Layman victory tarnished by dirty campaign!
Opinion
Opinion
Eagle County - Once and for
all, “No, the Eagle County
Times is not published by the
Business Briefs publisher!”
Business Briefs is published
by Business Briefs,
Inc.. Michael Cacioppo is the
Eagle County - 30-year government
employee Jeff
Layman’s victory Tuesday
over local businessman
Johnie Rosenfeld left a very
bad taste in the mouth of
many local Republicans,
who may now take a closer
look at the unaffiliated candidate,
Dale Nelson, of
Homestead in Edwards.
Rosenfeld, who defeated
Layman by an approximate
2 to 1 margin at the county
assembly in May, had the
tables turned on him by a 2
to 1 margin June 26th, due
primarily to the viscious
attack by Layman supporters
wrongly stating that
Rosenfeld was “out of business,”
which he isn’t, and
other false allegations.
While one of their allegations
contained a glimmer
of truth, there was a second
side to that story as well.
Yet, Layman’s supporters
played fast and loose
with the truth, in a campaign
designed to put Rosenfeld
out of business, as opposed
to debating the issues about
what each candidate’s plans
were, if elected, to the Eagle
County Commission.
Layman, in fact, failed to
show up at a debate at the
Avon Library, failed to show
up at the Republican
Women’s luncheon, and
failed to show up on election
night at a celebration gathering
in Edwards. Rosenfeld
attended all of those events.
After his victory,
Layman told the Vail Daily,
he would need “to work to
mend some of the hard feelings
that may have surfaced
President. Business Briefs
distributes 10,000 copies per
issue, to almost 900 locations
in Eagle County, and online
world-wide, plus an email
blast world-wide.
The Eagle County Times,
an online-only publication,
has zero hard-copy locations,
and is written by Peter
Buckley, a former conserative
who is now pandering
to the left, due to his loss of
friends in the Republican
Party.
Clayton Moore, an actor,
was “The Lone Ranger,” and
is a Buckley pseudonym.
Cacioppo claims to have
no friends.
Buckley is losing friends
at a very fast rate, and
replacing them with the
likes of “Dirty Tricks Louise
Funk,” who runs the nasty
school district campaigns,
and is a boss of so-called
as the result of the primary
campaign. There are some
fences to mend, and I want
to sit down with some of the
people in my party to discuss
these issues in depth.”
From what was heard
election night from many of
the party regulars attending,
Layman may be wasting his
time.
Many of this group will
probably be looking to support
Nelson, the unaffiliated
candidate, who appears to
be about as liberal as
Layman, but without the
stain of deceit and deception
hanging around
Layman’s neck.
All in all, it should be an
interesting campaign, with
the most liberal candidate,
another former government
employee, Jill Hunsaker
Ryan, the Democrat, running
against the moderate
Nelson, who will probably
split the vote with the liberal
tax-hike supporter, RINO
(Republican In Name Only)
Layman.
Our guess is that you
can now call her
Commissioner Ryan,
because what goes around,
usually comes around.
Now, will Layman
answer some of the questions
that many have wanted
answered, including why
he really left the Avon Police
Department? Was he
involved in a sexual harassment
lawsuit with a former
Eagle County Sheriff’s
Deputy? Was he involved in
the ludicrous decision to put
one female deputy in a large
open cell with 40 alleged
male criminals, which the
publisher personally witnessed?
With decisions like that,
we can only wonder what
kind of decisions Layman
would make as a county
commissioner.
Layman, who could
have had the support of
most Republicans, had his
supporters run a clean campaign,
will go down in history
as the candidate who
failed to show leadership by
calling off the dogs and
telling them that he would
have no part of such a campaign.
Instead, he sat by while
his minions did the dirty
work, and by refusing to
debate like a real man or
woman would.
Jeff lost a lot of respect
in our eyes. We doubt he
can earn that back, even if
he is now willing to talk!
Staff Report
Avon - Levi Clock of
Clockwork Financial is coming
back to Eagle County for
two seminars on Monday,
July 23rd, 2012, one 90
minute breakfast seminar
and one 90-minute dinner
seminar.
Clock and his wife,
Chantel, will stay in Avon
for several days after the
Monday events, speaking
privately by appointment to
seminar attendees and others
who might be unable to
attend on Monday.
