Layman victory tarnished by dirty campaign!<br />

Layman’s victory Tuesday<br />

over local businessman<br />

Johnie Rosenfeld left a very<br />

bad taste in the mouth of<br />

many local Republicans,<br />

who may now take a closer<br />

look at the unaffiliated candidate,<br />

Dale Nelson, of<br />

Homestead in Edwards.<br />

Rosenfeld, who defeated<br />

Layman by an approximate<br />

2 to 1 margin at the county<br />

assembly in May, had the<br />

tables turned on him by a 2<br />

to 1 margin June 26th, due<br />

primarily to the viscious<br />

attack by Layman supporters<br />

wrongly stating that<br />

Rosenfeld was “out of business,”<br />

which he isn’t, and<br />

other false allegations.<br />

While one of their allegations<br />

contained a glimmer<br />

of truth, there was a second<br />

side to that story as well.<br />

Yet, Layman’s supporters<br />

played fast and loose<br />

with the truth, in a campaign<br />

designed to put Rosenfeld<br />

out of business, as opposed<br />

to debating the issues about<br />

what each candidate’s plans<br />

were, if elected, to the Eagle<br />

County Commission.<br />

Layman, in fact, failed to<br />

show up at a debate at the<br />

Avon Library, failed to show<br />

up at the Republican<br />

Women’s luncheon, and<br />

failed to show up on election<br />

night at a celebration gathering<br />

in Edwards. Rosenfeld<br />

attended all of those events.<br />

After his victory,<br />

Layman told the <strong>Vail</strong> Daily,<br />

he would need “to work to<br />

mend some of the hard feelings<br />

that may have surfaced<br />

President. <strong>Business</strong> <strong>Briefs</strong><br />

distributes 10,000 copies per<br />

issue, to almost 900 locations<br />

in Eagle County, and online<br />

world-wide, plus an email<br />

blast world-wide.<br />

The Eagle County Times,<br />

an online-only publication,<br />

has zero hard-copy locations,<br />

and is written by Peter<br />

Buckley, a former conserative<br />

who is now pandering<br />

to the left, due to his loss of<br />

friends in the Republican<br />

Party.<br />

Clayton Moore, an actor,<br />

was “The Lone Ranger,” and<br />

is a Buckley pseudonym.<br />

Cacioppo claims to have<br />

no friends.<br />

Buckley is losing friends<br />

at a very fast rate, and<br />

replacing them with the<br />

likes of “Dirty Tricks Louise<br />

Funk,” who runs the nasty<br />

school district campaigns,<br />

and is a boss of so-called<br />

as the result of the primary<br />

campaign. There are some<br />

fences to mend, and I want<br />

to sit down with some of the<br />

people in my party to discuss<br />

these issues in depth.”<br />

From what was heard<br />

election night from many of<br />

the party regulars attending,<br />

Layman may be wasting his<br />

time.<br />

Many of this group will<br />

probably be looking to support<br />

Nelson, the unaffiliated<br />

candidate, who appears to<br />

be about as liberal as<br />

Layman, but without the<br />

stain of deceit and deception<br />

hanging around<br />

Layman’s neck.<br />

All in all, it should be an<br />

interesting campaign, with<br />

the most liberal candidate,<br />

another former government<br />

employee, Jill Hunsaker<br />

Ryan, the Democrat, running<br />

against the moderate<br />

Nelson, who will probably<br />

split the vote with the liberal<br />

tax-hike supporter, RINO<br />

(Republican In Name Only)<br />

Layman.<br />

Our guess is that you<br />

can now call her<br />

Commissioner Ryan,<br />

because what goes around,<br />

usually comes around.<br />

Now, will Layman<br />

answer some of the questions<br />

that many have wanted<br />

answered, including why<br />

he really left the Avon Police<br />

Department? Was he<br />

involved in a sexual harassment<br />

lawsuit with a former<br />

Eagle County Sheriff’s<br />

Deputy? Was he involved in<br />

the ludicrous decision to put<br />

one female deputy in a large<br />

open cell with 40 alleged<br />

male criminals, which the<br />

publisher personally witnessed?<br />

With decisions like that,<br />

we can only wonder what<br />

kind of decisions Layman<br />

would make as a county<br />

commissioner.<br />

Layman, who could<br />

have had the support of<br />

most Republicans, had his<br />

supporters run a clean campaign,<br />

will go down in history<br />

as the candidate who<br />

failed to show leadership by<br />

calling off the dogs and<br />

telling them that he would<br />

have no part of such a campaign.<br />

Instead, he sat by while<br />

his minions did the dirty<br />

work, and by refusing to<br />

debate like a real man or<br />

woman would.<br />

Jeff lost a lot of respect<br />

in our eyes. We doubt he<br />

