Layman victory tarnished by dirty campaign!

Layman’s victory Tuesday 

over local businessman 

Johnie Rosenfeld left a very 

bad taste in the mouth of 

many local Republicans, 

who may now take a closer 

look at the unaffiliated candidate, 

Dale Nelson, of 

Homestead in Edwards. 

Rosenfeld, who defeated 

Layman by an approximate 

2 to 1 margin at the county 

assembly in May, had the 

tables turned on him by a 2 

to 1 margin June 26th, due 

primarily to the viscious 

attack by Layman supporters 

wrongly stating that 

Rosenfeld was “out of business,” 

which he isn’t, and 

other false allegations. 

While one of their allegations 

contained a glimmer 

of truth, there was a second 

side to that story as well. 

Yet, Layman’s supporters 

played fast and loose 

with the truth, in a campaign 

designed to put Rosenfeld 

out of business, as opposed 

to debating the issues about 

what each candidate’s plans 

were, if elected, to the Eagle 

County Commission. 

Layman, in fact, failed to 

show up at a debate at the 

Avon Library, failed to show 

up at the Republican 

Women’s luncheon, and 

failed to show up on election 

night at a celebration gathering 

in Edwards. Rosenfeld 

attended all of those events. 

After his victory, 

Layman told the Vail Daily, 

he would need “to work to 

mend some of the hard feelings 

that may have surfaced 

President. Business Briefs

issue, to almost 900 locations 

in Eagle County, and online 

world-wide, plus an email 

blast world-wide. 

The Eagle County Times, 

an online-only publication, 

has zero hard-copy locations, 

and is written by Peter 

Buckley, a former conserative 

who is now pandering 

to the left, due to his loss of 

friends in the Republican 

Party. 

Clayton Moore, an actor, 

was “The Lone Ranger,” and 

is a Buckley pseudonym. 

Cacioppo claims to have 

no friends. 

Buckley is losing friends 

at a very fast rate, and 

replacing them with the 

likes of “Dirty Tricks Louise 

Funk,” who runs the nasty 

school district campaigns, 

and is a boss of so-called 

as the result of the primary 

campaign. There are some 

fences to mend, and I want 

to sit down with some of the 

people in my party to discuss 

these issues in depth.” 

From what was heard 

election night from many of 

the party regulars attending, 

Layman may be wasting his 

time. 

Many of this group will 

probably be looking to support 

Nelson, the unaffiliated 

candidate, who appears to 

be about as liberal as 

Layman, but without the 

stain of deceit and deception 

hanging around 

Layman’s neck. 

All in all, it should be an 

interesting campaign, with 

the most liberal candidate, 

another former government 

employee, Jill Hunsaker 

Ryan, the Democrat, running 

against the moderate 

Nelson, who will probably 

split the vote with the liberal 

tax-hike supporter, RINO 

(Republican In Name Only) 

Layman. 

Our guess is that you 

can now call her 

Commissioner Ryan, 

because what goes around, 

usually comes around. 

Now, will Layman 

answer some of the questions 

that many have wanted 

answered, including why 

he really left the Avon Police 

Department? Was he 

involved in a sexual harassment 

lawsuit with a former 

Eagle County Sheriff’s 

Deputy? Was he involved in 

the ludicrous decision to put 

one female deputy in a large 

open cell with 40 alleged 

male criminals, which the 

publisher personally witnessed? 

With decisions like that, 

we can only wonder what 

kind of decisions Layman 

would make as a county 

commissioner. 

Layman, who could 

have had the support of 

most Republicans, had his 

supporters run a clean campaign, 

will go down in history 

as the candidate who 

failed to show leadership by 

calling off the dogs and 

telling them that he would 

have no part of such a campaign. 

Instead, he sat by while 

his minions did the dirty 

work, and by refusing to 

debate like a real man or 

woman would. 

Jeff lost a lot of respect 

in our eyes. We doubt he 

can earn that back, even if 

he is now willing to talk!

Summer is upon us - a 

personal “Thank God” 

from me! 

As we, who are getting

Ranch on Thursday, July 

5th, with lessons at 6pm.

“Winter is wonderful, 

summer is 

why we live 

here!” 