Clock, who has been
helping Eagle County businesses
for about three years
now, offers one of the most
dynamic alternatives to the
so-called mainstream of
Financial Planning that business
owners investors have
been used to.
The Business Briefs publisher
has attended many of
Clockwork’s seminars over
the past several years and
declares that he always
learns something new from
Clock.
Not your typical
financial seminar!
“This isn’t the typical
seminar that most people
are used to,” says the publisher.
“I’ve seen a number
of bright people who have
attended in the past, and
personally thanked me for
recommending that they
check out Clock’s dynamic
alternative thinking.”
The seminars often show
how much the average business
owner spends on
financing costs or lost
opportunity cost over their
lifetime.
The seminars teach why
every business owner
should be in two businesses,
their primary passion,
and the banking business.
Yes, the banking business.
No, you won’t be starting
a traditional bank and
attempting to attract other
customers.
What Clockwork teaches
is how business owners
and astute investors need to
think like a bank, act like a
bank, or pay them much of
your money!
No questions
asked banking?
Wouldn’t it be nice if
there was a bank out there
that would underwrite your
loan on the spot with no
questions asked?
Wouldn’t it be nice if
that bank then returned
nearly all the interest on
your loan directly back to
you?
Wouldn’t it be nice, too,
if you could put all that recaptured
interest into that
same bank, worry-free of
risky banking speculation,
and, you could watch your
money actually grow AND
work for you at the same
time?
And, as an added
bonus, wouldn’t it be nice if
your bank was generous
enough to pay your outstanding
loans and even
pay your family or estate a
windfall when and if you
were to pass away?
There is such
a banking system!
The largest and smallest
traditional banks all across
the globe use this concept
for their own banking needs.
They use the idea to lend
you money, but they don’t
share the idea with you.
However, in the last 20
years, the idea has finally
been gaining mainstream
popularity, as more and
more people and small business
owners understand its
economic power.
The idea is: “The Infinite
Banking Concept,” or IBC.
It is not a myth or a gimmick.
It is a sound financial
principle that traditional
banks and the wealthy have
used to their own advantage
in order to make their
money off of your money!
To learn more about the
IBC and how to better
finance your life needs, contact
Levi Clock for a free 45
minute consultation that,
Republican commissioner
candidate, Jeff Layman.
Buckley has crossed the
line with many people.
If he keeps it up,
reporting more on Buckley
in the future!
lives, you owe it to yourself
Peter Fontanese reviews music in Eagle County
Minturn Concert Series, Shakedown Bar, Route 6 Cafe & Lounge, Agave, Old Kentucky Tavern
P e t e r F o n t a n e s e
By Peter Fontanese
Hello Live Music lovers,
Summer is upon us - a
personal “Thank God”
from me!
As we, who are getting
Country rock favorite
Walker Williams and his
band will play at 4-Eagle
Ranch on Thursday, July
5th, with lessons at 6pm.
older, say,
“Winter is wonderful,
summer is
why we live
here!”
I have structured
this column
in a way that
takes us from the
upper reaches of
our fair county, to
the center of the
county, to the far
western reaches.
For this issue, I
am concentrating on some
interesting events that
have caught my attention
in the county.
This is by no means a
complete list, but just one
that I think is cool and
hope that you will too.
• The Minturn Concert
Series. This great concert
series first started in 2007
or 2008; however, I could
be mistaken about that.
What is exciting about this
event is that it occurs at
Little Beach Park in
Minturn (go south on
Highway 6 & 24 until you
come to a bridge across the
Eagle river, about half-way
through town. Little Beach
Park is on the banks of the
Eagle River on the east
side. In summer, concerts
are held every Thursday.
You can see the Minturn
Route 6’s Ollie with “SHEL.”
These girls rock! Future stars!
concert series website on
the internet for details.