can earn that back, even if<br />

he is now willing to talk!<br />

Hello Live Music lovers,<br />

Summer is upon us - a<br />

personal “Thank God”<br />

from me!<br />

As we, who are getting<br />

Country rock favorite<br />

Walker Williams and his<br />

band will play at 4-Eagle<br />

Ranch on Thursday, July<br />

5th, with lessons at 6pm.<br />

older, say,<br />

“Winter is wonderful,<br />

summer is<br />

why we live<br />

here!”<br />

I have structured<br />

this column<br />

in a way that<br />

takes us from the<br />

upper reaches of<br />

our fair county, to<br />

the center of the<br />

county, to the far<br />

western reaches.<br />

For this issue, I<br />

am concentrating on some<br />

interesting events that<br />

have caught my attention<br />

in the county.<br />

This is by no means a<br />

complete list, but just one<br />

that I think is cool and<br />

hope that you will too.<br />

• The Minturn Concert<br />

Series. This great concert<br />

series first started in 2007<br />

or 2008; however, I could<br />

be mistaken about that.<br />

What is exciting about this<br />

event is that it occurs at<br />

Little Beach Park in<br />

Minturn (go south on<br />

Highway 6 & 24 until you<br />

come to a bridge across the<br />

Eagle river, about half-way<br />

through town. Little Beach<br />

Park is on the banks of the<br />

Eagle River on the east<br />

side. In summer, concerts<br />

are held every Thursday.<br />

Last night’s opener<br />

kicked off with New<br />

Orleans Billy Franklyn and<br />

his NOLA project, a collection<br />

of Mr. Franklyn’s<br />

favorite Funk and other<br />

great musicians. July<br />

promises to be just as exciting<br />

with performances by<br />

Minturn’s own Schwing<br />

Daddy, and Boneless. One<br />

of my favorite aspects of<br />

performing here, for 30<br />

years now, is the absolute<br />

friendliness and willingness<br />

of musicians of all different<br />

bands to get together<br />

and “Jam!” Boneless is<br />

one of these bands, made<br />

from members of Skin the<br />

Rabbit, and Laughing<br />

Bones. This band explores<br />

the less structural aspects<br />

of material that both bands<br />

feature in their regular<br />

sets. I wonder,<br />

does this remind<br />

anybody of a Bay<br />

Area band from<br />

the mid-60’s? No<br />

more hints than<br />

that! Another<br />

very surprising<br />

and happy addition<br />

to the<br />

Minturn Concert<br />

Series lineup this<br />

summer will be<br />

“BLT.” This<br />

extremely diverse<br />

trio made up of Tony<br />

Gulizia and Brian Loftis, (I<br />

believe it is just the two of<br />

them) will be appearing<br />

sometime in July at the<br />

Minturn Concert series.<br />

The big surprise, at least<br />

for me will be an appearance<br />

by Denver’s own<br />

“Queen of Soul,” Hazel<br />

Miller, at the Minturn<br />

Concert series, sometimes<br />

in August. My hat is off to<br />

the organizers of this fine<br />

concert series. We wish<br />

you continued success<br />

over the ensuing years of<br />

your series!<br />

• The new Shakedown<br />

Bar in <strong>Vail</strong> village is a<br />

great addition to our live<br />

music scene. It is nice to<br />

walk into this establishment<br />

and have a very neutral<br />

smell, and not stick to<br />

the floor! I am sorry if that<br />

seems a little petty, but<br />

give these guys 20 years<br />

and anything can happen!<br />

and George Hilliard have<br />

managed to put in a sound<br />

system fit for any live band<br />

- well maybe not Led<br />

Zeppelin, the Stones or the<br />

Grateful Dead, or maybe<br />

not ACDC, but pretty<br />

much anything else! Scott<br />

Rednor’s kick butt band<br />

can be heard on featured<br />

evenings every week, and<br />

George Hilliard’s “The<br />

Dead Rednecks” can also<br />

be heard on select<br />

evening’s every week.<br />

Hey George, is that an ode<br />

to departed members of<br />

the Grateful Dead and the<br />

Allman Brothers - or<br />

maybe Lynyrd Skynyrd?<br />

In any event, I like it!<br />

When these two guys are<br />

not performing with their<br />

own bands at Shakedown,<br />

look for eclectic and interesting<br />

national acts from<br />

all over the map. This is<br />

definitely a very good<br />

addition to the bridge<br />

street scene!<br />

• Ollie Holdstock has<br />

gone and done it folks!<br />

The Route 6 Café &<br />

Lounge is now officially<br />

across the highway and<br />

west from where it was.<br />

Ollie is featuring great<br />

food, great ambiance, reasonable<br />

prices, and great<br />

music on Sunday afternoons<br />

featuring the Brett<br />

Riggin band. I had not<br />

seen Brett perform much<br />

in our county in the last 15<br />

