What to do if you are accused of driving<br />

under the influence of alcohol<br />

1. Pull the car over<br />

2. Show the police officer your<br />

driver’s license, proof of insurance<br />

and auto registration.<br />

3. Listen carefully to the officer’s<br />

instructions,<br />

and do not object to their<br />

requests or resist cooperation.<br />

4. Remember, you have the right<br />

to refuse answering<br />

any of the<br />

following questions until consulting with a lawyer: where were you? Did<br />

you consume alcohol? How much alcohol did you consume? Instead, you<br />

can choose to answer in the following way: “I don’t want to answer any<br />

questions, I just want to speak to my attorney”<br />

5. You also have the right to deny the request to take part in any<br />

kind of testing whether on site or at the police station, that could prove the<br />

consumption of alcohol:<br />

• This includes being asked to touch your nose, stand on one leg, make eye<br />

contact, walk, or turn around<br />

• You also have the right to deny a breathalyzer test, blood test, or any kind of<br />

bodily fluid test, including testing of body tissue<br />

• Searching you, your car, or any of your belongings<br />

Instead, you can explain to the officer in the following way:<br />

“I refuse to take any tests until I first speak to my lawyer”.<br />

6. Should you decide to not answer any questions, or refuse testing,<br />

be prepared to possibly face psychological pressure by the officer through<br />

yelling, verbal or physical threats, or even through exaggerated friendliness.<br />

Never leave the scene of<br />

an accident you are involved<br />

in, even if the collision<br />

seems minor or harmless.<br />

2. Offer assistance<br />

If anyone has sustained<br />

injuries, immediately call<br />

for a doctor or ambulance.<br />

3. Seek medical<br />

attention Should you have any doubts regarding your<br />

health or anyone else involved in the accident with you,<br />

immediately call for an ambulance to transport you to the<br />

nearest medical facility.<br />

4. Notify the police<br />

Filing a police report can be helpful should an investigation<br />

be carried out and the case goes to court.<br />

5. Gather and provide information<br />

State law requires drivers to release their first and last<br />

name, address, telephone number, and vehicle registration<br />

number, as well as the information of the vehicle<br />

owner. Also, ask for proof of the other drivers insurance,<br />

and collect necessary information from any witnesses.<br />

6. Call your insurance<br />

Contact your insurance company as soon as possible to<br />

provide them with all crucial information.<br />