Last night’s opener
kicked off with New
Orleans Billy Franklyn and
his NOLA project, a collection
of Mr. Franklyn’s
favorite Funk and other
great musicians. July
promises to be just as exciting
with performances by
Minturn’s own Schwing
Daddy, and Boneless. One
of my favorite aspects of
performing here, for 30
years now, is the absolute
friendliness and willingness
of musicians of all different
bands to get together
and “Jam!” Boneless is
one of these bands, made
from members of Skin the
Rabbit, and Laughing
Bones. This band explores
the less structural aspects
of material that both bands
feature in their regular
sets. I wonder,
does this remind
anybody of a Bay
Area band from
the mid-60’s? No
more hints than
that! Another
very surprising
and happy addition
to the
Minturn Concert
Series lineup this
summer will be
“BLT.” This
extremely diverse
trio made up of Tony
Gulizia and Brian Loftis, (I
believe it is just the two of
them) will be appearing
sometime in July at the
Minturn Concert series.
The big surprise, at least
for me will be an appearance
by Denver’s own
“Queen of Soul,” Hazel
Miller, at the Minturn
Concert series, sometimes
in August. My hat is off to
the organizers of this fine
concert series. We wish
you continued success
over the ensuing years of
your series!
• The new Shakedown
Bar in Vail village is a
great addition to our live
music scene. It is nice to
walk into this establishment
and have a very neutral
smell, and not stick to
the floor! I am sorry if that
seems a little petty, but
give these guys 20 years
and anything can happen!
Proprietors Scott Rednor
and George Hilliard have
managed to put in a sound
system fit for any live band
- well maybe not Led
Zeppelin, the Stones or the
Grateful Dead, or maybe
not ACDC, but pretty
much anything else! Scott
Rednor’s kick butt band
can be heard on featured
evenings every week, and
George Hilliard’s “The
Dead Rednecks” can also
be heard on select
evening’s every week.
Hey George, is that an ode
to departed members of
the Grateful Dead and the
Allman Brothers - or
maybe Lynyrd Skynyrd?
In any event, I like it!
When these two guys are
not performing with their
own bands at Shakedown,
look for eclectic and interesting
national acts from
all over the map. This is
definitely a very good
addition to the bridge
street scene!
• Ollie Holdstock has
gone and done it folks!
The Route 6 Café &
Lounge is now officially
across the highway and
west from where it was.
Ollie is featuring great
food, great ambiance, reasonable
prices, and great
music on Sunday afternoons
featuring the Brett
Riggin band. I had not
seen Brett perform much
in our county in the last 15
or 20 years, however, I am
still quite impressed by
Peter Fontanese reviews music in Eagle County
Minturn Concert Series, Shakedown Bar, Route 6 Cafe & Lounge, Agave, Old Kentucky Tavern
From Page 1 of Pull-Out
this piano virtuoso’s ability
to talk other primo local
musicians into doing these
jams on Sundays. Nice job
Brett! Good to see you
back. Please stick around.
• I have to give a nod to
Agave, an establishment
that makes me smile
everytime I perform there.
Back in April it was my
privilege to perform with
original members of
Shakedown Street and
some newcomers to our
valley. Mr. Ted Tilton,
from the Front Range, has
a band called “Deadphish
Orchestra.” SEE THESE
GUYS if you can. Ted is a
monster keyboardist and
singer. Also new to our
scene is Mr. Rob Eaton, Jr.
That’s right folks; Sr. is the
man who gave us
“Darkstar Orchestra.”
When asked if Rob Sr.
wanted to be part of this
great RMGD Review
(Rocky Mountain Grateful
Dead Review), Sr. said,
“Hire Jr. He’s
even better than I
am!” Well in my
book, BOTH Rob
Eaton’s smoke
and should NOT
be missed!
• I will close
this month’s column
with a
heads-up for
some of our new
and up and coming
talent, and
one more place to
visit in your travels.
The Olde
Kentucky Tavern
on Broadway in
Eagle is a very
promising venue
for live music. My friend,
Andre Lemieux, performs
there every week (call and
ask for Monica, the new
owner, for details). You
can hear the mellow
sounds of Jeff Reed at
Fiesta Jalisco on Saturday’s
in Eagle, from 6-9pm, and
also on Tuesdays from 6-9
pm.
Jeff Reed smiles with Merlin!
• Some other up and
comers that you should
not miss around the county
include a young man
named James Pieper, who
plays and sings his original
music, as well as a
great set of eclectic stuff. I
got to do a show with
James recently, and this 28-
year-old kept this 53-yearold
firmly on my
toes! Also, not to
be missed, are a
more and more
popular collaboration
of Nick
Steingart and Bob
Masters. Nick of
“Skin the Rabbit”
and Bob of
“ L a u g h i n g
Bones” fame are a
REAL delight
together!!