or 20 years, however, I am<br />

still quite impressed by<br />

in Eagle County. In fact,<br />

Ollie has been involved<br />

in the food business<br />

since 1983, when he<br />

moved from Southern<br />

California to <strong>Vail</strong>.<br />

Originally from<br />

Chester, England, Ollie<br />

developed a deep love<br />

affair for the outdoors<br />

and moved here to ski.<br />

that brought him to<br />

<strong>Colorado</strong>.<br />

He first became a<br />

bartender at the old<br />

Cyrano’s, in the heart of<br />

<strong>Vail</strong> Village. There he<br />

met his lifetime friend,<br />

Peter Millett, who lately<br />

had been the head<br />

chef at Sapphire. In this<br />

time of sudden transitions,<br />

Sapphire closed<br />

and Ollie needed a new<br />

address to relocate the<br />

Route 6 Café that he<br />

had been successfully<br />

running for several<br />

year. His lease was up<br />

and the old Paddy’s on<br />

Highway 6 had been<br />

sitting empty for a<br />

while.<br />

In an ample leap of<br />

faith, Ollie and Peter<br />

put their head together<br />

and decided, “Let’s do<br />

it again!”<br />

As in most cases of<br />

Grace, once the decision<br />

was made, all sorts<br />

of friends and circumstances<br />

came together<br />

at one confluence, and<br />

the new Route 6 Café<br />

and Lounge is now<br />

open and running, not<br />

only for breakfast and<br />

lunch, but also for dinner.<br />

A lovely patio was<br />

built with flowers and<br />

shade for the weary<br />

travelers who need<br />

nourishment and<br />

friendliness. A stage<br />

was built, and a comfortable<br />

lounging area<br />

with leather sofas and<br />

artwork was created by<br />

Eagle - Grand Ave.<br />

for the sampling of the<br />

dinner menu, the patio<br />

was in radiant sunlight.<br />

Ollie was in the back,<br />

unloading the truck of a<br />

vast amount of fresh<br />

produce that he picks<br />

himself, to make sure<br />

only the freshest gets in<br />

our mouths.<br />

were ready for the culinary<br />

feast.<br />

The entrée menu is<br />

The prices are so<br />

reasonable that the<br />

excitement of not having<br />

AARP, you need another<br />

insurance agent!” Clark<br />

told the Rotary Club members<br />

of Edwards and <strong>Vail</strong>.<br />

Clark said that<br />

Medicare is “way complicated.<br />

the best plan is<br />

the original Medicare plus<br />

Part D plus Supplement F.<br />

“Unless you are well<br />

and healthy, you can’t get a<br />

Medicare supplement,” he<br />

continued.<br />

“It changes all the<br />

time,” said Clark.<br />

Clark didn’t have much<br />

good to say about HMOs<br />

either.<br />

“HMOs mostly pay in<br />

your home area, not where<br />

you want to go. A doctor<br />

can decide to not take<br />

you.”<br />

you your nest egg!<br />

designed to help you make<br />

the right decision about<br />

what the best Medicare<br />

Clark wrote that “the<br />

most important thing is to<br />

realize that what is best for<br />

an insurance company is<br />

He also wrote that what<br />

is best for the government<br />

is not what is best for you.<br />

Clarks said to avoid<br />

calling them and certainly<br />

avoid taking their suggestions.<br />

He says there are<br />

many advisors who specialize<br />

in Medicare and not<br />

just in Medicare<br />

Advantage. He says his<br />

WHAT IS A REVOCABLE<br />

OR “LIVING” TRUST?<br />

A Revocable Trust can be<br />

used as your main estate planning<br />

document instead of a Last<br />

Will. It is important to note that<br />

if you have a Will, the probate<br />

process must be used to administer<br />

the Will. A Will does not<br />

avoid probate.<br />

If you have a revocable trust<br />

you can avoid the probate<br />

process by titling your assets in<br />

the name of your trust. If assets<br />

are owned by a trust, no court is<br />

involved in the transfer of assets<br />

upon death. Therefore, no estate<br />

has to be opened with the court,<br />

no newspaper notices or letters<br />

where real estate is owned (this<br />

includes timeshares) and in the<br />

state where the decedent lived on<br />

Route 6 has more<br />

immagination and flavors<br />

than any other restaurant in<br />

Homeowners allege fraud<br />

in home foreclosure!<br />

Dear Publisher,<br />

I am attaching the most<br />

recent phenomenal development<br />

by Spire Law Firm in<br />

New York. I think it is<br />

important to remember that<br />

we are not the only homeowners<br />

who have (allegedly)<br />

faced fraud and deception<br />

and are going through<br />

foreclosure and eviction at<br />

the hands of these<br />

unscrupulous lenders and<br />