I have structured 

this column 

in a way that 

takes us from the 

upper reaches of 

our fair county, to 

the center of the 

county, to the far 

western reaches. 

For this issue, I 

am concentrating on some 

interesting events that 

have caught my attention 

in the county. 

This is by no means a 

complete list, but just one 

that I think is cool and 

hope that you will too. 

• The Minturn Concert 

Series. This great concert 

series first started in 2007 

or 2008; however, I could 

be mistaken about that. 

What is exciting about this 

event is that it occurs at 

Little Beach Park in 

Minturn (go south on 

Highway 6 & 24 until you 

come to a bridge across the 

Eagle river, about half-way 

through town. Little Beach 

Park is on the banks of the 

Eagle River on the east 

side. In summer, concerts 

are held every Thursday.

Last night’s opener 

kicked off with New 

Orleans Billy Franklyn and 

his NOLA project, a collection 

of Mr. Franklyn’s 

favorite Funk and other 

great musicians. July 

promises to be just as exciting 

with performances by 

Minturn’s own Schwing 

Daddy, and Boneless. One 

of my favorite aspects of 

performing here, for 30 

years now, is the absolute 

friendliness and willingness 

of musicians of all different 

bands to get together 

and “Jam!” Boneless is 

one of these bands, made 

from members of Skin the 

Rabbit, and Laughing 

Bones. This band explores 

the less structural aspects 

of material that both bands 

feature in their regular 

sets. I wonder, 

does this remind 

anybody of a Bay 

Area band from 

the mid-60’s? No 

more hints than 

that! Another 

very surprising 

and happy addition 

to the 

Minturn Concert 

Series lineup this 

summer will be 

“BLT.” This 

extremely diverse 

trio made up of Tony 

Gulizia and Brian Loftis, (I 

believe it is just the two of 

them) will be appearing 

sometime in July at the 

Minturn Concert series. 

The big surprise, at least 

for me will be an appearance 

by Denver’s own 

“Queen of Soul,” Hazel 

Miller, at the Minturn 

Concert series, sometimes 

in August. My hat is off to 

the organizers of this fine 

concert series. We wish 

you continued success 

over the ensuing years of 

your series! 

• The new Shakedown 

Bar in Vail village is a 

great addition to our live 

music scene. It is nice to 

walk into this establishment 

and have a very neutral 

smell, and not stick to 

the floor! I am sorry if that 

seems a little petty, but 

give these guys 20 years 

and anything can happen! 

Proprietors Scott Rednor 

and George Hilliard have 

managed to put in a sound 

system fit for any live band 

- well maybe not Led 

Zeppelin, the Stones or the 

Grateful Dead, or maybe 

not ACDC, but pretty 

much anything else! Scott 

Rednor’s kick butt band 

can be heard on featured 

evenings every week, and 

George Hilliard’s “The 

Dead Rednecks” can also 

be heard on select 

evening’s every week. 

Hey George, is that an ode 

to departed members of 

the Grateful Dead and the 

Allman Brothers - or 

maybe Lynyrd Skynyrd? 

In any event, I like it! 

When these two guys are 

not performing with their 

own bands at Shakedown, 

look for eclectic and interesting 

national acts from 

all over the map. This is 

definitely a very good 

addition to the bridge 

street scene! 

• Ollie Holdstock has 

gone and done it folks! 

The Route 6 Café & 

Lounge is now officially 

across the highway and 

west from where it was. 

Ollie is featuring great 

food, great ambiance, reasonable 

prices, and great 

music on Sunday afternoons 

featuring the Brett 

Riggin band. I had not 

seen Brett perform much 

in our county in the last 15 

or 20 years, however, I am 

still quite impressed by

running for several 

year. His lease was up 

and the old Paddy’s on 

Highway 6 had been 

sitting empty for a 

while. 

In an ample leap of 

faith, Ollie and Peter 

put their head together 

and decided, “Let’s do 

it again!” 

As in most cases of 

Grace, once the decision 

was made, all sorts 

of friends and circumstances 

came together 

at one confluence, and 

the new Route 6 Café 

and Lounge is now 

open and running, not 

only for breakfast and 

lunch, but also for dinner. 