That’s it for
now.
Fodde reviews the new Route 6 Cafe & Lounge in EV
By Simone Fodde
Ollie (Steven)
Holdstock is not new to
the restaurant business
in Eagle County. In fact,
Ollie has been involved
in the food business
since 1983, when he
moved from Southern
California to Vail.
Originally from
Chester, England, Ollie
developed a deep love
affair for the outdoors
and moved here to ski.
“I am a ski bum who
runs a restaurant, not a
emphatically when I
asked him the reasons
that brought him to
Colorado.
He first became a
bartender at the old
Cyrano’s, in the heart of
Vail Village. There he
met his lifetime friend,
Peter Millett, who lately
had been the head
chef at Sapphire. In this
time of sudden transitions,
Sapphire closed
and Ollie needed a new
address to relocate the
Route 6 Café that he
had been successfully
running for several
year. His lease was up
and the old Paddy’s on
Highway 6 had been
sitting empty for a
while.
In an ample leap of
faith, Ollie and Peter
put their head together
and decided, “Let’s do
it again!”
As in most cases of
Grace, once the decision
was made, all sorts
of friends and circumstances
came together
at one confluence, and
the new Route 6 Café
and Lounge is now
open and running, not
only for breakfast and
lunch, but also for dinner.
A lovely patio was
built with flowers and
shade for the weary
travelers who need
nourishment and
friendliness. A stage
was built, and a comfortable
lounging area
with leather sofas and
artwork was created by
If you were passionate
about “Cheers,” the
TV show, you will
notice a similarity in
energy and will love
the new Route 6 Café
and Lounge. The old
crew from the prior
location: Beth and
Ioana (Ewana) are still
the core crew. A few
others have joined in as
well.
Andrew, Ollie’s
handsome young
nephew, moved to the
county to help his uncle
run the place. His
friendly, welcoming
smile will greet everyone
with warmth and
that sense of humor
only the Brits can bring.
Ollie is a radiant
sun whose loving
energy feeds the soul
beside your belly. He
surrounded himself
with a friendly staff of
happy people, and the
energy is palpable.
The breakfast and
lunch menu are the
familiar ones we all
love. Good, homemade
comfort food - good for
the belly and the soul!
The dinner menu,
however, has a nouvelle
cuisine flair that is
evident of Peter
Millett’s style and creativity.
When I walked in
for the sampling of the
dinner menu, the patio
was in radiant sunlight.
Ollie was in the back,
unloading the truck of a
vast amount of fresh
produce that he picks
himself, to make sure
only the freshest gets in
our mouths.
My publisher and I
were ready for the culinary
feast.
A sampling of Tuna
Nachos and Steamed
Mussels arrived at the
table. The sensual
smells of spices and
white wine reduction
stopped the conversation!
Forks were raised
to the occasion. I felt
my mouth salivating.
The tuna is seared
and spiced with sweet
red chili sauce. The
Mussels have an enticing
white wine and fresh
decided there is no
seafood!
The Crab cakes
came next with a
refreshing glass of
Pinot Grigio, freshly
dressed in citrus vinaigrette.
Other appetizers on
the menu include
Greek salad, Asian
Chicken salad, my publisher’s
favorite, and
Ceviche, one of my
favorite foods!
Once all plates were
cleared, a whole array
of sensual flavors and
colors that presented an
abundance of sample
dinner entrees came
marching in.
I decided Heaven is
prevailed!
For the vegetarian
out there: the Veggie
with healthy greens,
corn, veggies and
served with black beans
and a tasty tomatillo
served in a Pistachio
with mashed potatoes,
and a flavorful roasted
The entrée menu is
vast and includes
grilled Rocky Mountain
Trout, Flat Iron steak;
Herb roasted chicken
and other succulent
choices.
The prices are so
reasonable that the
excitement of not having
to drive too far or
taking a loan at the
bank to go out for dinner
is overwhelming.
We can have this quality
of cuisine and easiness
of parking all in
the same address? I am
overtaken with sensual
joy!
I noticed no desserts
were written down in
the dinner menu: I am
compelled to ask! No,
we don’t need to write
them down, is the
answer, because they
change according to
the mood of Peter, the
chef and creator, and
the flavor of produce in
season.