foreclosure mills. This case<br />

is a landmark case. When<br />

you open it, you will see<br />

why.<br />

For my brief summary<br />

below:<br />

Douglas and Donna Fasi are<br />

currently in a legal battle to<br />

save their farm from a<br />

wrongful foreclosure conducted<br />

by the Eagle County<br />

Trustee, the Eagle Combined<br />

Courts, Castle & Stawiarski<br />

LLC, and HSBC Bank. All<br />

entities have acted (allegedly)<br />

in concert to deprive the<br />

Fasis of their farm of 30<br />

years, for no other reason<br />

than the Fasis entering into<br />

negotiations to get a loan<br />

modification.<br />

In 2006, I refinanced my<br />

farm from an adjustable rate<br />

mortgage to a fixed rate<br />

mortgage. In 2009, I was<br />

contacted by a representative<br />

of Wells Fargo Bank and<br />

informed that my<br />

“adjustable rate mortgage”<br />

was to increase to more than<br />

$2,700.00 per month.<br />

Our current mortgage<br />

payment on the fixed rate<br />

mortgage that I signed for<br />

was $2190.00 per month. We<br />

knew what they had signed<br />

for in 2006, and were clear in<br />

2006 with the mortgage broker<br />

that they would not refinance<br />

into another ARM<br />

Note, and Wells Fargo at the<br />

time would not loan on their<br />

entire property because the<br />

property did “not conform”<br />

to the fixed rate product<br />

they were offering.<br />

So, in 2006, we only refinanced<br />

a portion of the farm<br />

comprising the house and<br />

seven acres. I tried unsuccessfully<br />

throughout 2009 to<br />

get the mortgage discrepancy<br />

corrected, but no one at<br />

Wells Fargo was listening.<br />

Throughout all this, we<br />

never missed a mortgage<br />

payment, even when it<br />

increased to $2,700.00 per<br />

month for a period of six<br />

months in 2009. In<br />

September of 2009, not<br />

knowing what else to do, we<br />

requested a loan modification<br />

from Wells Fargo and<br />

were told in order to qualify,<br />

we would have to miss three<br />

payments. We did as<br />

instructed, never understanding<br />

that missing the<br />

three payments would start<br />

a roller coaster towards foreclosure<br />

that could not be<br />

corrected. In 2010, when we<br />

were still trying, after<br />

months of delay on the part<br />

of Wells Fargo, to get a loan<br />

modification, HSBC Bank<br />

filed to foreclose on the<br />

Donna and Doug Fasi.<br />

farm. Prior to HSBC Bank<br />

filing the Notice of Election<br />

and Demand, someone went<br />

to the County Clerk and<br />

Recorder and re-filed the<br />

original Deed of Trust we<br />

signed, and changed the<br />

legal description for the<br />

mortgage to include the<br />

entire farm, instead of the<br />

house and seven acres listed<br />

on the HUD statement at the<br />

closing in 2006.<br />

We were now aware that<br />

a (an alleged) fraud had<br />

been committed, again discovered<br />

in 2010, that the<br />

Note used to foreclose on<br />

our property in no way<br />

resembled the Note I signed<br />

in 2006. The (alleged)fraud<br />

Note contained terms of up<br />

to 13.25% interest rates, was<br />

an adjustable ARM, and did<br />

not have my initials on the<br />

first two pages. My original<br />

Note was a fixed rate Note<br />

for 30 years, with a 7.125%<br />

rate and had my initials on<br />

we did to protect our home,<br />

the farm was sold at a<br />

Trustee sale on January 19,<br />

2011. Through a Rule 120<br />

Hearing, a District Court<br />

case, and now a forced<br />

Chapter 13 Bankruptcy we<br />

have continued to fight for<br />

our home. We will soon be<br />

filing an adversary proceeding<br />

in Federal Court and<br />

refuse to leave our property.<br />

I have possession, I am in<br />

the right, and I refuse to<br />

thrown out on the street, just<br />

so a bank can (allegedly)<br />

commit fraud and theft.<br />

I want to know why my<br />

an attorney affidavit that<br />

says the foreclosure paperwork<br />

is authentic, to suffice<br />

in a court of law, when it is<br />

clear from thousands of<br />

other homeowners in the<br />

same situation that the<br />

paperwork is not correct,<br />

but is in fact (allegedly)<br />

fraudulent.<br />

Nobody I know wants to<br />

not make their mortgage<br />

payments, but this is not<br />

about default, it is entirely<br />

about (alleged) fraud on the<br />

part of lenders and foreclosing<br />

attorneys, so they can<br />

foreclose quickly without<br />

producing proper paperwork.<br />

We are currently in possession<br />

of our home, while<br />

awaiting the filing of yet<br />

another lawsuit to vacate<br />

the sale, and may still be<br />