A lovely patio was 

built with flowers and 

shade for the weary 

travelers who need 

nourishment and 

friendliness. A stage 

was built, and a comfortable 

lounging area 

with leather sofas and 

artwork was created by 

Eagle - Grand Ave.

VAIL - Joe Clark is a former 

state patrolman who 

became a very knowledgeable 

health insurance 

agent. Medicare is his specialty. 

Many seniors get their 

Medicare advice and work 

with AARP (the American 

Association of Retired 

People), one of the most 

powerful organizations in 

the country. 

Clark doesn’t 

care for AARP! 

“If you are getting your 

car insurance through 

AARP, you need another 

insurance agent!” Clark 

told the Rotary Club members 

of Edwards and Vail. 

Clark said that 

Medicare is “way complicated. 

Call or email me at 

no fee. Or, have your insurance 

agent contact me.” 

Clark doesn’t 

like Obama Care either! 

“It’s a totally unnecessary 

piece of junk!” 

said Clark.

hopital plan, Clark

Clark said that

titled, “Vail Police Chief 

We’ve Moved!

accused of trying to run 

off limo owner,” limo 

associate Leo Lala, who 

works with limo owner 

Jonathan Levine’s company, 

finally was 

allegedly able to identify 

the alleged older Vail 

Police officer who told 

him that “The state 

would be much better 

off if he (Levine) was 

not in business here.” 

Lala said that he had 

been asking for assistance 

at the police 

department as to the 

name of the older cops,

Finally, Lala stated, 

he saw a picture of Vail 

Police Commander 

Steve Wright and identified 

Wright as the officer 

who allegedly told 

him this at the West Vail

WHAT IS A REVOCABLE 

OR “LIVING” TRUST? 

A Revocable Trust can be 

used as your main estate planning 

document instead of a Last 

Will. It is important to note that 

if you have a Will, the probate 

process must be used to administer 

the Will. A Will does not 

avoid probate. 

If you have a revocable trust 

you can avoid the probate 

process by titling your assets in 

the name of your trust. If assets 

are owned by a trust, no court is 

involved in the transfer of assets 

upon death. Therefore, no estate 

has to be opened with the court, 

no newspaper notices or letters

to heirs are required, no records 

become public and no statutory 

waiting periods apply. 

It is still necessary to determine 

what assets exist, to pay 

creditors, to file required tax 

returns and to distribute assets to 

beneficiaries. However, with a 

trust, the person you name as 

trustee can accomplish these 

things without having to go 

through court proceedings and 

statutory requirements to do so. 

This simplifies and expedites the 

process for your heirs. 

A revocable trust does not 

affect your ability to manage and 

control your own property while 

you are alive. You stay in charge 

of everything. 

A revocable trust is acceptable 

in all states, so you can 

avoid probate on out-of-state 

property as well as assets located 

in the state of residence. (A 

will requires probate in each state 

where real estate is owned (this 

includes timeshares) and in the 

state where the decedent lived on 

the date of death.) 

A revocable trust also provides 

for management of assets 

by a family member or a financial 

institution (whichever you select) 

if you are unable to manage 

assets due to health problems. 

This avoids the necessity 

and expense of your family 

members having to go to court, 

and ask to have you found

A revocable trust works well 

for single or married people. 

Joint trusts may be used in situations 

where joint tenancy would 

typically be used, but where probate 

avoidance on both estates is 

desired. In cases where married 

couples choose to keep their 

assets separate, such as when 

spouses have children from previous 

marriages or to implement 

tax planning, a separate living 

trust may be executed by each 

spouse, with the plan of distribution 

of each spouse set forth in 

that spouse’s trust. 

Because you would still be in 

charge of managing your assets, a 

revocable trust does not offer 

asset protection against from 

creditors. 

As with all estate planning, 

each person’s individual situation 

and wishes must be analyzed 

before a decision is made 

as to the most effective estate 

planning techniques.

Homeowners allege fraud 

in home foreclosure! 

Dear Publisher, 

I am attaching the most 

recent phenomenal development 

by Spire Law Firm in 

New York. I think it is 

important to remember that 

we are not the only homeowners 

who have (allegedly) 

faced fraud and deception 

and are going through 

foreclosure and eviction at 

the hands of these 

unscrupulous lenders and 

foreclosure mills. This case 

is a landmark case. When 

you open it, you will see 

why. 