We were then presented
with the creation
of the day: a warm
Navigating the Medicare Maze, by Joe Clark
Staff Report
VAIL - Joe Clark is a former
state patrolman who
became a very knowledgeable
health insurance
agent. Medicare is his specialty.
Many seniors get their
Medicare advice and work
with AARP (the American
Association of Retired
People), one of the most
powerful organizations in
the country.
Clark doesn’t
care for AARP!
“If you are getting your
car insurance through
AARP, you need another
insurance agent!” Clark
told the Rotary Club members
of Edwards and Vail.
Clark said that
Medicare is “way complicated.
Call or email me at
no fee. Or, have your insurance
agent contact me.”
Clark doesn’t
like Obama Care either!
“It’s a totally unnecessary
piece of junk!”
said Clark.
The 4 parts
of Medicare
Part A is the
hopital plan, Clark
stated. Part B is
for outpatient
care. Part D is for
prescription coverage.
And, Part C
is Medicare
Advantage.
Clark said that
the best plan is
the original Medicare plus
Part D plus Supplement F.
“Unless you are well
and healthy, you can’t get a
Medicare supplement,” he
continued.
“It changes all the
time,” said Clark.
Clark didn’t have much
good to say about HMOs
either.
“HMOs mostly pay in
your home area, not where
you want to go. A doctor
can decide to not take
you.”
“A doctor can decide to
accept only 10% of his
Medicare expert Joe Clark spoke
to the Vail Rotary club last week.
practice as Medicare
patients.”
Clark said there are
Medicare deadlines for
applying, including three
months before and three
months after your birthday
month, for a total of seven
months for the initial
enrollment. He said that
another deadline is 6
months after turning 65, to
join Medigap.
He suggested joining
Part C during the initial
application and then opt
out before the 66th birthday
to join Medigap.
What’s not
covered by
Medicare!
Long-term care,
dentures, hearing
aids, cosmetic surgery
and acupuncture
are among the
list of what is not
covered by
Medicare, said Clark.
Never deal with an
insurance company
directly!
Clark said that you
need to be very careful
about who you call and
who you believe. He said
that insurance agents know
more than the company’s
employees!
Clark said that a mistake
made in your
Medicare choices can cost
you your nest egg!
So, in order to help,
Clark wrote a book called,
“Medicare Primer -
Navigating the Medicare
Maze. The book is
designed to help you make
the right decision about
Medicare - to avoid losing
your nest egg.
His back page states
that the early pages are
designed to give you a
quick and simple look at
what the best Medicare
solutions are for you.
Clark wrote that “the
most important thing is to
realize that what is best for
an insurance company is
not what is best for you!
He also wrote that what
is best for the government
is not what is best for you.
Clarks said to avoid
calling them and certainly
avoid taking their suggestions.
He says there are
many advisors who specialize
in Medicare and not
just in Medicare
Advantage. He says his
book can help you avoid
major mistakes.
Vail Police Chief allegedly wants Levine’s Limos gone!
Vail - As a follow-up to
the February 9th issue
titled, “Vail Police Chief
associate Leo Lala, who
works with limo owner
Jonathan Levine’s company,
finally was
allegedly able to identify
the alleged older Vail
Police officer who told
him that “The state
would be much better
off if he (Levine) was
not in business here.”
Lala said that he had
been asking for assistance
at the police
department as to the
name of the older cops,
but that the police
would not help him.
Finally, Lala stated,
he saw a picture of Vail
Police Commander
Steve Wright and identified
Wright as the officer
who allegedly told
him this at the West Vail
Business Briefs sent
an email to Commander
Wright, asking him to
there was no response.
So, Business Briefs
had been a contact in
the February story, but
Advertorial by
Attorney Ed Woodland
In the last three years,
a lot of bad things have
happened to good people
in this valley. We all know
at least one person who
has lost all of their home
equity, lost a job, been
foreclosed on, spent all of
their savings paying their
creditors, been turned
down for a loan modification,
had their wages garnished,
been sued, or lost
everything.
You don’t have to be
the next victim on the list.
Bankruptcy can help!
