New DA, Bruce Brown, wins his
first jury trial, over Eric Moser!

Eagle - Bruce Brown, a
former defense attorney
who was recently elected
to be the Fifth Judicial
District Attorney, won
his first jury trial last
week in Eagle.
Brown turned in a
solid performance convicting
Eric Paul Moser
on two charges.
Moser was suspected
of burglarizing the home
of Merv and Lanie
Lapin, who live in Vail.
Another solid performance
was turned in
by a young, former Vail
patrolman, Ryan Larsen,
who was the only officer
who answered the call
around midnight last
year. Without the help of
Vail police detectives,
Larsen tracked the
movements of the suspect
to a Rifle, Colorado
Radio Shack store via
the use of Lainie Lapin’s
missing credit card, and
the use of his own credit
card six minutes later.
It is unclear why Vail
police detectives waited

almost nine months later
to perform finger printing
at the Lapin home,
instead of the day after
the burglarly.
The young patrolman,
who is not a
trained police detective,
failed to perform the finger
printing the night of
the burglarly, but his
actions to track the
movement of the suspect
to Rifle turned out
to be more important to
the timeline of his capture.
Prosecutor Brown
inherited the case from
his predecessor, Mark
Hurlbert, and made the
most of what evidence
was available to get the
two convictions, mostly
on circumstantial evidence.
Moser never took the
stand in his defense, but
fortunately for him had
a strong defense provided
by Sommer Spector
of the Public Defender’s
office. Spector skillfully
fought to get five not
guilty findings on five of
the seven charges. Her
closing argument was
outstanding.
Patrolman Larsen is
now working as a
Washington state city
patrolman, but came
back to Eagle County to
testify at the trial.
Moser was supposedly
homeless for a time
and was working in Vail,
prior to the burglary.
Sentencing is set for
next month, and Moser
is elegible for up to 18
months on one charge,
and up to 6 years on
another charge.
