Eagle - <strong>Bruce</strong> <strong>Brown</strong>, a<br />
former defense attorney<br />
who was recently elected<br />
to be the Fifth Judicial<br />
District Attorney, won<br />
<strong>his</strong> <strong>first</strong> <strong>jury</strong> <strong>trial</strong> last<br />
week in Eagle.<br />
<strong>Brown</strong> turned in a<br />
solid performance convicting<br />
<strong>Eric</strong> Paul <strong>Moser</strong><br />
on two charges.<br />
<strong>Moser</strong> was suspected<br />
of burglarizing the home<br />
of Merv and Lanie<br />
Lapin, who live in Vail.<br />
Another solid performance<br />
was turned in<br />
by a young, former Vail<br />
patrolman, Ryan Larsen,<br />
who was the only officer<br />
who answered the call<br />
around midnight last<br />
year. Without the help of<br />
Vail police detectives,<br />
Larsen tracked the<br />
movements of the suspect<br />
to a Rifle, Colorado<br />
Radio Shack store via<br />
the use of Lainie Lapin’s<br />
missing credit card, and<br />
the use of <strong>his</strong> own credit<br />
card six minutes later.<br />
It is unclear why Vail<br />
police detectives waited<br />
B r u c e B r o w n<br />
almost nine months later<br />
to perform finger printing<br />
at the Lapin home,<br />
instead of the day after<br />
the burglarly.<br />
The young patrolman,<br />
who is not a<br />
trained police detective,<br />
failed to perform the finger<br />
printing the night of<br />
the burglarly, but <strong>his</strong><br />
actions to track the<br />
movement of the suspect<br />
to Rifle turned out<br />
to be more important to<br />
the timeline of <strong>his</strong> capture.<br />
Prosecutor <strong>Brown</strong><br />
inherited the case from<br />
<strong>his</strong> predecessor, Mark<br />
Hurlbert, and made the<br />
most of what evidence<br />
was available to get the<br />
two convictions, mostly<br />
on circumstantial evidence.<br />
<strong>Moser</strong> never took the<br />
stand in <strong>his</strong> defense, but<br />
fortunately for him had<br />
a strong defense provided<br />
by Sommer Spector<br />
of the Public Defender’s<br />
office. Spector skillfully<br />
fought to get five not<br />
guilty findings on five of<br />
the seven charges. Her<br />
closing argument was<br />
outstanding.<br />
Patrolman Larsen is<br />
now working as a<br />
Washington state city<br />
patrolman, but came<br />
back to Eagle County to<br />
testify at the <strong>trial</strong>.<br />
<strong>Moser</strong> was supposedly<br />
homeless for a time<br />
and was working in Vail,<br />
prior to the burglary.<br />
Sentencing is set for<br />
next month, and <strong>Moser</strong><br />
is elegible for up to 18<br />
months on one charge,<br />
and up to 6 years on<br />
another charge.<br />