The specific benefits to
filing for bankruptcy are
varied, depending upon
whether you file under
Chapter 7 or Chapter 13,
as well as the specific circumstances
of your financial
situation and your
case itself. Possibly the
most important benefit at
the start of the bankruptcy
process is that all debt collection
efforts must cease,
Bankruptcy allows for a fresh start in life!
once you file your bankruptcy
petition.
This means that creditor
harassment, wage garnishment,
foreclosure,
debt collection lawsuits,
repossession and all related
activity must be placed
on hold. Filing for bankruptcy
can give you muchneeded
breathing room as
you figure out what to do
to save your home from
foreclosure, or what debts
you wish to reaffirm so
you can keep certain property.
It is a common misconception
that filing for
bankruptcy will mean
that you will lose your
home, your car, your business
and all of your possessions,
and that you
will not be able to rebuild
your credit in the future.
This is simply not the
truth!
Even when filing for
bankruptcy, you can
ensure that certain assets
are protected, particularly
if you file under Chapter
13 and undergo a reorganization
of your debt, rather
bankruptcy law
truly offers people
a second chance -
a fresh start!
than a liquidation of assets
to pay off creditors.
When a Chapter 7 or
Chapter 13 bankruptcy is
successfully completed, all
eligible debt will be discharged.
You will be free
and clear of all eligible
debt and will have no further
obligation to those
creditors.
This is the final goal of
any bankruptcy case and
the reason it can benefit a
debtor so greatly.
Bankruptcy law truly
offers people a second
chance - a fresh start!
Bankruptcy Myths
There are many myths
about how difficult life can
be after bankruptcy. Some
may say that it will be
impossible to buy a home
or a car, or that you can
never rebuild your credit.
This is simply untrue.
Most of our clients feel
a great deal of relief after
filing for bankruptcy. In
taking control of their
finances, stopping foreclosure
and discharging debt,
they are able to breathe
again and have the opportunity
to make the right
decisions this time around,
in order to avoid a similar
situation again in the
future. Bankruptcy is a
valuable legal recourse
that enables people to get
a fresh start financially.
WHAT IS A REVOCABLE
OR “LIVING” TRUST?
A Revocable Trust can be
used as your main estate planning
document instead of a Last
Will. It is important to note that
if you have a Will, the probate
process must be used to administer
the Will. A Will does not
avoid probate.
If you have a revocable trust
you can avoid the probate
process by titling your assets in
the name of your trust. If assets
are owned by a trust, no court is
involved in the transfer of assets
upon death. Therefore, no estate
has to be opened with the court,
no newspaper notices or letters
ASK A LAWYER
to heirs are required, no records
become public and no statutory
waiting periods apply.
It is still necessary to determine
what assets exist, to pay
creditors, to file required tax
returns and to distribute assets to
beneficiaries. However, with a
trust, the person you name as
trustee can accomplish these
things without having to go
through court proceedings and
statutory requirements to do so.
This simplifies and expedites the
process for your heirs.
A revocable trust does not
affect your ability to manage and
control your own property while
you are alive. You stay in charge
of everything.
A revocable trust is acceptable
in all states, so you can
avoid probate on out-of-state
property as well as assets located
in the state of residence. (A
will requires probate in each state
where real estate is owned (this
includes timeshares) and in the
state where the decedent lived on
the date of death.)
A revocable trust also provides
for management of assets
by a family member or a financial
institution (whichever you select)
if you are unable to manage
assets due to health problems.
This avoids the necessity
and expense of your family
members having to go to court,
and ask to have you found
incompetent and to be named
your guardian or conservator. A
Will only takes affect at your
death and can not provide for
management of your assets
should you become legally
incompetent during your life.
A revocable trust works well
for single or married people.
Joint trusts may be used in situations
where joint tenancy would
typically be used, but where probate
avoidance on both estates is
desired. In cases where married
couples choose to keep their
assets separate, such as when
spouses have children from previous
marriages or to implement
tax planning, a separate living
trust may be executed by each
spouse, with the plan of distribution
of each spouse set forth in
that spouse’s trust.
Because you would still be in
charge of managing your assets, a
revocable trust does not offer
asset protection against from
creditors.
As with all estate planning,
each person’s individual situation
and wishes must be analyzed
before a decision is made
as to the most effective estate
planning techniques.

Homeowners allege fraud
in home foreclosure!
