
Contaminated <strong>Soil</strong> for the purpose <strong>of</strong> this <strong>Plan</strong>, means soil where a substance is present at<br />
a concentration greater than the Relevant <strong>Guide</strong>lines appropriate to the site.<br />
Contaminated Land Register (CLR) is a DEHP register <strong>of</strong> ‘risk’ sites that contain proven<br />
contaminated land which is causing or may cause serious environmental harm. Land is<br />
recorded <strong>of</strong> the CLR when scientific investigation shows it is contaminated and action needs<br />
to be taken to remediate or manage the land.<br />
<strong>Disposal</strong> <strong>Soil</strong> means soil that is surplus to the development and requires disposal to<br />
another location from where it was excavated.<br />
Environmental Management Register (EMR) is a DEHP land-use planning and<br />
management register. Land that has been or is being used for a notifiable activity, and about<br />
which DEHP is notified, is recorded <strong>of</strong> the EMR.<br />
Environmentally relevant activity (ERA) means activities with the potential to release<br />
contaminants to the environment. ERAs are defined in Schedule 2 <strong>of</strong> the Environmental<br />
Protection Regulation 2008. All ERAs are required to have development approval or a code<br />
<strong>of</strong> environmental compliance, and registration certificate, before the activity can commence,<br />
and incur ongoing fees, as outlined in the regulation.<br />
Exempt waste means waste that is not levyable on disposal as <strong>of</strong> 1 December 2011.<br />
Lease area refers to the land parcel described in a leaseholders Contract <strong>of</strong> Lease.<br />
Notifiable Activity ‘Activities that have been identified as likely to cause land<br />
contamination are listed in Schedule 3 <strong>of</strong> the Environmental Protection Act 1994’.<br />