For my brief summary 

below: 

Douglas and Donna Fasi are 

currently in a legal battle to 

save their farm from a 

wrongful foreclosure conducted 

by the Eagle County 

Trustee, the Eagle Combined 

Courts, Castle & Stawiarski 

LLC, and HSBC Bank. All 

entities have acted (allegedly) 

in concert to deprive the 

Fasis of their farm of 30 

years, for no other reason 

than the Fasis entering into 

negotiations to get a loan 

modification. 

In 2006, I refinanced my 

farm from an adjustable rate 

mortgage to a fixed rate 

mortgage. In 2009, I was 

contacted by a representative 

of Wells Fargo Bank and 

informed that my 

“adjustable rate mortgage” 

was to increase to more than 

$2,700.00 per month. 

Our current mortgage 

payment on the fixed rate 

mortgage that I signed for 

was $2190.00 per month. We 

knew what they had signed 

for in 2006, and were clear in 

2006 with the mortgage broker 

that they would not refinance 

into another ARM 

Note, and Wells Fargo at the 

time would not loan on their 

entire property because the 

property did “not conform” 

to the fixed rate product 

they were offering. 

So, in 2006, we only refinanced 

a portion of the farm 

comprising the house and 

seven acres. I tried unsuccessfully 

throughout 2009 to 

get the mortgage discrepancy 

corrected, but no one at 

Wells Fargo was listening. 

Throughout all this, we 

never missed a mortgage 

payment, even when it 

increased to $2,700.00 per 

month for a period of six 

months in 2009. In 

September of 2009, not 

knowing what else to do, we 

requested a loan modification 

from Wells Fargo and 

were told in order to qualify, 

we would have to miss three 

payments. We did as 

instructed, never understanding 

that missing the 

three payments would start 

a roller coaster towards foreclosure 

that could not be 

corrected. In 2010, when we 

were still trying, after 

months of delay on the part 

of Wells Fargo, to get a loan 

modification, HSBC Bank 

filed to foreclose on the

farm. Prior to HSBC Bank 

filing the Notice of Election 

and Demand, someone went 

to the County Clerk and 

Recorder and re-filed the 

original Deed of Trust we 

signed, and changed the 

legal description for the 

mortgage to include the 

entire farm, instead of the 

house and seven acres listed 

on the HUD statement at the 

closing in 2006. 

We were now aware that 

a (an alleged) fraud had 

been committed, again discovered 

in 2010, that the 

Note used to foreclose on 

our property in no way 

resembled the Note I signed 

in 2006. The (alleged)fraud 

Note contained terms of up 

to 13.25% interest rates, was 

an adjustable ARM, and did 

not have my initials on the 

first two pages. My original 

Note was a fixed rate Note 

for 30 years, with a 7.125% 

rate and had my initials on

the first two pages and my 

signature on the signature 

page. 

In spite of everything 

we did to protect our home, 

the farm was sold at a 

Trustee sale on January 19, 

2011. Through a Rule 120 

Hearing, a District Court 

case, and now a forced 

Chapter 13 Bankruptcy we 

have continued to fight for 

our home. We will soon be 

filing an adversary proceeding 

in Federal Court and 

refuse to leave our property. 

I have possession, I am in 

the right, and I refuse to 

thrown out on the street, just 

so a bank can (allegedly) 

commit fraud and theft. 

I want to know why my 

loan was fraudulently 

changed. I want to know 

where my payments have 

gone all this time, and I 

want to know why 

Colorado judges are allowing 

an attorney affidavit that 

says the foreclosure paperwork 

is authentic, to suffice 

in a court of law, when it is 

clear from thousands of 

other homeowners in the 

same situation that the 

paperwork is not correct, 

but is in fact (allegedly) 

fraudulent. 

Nobody I know wants to 

not make their mortgage 

payments, but this is not 

about default, it is entirely 

about (alleged) fraud on the 

part of lenders and foreclosing 

attorneys, so they can 

foreclose quickly without 

producing proper paperwork. 

We are currently in possession 

of our home, while 

awaiting the filing of yet 

another lawsuit to vacate 

the sale, and may still be 

evicted at any time. Spire