Dear Publisher,
I am attaching the most
recent phenomenal development
by Spire Law Firm in
New York. I think it is
important to remember that
we are not the only homeowners
who have (allegedly)
faced fraud and deception
and are going through
foreclosure and eviction at
the hands of these
unscrupulous lenders and
foreclosure mills. This case
is a landmark case. When
you open it, you will see
why.
For my brief summary
below:
Douglas and Donna Fasi are
currently in a legal battle to
save their farm from a
wrongful foreclosure conducted
by the Eagle County
Trustee, the Eagle Combined
Courts, Castle & Stawiarski
LLC, and HSBC Bank. All
entities have acted (allegedly)
in concert to deprive the
Fasis of their farm of 30
years, for no other reason
than the Fasis entering into
negotiations to get a loan
modification.
In 2006, I refinanced my
farm from an adjustable rate
mortgage to a fixed rate
mortgage. In 2009, I was
contacted by a representative
of Wells Fargo Bank and
informed that my
“adjustable rate mortgage”
was to increase to more than
$2,700.00 per month.
Our current mortgage
payment on the fixed rate
mortgage that I signed for
was $2190.00 per month. We
knew what they had signed
for in 2006, and were clear in
2006 with the mortgage broker
that they would not refinance
into another ARM
Note, and Wells Fargo at the
time would not loan on their
entire property because the
property did “not conform”
to the fixed rate product
they were offering.
So, in 2006, we only refinanced
a portion of the farm
comprising the house and
seven acres. I tried unsuccessfully
throughout 2009 to
get the mortgage discrepancy
corrected, but no one at
Wells Fargo was listening.
Throughout all this, we
never missed a mortgage
payment, even when it
increased to $2,700.00 per
month for a period of six
months in 2009. In
September of 2009, not
knowing what else to do, we
requested a loan modification
from Wells Fargo and
were told in order to qualify,
we would have to miss three
payments. We did as
instructed, never understanding
that missing the
three payments would start
a roller coaster towards foreclosure
that could not be
corrected. In 2010, when we
were still trying, after
months of delay on the part
of Wells Fargo, to get a loan
modification, HSBC Bank
filed to foreclose on the
Donna and Doug Fasi.
farm. Prior to HSBC Bank
filing the Notice of Election
and Demand, someone went
to the County Clerk and
Recorder and re-filed the
original Deed of Trust we
signed, and changed the
legal description for the
mortgage to include the
entire farm, instead of the
house and seven acres listed
on the HUD statement at the
closing in 2006.
We were now aware that
a (an alleged) fraud had
been committed, again discovered
in 2010, that the
Note used to foreclose on
our property in no way
resembled the Note I signed
in 2006. The (alleged)fraud
Note contained terms of up
to 13.25% interest rates, was
an adjustable ARM, and did
not have my initials on the
first two pages. My original
Note was a fixed rate Note
for 30 years, with a 7.125%
rate and had my initials on
In spite of everything
we did to protect our home,
the farm was sold at a
Trustee sale on January 19,
2011. Through a Rule 120
Hearing, a District Court
case, and now a forced
Chapter 13 Bankruptcy we
have continued to fight for
our home. We will soon be
filing an adversary proceeding
in Federal Court and
refuse to leave our property.
I have possession, I am in
the right, and I refuse to
thrown out on the street, just
so a bank can (allegedly)
commit fraud and theft.
I want to know why my
loan was fraudulently
changed. I want to know
where my payments have
gone all this time, and I
want to know why
Colorado judges are allowing
an attorney affidavit that
says the foreclosure paperwork
is authentic, to suffice
in a court of law, when it is
clear from thousands of
other homeowners in the
same situation that the
paperwork is not correct,
but is in fact (allegedly)
fraudulent.
Nobody I know wants to
not make their mortgage
payments, but this is not
about default, it is entirely
about (alleged) fraud on the
part of lenders and foreclosing
attorneys, so they can
foreclose quickly without
producing proper paperwork.
We are currently in possession
of our home, while
awaiting the filing of yet
another lawsuit to vacate
the sale, and may still be
evicted at any time. Spire
Publisher’s note: The publisher
attempted to get the
other side of the story at a
recent Eagle County court
hearing, but the attorney for
the lender stated that they
had “no comment.”
